NEW ADJUNCT FACULTY – SPRING 2016 MATTHEW R. BOGOSIAN (Divorce and Family Mediation): Matthew Bogosian is certified as a Family Law Specialist by the State Bar of California, Board of Legal Specialization and has over 20 years of experience in family law litigation and mediation. Mr. Bogosian received his Bachelor of Arts in Linguistics from the University of California at Los Angeles, graduating Magna Cum Laude and earning Departmental Honors in Linguistics. He earned a Juris Doctor and Certificate in Dispute Resolution from Pepperdine University School of Law in Malibu, California, where he received the American Jurisprudence Award in Negotiation and Settlement Advocacy and completed elective courses in Family Law, Advanced Family Law, Community Property, and Divorce Mediation. Mr. Bogosian served as a Judicial Assistant to Family Law Commissioner Bobbi Tillmon of the Los Angeles Superior Court in Santa Monica, California and as a research assistant to celebrity divorce attorney Robert S. Kaufman before joining the Los Angeles office of Morrison & Foerster, LLP where he handled family law matters under the supervision of Certified Family Law Specialist Patricia Phillips. Following his tenure at Morrison & Foster, LLP, Mr. Bogosian practiced family law at Nordman, Cormany, Hair & Compton in Ventura County. Since 2005, Mr. Bogosian has served as a family law mediator, consultant, expert witness, lecturer and litigator with offices in Calabasas and Beverly Hills, California. JOSEPH KIM (Entertainment Law Seminar: Special Problems in the Television Industry): Joseph Kim received B.A. and J.D. degrees from Yale. A member of the New York and California Bars, Joseph practiced business law in New York City before moving to Los Angeles to focus on entertainment law. He is currently Executive Vice President of Paulist Productions, a film and television production company in Pacific Palisades. At Paulist Joseph has been responsible for legal and business affairs for over 13 years. He structures, negotiates and documents deals for television movies, series and documentaries, and analyzes copyright, trademark and guild issues on a daily basis. Prior to joining Paulist Productions Joseph practiced music law extensively. He was in-house counsel at A&M Records and in Disney’s music department and also represented singers, producers and record labels in private practice. As an adjunct professor, Joseph taught music law to law students at Pepperdine and entertainment law to undergraduates at U.C. Irvine. His article “Copyright: Jazz’s Friend or Foe?” was recently published online by the American Bar Association. Also a musician, Joseph has studied classical piano and singing with faculty at the Eastman School of Music and Yale, and jazz piano and composition privately with Taylor Eigsti. Joseph served as music director at a Catholic parish in West Los Angeles, where he cantored at worship services and taught music to children in kindergarten through eighth grade. He fondly remembers the days when he sang with kids in the morning, negotiated deals with lawyers during the day and engaged in intellectual exchange with law students in the evening. Joseph is delighted to return to Pepperdine to teach television law. SHANE L. MICHAEL (Trial Preparation and Settlement, Criminal): Professor Michael is a Deputy District Attorney for the County of Los Angeles, where he has worked as a trial attorney since June 2012 prosecuting felonies and misdemeanors. Prior to his time as a prosecutor, Professor Michael served as Pepperdine’s Nootbaar Fellow in Uganda, working in partnership with the Ugandan Judiciary to help develop and implement the J-FASTER plea bargaining program. He also worked as a mediator in the Commercial Division of Uganda’s High Court, facilitating alternative dispute resolution practices. While at Pepperdine, Professor Michael earned the Straus Institute for Dispute Resolution Certificate and was a member of Professor Caldwell’s Honors Trial Advocacy Team for three semesters, winning the National Civil Trial Competition in 2010. He spent the summer following his 1L year as a judicial extern in Uganda. Prior to law school, Professor Michael taught English for seven years at Loyola High School, Los Angeles. He was born and raised in Seattle, Washington. JAN FRANKEL SCHAU (Mediation Theory and Practice): is a practicing neutral with ADR Services, Inc. Ms. Schau had over twenty years of experience as a litigator before transitioning into ADR. Since 2003, Jan has successfully mediated over 1,000 litigated cases. She is widely considered one of L.A.’s preeminent mediators. A former President of the Southern California Mediation Association, Jan is also a Distinguished Fellow of the International Academy of Mediators and an appointed member of the United States District Court’s Attorney Settlement Officer panel. Jan is the author of numerous scholarly articles and the book, “View from the Middle of the Road: A Mediator’s Perspective to Life, Conflict and Human Interaction”. She served as adjunct faculty for the Tseng College of Extended Learning, “Conflict Resolution Practicum and Training” and has been a frequent and popular guest lecturer at Straus Institute. Ms. Schau holds an undergraduate degree in International Relations from Pomona College in Claremont, Ca. and a J.D. from Loyola Law School of Los Angeles. She brings over a decade of practical experience and wisdom from the real world of civil mediation and ADR, recounted in a weekly blog and is a well-respected “thought leader” on topics arising within the profession.

MICHAEL C. SIBONI, (Mediation Theory and Practice): has been a trial lawyer since 1981. He is a founding Member of Siboni & Buchanan, PLLC, a litigation firm located in Ocala, Florida. He has focused his practice on complex litigation in the areas of aviation, product liability, personal injury, wrongful death, commercial transactions, insurance and equine law, in both State and Federal Courts. He has lectured and authored materials in the areas of product liability, litigation and equine law. Mr. Siboni is a member of the Florida Bar and is Board Certified in Aviation Law by the Florida Bar Board of Legal Specialization and Education. He is licensed to practice before the United States Supreme Court, United States Court of Appeals, Fifth and Eleventh Circuits, and the United States District Court – Southern, Middle and Northern Districts of Florida. In the field of Alternative Dispute Resolution, Mr. Siboni is certified by the Florida Supreme Court as a Circuit Civil and Appellate Mediator. Additionally, he is a Federal Court Mediator and Florida Supreme Court qualified as an Arbitrator. His significant experience litigating complex civil matters has instilled confidence in his mediation clients, and as such, he maintains an active Mediation practice in the following areas: Product Liability, Personal Injury, Wrongful Death, Medical Malpractice, Professional Malpractice, Business Torts, Aviation, Subrogation, Property Damage, Employment, Admiralty, Commercial Disputes, Healthcare Litigation, Federal Tort Claims, Contract Disputes, Insurance, Premises Liability, Environmental and Equine. THE HONORABLE JUDGE RYAN WRIGHT (Sentencing and Corrections): Ryan Wright is a Superior Court Judge in Ventura County. He was elected by Ventura County voters on June 8, 2010 and was sworn into office on January 3, 2011. Judge Wright was born and raised in the City of Ventura. He attended Saint Bonaventure High School, University of California, Irvine and the Pepperdine School of Law. Upon his law school graduation in 1997, Judge Wright was offered a full time position as a Deputy District Attorney in the Ventura County District Attorney’s Office. He was promoted to Senior Deputy District Attorney in 2007. During his years as a prosecutor, Judge Wright served in the misdemeanor, felony, sexual assault, domestic violence and major narcotics units. Judge Wright tried over 100 cases to verdict as a Prosecutor. Additionally, he has presided over 100 jury trials as a Judge, including several murder cases.

NEW COURSES BEING OFFERED-SPRING 2016 CURRENT ISSUES IN RACE, ETHNICITY, INCLUSION, AND THE LAW (2 units) In response to the increasing tensions on university campuses nationwide, this course entitled “Current Issues in Race, Ethnicity, Inclusion and the Law” aims to examine how and why race, racism, racial preferences and racial biases inform and shape our legal structures and impact the legal decision-making process, and to provide a classroom workshop for enhancing inclusiveness through teaching projects. The first week will focus on a preliminary exploration of different views of what race means and what constitutes racism. Then, each week the course will examine the historical and legal background of each of these major racial groups in the United States: African Americans, Native Americans, Latino Americans, Asian Americans and White Americans. With this historical and legal background, the second half of the semester will focus on current issues involving race and ethnicity in the news, and ways to enhance inclusiveness in the law school, the university, and in the larger community. Groups of students will research, prepare and conduct events, including panel discussions, lectures or other means of opening dialogue about race and ethnicity on campus and in the larger community. Each student group will lead one event, and assist in one event led by another group. Groups will rehearse their events in class, with feedback provided by the other class participants. DOING JUSTICE WITHOUT DOING HARM (1 unit) Our religious and moral traditions call on us to serve those in need and to “do justice” (Micah 6:8); they also call on us to “do no harm” (Hippocrates). Individuals, groups, and laws often cause harm as they attempt to do good. Attempts to help can generate dependence or harm bystanders. The work of governments and NGOs can undercut local institutions that might address local problems. Laws can have unintended consequences that do greater harm than good. We need to make a difference, but to do so wisely. Conference speakers include Gary Haugen (International Justice Mission); Brian Fikkert, (co-author of “When Helping Hurts”); Rabbi Elliot Dorff, (American Jewish University); and Nicholas Wolterstorff (Yale University). ENTREPRENEURSHIP LAW PRACTICUM (2 units) This course will examine the legal issues associated with starting and operating a new business, such as the choice of entity; management, governance and succession issues in a closely held business; venture capital and debt financing arrangements; protecting a new company’s intellectual property; employment and executive compensation issues; operating contracts; and ethical issues facing attorneys who represent entrepreneurs. The course is taught by local practicing attorneys and entrepreneurs and will focus on real and/or hypothetical case studies. Students will work in groups to conduct research, prepare client correspondence, and draft legal documents related to the case studies. In this Pass/Fail course students will be evaluated based on their written work and class participation. There is no final examination. LOW INCOME TAXPAYER CLINIC (3 units) The Low Income Taxpayer Clinic provides direct legal representation to low income taxpayers at the Pepperdine Legal Aid Clinic in downtown Los Angeles. Under attorney supervision, LITC students represent taxpayers in disputes with the Internal Revenue Service, including audits, appeals, collection matters, and federal tax litigation. In addition, the clinic provides taxpayer education programs to various social services organizations and community groups. RESTORATION AND JUSTICE CLINIC (3 units) The Restoration and Justice Clinic provides diverse, civil legal services for victims of domestic violence, sexual assault, prostitution and human trafficking. Under faculty supervision, students provide civil legal services to promote clients’ empowerment and liberty as they emerge from abuse, violence and exploitation, and may include matters of civil protection orders, family law, civil rights, consumer protection, taxation, housing, immigration, asylum, benefits and human rights. The practice will intersect with criminal law and procedure as clients participate in criminal prosecutions against their abusers. Students will engage in legal research and writing, civil litigation, advice and counsel, multidisciplinary collaboration, negotiation, case evaluation and multiple forms of advocacy. With intensive classroom instruction and guidance, students will learn and apply substantive law, interview clients and evaluate matters, draft and file legally operative documents, research and

analyze law and policy, advise and counsel clients, make oral and written presentations to clients, communities and collaborators, and represent clients in court. TAX POLICY (3 units) This course offers an opportunity for students to read and react to articles in progress on cutting-edge topics in tax policy. There will be seven presentations during the semester by tax professors from other law schools. In advance of each presentation, students will read the work-in-progress (along with assigned background reading) and prepare short (3-5 page) reaction papers. At each presentation, students will pose questions to the professor presenting the work-in-progress. After each presentation, students will critique the presentation and work-in-progress. Other Pepperdine faculty and local practitioners may attend the presentations.

REVISED COURSE TITLES AND DESCRIPTIONS – SPRING 2015 DOMESTIC VIOLENCE LAW SEMINAR (Revised Course Description for Spring 2015) This seminar introduces students to Domestic Violence law and policies, and provides students with an opportunity to conduct in-depth research into cutting edge topics in Domestic Violence Law. This course is designed to critically examine and expound upon the psychological dynamics underlying domestic violence, the construction of victim’s rights and remedies within civil and criminal laws, and the policies and practices that implement these laws. First, each student will select, present, and lead a critical discussion on a scholarly article on a domestic violence topic. Second, each student will choose a topic of interest and write a research paper that satisfies the rigorous Upper Division Writing Requirement. Each student will make a presentation to the group explaining the results of her or his research during the second half of the semester. RACE AND ANTI-DISCRIMINATION LAW (Previously called Race and the Law Seminar) This course will study how different legal systems conceptualize equality, and the cultural, social, and historical forces that impact discrimination and shape anti-discrimination laws and practices. It provides an overview of federal and state constitutional and statutory antidiscrimination law, in comparison with and in contrast to international laws, covenants, treaties and conventions. Contexts such as employment, affirmative action, marriage and reproductive rights, hate speech, free exercise and establishment of religion will be addressed. The course will focus on discrimination based on race, ethnicity, gender, sexual orientation, and religion, with some attention to other characteristics.

Clinical and Externship Courses Notes-Spring 2016 Clinics: Students receive credit for the scheduled, required class sessions and for work in the clinic under faculty supervision. In the Legal Aid, Special Education, and Ninth Circuit Appellate Advocacy clinics students and professors will determine the work schedule for students in the clinics. The Community Justice Clinic, the Special Education Advocacy Clinic, and the Restoration and Justice Clinic meet and work primarily on-campus in the clinical suite. In the Ninth Circuit Appellate Advocacy Clinic, students must apply and register only with approval of the professor, and students must commit to working two terms in the clinic. In the Legal Aid Clinic, students will work primarily at the Union Rescue Mission in downtown Los Angeles. In the Ninth Circuit Appellate Advocacy Clinic, students will work primarily with the professor at his firm in Encino. All classes will be at the School of Law. The Fair Employment and Housing Mediation Clinic will be housed in the Mediation Division at California’s civil rights enforcement agency, The Department of Fair Employment and Housing. There may be potential employment opportunities with this placement. The Department hires a Civil Rights Fellow for a year fellowship after law school and approximately 50% of Fellows are retained for permanent employment in the litigation department. This class requires a special application. Anyone interested in participating should speak with Professor Stephanie Blondell in the Straus Office. In the Mediation Clinic students have the opportunity to mediate actual disputes. The Mediation Clinic will require 2 hours of class time weekly (scheduled) and approximately 8 hours of fieldwork per week. Students are advised to leave two time blocks (2 mornings, 2 afternoons or 1 of each) in their schedule to accommodate mediations at various courthouses throughout Los Angeles County. All clinical courses fulfill the Pro Bono Service Requirement and are graded as High Pass/Pass/Credit/Fail. Externships: Students interested in participating in an externship in the Spring 2016 term should contact Professor Adamson, Director of Externships, at [email protected] through the end of the Fall 2015 term or Donna Brabec, Clinical Program Manager, at [email protected]. After January 1, 2016 students should contact Professor Richard Peterson at [email protected]. Students may not register themselves for externship courses but must complete the requisite paperwork and must receive approval from Prof. Adamson or Prof. Peterson to register for an externship. Students must register for an externship by the deadline for add/drop; students who secure a field placement after the add/drop deadline will be limited may only enroll for up to 2 units of credit and must secure a faculty advisor. Each unit of externship credit requires 52.5 hours of work at the student’s field placement, and students must register in advance for the number of units for which they will work. Students may earn up to 10 units. Students must also attend mandatory, bi-weekly externship workshops during the term of their first externship, and the time spent in workshops may count toward the students’ required time in the field. Students who are taking externships for the second or third term are not required to attend the workshops.

Externships (continued): The Director of Externships must approve all field placements in advance of registration. In general, field placements qualify for externship credit if the student is engaged in legal work, under the supervision of a licensed attorney, not for pay, in judicial, governmental, public interest or public service law offices. Field placements in in-house counsel offices in entertainment and other corporate offices may also qualify. Work in private, for-profit law firms does not qualify unless the student’s work is exclusively on pro bono matters. Externships taken for 3 units or more fulfill the upper division skills requirement or count towards the experiential learning requirement. All externships are graded as High Pass/Pass/Credit/Fail. Practicums: For the Federal Criminal Practice Practicum, when announced, students must submit a letter of interest, resume and writing sample for lawyers at each field placement to rank their preferred candidates. The top two students ranked by consensus will be selected to enroll in the course. Upon selection, students must complete a timely background check. Students must meet the minimum requirements outlined in the course description including the pre-requisites classes, Criminal Procedure and Evidence For the Veterans Law Practicums in Ventura County and in Los Angeles County, students must meet the minimum requirements outlined in the course description. Students must also submit a resume, letter of interest and writing sample for lawyers at the field placement to review and rank their preferred candidates. Students will be selected and notified of their selection in the practicum. The Veterans Law Practicums and the Federal Public Defender segment of the Federal Criminal Practice Practicum satisfy the pro bono requirement. Washington, DC Externships: Students completing an externship as part pf the Washington, DC externship semester must enroll in 9 or 10 units of externship.
