With May just around the corner, we are once again planning for our annual Law Day events. This year, the national theme is “The Legacy of John Adams from Boston to Guantanamo,” whichagain provides us the opportunity to reflect on the rule of law and the way in which our profession interacts with the rest of society. John Adams became our first lawyer president in 1797 and is generally considered one of the great defenders of our nation’s rule of law. Perhaps best known for his defense of the British officers involved in the Boston massacre, he was well-known not only in rhetoric but practice for representing unpopular, controversial clients and believing in their right to the protection of law.President Adams once explained, “Each individual of society has a right to be protected by it in the enjoyment of his life, liberty, and property...no part of the property of any individual can, withoutjustice, be taken from him, or applied to public uses, without his own consent or that of the representative body of the people.” At a time when it was unpopular, he abhorred slavery, hedefended the poor and weak, and he called for protections against the rich and powerful—through both the rule of law and political action. He once said, “Liberty must at all hazards be supported. We have a right to it, derived from our maker.” He espoused a creed toward which most lawyers strive: “Always stand on principle, even if you stand alone.”

Whatever our practice area, and whoever receives our advocacy, we are each governed by that rule of law, which Adams found inextricably tied to society’s moral code. Since Adams saidit much better than I could, I will take my mom’s advice that sometimes it is better to shut my mouth and listen; and thus I provide you his words on the rule of law. Adams explained, “The dignity and stability of government and all its branches, the morals of the people, and every blessing of society depends so much upon an upright and skillful administration of justice.” The administration of justice he believed derived from the judges who oversee the legal system, and who he believedwould be free from party politic. Making clear where he would have stood on the non-partisan court plan, Adams once stated, “Judges therefore should be always men of learning and experience in the laws, of exemplary morals, great patience, calmness, coolness and attention. Their minds should notbe distracted with jarring interests; they should not be dependent upon any man, or body of men.” As we examine our profession as part of Law Day, Adams’ words can help guide each of ourreflections. To put much more substance to this year’s theme, we are pleased to announce that Attorney General Chris Koster will be giving the keynote address on May 5, 2011, at 11:30 a.m., at Hickory Hills Country Club. I know that all who heard him speak at the

luncheon shortly after he took officecan attest to his exceptional oratory skills, and we are very much looking forward to hearing from him again. The Law Day festivities at Hickory Hills will also include the presentation of Distinguished Attorney Award, the Liberty Bell Award, law students scholarships, as well as awards for essay contest winners and poster contest winners. The Law Day events continue with the 5K run, which will again be held at Phelps Grove Park, at 4:00 p.m., followed by Happy Hour at southside Ebbett’s Field. I look forward to seeing you all at this year’s events.

1958Law Day USAEstablished by Presidential Proclamation

WHEREAS it is fitting that the people of this Nation should remember with pride and vigilantly guard the great heritage of liberty, justice and equality under law which our forefathers bequeathed to us; and

WHEREAS it is our moral and civic obligation as free men and as Americans to preserve and strengthen that great heritage; and

WHEREAS the principle of guaranteed fundamental rights of individuals under the law is the heart and sinew of our Nation, and distinguishes our governmental system from the type of government that rules by might alone; and

WHEREAS our government has served as an inspiration and a beacon light for oppressed peoples of the World seeking freedom, justice and equality of the individual under law; and

WHEREAS universal application of the principles of the rule of law in the settlement of international disputes would greatly enhance the cause of a just and enduring peace; and

WHEREAS a day of national dedication to the principle of government under law would afford us an opportunity better to understand and appreciate the manifold virtues of such a government and to focus the attention of the World upon them;

NOW, THEREFORE, I, DWIGHT D. EISENHOWER, President of the United States of America, do hereby designate Thursday, May 1, 1958 as Law Day - USA. I urge the people of the United States to observe the designated day with appropriate ceremonies and activities, and I especially urge the legal profession, the press, and the radio, television and motion picture industries to promote and to participate in the observance of that date.

1963May 1Law: Rule of Right, Not MightLaw Day Address by Dr. Francisco TaracidoThe Greene County Bar’s first law day address was given by Dr. Francsco Taracido, a Cuban lawyer who fled his home country after he was compelled to participate in May Day celebrations on May 1, 1960 in Havana. The address was delivered to a standing room only crowd packed into the Southern District Court of Appeals Courtroom and was televised on KYTV, KTTS-TV, and broadcast on radio stations KWTO and KTTS. The Greene County Bar also conducted its first essay contest in 1963.

DISTINGUISHED ATTORNEY AWARD

The purpose of this award is to recognize members of the bar who exemplify the highest legal and ethical standards to which all in the legal profession should strive.

This award is annually presented in the form of a plaque at the SMBA Law Day Luncheon.

The minimum qualifications for the award are as follows:• That the attorney be a member in good standing of the SMBA, the Missouri Bar, and any other state or federal courts in which the attorney is licensed.

• That the attorney exhibit high standards in the practice of law for 20 years or more.

• That the attorney be actively involved in service to both the legal and non-legal community.

• That the attorney exhibit exemplary ethical standards in the practice of law.

LIBERTY BELL AWARD

The purpose of this award is to recognize a non-lawyer whose service strengthens the effectiveness of the American system of freedom under the law and encourages respect for the American legal system. This award is presented in the form of a plaque at the SMBA Law Day Luncheon. The award recognizes a person for outstanding service in one or more of the following areas: • Promoting a better understanding

of our Constitution and the Bill of Rights;

• Encouraging a greater respect of law and the Courts;

• Stimulating a deeper sense of individual responsibility so that citizens recognize their duties as well as their rights;

• Contributing to the effective functioning of our institutions and government;

• Fostering a better understanding and appreciation of the law.

Any individual who has rendered outstanding service to his or her community in one or more of these areas may be nominated. Persons in all fields of endeavor are eligible for the Liberty Bell Award. Past recipients have come from both the public and private sectors and such diverse fields as education, law enforcement, and charitable organizations.

2011 SMBA LAW DAY SCHOLARSHIP

The John D. Ashcroft scholarship is awarded annually to a 2L or 3L by the Springfield Metropolitan Bar Association at the Law Day lunch celebration. This scholarship has provided over $20,000 in financial assistance to law school students. The purposes of this scholarship are: • To aid and encourage students to practice in the

communities served by the Springfield Metropolitan Bar Association

• To promote collegiality within the Springfield Metropolitan Bar Association

• To foster and increase a spirit of participation by the Springfield Metropolitan Bar Association in community service.

Several previous award recipients have returned to become active members of the SMBA after completing law school. The criteria for the scholarship is as follows: • The applicant must be entering his or her second or third

year of law school. • Factors that will be favorably considered include:

1) Domicile in the Southwest Missouri region, 2) Ties to the Southwest Missouri region (including previous

residence in Southwest Missouri), family ties to South-west Missouri, and/or

3) An interest to reside in Southwest Missouri.

LAW DAY ESSAY CONTEST

The Springfield Metropolitan joins in the annual celebration of Law Day USA by sponsoring an essay contest for local middle school students. The objective of this contest is to appreciate, celebrate and foster a greater understanding of our legal system’s ability to insure equal justice for all.

ESSAY CONTESTOpen to students in grades 6-8

Instructions and rules: • Write an essay consistent with the

national theme for Law Day 2011: The Legacy of John Adams: From Boston to Guantanamo.

• Essays must be type written on 8.5 x 11 white paper and must not exceed 1000 words in length.

• Essays will be judged on the basis of originality and coverage on the subject matter.

• Entries will be judged by a committee of attorneys who are members of the SMBA.

• Submissions must include name, school, grade, home address, email and phone number.

• Essays must be received on or before Friday, April 15, 2011, 5:00 p.m. Mail or deliver entries to Law Day contest c/o Chandler Gregg, SMBA, 1615 S. Ingram Mill Rd., Building D, Springfield, MO 65804.

Prizes:Prizes will be given to first, second and third place essays and the winners will be invited to receive their award at the 2011 SMBA Law Day lunch celebration.
