    Welcome to Westlake Corporation, Lake Charles, Louisiana. We are pleased to have you as part

    of our workforce and hope that your time spent here will be safe, productive and rewarding. This manual is intended to be a guide to the safe work practices that comply with both state and

    federal guidelines to promote a safe working environment for all employees at our facility.

    Our goal at Westlake is always "Zero Accident Performance". We are firmly committed to the

    idea that all accidents are preventable. Be continually aware of the hazards around you and your

    jobsite; watch out for yourself and for others; report any unsafe condition to your supervisor

    immediately!

    Westlake strongly encourages all of its contractors and their subcontractors to participate in the A Westlake Contractor Safety Forum. The Forum is a partnership between Westlake and its

    contractors to promote a safety culture that provides for an accident-free and environmentally

    safe workplace for those working at the Westlake facility.

    Please read and examine this manual thoroughly to ensure you are fully aware of its contents.

    Accidents can be avoided by familiarizing yourself with proper safety procedures and adhering

    to specific safety guidelines. Do not take shortcuts with safety.

    I. Introduction

    This safety manual contains the minimum safety rules and procedures for the performance of work by Contractors and their subcontractors as required by Westlake Corporation. Contractors assume the full responsibility and liability for the safety of their agents, and employees and for the compliances of its subcontractors. Any exception to the rules set forth herein must have prior written authorization from the Owner. The Owner is established as Westlake Corporation.

    In addition to the rules set forth herein, Contractors working in or near an existing operating facility must be knowledgeable of and must comply to the Owner's safety rules for the area and any federal state, or local laws governing.

    Should any procedure set forth herein conflict with applicable federal, state, or local laws, the latter will apply.

    Contractors unable or unwilling to secure personnel whose performance is in keeping with these rules will not be acceptable. Contractor's supervisors and employees who do not exhibit support in word and action for performing work safely and complying with established safety procedures will be unacceptable. EMPLOYEES WHO LEAVE A JOB DUE TO SAFETY VIOLATIONS WILL NOT BE ALLOWED TO RETURN TO OWNER'S WORK SITE WITHOUT PRIOR AUTHORIZATION FROM THE OWNER.

    Contractors and their employees are required as of February 15, 1993, to have successfully completed an eight hour safety awareness and training program or an approved reciprocal program. This program is administered by the Safety Council of Southwest Louisiana for this area.

    On the Westlake Chemical South LC Intranet webpage there is a complete list of Westlake Chemical South Safety Procedures. If you do not gain access to the LC Intranet system, get with your Westlake representative to produce these procedures for you.

    II. Definitions

    "Owner", "Owner's Representative". "Contractor", "Contractor's Representative", "Subcontractor", and "Work" shall be as defined in the General Terms and Conditions and the Agreement. "Construction Management Contractor" shall mean the contractor who has been duly authorized to act as “Owner's Representative" in those responsibilities so delegated by the Owner.

    The relationship between the "Construction Management Contractor" and the "Contractor" shall be the same as between the "Owner's Representative" and the "Contractor" on responsibilities so delegated by the "Owner".

    III. Construction Site

    The job site location for this construction project is within the confines of the operating plant and all security and safety procedures relative to that condition will be in effect.

    IV Construction Hours

    A. Working Hours

    Unless the Owner otherwise notifies the Contractor, normal working hours will be based on a 40-hour work week from 7:00 a.m. to 5:30 p.m., exclusive of a 30-minute lunch period, on Monday through Thursday.

    Make-up days for time lost due to weather conditions are not normally allowed but will be considered depending upon job criticality. Arrangements must be made with the Owner's Representative in advance.

    B. Overtime

    No overtime will be permitted except on an emergency basis or authorized by the Owner's Representative.

    C. Quitting Time

    At the end of the working day, the Contractor's employees are allowed to make their way to the gate leading to the parking area.

    Contractors should control the actions of their employees to prevent “early quits" and to assure that no worker arrives at their construction gate more than five minutes prior to the designated quitting time.

    At the designated quitting time, Contractor's employees are allowed to leave through the gate in an orderly manner.

    Trucks leaving the Owner’s property through the same gate as walking employees must wait for pedestrians to clear before leaving.

    D. Tardiness and Absenteeism

    Excessive tardiness or leaving the construction site early will be cause for dismissal and the contractor should be kept aware of any violations in order to take proper action. Any employee who is absent without proper notification or excuse is subject to discharge for excessive absenteeism.

    V. Parking Lot

    A parking lot will be furnished to the Contractor for his employees parking. The lot will be outside the plant security area. Vehicles in the parking lot are s u b j e c t to random searches.

    The Owner will maintain the parking lot area during the construction period, but cooperation is expected from the Contractor to minimize the maintenance and clean up.

    No private vehicles will be allowed to park on public or plant roads. It is required that care and safety be exercised when employees are entering or leaving the parking lot whether walking or driving. Speeding or other reckless acts by the Contractor's employees will lead to dismissal. No weapons are allowed on Westlake Industries property.

    VI. Construction Gate

    A. Location

    A construction gate will be assigned to the Contractor for access to the job concerning the Contractor's construction site. All vehicles and packages are subject to random searches.

    B. Transportation

    The distance from the assigned construction gate to the construction site is great enough that transportation of employees will be warranted.

    Transportation for Contractor's employees will be furnished by the contractor subject to the security and safety regulations for vehicles at the construction site.

    C. Guard Services

    The Owner will furnish the Guard service for the construction gate. The duty is to provide the security required under this contract. The Guard is responsible directly to the Owner.

    The normal working hours for the Guard will be 5:30 a.m. to 6:00 p.m. on the days when construction is scheduled. The need for the Guard at other hours will have to be arranged.

    The Guard, with permission of the Owner, will conduct lunch box inspection at the Construction Gate at the request of the Contractor.

    D. Access to the Construction Site

    Only authorized personnel will be allowed access to the construction site and it is the contractor's responsibility to abide by the regulations relative to the situation.

    All employees entering Westlake premises must have TWIC card. Contractor's Employees will be allowed entrance at the construction gate by means of badges. Contractor will be required to obtain a picture badge from one of the recognized providers of the Basic Plus safety training. The Construction Gate Guard / Construction Coordinator will register these badges into a computer tracking program. Each employee is to maintain these badges visibly on their person at all times while on the Owner's premises. Upon termination of an employee, the Construction Guard / Contractor Coordinator must be notified and the badge made inactive.

    Contractor Hourly Employees will be hired, indoctrinated to rules and badge activated prior to being allowed to enter and perform work.

    Hourly employees are expected to remain on the jobsite during working hours or to have approval from their supervision to enter or exit the construction gate during that period. Although this does not apply during the stipulated lunch period, employees should be discouraged f rom leaving the construction site due to the short time interval allowed.

    Visitors are not allowed entrance through the Construction Gate without approval of the Owner. There should be justifiable reasons for their being on the construction site and assurance that the Contractor assumes the total responsibility for their being afforded entrance.

    Visitors must be met at the Construction Gate and escorted by responsible Contractor's personnel during the time they are on the premises.

    Union Business Representatives are considered as having no contractual obligations to this construction project and therefore will be considered “visitors". All regulations concerning that status will be adhered to.

    Subcontractors will be considered employees of the Contractor and access to the construction site will be the same as for the Contractor.

    Vendor Representatives and Salesmen for security reasons are considered to have a "Visitor Status" and regulations concerning this status will be adhered to. It is suggested that conferences with these people be done outside the security area.

    Contractor’s Employees are required to wear a photo ID on their outer most piece of clothing at all times while in the complex.

    Vendor Representative and Salesmen will not have access to the job site other than the field offices unless they are given Factory Representative Status and be registered as such.

    Equipment Repair Personnel - When service on equipment or trucks is required that must be done by other than Contractor's personnel; this service should be performed off the jobsite when practical. These service personnel will be considered as a Subcontractor to Contractor if necessary to enter the construction gate.

    Engineering Services - The Owner may have Engineering Personnel entering the same construction gate as the Contractor. Under these circumstances the clearance of these employees will be the responsibility of the Owner.

    Other Contractor's Personnel - The Owner may have other Contractors using the same construction gate as this Contractor. Under these circumstances, other Contractors will be subject to the same security and safety rules as this Contractor.

    Owner's Employees - The Owner may have some of their employees using the same gate as this Contractor. Under these circumstances there will be only supervisory personnel involved and no Owner hourly employees will enter this gate.

    Contractor's Material Deliveries - All Contractor material deliveries will enter through the Construction Gate. Buses furnished by the Contractor for transportation of his employees will stay on a route approved by the Owner .

    VII. Warehousing

    The Owner will operate a warehouse for receiving and storing construction materials purchased by the Owner or his agent and issuing items to the Contractor for installation. The Contractor will be responsible for the materials he purchases as to receiving, storing and issuing.

    Access to the Owner's warehouse will be limited to those authorized by the Contractor to request an issue of materials to his care. All material issued to a contractor will become his responsibility and it is his duty to see that it is properly taken care of, transferred to the jobsite, and handled in such a manner to ensure job efficiency and safety.

    The Contractor shall furnish the Contractor’s Procedures for Material Handling including receiving, warehousing, requisitioning and issuing to the Owner.

    The Owner will issue procedures for the requisitioning and issuing of materials from the Owner’s warehouse.

    The Owner will furnish the personnel to perform all the functions of warehousing including the issuing of receiving reports, controlling inventories, filing damage claims and making material returns and shortage reports.

    Material in the Owner's warehouse or designated lay-down area will normally be unloaded, stored and moved by the Owner's personnel. If desired by the Owner, the Contractor will unload or move material in these areas as directed

    by the Owner after meeting the terms of the contract under which the Contractor is working. The material still remains in the custody of the Owner until issued to the Contractor.

    The Owner's Plant Storeroom is not to be used as a source to provide construction materials except on an emergency basis. All requests for such an issue should be directed to the Owner's Construction Manager at the jobsite.

    VIII. Owner’s Maintenance and Operating Departments

    Portions of the construction work will involve coordination with the Owner's Maintenance and Operations Departments either during the construction stage or during plant turnover. Where shutdowns are required for any cons t ruc t ion activity, the Owner's Representative will work with the Contractor to coordinate the effort to alleviate any adverse conditions. It will be the responsibility of the Contractor to plan his work in order to have the proper tools, necessary material and adequate work force to complete this portion of work within the scheduled time allowed. Considerations should be made for maintenance activities that could be in progress during the same period of time and in the same area.

    During Plant turnover, the Contractor must be aware that commissioning activities could be in progress in the final construction stages in portions of the plant and that his planning during this period will take into consideration this effort to avoid conflicts and restraints.

    IX. Temporary Facilities

    Change houses provided by the Contractor will be located in areas approved by the Owner's Representative so as not to interfere with the progress or safety of the work.

    Field Offices and other temporary buildings furnished by the Contractor or his Subcontractors shall be limited and located in areas approved by the Owner's Representative or designated on plot plans furnished by the Owner.

    A location will be provided for the housing of one clerk at the Construction Gate. It is expected that hiring will take place at this location or other facilities provided off the jobsite by the Contractor.

    Contractors will provide for their own potable water.

    Electrical power is available of the capacity and location as shown on the plot plan. Temporary buildings must have approval by the State Fire Marshal (SFM). SFM approval is required for structures with such intended uses as offices, storage areas, and similar functions, as set forth in La. R S. 40:1574 A and B, included in the "Official Manual of the Office of State Fire Marshal" dated April 1, 1988. For temporary structures which are to be brought into Westlake by a Contractor and which are to remain on-site for periods of less than approximately twelve (12) weeks, the SFM may grant a written waiver (exemption) from formal plan review procedures upon written request from the Contractor.

    When requesting a waiver, the Contractor should submit a letter to the SFM, indicating the size and brief description of the Structure(s), intended use, anticipated number of occupants, identification (name and number), and duration, along with a small Westlake plot plan marked-up to show the location of the building on the complex site. (A copy of this Westlake plot plan is attached as an appendix to this document.) This letter may be faxed (504-925-4414) to the SFM office located at 5150 Florida Blvd., Post Office Box 66614, Baton Rouge, and LA 70806.

    A copy of the written SFM approval or grant of waiver must be submitted to the Westlake Project Engineer prior to placing the building on Westlake's premises

    X. Subcontractor Approval

    A provision is made in the General Terms and Conditions for Contractors to designate their Subcontractors and conditions of their contracts to be approved by the Owner and included in the Agreement.

    All Subcontractors, not included in the Agreement, must be approved by the Owner's Representative, prior to the Contractor awarding the subcontract.

    XI. Pre-Job Conferences

    A pre-job conference by the Owner will be held with the Contractor prior to starting work. Subjects that will be discussed at this time are:

    XII. Contractor's Responsibilities

    The Owner holds the Contractor responsible for the production and quality of work. In order to perform his duties, he has the responsibility in giving orders to his supervisors, and they to their men. The Owner's Representative will cooperate with the Contractor's supervisors in order to expedite the work and will make inspections to see that the work complies with the issued specifications, procedures and drawings.

    By submitting a bid, a contractor implicitly agrees that his employees have the necessary training and job skills to perform the work. Westlake Industries will not allow any person under 18 years old to perform work in the Lake Charles Plant. The contractor, upon request, shall be required to provide proof of employees' skills, training and ability.

    The Contractor is expected to maintain the proposed construction schedule and submit verification to its adherence.

    The Owner's personnel will not interfere or give orders to the workmen unless it is immediately necessary to do so for safety reasons. The Owner expects the Contractor to have a representative on the jobsite when his workmen are present to act in the Contractor's behalf on matters pertaining to his contract. The Contractor's supervisory force should be kept well informed and the Owner holds them directly responsible for the workmen's actions in the field relative to production and quality of work.

    The Contractor's supervisory force should see that their men are on the job ready to work at starting time and also see that they remain on the job until the specified stopping time, whether it is lunch time, scheduled break period, or the end of the day.

    There will be no break periods by the Contractor's employees unless scheduled with permission of the Owner.

    The Owner expects the Contractor and all of his supervisory personnel to be fully acquainted with the required safety rules and regulations and to see that

    they are obeyed. Repeated failure to observe safety rules will be 'just cause for dismissal.

    Contractor employees will have to be certified intoxicant-free before working on Westlake property. A letter identifying, by name, the employee who will be working in the plant and has successfully passed the intoxicant screening must be in Westlake's hands before the employees are permitted to pass the Guard Gate. Attachment “A” Sample Letter.

    Westlake reserves the right to request intoxicant screening of any person employed on Company premises who appears to be under the influence of an intoxicant or one involved in an accident of unusual circumstances.

    The Contractor should keep the Owner's Representative informed, at all times, of the number of men on his payroll including future reductions or increases in his forces.

    The Contractor's Supervisor must contact the Owner's Representative of any questions regarding materials, drawings, field changes, etc., so immediate steps can be taken to obtain information on any problems.

    The Owner will hold the Contractor responsible for good housekeeping at all times. The Contractor's supervision will be expected to make housekeeping inspections with an Owner representative.

    Contractor's employees are at all times to remain in their assigned work area and are prohibited from visiting other areas for whatever purpose. There will be no soliciting, or selling of merchandise, or the distribution of literature for any cause on the Owner's property, unless permission of the Owner is obtained.

    Gambling will not be tolerated at any time on the Owner's property.

    The Contractor's supervisory force must understand that the Owner is responsible for shutting down and lockout of plant equipment and Contractor is responsible for following and participating in the facility Lockout Procedure.

    It is not the intent of the Owner to choose the Contractor's supervision, but the individual supervisors chosen by the Contractor are subject to approval by the Owner.

    Any Contractor's supervisor who cannot or will not perform the above

    functions is to be relieved of his responsibility and another supervisor chosen. All conditions of the Agreement are binding on the Subcontractors including mark-ups for extra or additional work and subcontracting work unless otherwise stipulated in the Agreement.

    XIII. Owner's Representative Management Responsibilities

    Insure that all drawings, specifications, procedures and documents pertaining to the construction contract have been issued to the Contractor and are being followed in the field.

    Insure that the Owner receives good quality workmanship.

    Keep the Contractor's supervisory force fully informed of all materials received in the Owner's warehouse.

    Insure that materials to be furnished by the Owner are made available to the Contractor within the scheduled time.

    See that all safety regulations are enforced and take appropriate action when they are not.

    Issue to the Contractor all safety permits and tag all equipment required by the Safety Regulations on this project.

    Witness and approve all field tests required of the Owner by the contract procedures.

    Inspect, approve and accept all Contractors’ work for the Owner. Discuss with the Contractor's supervisors the workmanship performed by the various individuals on the Contractor’s payroll in order that quality work be performed.

    Act as liaison, between the field and the Engineering responsibility, so that field changes and other necessary information can be obtained in the shortest possible time.

    Write field change orders according to Contract Agreement to expedite the work where conditions warrant and further engineering is not required.

    Approve the Contractor's work schedule and coordinate his efforts with other contractors in the job site.

    Verify the work, in progress completion and approve all progress payments to the Contractor.

    Call to the attention of the Contractor's supervision any deviations from the policies of the owner.

    It is the Owner's intent to have full time representation in the field to seek resolutions to all field problems that arise during the construction stage of the project. The Owner's Representative has the authority to carry out his responsibilities and is instructed in methods to be used when decisions must be made quickly. It is not the intent that any work or job be held up unduly by indecision.

    XIV. Construction Safety Section

    A. General Safety Policy

    A safe construction project is a requirement of the Owner and mandatory for the Contractor. Safety rules represent minimum requirements and are only intended to cover average conditions. Accident prevention depends on the interest of the individual in observing safety rules, keeping his mind clear and going out of his way to do the common sense things which prevent injury to himself and his fellow workers.

    VIOLATION OF OWNERS SAFETY REGULATIONS CAN RESULT IN THE IMMEDIATE EXPULSION OF THE VIOLATOR FROM THE OWNER’S PROPERTY AND TERMINATION OF THE CONTRACTOR’S CONTRACT AT THE DISCRETION OF THE OWNER.

    B. Indoctrination

    All Contractors’ employees, including supervisors, will be given a general site safety orientation and a unit specific safety orientation before going to work in order to acquaint them with job hazards before entering the construction site.

    The Owner’s Representative or Contracted Provider will give indoctrination.

    Contractor will be accountable for his employees and their actions in the event of an emergency.

    Contractors are required to participate in any practice of emergency procedures

    C. First Aid

    The Plant emergency response team is available to the Contractor in case of serious injury to employees.

    The Contractor will furnish transportation of non-life-threatening injuries to a doctor’s office or to the emergency room of a hospital for an injured Contractor’s employee.

    D. Safety, Inspection and Observations

    The Contractor must have a designated safety representative at all times on the construction site when his employees are working. His responsibility is to ensure that safety regulations are being observed and to take proper corrective action when violations are being observed or reported.

    E. Reports of Accidents and Investigations

    All reports of accidents to the Contractor's employees on the jobsite must be reported to the Owner immediately.

    The Owner's Safety Representative will participate with the Contractor's Safety Representative in the investigation of all accidents to the Contractor's employees.

    F. OSHA Inspections

    It is expected of the Contractor to comply with the OSHA regulations pertaining to his contracted construction work. The Contractor is also required to protect any of the Owner's personnel that may be involved in the course of the Contractor performing work.

    If a Contractor is notified of an OSHA inspection of his work place or for reported violations of OSHA regulations, the Owner must be notified immediately.

    An Owner's Representative will participate in the OSHA inspection of the Contractor's work place. It is the responsibility of the Contractor to alert the Owner in time to accomplish this participation.

    G. Construction Safety Regulations

    The Owner's Safety Regulations will be observed when the Contractor is performing in an operating plant and/or portions of this project when working in an area under the care, custody and control of the Owner as accepted from the Contractor.

    Approved non-metallic hard hats will be worn at all times when working on the Owner's property or when in areas with overhead exposure.

    The Owner will not furnish these protective hats to the Contractor's employees.

    Adequate eye protection will be worn while on the Operating Plant property at all times. The minimum requirement for work areas is the wearing of safety glasses with side shields. The Contractor will furnish the safety glasses and the proper type of goggle for the area specified.

    Appropriate escape respirators must be carried at all times in the work area or within easy reach in office areas while on Operating Plant property. The Owner will furnish proper escape respirators required for an area.

    Owner furnished safety equipment is on a loan basis to the Contractor and should be returned with the termination of each of his employees. Usage deemed to be excessive will be back charged to the Contractor. The Owner has lockout procedure that provides for working on operating equipment in a safe manner. This lockout procedure will be furnished to the Contractor and will be strictly followed.

    XV. Insurance

    No Contractor's employees shall enter the plant to commence construction activities unless insurance requirements specified in the General Terms and Conditions have been met.

    Insurance certificates covering the stipulated requirements for the Contractor or his individual subcontractors will be presented to the Owner's Purchasing Dept. at the job site for each Purchase Order issued to the Contractor prior to

    commence of work. The Contractor will also send a copy of the certificate to Corporate Purchasing to the attention of Manager, Construction Services after award of the contract.

    XVI. Pictures Taken on Owner Property

    Cameras are not permitted on the construction site anytime unless approved by the Owner's Representative. Pictures required by the Contractor to provide proof of damage will either be taken by the Owner or under the Owner's direction.

    The Owner or an authorized photographer will take project photographs. Owner's Representative will be responsible for the care and distribution of these photographs.

    No photographs shall be reproduced or used for demonstration or advertising without a written request for such usage to the Project Manager and written approval received.

    XVII. E.E.O. Regulations

    The Contractor and his Subcontractors will meet the Equal Employment Opportunity provisions as stipulated in the General Terms and Conditions.

    XVIII. Environmental Considerations

    The Owner is legally obligated to comply with certain environmental rules and regulations, which have been enacted by various governmental agencies. The prime areas of concern are air, water and soil. The Contractor must recognize that all plant surface drainage and sewers are collected, monitored and consequently exit the plant under strict permit conditions.

    The Contractor is required to immediately report any spill or release the he notices or causes to unit operations or Westlake supervision.

    Also, the (east) boundary of the plant is a navigable waterway and law strictly prohibits accidental or intentional release of any contaminating substance into this waterway.

    A permit is required to burn material resulting from land clearing and for the operation of certain combustion equipment utilizing sulfur-bearing fuels.

    In the performance of his work, the Contractor assumes full responsibility for preventing release of any contaminating substance into the plant air

    space, surface drainage sewers or any adjacent waterways by his subcontractor's employees or their actions. If such a release occurs, the Contractor shall notify the Owner immediately and make every practical effort to stop and contain the release and to properly remove and dispose of the contaminating substance. In the event that the Owner is assessed a fine due to release of a contaminating substance by the Contractor or his Subcontractor employees, said fine will be for the Contractor's account.

    Contractors who bring onto Westlake property, or arrange to have delivered, OIL AND/OR DIESEL, including that contained in various equipment, will be required to comply fully with SPCC (Spill Prevention Control and Containment), 40 CFR

    Contractors must provide adequate preventative measures for spill control and immediate response for spills should they occur.

    Specific Environmental Requirements

    New Chemicals Brought on Site

    Contractors bringing in new chemicals into the Lake Charles facility must:

    Submit a SDS for the new chemical to Purchasing before it is used or

    stored at Westlake

    Maintain a hardcopy of the new chemical MSDS onsite as per

    Hazardous Communication regulations

    Work with Westlake unit operations to update their chemical inventory

    list to include the new chemical, if applicable

    Contact the Westlake Environmental Department before taking any

    waste offsite from new or old chemicals

    A. Waste

    There are three types of Waste generated at Westlake of which

    contractors should be aware so they can recognize and help manage

    them:

    Trash – Uncontaminated office or garbage waste - containers are

    marked as “TRASH” and should be fitted with a flip-top spring-loaded

    lid on the drum

    Industrial Solid Waste – Non-hazardous industrial contaminated waste

    - cannot be disposed in regular TRASH container - Some of the ISW

    wastes include oil-contaminated solids, Silicas waste, etc., with

    containers usually marked as “INDUSTRIAL SOLID WASTE” on a

    green label.

    Hazardous Waste – Defined by regulations that require disposal as

    hazardous – includes empty aerosol cans, debris from the Derivatives

    areas, filters used in the Derivatives process, etc., with containers

    marked as “HAZARDOUS WASTE” with yellow and/or yellow and red

    labels

    Satellite Accumulation Point Drums Satellite Accumulation Point (SAP) drums are the primary way that Westlake

    manages non-bulk quantities of waste generated onsite. The following

    information is important when dealing with these drums:

    All wastes (Hazardous and Industrial Solid Waste) can be stored

    indefinitely until 55 gallons has been accumulated in a specific

    area

    The containers must be labeled as “Hazardous Waste” or Industrial

    Solid Waste” AND the contents must also be marked on the drum. Do

    NOT mix wastes (e.g., regular TRASH in an empty aerosol can drum,

    regular TRASH with Derivatives Hazardous Trash, etc.)

    Once filled, the SAP

    Trash All containers of waste that are not SAP drums or marked as TRASH

    MUST have either an Industrial Solid Waste label or a Hazardous Waste

    label along with an Accumulation Start Date. There are two types of labels

    for use on these containers and they are as follows:

    Temporary labels are used when

    o Permanent tracking labels are not immediately available

    o Weeknights (Backshift)

    o Weekends

    Permanent Tracking labels should be ordered from the Derivatives

    Waste Coordinator

    Drums should not have two labels, so do one of the following

    o Remove the Temporary label before adding the Permanent label or

    o Put the Permanent label over the Temporary label or

    o Paint over the Temporary label after the Permanent label is put

    on the drum.

    B. SPCC Plan for Oil and Petroleum-Based Chemicals

    Westlake has a SPCC Plan to specifically address management of oil and

    petroleum-based chemicals developed to prevent getting to the Waters of

    the State. In addition to the Plan addressing oil containment and

    management of spills of oil and oil-related materials, it also addresses the

    amount, location, and storage of these materials. So, to properly maintain

    the accuracy of the SPCC Plan, the Environmental Department must be

    notified immediately of the following:

    Addition or relocation of oil storage containers > 55 gallons or oil

    storage areas

    Any fuel tanks brought in or sent back to the supplier, particularly if it

    is a rental unit

    Replacement or installation of oil-filled transformers

    Construction or demolition that may alter secondary

    containment structures

    Changes of product or services (e.g., kerosene heater changed to

    natural gas, diesel tank converted to gasoline tank)

    Revision of SOPs or SMPs involving the use, transfer, or storage or oils

    or fuels in quantities > 55 gallons

    Some examples of oils and oil-related materials are:

    o Used oil

    o Transformer oil

    o Gasoline and diesel

    o Kerosene

    o Waste Paint

    Spills The primary purpose of most of the information above having to do with

    proper storage and maintenance of waste and oil-related materials is to

    prevent SPILLS – spills to the water, spills to the ground, and spills to the

    air. If you have a spill or see evidence of a spill, remember the following:

    All spills of chemicals (including oil) must be cleaned up promptly

    (within

    24 hours)

    Notify your Supervisor or Westlake Field Engineer immediately

    upon spill discovery so that notification may be made by Westlake

    within 1 hour, if necessary

    XIX. Potable Water

    Westlake’s Potable Water System must to be kept separate from the other non- potable water systems; unauthorized tie-ins and potentially harmful cross- connections are not permitted.

    A continuous source of potable water is provided via a pipe distribution system originating at each of the facility water wells. This system supplies potable water to each production building and unit of the plant.

    Water delivered through the potable water distribution system will not be classified as "drinking water" due to the natural mineral content of groundwater native to the area.

    All potable water outlets (may include adjacent lines) will be labeled “potable water”. The only type of connection permitted on non-potable water is a Chicago coupling or “crow’s foot” type connection.

    All piping outlets on the Potable Water System shall be equipped with potable water connections, blind flanges or plugs to prevent cross connection with non- potable systems.

    Potable water connections will be 3/4" male hose thread connections with a hose bib vacuum breaker attached. These connections will accept the standard hose connections for potable water hose.

    Only potable water hose (garden hose), will be connected to potable water piping. The male end of a potable water hose may be:

    a. Left open with nothing attached.

    b. Attached to another potable water hose.

    XX. Union Stewards

    Any Contractor with union affiliations is to recognize union stewards and allow them to perform their duties according to the Union Contracts. However, in no case will the stewards working for one Contractor be allowed to visit the job site of other Contractors or to interfere in any way with work being performed by other Contractors. It is expected that a steward would first contact his Contractor regarding any subject he feels should be corrected. After contacting his Contractor, the steward should have the privilege of contacting his Business Manager regarding the subject if no action is taken.

    XXI. Labor Negotiations

    It is the duty of Contractors with union contracts to take an active part in negotiation while they are in progress currently with his contracts and to govern his operations in harmony with local or area employer's bargaining groups.

    XXII. Special Conditions

    It is the policy of the Westlake Lake Charles facility to ensure all contract employees entering the plant have had a recent screen for the use of controlled substances. Our policy further requires that contract employees working in certain areas of the plant be certified medically fit for work through blood, urine, and medical exam as required.     A. Screening for Substance Abuse

    Contract Employees Requiring Drug Screen

    All contract employees performing work (i.e., physical labor or use tools or equipment) or directly supervising "work" are required to submit proof of a negative drug screen. Preferably, the p r o o f should be in the form of a letter on Company letterhead signed by a corporate officer verifying negative drug screen results with date of test, employee name and social security number. The minimum drug screen acceptable is the five-substance panel required for DOT regulated work (i.e., cocaine, marijuana, amphetamines, opiates and phencyclidine) with the cut-off limits specified by the U.S. Dept. of Health and Human Services (DHHR). Westlake does not pay for or schedule drug screens. Drug screens are valid for one year and must be repeated annually.

    Waivers of Drug Screens

    All waivers must be given by Construction Safety Supervisor, Manager of Safety and Health, or Shift Safety and should be contacted in this order. The person giving the waiver will provide written notification to the Security Personnel.

    Work or services for which Westlake has an immediate need may require a waiver of the drug screen. "Immediate" means work or service that will require less than a day to complete and must be done expeditiously to avoid an environmental, safety or production loss. If the screen is waived, a Westlake employee who is knowledgeable in the system being serviced must directly and continuously observe all work done by this contractor.

    C. Contractors’ Supervisors

    Supervisors are responsible for the action of their workers and are required to insure that all federal, state and Owner's safety standards are followed during the duration of work on Westlake properties. In addition, they will:

    • Set an example in matters of safety.

    • Personally observe and correct safety violations or any potential work hazards.

    • Take necessary corrective action against employees who violate safety standards.

    • Acquaint employees with safety standards.

    • Personally assist in accident investigations.

    • Report all accidents, near misses and fires.

    • Correct all hazards or violations observed by Safety Department or Project Engineer in an expeditious manner.

    • Provide employees with material and equipment that are adequate to perform their job safely.

    • Maintain their work sites in an orderly manner by insisting on good housekeeping.

    • Maintain continuous safety planning to cover job where circumstances have changed and new hazards require new controls.

    • Not use or allow to be used any plant system, tools, or equipment without written permission of Safety Department or Project Engineer.

    D. Contractor’s Employees

    Employees will abide by all safety regulations and be advised that repeated safety violations, accidents, or abuse of Westlake properties will be grounds for dismissal. The following requirements must also be met:

    No horseplay.

    No running in plant.

    Proper dress; no sleeveless shirts (tank tops, etc.).

    Signs and barricades honored.

    No unsafe short cuts, such as walking pipelines or cable trays, sliding down pipe stanchion, or jumping from transport vehicle while moving.

    No loitering or wandering through operating units.

    Possession or use of drugs or alcohol will mean immediate termination.

    No sleeping in plant.

    No modifying of personal safety equipment.

    Never jump from platform, scaffolds, or other elevated places.

    Tools, materials or equipment must not be intentionally dropped or thrown from one level to another.

    During transport, hard hats, safety glasses and respirators will be worn unless inside an enclosed cab.

    Attendance to safety meetings is required.

    E. Westlake Construction Coordinators

    Enforcing safety regulations is one of the functions of Westlake Construction Coordinators. Should there be a difference of opinion between a Contractor and a Construction Coordinator regarding safety, the decision of a Westlake Safety Coordinator will prevail. In addition, the Construction Coordinator:

    Controls the issuing and "pulling" of permits.

    Approves "Lockout" procedures prior to beginning of work.

    Assists in accidents, near misses, property damage and fire investigations.

    Will be the first Westlake person Contractors contact for safety variances.

    Will be kept advised of all work activities, scheduled or unscheduled.

    F. Westlake Contractor Safety Coordinator

    The primary responsibility for job and employee safety rests upon the Contractor. The Owner is represented by the Westlake Contractor Safety Coordinator. In matters requiring an interpretation of federal, state, and Owner's safety standards, policies or guidelines, the Safety Coordinator will prevail. In addition to monitoring regulatory compliance with all safety requirements the Safety Coordinator will:

    Inspect as needed, the job site for safety violations and require needed corrections from Contractor Supervisors.

    Stop any job where an immediate danger exists.

    Be involved in any deviation from established safety standards or guidelines.

    Request a review, by Construction Coordinating Management, of repeated safety violations or accidents incurred by Construction Supervision or employees.

    Provide information or advice as required by supervision.

    XXIII. GENERAL INFORMATION

    A. Westlake Reportable Incidents

    A Westlake Reportable Incident is defined as an event or sequence of events resulting in harm to people, the environment, process, and product or company image. Employee Health & Safety (EHS) incidents include: work-related occupational injuries/illnesses, environmental spills/releases, environmental compliance and legal action events, fires, explosions, property damage, and process safety events.

    The Westlake Contractor Safety Coordinator along with the Construction Engineer will be notified immediately in the event of any death occurring within the facility. The Westlake Contractor Safety Coordinator will contact the Westlake Safety and Health Manager with pertinent information as it becomes available. The Contractor Safety Coordinator will also be notified immediately of any occupational disease, disabling injury or potentially significant injury to a Contractor's employee (whether or not it is determined that a "disabling injury" will be involved) while at work on Owner's site.

    Westlake Reportable Incidents will be extensively investigated by the Contractor Safety Coordinator in cooperation with the Construction Coordinator and the Contractor. A Root Cause Analysis is required if any of these events occur. It is expected that Westlake personnel be intimately involved in the investigation and RCA process including corrective actions. A preliminary written report must be submitted to the Westlake Contractor Safety Coordinator by the contractor by the close of business the day following the incident.

    For all Non-Reportable injuries and incidents, the Westlake Safety Specialist covering that area shall be notified immediately and a written report must be submitted by the Contractor's supervisor no later than close of business of the day following the injury.

    It is expected that all employees must report injuries to their immediate supervisor even though it may not be considered significant. It is important to capture and address minor injuries before they escalate.

    It is expected that all "near misses" involving employees or equipment must be reported and a report filed. The principal Contractor’s Supervisor and the Construction Coordinator will conduct investigation. Near misses bearing the potential of employee injury or Owner property damage will involve the Contractor Safety Supervisor.

    All fires must be reported to the Construction Coordinator and Shift safety Duty person regardless of duration or extent. The Contractor Safety Coordinator in conjunction with the principal Contractor will investigate each occurrence and a written report will be submitted to Westlake.

    B. Drugs, Alcohol, Tobacco, Firearms, and Cell Phones

    The possession or use of drugs or alcohol will not be tolerated anywhere on Owner's property, including parking lots.

    Firearms will not be brought onto Owner's properties, including parking lots.

    Smoking is permitted in designated areas only. Smoking activity can only take place within 10 feet of a designated area sign. If a designated sign with a directional arrow is present, smoking activity can only take place to the right or left of the sign, and no more than 10 feet away from this specified boundary. Lighters will only be permitted for use within designated smoking areas and are to be carried only when traveling to or from a designated smoking area. When not in use, lighters should be stored inside buildings or lockers. In the case of a unit siren or plant evacuation, all smoking in the affected areas must cease. This smoking policy also strictly applies to electronic cigarettes and vaporizer devices.

    Tobacco chewing is allowed inside and outside of buildings and control rooms. Spitting is allowed into containers only. Spitting is NOT allowed directly into garbage cans or onto pedestrian traffic areas.

    Cell phones may not be used while driving a vehicle or other piece of equipment. The vehicle or equipment operator must pull off of the road and stop the vehicle prior to answering a call or placing a call.

    Violators are subject to immediate termination.

    C. Employee's Break Areas

    Areas will be assigned by the Construction Coordinator.

    No sleeping is allowed.

    Employees must remain in assigned area and not wander about operating units.

    D. Safety Meetings

    Contractor's supervisors will hold a documented weekly “gang box" safety meeting.

    The topic will be listed and each employee shall sign his or her name and badge number.

    A completed copy will be kept on file by the contractor and made available upon request.

    E. Security

    The Owner bears no responsibility for tools, equipment, vehicles or personal items brought onto Owner's property.

    All construction employees and vehicles entering or leaving Owner's property are subject to search without notification.

    Tools and equipment should be marked with Contractors identification.

    Tools and equipment, including leased items, entering or leaving plant require a gate pass from Owner's Materials Manager.

    Contractors are responsible for securing their tools and equipment on job site.

    All losses of tools, equipment or break-ins must be reported immediately to the Construction Coordinator.

    Lay-down areas will be assigned by Construction Coordinator.

    Cameras are not allowed in plant unless written permission is given from the Plant Construction Engineer.

    All Contractor vehicles must have some type of identification (painted sign, logo, magnetic sign, etc.) attached to both sides before entering Owner's plant and be visible from a distance of 40’. The magnetic hat will be an acceptable substitute for short term visits.

    F. Temporary Construction Trailers

    Location and set-up will be controlled by the Construction Coordinator.

    No flammable or combustible liquids shall be stored in or around trailers.

    Areas around trailers shall be kept clean and in an orderly manner.

    Trailers should be locked when unoccupied.

    G. Vehicle and Traffic Regulations

    Automobiles and trucks permitted to enter plant will be limited. Permission will be controlled by Construction Coordinator.

    All contractor vehicles must have some type of identification (painted sign, logo, magnetic sign) attached to both sides of the vehicle

    before entering the owners plant. Signage must be legible from a minimum 40 feet away.

    Transport vehicles can be equipped with acceptable benches as long as there are completed sides and a roof covering the cargo bed.

    No employee shall ride on the sides, running board or tailgate of transport vehicle. See Traffic Guideline Procedure

    No employee shall ride atop equipment or materials being transported.

    Vehicle routes to and from work site will be assigned by Construction Coordinator.

    Vehicles or equipment shall not be left running while unattended.

    Speeding or other reckless acts will not be tolerated.

    A flagman is required at all intersections for ribbed cranes traveling with boom down.

    When moving a telescoping bo
