Chapter I

Article 1: The devalaya of Shree RastroliParpoleshwar was originally established in 1939and popular in Sorvem Wado of Small Guirim,Bardez-Goa survey No. 38/1 where it is presentlyfound.

Article 2: The affiliated deities of the saidDevalaya are

1. Shree Rastroli Parpoleshwar.2. Tulsi.3. Holeshwar.

Article 3: The general body of mahajans of saidconsecutive devalaya is composed of mahajansordinarily residents of Guirim for three years and isenrolled in the annexed list to the bye-laws andthose who may be enrolled in the future in theterms of Article 3 by complying with the procedural

The rights of mahajans including thosewho may be admitted as mahajans in terms ofArticle 3 are hereditary, perpetual, co-sanguinely,masculine lineage as are transmitted as mahajansfrom generation to generation by consanguinity orby legal adoption and these rights become effectiveonce a person becomes major of age and is dulyenrolled as mahajan. The up-to-date list of allmahajans shall be maintained by managingcommittee and a copy of the same shall be displayedon notice board every year in the month of January.

Clause 1: Any person professing Hindu religionirrespective of caste, colour, sect or family groupcan be admitted as mahajan by managingcommittee of mahajans in future on payment ofentrance fee that may be prescribed for the purposeof mahajans committee which for in no class shallexceed Rs. 101/- (One hundred one only). Any personenrolled as mahajan in terms of this clause shallenjoy equal rights, priviledges, honours andobligations, along with all other mahajans includingthose referred to in Article 3.

Clause 2: The main function of anniversary ofdevalaya will be held in the month of Magh on theday of Mahashivratri. This consists of Mahabhishek,Shree Satyanarayan mahapuja followed by bhajanand public auction of articles offered to the God,and prasad. On the next night there will be culturalprogramme which are optional and will becelebrated according to contribution/collection ofdonations from mahajans/public. This anniversarywill be assigned to mahajans by lottery and rotation.A record of this will be maintained by secretary ofthe managing committee. Similarly on everyMonday there will be pooja and these Mondays ofthe year will be assigned by lottery system and byrotation except the 1st Monday of Shravan monthwill be celebrated in common with the expenses oftemple under the guidance of president of thetemple.

Chapter II

The Rights and Duties of Mahajans

Article 4: Every active member of general bodyshall have right to take part in the proceedings ofgeneral body meeting and put forth his views,objections, if any, which may contribute to efficientrunning of devalaya.

Article 5: All mahajans are bound in duty to holdgratis the office of the management andadministration of devalaya for which they may beelected or appointed and they shall try their bestfor welfare and maintenance of worship andprogress of the devalaya.

Chapter III

Assets and Liabilities of Devalaya

Article 6: The assets of devalaya consist of(a) the building of the devalaya admeasuring 9 mts.by 6 mts. (b) the stage for drama 64 m2 (c) thetulsi (d) The ornaments and other metals(e) miscellaneous utensils and articles (f) thebalance in cash in hand, in bank and in fixeddeposit.

Clause 1: All such assets movable and immovablewill be listed in the inventory of devalaya and thiswill be verified by the managing committee everyyear, and up-dated for the information ofmahajans.

Article 7: The income of the devalaya consists of(1) the income from deposits in bank (2) productsof oblations and donations (3) the income from saleof religious goods during festivals (4) anyincome from eventual proceeding (5) the fees paidby the mahajans (6) any other receipts frommahajans or members of public for up keeping andmaintenance of devalaya. The yearly subscriptionwill be fixed by committee elected according toexpenses, if any member fails to pay subscriptioncontinuously for a period of three years, hismembership will be cancelled after due process.

The responsibility for issuing receipts andmaintenance of accounts will be on theexisting committee. The annual subscription ofmember will be initially Rs. 51/- (Rupees fifty oneonly) and will change according to expenses.

Article 8. The expenses consists of:

1. Renovation, extension, maintenance andcleanliness of temple and its surroundings.

2. Remuneration to servants of temple includingthe pujari.

3. Costs of worship including the 1st Monday ofShravan month every year.

4. Any other expenditure for celebration ofanniversary of devalaya or the day ofMahashivratri.

5. Any other eventual expenses allowed in thebudget or otherwise the income and expenseswill be made known from the respectivebudget.

Chapter IV

The Festivals and other Ceremonies celebratedin the Devalaya are

Worship

Article 9: According to religious percepts andtradition everyday in general and every Monday inparticular there shall be pooja to be performed bypoojari and in the evening there will be bhajansinging, followed by distribution of prasad. Thisbhajan will commence from 9 pm and conclude byall means before 11 pm. The prasad will be purevegetarian in nature and intoxicating drinks andnon veg. articles of food are strictly banned.

Festivities

Article 10: In the devalaya of RastroliParpoleshwar Temple there shall be followingreligious festivities.

1) On the day of Mahashivratri in the monthof Magh there shall be anniversary ofShree Rastroli Parpoleshwar. This includesMahabhishek, Satyanarayan pooja by themahajans by lottery and rotation, bhajan,aarati, auction sale of articles and prasadfollowed by drama of youth or any othercultural programme.

2) In month of Kartik Tulsi Vivah.

3) In the month of Shravan the 1st Monday.

4) The above festivities are to be celebratedunder the guidance of committee withexpenses from devalaya.

5) The other Mondays of the year to becelebrated by mahajan by lottery and byrotation with own expenses.

Article 11: The charges payable by the devoteesfor performance of various religious ceremoniesshall be shown below, subject to modification asmade by the general body of devalaya from timeto time.

c) Nandadip (for month) Rs. 30.00d) Celebration of Monday Rs. 51.00

This includes charges ofelectricity etc.

Clause 1: The charges referred to in the aboveArticle a to c shall share between devalaya andpujari who officiate the respective acts as per therules formed by the committee and approved bygeneral body of mahajans from time to time.

Article 12: All those professing Hindu religion,irrespective of caste, class, sect or family groupshall be allowed according to usage and custom, torender worship in the premises of temple andto perform religious acts and to institute festivitiesand make donations to the devalaya. Such acts,however in no way, entitle them to claimmahajanship of devalaya temple.

Article 13: In all religious and festival actscelebrated by mahajans or instituted by privateparties, the mahajans or other workers in generalshall execute their respective duties.

Article 14: The mahajans do not renounce theright which by any way they may have forimmovable properties right whereas the activedebts etc., shall be claimed as an integral part ofdevalaya and not from mahajans.

Article 15: It is vested in the general body ofmahajans the power to resolve the matter inherentto the worship, resolutions whereof are speciallyvested in the managing committee as well as toamend and alter the present bye-laws inaccordance and manner established in law.

Article 16: The administration of the devalayashall be regulated by these bye-laws and by the”Regulamento das Mazanias” in force in Goa aswell by any other general special laws andregulations applicable or which may be applicableto such institutions in future.

Article 17: In cases for which no provision ismade in the present bye-laws the customs followedfrom the antiquity and which are not inconsistentwith the legal provisions shall be observed.

Article 18: The committee of devalaya is boundby law to submit returns/reports to the mamlatdarof Bardez-Goa who is the official administrator ofdevalayas of Bardez and are bound by hisinstructions and circular issued from time to time.

Article 19: Any amendment to above Articles,Clauses shall be decided by general body ofmahajans by the general majority of members

present and voting. For any misbehaviour bymahajans his membership will be cancelled afterwarning two times, so also for unparliamentarylanguage/abuses the above punishment will beenforced. In this regard the decision of general bodyof mahajans is final and binding on mahajans.

Article 20: For smooth running and maintenanceof devalaya every active member shall subscribeannually Rs. 51.00 (Rupees fifty one only). Howeverit is left open to them to contribute any amountover the minimum. A permanent membership canbe conferred on any mahajan on payment ofRs. 1001.00 (Rupees one thousand one only) andsuch amount received due to permanentmembership should be deposited in F.D.R. in anynationalized bank. The committee reserves theright to recover the subscription fallen due uptodue period of three years. For non payment ofsubscription for three years, the membership isliable to be cancelled; however the general body ofmahajans will decide such issue by due process oflaw.

Article 21: The bank accounts shall be openedby a) President b) Secretary c) Treasurer, howeveroperated by any two at a time. The petty cash inthe hand should not exceed Rs. 500/- (Rupeesfive hundred only). The payment exceedingRs. 500/- shall be remitted in the bank A/cimmediately.

Article 22: If any provision of the above Article//Clause is violated and individual mahajan or joinedmahajans are entitled to seek the redressal of theirgrievances by filing proper complain before theadministration of devalaya Bardez-Goa.
