There are feelings of both excitementand anxiousness. It is time to submitan offer. This critical part of the buy-ing process has significant ramifica-tions. In today's complex and rapidlychanging real estate market, it isimperative you have a realtor that willprotect your most prized investment.

This article will discuss the essen-tial clauses that should be part andparcel of any offer.

All offers will spell out the usu-als –– offering price, deposit and clos-ing date. However, there is muchmore that needs to be incorporatedinto your offer to make sure yourinterests are fully protected.

If you are looking to secure amortgage and have a pre-approvalfrom a financial institution, it wouldstill be prudent to include a financingcondition clause. The typical timeframe is 5 to 7 business days. If forwhatever reason you couldn't arrangefinancing, then your deposit would bereturned in full. Often times a pur-chaser mistakenly believes a pre-approved mortgage is a guarantee of amortgage approval. If you review thefine print you will notice most pre-approvals have many conditions. Ifthese conditions are not met the finalmortgage approval may not be grant-ed.

Another imperative condition toinclude in an offer is a home inspec-tion clause. This clause allows thepurchaser the right to hire a profes-sional home inspector who will con-duct a home inspection of the subjectproperty which typically takes 2 to 3hours. The inspector will review themajor components of the homeincluding the roof, the furnace, elec-trical system, plumbing and exteriorfoundation. If for whatever reason thepurchaser is unhappy with the out-come of the inspection he can nullifythe transaction. Often times if a homeinspection reveals a deficiency thepurchaser may obtain an abatement(price adjustment) from the vendor.

An often overlooked clause is thechattel warranty clause. This typicallyapplies to the appliances and ensuresthat the appliances remaining on thepremises will be in good workingorder on closing. If an appliance is notworking you will have legal recourseagainst the vendor. In many instancesno mention is made of chattel war-ranties and the purchaser is at riskshould the appliances not be opera-tive.

The right to view the property oneor two further time(s) should beinserted in the offer. This allows thepurchaser the opportunity to visit theproperty prior to closing typically for

the purpose of taking measurementsor showing the property to other fam-ily members. In many cases it isadvisable to have the purchaser viewthe property just prior to closing toensure that there are no significantchanges in the condition of the prop-erty. The purchaser is in a position ofstrength prior to closing and shouldany problems arise it is easier for thepurchaser's lawyer to remedy the situ-ation.

Typically, a survey is required byboth the solicitor and the lender.Therefore you should include a surveyclause to satisfy both of these parties.In the event a survey is not availableyou can still obtain title insurancewhich will guarantee you "good title"to the property. Prior to title insur-ance, if a survey wasn't available theneither the purchaser or vendor wouldhave to bear the cost of a new survey.(A survey is the accurate measure-ment of both land and building madewith the aid of instruments.)

If you are buying a condominiumyou want to ensure the sound financialhealth of the condominium corpora-tion. Any offer should be conditionalupon obtaining a status certificatefrom the condominium corporationand having your lawyer review and besatisfied with such documentation.This certificate highlights manyimportant aspects of the condo corpo-ration such as the current amount ofmoney in the reserved fund, if thereare proposed increases in the mainte-nance fees, if there are any specialassessments being contemplated, andthe outcome of any engineering stud-ies determining the adequacy of thereserve fund.

Situations may arise where spe-cial assessments in excess of $10,000are levied against each unit owner. Byreviewing all pertinent documentationthis will ensure there will be no costlysurprises.

If you are unsure or uncomfort-able about any aspects of the offer youmay want to include a clause statingthat it is conditional upon your lawyerreviewing the offer and being satisfiedwith the same, failing which the offershall become null and void. This willallow your lawyer the opportunity toreview the offer and if any changesneed to be made, your lawyer canmake such changes to the agreementof purchase of sale. If the other sideobjects to such changes then you canvoid the agreement. This will give youpeace of mind when you are submit-ting your offer.

CRAYON ON WALLSFor crayon on walls, use WD-40. It removes it immediately, but if you use it

on a flat paint it will leave a greasy line that can easily be washed off with soapand water.

Another option is to use WD-40 or lighter fluid, it does come right off with-out the hot water and soap. But of course you want to rinse the chem smell.

CHEWINg gumTo remove chewing gum from clothes freeze, or cover the gum with ice, then

crack and scrape off.

INk STAINSIf the ink is still wet put salt on the stain, and then brush it off after a few

minutes when it has soaked up some of the ink. You may need to repeat this a fewtimes. Clean wet ink off carpet with soda water, then blot it off with paper tow-els. Then clean with a detergent.

ANTS IN THE HOuSEAnts will not cross a chalk line drawn on any surface. Of course if you live

in a rainy area where ants are a problem, you must re-draw the chalk lines eachtime it rains.

EARWIgS If you have a problem with earwigs just roll up a newspaper and leave it in

the problem area over night when you wake up in the morning they will be insidethe paper put in plastic bag and throw away. Of course it isn't a permanent solu-tion but it will help cut down on the quantity.

mOuSE TRAPSBait the trap with peanut butter and put it in a brown paper lunch bag. The

mice seem drawn to the small place to explore and all you have to do is close thebag and throw it away after they've been caught! No muss, no fuss!

SCuFF mARkSTake a rubber soled shoe (like tennis shoes) wipe across the scuff and it will

come off.

early 2010, housing starts are expectedto moderate in the second half of 2010.Starts are expected to stabilize at levelsconsistent with demographic funda-mentals in 2011, according to CanadaMortgage and Housing Corporation’s(CMHC) third quarter Housing MarketOutlook, Canada Edition.1

Housing starts are expected to bein the range of 170,200 to 198,400units in 2010, with a point forecast of184,900 units. In 2011, housing startswill be in the range of 146,900 to210,500 units, with a point forecast of176,900 units.

"Housing starts will moderate inthe coming months as activitybecomes more in-line with long termdemographic fundamentals,” said BobDugan, Chief Economist for CMHC.

Mr. Dugan also noted that theexisting home market conditions willremain balanced over the next twoyears as MLS®2 sales ease and inven-tory levels remain elevated. Existinghome sales will be in the range of450,000 to 485,700 units in 2010, witha point forecast of 463,800 units. In

2011, MLS® sales will move lowerand are expected to be in the range of425,000 to 490,700 units, with a pointforecast of 456,000 units.

With an improved balancebetween demand and supply, the aver-age MLS® price is expected to edgelower through the end of 2010 and thenrise modestly in 2011.

Always consult your local struc-tural building code with respect tobasement wall framing. Some munic-ipalities spell out how the top andbottom plates are attached. Somecodes want the walls to be allowed tofloat.

Framing the Exterior BasementWalls

You'll frame your walls using 2”X 4” lumber. Be sure to select onlythe straightest and truest boards.You'll find there are three compo-nents to your wall – bottom plate (it'shorizontal, it's on the floor, it contactsyour concrete basement wall), topplate (the bottom plate's complement,which is nailed to the bottom of yourceiling joists), and finally the studs(they're vertical, toenailed at the bot-tom plate, top plate).

Secure your bottom plate to thefloor. Use either a powder actuatednail gun, driving nails via a .22 calblank or using a hammer with con-crete nails. The powder gun is thebest choice. Make sure you wear yoursafety glasses.

Now you can nail the top plate.There are two ways to accomplishthis: hammer it up or use a gun. A nailgun is the best choice because ham-mering in the upside down positionwill wear you out! Use 2 nails onevery joist. You will need to cut your2” X 4”s to make them break in themiddle of a joist.

Next, starting in any corner, standa stud up to the concrete wall betweenyour top plate and your bottom plate.Toe-nail it to your top plate. Now doyour bottom plate. Next, nail the nextstud to that stud, pressing the 2” sideof your first stud against the 4” side ofyour second. Now nail a third stud sothat its 2” side is also touching the 4”side of the first stud and its 4” side iscontacting the 4” side of the secondstud. It is a little hard to explain with-out illustrations but try it – the point isthat the resulting intersection of thestuds matches the intersection formedby the bottom and top plates (90degrees). This is so your drywall will

have nailing surfaces.

Filling in the StudsDo the stud layout now. Starting

with your tape measure on the floor inthe corner, extend it along the bottomplate and mark the plate every 16”.This will be the center of the stud.Continue around the basement. Itdoesn't matter what you end up within each opposing corner; what countsis that you start with 16”. Go back tothe corner you began at and cut thestud so that it fits snug but not bow-ing. Toe nail it at the bottom, plumb itwith a 4' level and toe nail it at thetop. Now you can hook your tapemeasure to that stud and mark theothers on 16” and the rest of the studsshould also be plumb.

Lay Out Your Electrical OutletsDo you already have electrical

outlets everywhere you need them onthe perimeter walls? Most likely notif your basement is currently unfin-ished. Even if you have them theymight need to be relocated so theycan be secured to the framing studs.Unless you are very familiar withelectrical work, it is highly recom-mended that you consult with alicensed Journeyman Electrician.

Building Your Interior PartitionsInterior basement walls are easier

to build on the ground and stand up.Measure the floor to ceiling at sever-al spots so that you can take the short-est height for the wall and use spacingshims where you need to. Before youstand the wall framing up, strike achalk line on the floor so you knowwhere the wall goes. Use the 3-4-5method to ensure that you are perpen-dicular with the exterior wall.

If the wall is going the oppositedirection as the ceiling joists, there'splenty to nail to. If not, you will needto add 2” X 4” nailers between thejoists.
