NOTES FOR FACILITATORS The first part of this exercise is intended to gauge the understanding that participants may already have of birth registration, its procedures and its importance, and the concept of and the right to nationality. The answers for this exercise are based on the Right-Based Approach. A rights-based approach uses a human rights lens to empower people to stand up for their rights, this means that we use international human rights law and domestic law as a basis for analysing our rights. The correct answers to these statements can be explained:

o Children should have their birth registered immediately after birth in accordance with the provisions of the Convention of the Rights of the Child.

o It is the joint responsibility of the parents and the authorities to ensure that children have access to birth registration.

o Many people do not have any knowledge on how to access identity documents because the citizenship law is complicated and the process is difficult to understand. It can be confusing in Myanmar to understand the process of birth registration with multiple actors involved.

o There are many problems that may arise in a child’s life if they are unable to register their birth.

o Birth registration is separate from confirming nationality, however a birth certificate is an important document to secure the legal identity of a child and perhaps confirm their nationality in the future.

o Some minority groups may face discrimination when they try to obtain their identity documents.

o The right to nationality is enshrined in various instruments in international law this includes Article 15 Universal Declaration of Human Rights, Article 7 Convention on the Rights of the Child, Article 9, Convention on the Elimination of all Forms of Discrimination Against Women, Article 18 Convention on the Rights of Persons with Disabilities, Article 24(3)

International Covenant on Civil and Political Rights. o A stateless person means a person who is not considered as a national by any

NOTES FOR FACILITATORS The facilitator wants to clarify some of the key points that come up in the responses:

1. What is your nationality/citizenship? Did the participants indicate they are from Myanmar? Or from a “national ethnic group”? Nationality in international law refers to the country you have citizenship. For example, Myanmar, Australia, etc. There might be many different ethnic groups in one country. 2. When did you acquire your nationality/citizenship? and 3. How did you acquire your nationality / citizenship? The Myanmar citizenship law is based on the principle of jus sanguinis meaning that

nationality is passed down by descent. This means that most Myanmar people acquired their nationality at birth. This is then confirmed when they apply for their citizenship documentation later in life. The important point is that they have acquired citizenship when they are born automatically. It is not possible to acquire Myanmar citizenship simply by being born on Myanmar territory. 4. Under what circumstances could you lose your nationality? Myanmar citizens who have acquired citizenship “by birth” meaning that they are members of one of the 135 recognised ethnic groups cannot have their citizenship revoked, unless they receive a citizenship from another country. Myanmar does not permit dual nationality. For those who are not citizens “by birth” the President has a discretionary power to revoke citizenship. For those who have naturalised or associate citizenship, it may be revoked if they are perceived to have acted “against the interests of the State”.

5. What proof(s) do you have of your nationality? In the Myanmar context, proof of citizenship means to have a Citizenship Scrutiny Card (CSC), Naturalised Citizenship Scrutiny Card (NCSC) or Associate Citizenship Scrutiny Card (ACSC). A National Registration Card (NRC) is not a proof of citizenship, it is a residency document only. 6. What would someone from another country need in order to acquire your

nationality/citizenship? It's not possible for someone from outside of Myanmar to obtain Myanmar citizenship. Even by marriage, after 1982 it is no longer possible for a spouse to obtain Myanmar citizenship. The facilitator can hand out copies of the 1982 Citizenship Law and 2008 Constitution as reference materials.

law. • Tell participants to tape the matching pairs together on the flipchart paper. • Tell participants to work as quickly as they can and to raise their hand when complete. • The facilitator or co-facilitator should check the answers. If the first group is

Each state is to determine under its own law who are its nationals. This law shall be recognized by other states in so far as it is consistent with International Conventions, International customs, and the principles of law generally recognized with regard to nationality. INSTRUCTIONS FOR MAYORS TO BE GIVEN DURING BREAK

• During a break, the facilitator should talk with two participants about playing the role of Mayors of Appletown and Bananaville (depending on the number of participants, it may be necessary to allocate two Mayors for each country). Please remember to think about asking women and minority participants to play Mayor.

• Give year Mayor the citizenship rules for their country (21.3.4 Rules of Appletown and Rule of Bananaville 21.3.5).

• Tell the Mayors that they will use these rules to decide if a participant can become a citizen of their country.

• Tell Mayors privately (not in discussion with the group) that they should deny at least one person using their discretionary power even if they are eligible, and grant citizenship to at least one person who is not eligible.

• Give the Mayors the Identity Cards (Handout 21.3.7) for their countries and tell them that when they give citizenship to a participant to give them a card. ( Give the Identity cards to the Mayors depends on the number of participants. To left the statelessness, the Facilitator needs to reduce the number of identiy cards in giving to the Mayors. )

• Tell participants that they are now going to play a game about citizenship. • Tell participants that they will each be given a profile (Handout 21.3.6) which

indicates some personal details about themselves and the “Rules” of two imaginary countries, Bananaville and Appleville (21.3.4 Rules of Appletown and Rule of Bananaville 21.3.5).

• Each participant should analyse the rules of each country and decide which country they think they are entitled to citizenship from.

• Encourage participants that if they are rejected by one country to apply for citizenship in the other country.

• Ask participants if they understand the directions. • Tell participants to begin by approaching the Mayors to apply for citizenship. • Tell participants that once they receive their identity card, they should return to their

seats and make a short list on post-its of what the impact will be on their lives with their new identity cards and stick them on the flipchart paper.

Some participants will be able to prove they are eligible for citizenship and others will have challenges, as follows:

• Eligible for citizenship: Those born in Appletown and those who have parents who are nationals of Bananaville. Those who have birth certificates will be able to prove they are eligible because their birth certificate will indicate the place of their birth and the names of their parents.

• Not eligible for citizenship: Those who were born in Bananaville and do not have parents from Bananaville.

A birth certificate is the first piece of official record for the existence of a child, in this context those who have a birth certificate are better placed to prove which citizenship they are entitled to. A birth certificate is an important document to ensure that statelessness is avoided later in life. Sometimes it is because of gaps in nationality laws that people are unable to have their citizenship confirmed. Sometimes, it is because of discrimination. The Mayors of Bananaville and Appletown had a broad discretion to not give citizenship to some people if they did not want to, on any basis.
