In Brand Book A-B-C, Refugio Coutny in 1853, we find the brand “M” registered in the name of CEBURN, JAMES and PERMELIA . We believe that JAMES (INDIAN JAMES), the uncle of these three children, registered the brand in their name as he was always known as their guardian, though without legal status. After the death of SIMON MARTIN, his wife and children moved back to Louisiana, where we find them in the 1860 census of Calcasieu Parish with ZACHARIAH MARTIN (II) shown as head of the house. According to a couple of affidavits found elsewhere, they were back in Refugio County in the early 1860s, where MARY AVERY, the widow and mother died.

CHAPTER NINE

SIMON MARTIN

1823-1853

In light of further developments, we believe SIMON MARTIN died in Refugio County, Texas in 1852 or 1853. It was more than likely 1852, shortly after arriving in that county fromLiberty County.

In Brand Book A-B-C, Refugio Coutny in 1853, we find the brand “M” registered in the name of CEBURN, JAMES and PERMELIA. (This should be AMELIA, and was perhaps misspelled by the clerk who registered it.

VI SIMON MARTIN, born in 1823, Rapides parish, AL. He moved to Liberty County, Texas in 1847 and was in Tyler County by 1850, as shown by the 1850 Census of that county. There has been, due to various circumstances, speculation that he died in one or the other of these counties. Furthe r dvelopments indicate that he died in Refugio County and that he did die in Refugio County. (In the document chapter, look in the SIMON MARTIN section to that part where ZACHARIAH (RYE) MARTIN and his brother AMOS each made a sworn affidavit saying that SIMON died in Refugio County. Following these affidavits is a story told by JAMES “PONY JIM” MARTIN to his daughter , GLADYS MARTIN ENLOE, wherein he states that his father died in Refugio County, so in light of this it can only be accepted as a fact that he died there. SIMON MARTIN, as his brothers, was a farmer and stockman. He was married to MARY AVERY, born in 1829, Rapides Parish, daughter of AMOS AVERY and SARAH SWEAT. This couple had:

He owned land with his brother, PONY JIM, and a double first cousin, HENRY MARTIN, (son of JOHN MARTIN and OLIVE AVERY) later selling his part of the land and bought other land on the Frio River, about eight miles from Tilden, which is still owned by the family. He was a rancher all of his life. He was a member and past master of Loma Alto Lodge #544, AF&AM, Tilden, Texas and a member of the Baptist Church at Tilden. October 8, 1874, Live Oak County, Texas, he was married to MARY ELIZABETH WALKER, born October 15, 1859, daughter of JOSEPH and MARY WALKER.
