10. General Information

1. General

1.1Definition

1.1.1 Air Transportation shall be any activities using

aircrafts for transporting passengers, cargos

and/or postal goods for one or more trips from one

airport to another airport or several other

aiports.

1.1.2 Commercial Air Transportation shall be public air

transportation with fares.

1.1.3 Unscheduled Commercial Air Transportation shall be

non-fixed and non-regular flight schedule with

fare in accordance with the agreement between the

service provider and service user which shall not

be published.

1.1.4 Airport shall be the airport managed by PT Angkasa

Pura II (Persero).

1.1.5 Aircraft Weight in Maximum Takeoff Weight (MTOW)

Unit shall be the maximum weight allowed for


taking off (maximum takeoff weight) as stated in

the Airworthiness Certificate (C of A) of the

relevant aircraft.

1.1.6 Certificate of Airworthiness (C of A) shall be

evidence of the fulfilment of airwrothiness.

1.1.7 Airlines shall be companies engaging in air

transportation to transport passengers, goods,

postal goods and other aviation activities with

fares using fixed wing or rotary wing carrying out

activities on a scheduled or unscheduled basis.

1.1.8 Air crews shall be aviation crews holding

certificate to serve as airplance crews and

aircraft supporting crews.

1.1.9 Aircraft Passengers shall be any persons

transported with aircraft and not registered as

the crews of the relevant aircraft.

1.1.10 Domestic Aircraft Passengers shall be aircraft

passengers having trip between airports within the

territory of Indonesia with or without transit or

transfer.

1.1.11 International Aircraft Passengers shall be

aircraft passengers in international flights

outside the territory of Indonesia with or without


transit or transfer in other Indonesian airports

or otherwise.

1.1.12 Transfer Passengers shall be aircraft

passengers in an airport continuing their fligt to

the destination airport with different aircraft.

1.1.13Transit Passengers shall be aircraft passengers

continuing their flight to the destination airport

with the same aircraft.

1.1.14Airport Services shall be services rendered by the

airport operator to the airlines.

1.1.15Level of Service shall be a minimal requirement or

condition which must be met in services or

facilities rendered to the parties received by the

service users the variables of which shall include

the aspects of safety, security, smoothness and

convenience.

1.1.16Airport Facilities shall be airport main

facilities which shall include air facilities,

ground facilities, navigational facilities,

landing aids, aviation communication facilitiesd

and airport supporting facilities.


1.1.17Airport Service Tariffs shall be amount of

compensation to be paid by the airport service

users for every service enjoyed by them.

1.1.18Aviobridge shall be mechanical operation which can

be easily adjusted for passengers to directly get

into aircrafts and buildings or vehicles.

1.1.19Airport Charges shall be tariffs that must be paid

by the airlines with regard to the utilization of

airport services and aviation supporting services

provided by the airport operators.

1.1.20Airport Operators shall be the Airport Enterprise,

in this matter PT Angkasa Pura II (Persero).

1.2Scope

Conditions of Use shall be documents containing the

conditions on the requirements for the utilization of

airport service facilities including tariff conditions

and other conditions.

Airlines or aircraft operators operating in the airports

must understand and comply with the Conditions of Use.

This Conditions of Use document shall be valid for

Soekarno-Hatta International Airport as of …………………………...


2. Requirements

2.1Administrative

2.1.1 For the operation of new scheduled domestic or

international flights, airlines or aircraft

operators must submit the plan for the operation

of flight to the airport operator c.q.:

2.1.2 Airlines or aircraft operators operating in the

airports must meet the requirements in accordance

with the applicable regulations.

2.1.3 Scheduled airlines or aircraft operators which

will be operating in the airports must pay the

aviation service tariff for 3 (three) months as

the operational guarantee which must be paid at a

time in advance.

2.1.4 Scheduled airlines or aircraft operators operating

in the airports must pay the aviation service

tariff in accordance with the applicable

regulations.

2.1.5 Airlines or aircraft operators operating in the

airports must provide the data of the number and

data of officers stationed in the airports.

2.2Operational


2.2.1 Aircrafts operating in airports must meet or

comply with the provisions of the requirements for

the operation of aircraft in the airports.

2.2.2 Scheduled airlines or aircraft operator operating

in the airports shall be obligated to submit the

Maximum Take Off Weight (MTOW) based on the

Certificate of Airworthiness to the airport

operator.

2.2.3 Airport operators shall be entitled to ask

airlines or aircraft operators to move the parking

of the aircraft for the interest of the operation

of the airport.

2.2.4 Airlines or aircraft operators must keep the

security, safety, convenience and cleanliness of

their operational activity locations in the

airport.

2.2.5 Aircraft Operator shall be entitled to make sure

and or require airlines or aircraft operators to

provide services in the airport in accordance with

the applicable regulations.

2.2.6 Airlines or aircraft operators shall be

responsible on the damage and loss of goods or

facilities of the airport operator or other


persons as the consequence of the implementation

of their operational activities.

2.2.7 Slot Time

2.2.7.1 The Airport operator shall determine the

aircraft landing and take off slot time by

referring to the Notice of Airport Capacity

(NAC).

2.2.7.2 The slot time shall be the ground for the

issuance of Flight Approval (FA) by the

Director General of Air Transportation of

the Ministry of Transportation of the

Republic of Indonesia.

2.2.7.3 Application for License for the operation

of new domestic or international scheduled

flights must be submitted to the airport

operator by no later than 2 (two) months as

of the planned flight schedule.

2.2.7.4 Under certain operational conditions, the

slot time applied for by the airlines or

aircraft operators shall be subject to

change by the airport operator.

2.2.7.5 Airlines or aircraft operators must

submit flight schedules, including


unscheduled flights and change thereto to

the airport operator c.q.:

2.2.7.6 Airlines or aircraft operators must

report any flight schedule change (delayed,

cancelled, postponed, etc) to the airport

operator by no later than 2 (two) hours

from the initial schedule.

2.2.7.7 The airport operator shall be entitled to

reject the addition of frequency or change

of flight schedule in the condition of /

under operational reason.

3 Airport Charges


3.1 Airlines or operators of scheduled and unscheduled

aircrafts operating in the airport shall be obligated

to pay aviation service tariff in accordance with the

applicable regulations.

3.2 The aviation service tariff charged to the airlines or

aircraft operators shall include landing fee, parking

fee, aviobridge fee, counter fee, CUCCS, passenger

service charge, dan route charges.

3.3 Landing Fee

3.3.1 Aircraft landing fee tariff shall be calculated

based on the aircraft weight or the Maximum Take

Off Weight (MTOW) permitted and recorded in the

data of the airport operator every year;

3.3.2 The aircraft landing fee shall be charged based on

the aircraft weight or the Maximum Take Off Weight

(MTOW), even though there is aircraft weight limit

or the Restricted Take Off Weight (RTOW) permitted

for the aircraft to land;

3.3.3 The aircraft weight or the Maximum Take Off Weight

(MTOW) shall be the aircraft weight stated in the

Certificate of Airworthiness

(C of A);


3.3.4 The aircraft landing tariff for scheduled flights

shall be collected every month from the airlines;

3.3.5 The aircraft landing tariff for unscheduled

flights shall be paid directly prior to the

aircraft take off with the Officer in Charge (OIC)

/ official with equal position appointed;

3.3.6 The aircraft landing tariff shall be as stated in

the table of airport charges.

3.4 Parking Tariff

3.4.1 The aircraft parking tariff shall be calculated


Off Weight (MTOW) permitted and recorded in the

data of the airport every year;

3.4.2 The aircraft parking tariff shall be charged after

after the aircraft has been parking for 2 (two)

hours and shall be subject to surcharge tariff

after having been parked for more than 2 (two)

hours;

3.4.3 The aircraft parking in the contact stand shall

only be limited for 2 (two) hours, if the parking

is more than 2 (two) hours, all airlines or


aircraft operators must relocate the aircrafts to

the aircraft parking area which has been

determined by the airport operator and shall be

subject to tariff in accordance with the

regulations;

3.4.4 The airport operator may require airlines or

aircraft operators to move the aircrafts for the

operational interest of the airport or to move the

aircrafts out of the airport area. Failure of the

airlines to move the aircraft by the airlines or

the aircraft operators in the period which has

been determined shall be subject to the tariff in

accordance with the regulations applicable in the

airport.

3.5 Storage Tariff

3.5.1 The aircraft storage service tariff shall be

calculated based on the aircraft weight or the

Maximum Take Off Weight (WTOM) permitted and

registered in the data of the aircraft operator

every year;

3.5.2 The aircraft storage service tariff shall be

charged to aircrafts stored in the aircraft hangar

of PT Angkasa Pura II (Persero);


3.5.3 The aircraft storage tariff shall be calculated as

of the taking in of the aircraft into the hangar

up to the taking out of the aircraft from the

hangar;

3.5.4 In the event that the aircraft is brought and out

from the hangar more than one time in a day, the

aircraft may be subject to storage service tariff

more than once according to the frequency of the

aircraft is brought in and out of the hangar on

that day.

3.6 Parking Surcharges

3.6.1 The aircraft surcharge parking tariff shall be

calculated based on the aircraft weight or the

Maximum Take Off Weight (WTOM) permitted and

registered in the data of the airport operator

every year;

3.6.2 The surchage parking tariff shall be charged to

aircrafts parked in the ”traffic stand” for more

than 2 (two) hours;

3.6.3 The surchage parking tariff shall be paid at a

time with the aircraft landing, parking and

storage service tariff.

3.7 Aviobridge tariff


3.7.1 The aviobridge tariff shall be calculated


off Weight (MTOW) permitted and recorded in the

database of the airport every year;

3.7.2 The aviobridge utilization tariff shall be

calculated based on the utilization of the

aviobridge. For 1 (one) docking shall be

considered as 1 (one) utilization and for

dedocking shall be considered as 1 (one)

utilization;

3.7.3 Aircrafts moved from the contact stand to

remote stand, hangar or other areas using

aviobridge (dedocking) shall remain to be charged

with aviobridge utilization tariff.

3.8 Counter Tariff

3.8.1 The check in counter utilization tariff shall be

charged based on the number of aircraft passengers

(adult, child, infant) permitted to check in;

3.8.2 The check in counter tariff shall be charged to

airlines of aircraft operators every month;

3.8.3 Airlines crews shall be exempted from the counter

utilization tariff.

3.9 Passenger Service Charges (PSC) Tariff


3.9.1 The passenger service charges tariff shall be the

tariff directly charged to air transportation

passengers for the utilization of the airport and

the services enjoyed by them in the airport;

3.9.2 The passenger service charges tariff shall be

collected in cash after the passengers have

checked in;

3.9.3 The passenger service charges tariff shall be

regulated according to the regulation applicable

in the airport;

3.9.4 Exemption of the passenger service charge tariff

shall be granted to infant passenger, crew, extra

crew, transit, transfer, passengers dan

International Delegates in official visits in

Indonesia;

3.9.5 Airlines or aircraft operators shall be obligated

to submit passenger manifest / other accountable

documents signed by the officer of the airlines or

the aircraft operator as attacment to the

passenger service charges tariff levy.

3.10 Common Use Check In Counter System (CUCCS) Tariff

3.10.1 The CUCCS tariff shall be the tariff charged

to airlines or aircraft operators using CUCCS


facilities in airports managed by PT Angkasa Pura

II (Persero);

3.10.2 The CUCCS tariff shall be charged based on the

number of passengers (adult, child, infant) per

flight using CUCCS system;

3.10.3 The CUCCS utilization tariff shall be charged

to airlines or aircraft operators per 10 (ten)

calendar days;

3.10.4 The CUCCS tariff collection shall be combined

with the check in counter tariff collection.

3.11 Aviation Service Tariff (PJP)

3.11.1 Any aircrafts providing domestic/international

flights passing the territory of Indonesia shall

be subject to Aviation Service Tariff (PJP) based

on the route unit;

3.11.2 The domestic / international aviation service

tariff shall be determined based on the applicable

regulations;

3.11.3 Airlines or aircraft operators failing to the

meet the obligation to pay the Aviation Service

Tariff as determined in the applicable regulation


shall be subject to sanctions in accordance with

the applicable laws and regulations.

3.12 Other Tariffs

Other tariffs related to the use of electricity,

electricity power, water installation, telephone line,

office room lease, executive lounge, waste water

disposal, airport ID pass for staffs, vehicle pass

sticker in apron, Driving License (TIM) in apron,

location of Ground Support Equipment (GSE), parking of

the car/motorcycle of the staff, airside license,

airport waste water and air conditioner (AC) shall be

stipulated in other tariff regulation which shall be

regulated separately.

4 Tariff Discounts

4.1 Airport operator shall give discounts to aeronautical

service tariffs to airlines or aircraft operator

opening new routes or adding routes from and / or to

the airport.

4.2 The amount of the aeronautical service tariff as

intended in point 4.1 shall be in accordance with the

applicable regulations as follows:


4.2.1 The Landing Fee, Parking Fee shall be 25% (twenty-

five percent) of the tarif applicable for domestic

and international flights;

4.2.2 The Aviobridge tariff shall be 25% (twenty-five

percent) of the tarif applicable for domestic and

international flights;

4.2.3 The Route charges shall be US$ 0,55 (zero point

fifty-five dollars of the United States of

America) for international flights.

4.3Return To Base (RTB) aircraft flight landing shall be

subject to 50% (fity percent) of the applicable tariff.

4.4Divert aircraft flight landing shall be subject to 50%

(fifty percent) of the applicable tariff.

4.5Joy flight aircraft flight landing shall be subject to

50% (fifty percent) of the applicable tariff.

4.6Aircrft flight landing for flying school, aerial

photograph, survey shall be subject to 50% (fifty

percent) of the applicable tariff.

4.7Aircraft flight landing for aircraft crew education,

test flight shall be subject to 25% (twenty-five

percent) of the applicable tariff.


4.8Aircraft flight landing for religious flight shall be

subject to 25% (twenty-five percent) of the applicable

tariff.

6 Payment

Airlines or aircraft operators must pay the airport charges

with regard to the airport services used for landing,

parking, aviobridge, counter, routes charges and other

airport facility tariffs in accordance with the airport

charges applicable in the airport.

The payment of the airport charges with regard to the

utilization of airport service facility for unscheduled

flights shall be made through the airport treasury office

prior to the departure of the aircraft or in accordance

with the written agreement between the airport operator and

the airlines.

In the event of absence of the MWTOW Certificate, the

payable tariff shall be calculated based on the MTOW in the

database of the airport operator.

The airport charges paid has include Value Added Tax (PPN)

and Income Tax arising, and the parties shall comply with

the applicable taxation regulation.


The airport operator shall issue airport charge invoice to

the fligt operator on a monthly basis which must be paid by

no later than 14 (fourteen) working days as of the receipt

of the invoice.

7 Data

7.1 Airlines or aircraft operators shall be obligated to

provide flight plan information, aircraft data, flight

schedule from time to time to the airport operator,

among other things:

7.1.1 The Flight plan;

7.1.2 Detailed information of the aircraft fleet

including the Maximum Take Off Weight (MTOW).

7.1.3 Flight schedule (in UTC) of all aircrafts from the

origin airport to the destination airport with the

duration of the flight.

7.1.4 Passenger and cargo manifest.

7.2Airlines or aircraft operators or ground handling

appointed must also provide data to the airport operator

containing the detailed data of all aircrafts of the

airlines by submitting the complete data on a timely

manner. The accurate operational data should be


submitted electronically in accordance with the IATA

messaging and standard communication.

7.2.1 The operational data required shall include:

7.2.1.1 Aircraft regristation;

7.2.1.2 Flight Schedule (including flight number,

aircraft type, route and flight hour);

7.2.1.3 ETD dan ETA;

7.2.1.4 Contact stand block on block off Time;

7.2.1.5 Departure delay in the contact stand

shall not be more than 15 (fifteen)

minutes;

7.2.1.6 With regard to the change of flight

number and regristation (including changes

thereto);

7.2.1.7 Arrival and departure Load Distribution

8 Ground Handling (Self Handling untuk Non-BSH)

8.1 The Self handling carried out by airlines or

aircraft operator in the airport must be under

operational license issued by competent agencies and

must be carried out under business license in the

airport issued by the airport operator under the

conditions as follows:

8.1.1 It must have certified facilities and equipment;

8.1.2 It must have certified personnel;


8.1.3 It must have operational procedure standard;

8.1.4 It must have maintenance procedure standard.

8.2 Airlines or aircraft operators carrying out self

handling must file prior application 3 (three) months

prior to the operation in the airport for obtaining

approval to carry out ground handling activity in the

airport.

8.3 The rejection for the application of ground

handling shall be determined based on, among other

things, the condition of the movement capacity or the

use of Ground Support Equipment (GSE) in the air.

9 Miscellaneous Condition

9.1 Close of runway/taxiway

In the event of close of runway/taxiway due to aircraft

operational technical reason, the airport operator

shall provide support and assistance in the evacuation

process in accordance with the conditions and

procedures in the Airport Emergency Plan (AEP)


9.2 Reposition and parking of non-operating aircrafts

9.2.1 In the event that the airlines or aircraft

operators are still in operation:

9.2.1.1 The airlines or aircraft operators must

announce the aircrafts which are no longer

in operation / no longer operated to the

airport operator;

9.2.1.2 In the event that the aircrafts which are

no longer in operation / no longer operated

are located in the contact stand / parking

stand, the airlines or aircraft operators

or the must relocate or move the aircrafts

to the locations / places determined by the

airport operator;

9.2.1.3 In the event that the airlines or

aircraft operators or their representatives

fail to reposition or move the aircraft as

regulated in in point 9.2.1.2, the airport

operator shall have the right to move the

aircraft upon the cost of the airlines or

aircraft operators;


9.2.1.4 The aircraft operators shall have the

right to determine or regulate the duration

for the parking of aircraft which are no

longer in operation / no longer operated by

the airlines or aircraft operators;

9.2.1.5 The airport operator shall coordinate

with airlines or aircraft operator or their

representatives in settling all matters

relevant to the parking and storage of non-

operating / non-operated aircrafts.

9.2.2 In the event that the airlines or aircraft

operators are no longer operating, then:

9.2.2.1 The airlines or aircraft operators or

their representatives must notify the

aforementioned condition in writing to the

airport operator;


their representatives must move or park the

non-operating / non-operated aircrafts to

other locations outside the airports by

firstly paying their liabilities to the

airport operator;


9.2.2.3 In the event that the non-operating/non

operated aircrafts are located in the

contact stand/parking stand, the airlines

or aircraft operators or their

representatives must move or park the

aircrafts to the locations/site determined

by the airport operator;

9.2.2.4 In the event that the relocation or

parking of the non-operating / non-operated

aircrafts as intended in point 9.2.2.2 and

point 9.2.2.3 to other place inside the

airport area, the airlines or aircraft

operator or their representatives must

enter into an agreement concerning the

costs and other conditions with the airport

operator.

9.2.3 In the event that the airlines or airlines become

insolvent, then:


their representatives must notify the

condition in writing to the airport

operator;


9.2.3.2 The airport operator shall be the party

to be prioritized in receiving all

responsibilities to be settled by the

airlines or aircraft operators or their

representatives;


their representatives must move or park

non-operating / non-operated aircrafts to

other location outside the airport by

firstly paying their obligations to the

airport operator;

9.2.3.4 In the event that the relocation or

parking of non-operating / non-operated

aircrafts as intended in point 9.2.3.3 to

other location in the airport area, the

airlines or aircraft operators or their

representatives must enter into an

agreement concerning the costs and other

conditions with the airport operator.

9.2.4 In the event that there are non-operating / non-

aircraft operators or their representative cannot

be contacted and they have let the aircrafts in


such a condition for 3 (three) months and the

airport operator has make notification /

announcement through newspapers, the airport

operator shall be entitled to carry out scrapping.

9.3 Incidents

9.3.1 Aircraft collision incident

9.3.1.1 The aircraft operator shall not be

responsible for incidents between aircrafts

and aircrafts and between aircrafts and

Ground Support Equipment (GSE) caused by

the airlines or aircraft operators or other

parties according to the result of

investigation carried out by the

government;

9.3.1.2 In the event of incidents as intended in

point 9.3.1.1, the airlines or aircraft

operators must settle all impacts as the

consequences of the incidents;

9.3.1.3 The airlines or aircraft operators shall

be responsible for the damage of airport

facilities caused by the airlines or


aircraft operators according to the result

of investigation carried by the government;

9.3.1.4 In the event of incidents as intended in

point 9.3.1.3, the airlines or aircraft

operators must settle all impacts as the

consequences of the incidents.

9.3.2 Aircraft passenger incidents

The airlines or aircraft operators shall be

responsible for the incidents experienced by the

aircraft passenger from the terminal to the

aircraft and conversely caused by the airlines or

aircraft operators.
