قَاَل يَْحيَى أَْخبََرنَا َوقَاَل اآلَخَراِن، َحدَّثَنَا اْبُن -َواللَّْفظُ ِليَْحيَى -َحدَّثَنَا يَْحيَى ْبُن يَْحيَى، َوأَبُو بَْكِر ْبُن أَبِي َشْيبَةَ َوإِْسَحاُق ْبُن إِْبَراِهيَم

َعْمرِ ْبِن، ُحَسْيٍن َعْن ِ ِ، َعْن َعِلي ْهِري َزْيٍد، أَنَّ النَّبِيَّ صلى هللا عليه وسلم قَاَل عُيَْينَةَ، َعِن الزُّ ْبِن ْبِن عُثَْماَن، َعْن أَُساَمةَ الَ " و

. "يَِرُث اْلُمْسِلُم اْلَكافَِر َوالَ يَِرُث اْلَكافُِر اْلُمْسِلَم

Usama bin Zaid (تعالی عنہ وسلم) reported Allah's Apostle (رضئ هللا آله و عليه as saying, a (صلى هللا

Muslim is not entitled to inherit from a non-Muslim, and a non-Muslim is not entitled to inherit

from a Muslim.

CHAPTER (1)

باب أَْلِحقُوا اْلفََرائَِض بِأَْهِلَها فََما بَِقَي فَألَْولَى َرُجٍل

ذََكٍر

Give the shares of inheritance to those who are entitled to them and whatever is left goes to the

closest male relatives



اٍد، ِ صلى -َوهَُو النَّْرِسيُّ -َحدَّثَنَا َعْبدُ األَْعلَى ْبُن َحمَّ َحدَّثَنَا ُوهَْيٌب، َعِن اْبِن َطاُوٍس، َعْن أَبِيِه، َعِن اْبِن َعبَّاٍس، قَاَل قَاَل َرُسوُل َّللاَّ

. "َرُجٍل ذََكٍر لَى َي فَُهَو ألَوْ أَْلِحقُوا اْلفََرائَِض بِأَْهِلَها فََما بَقِ " هللا عليه وسلم

Ibn Abbas (تعالی عنہ آله وسلم) reported Allah's Apostle (رضئ هللا as saying, give the (صلى هللا عليه و

shares to those who are entitled to them, and what remains, goes to the nearest male heir.


ْبُن اْلقَاِسِم، َعْن عَ َرْوُح ُزَرْيعٍ، َحدَّثَنَا ْبُن يَِزيدُ ، َحدَّثَنَا بِْسَطاَم اْلعَْيِشيُّ ْبُن أَبِيِه، َعِن اْبِن َعبَّاٍس، َحدَّثَنَا أَُميَّةُ ْبِن َطاُوٍس، َعْن ِ ْبِد َّللاَّ

ِ صلى هللا عليه وسلم قَاَل . "ِحقُوا اْلفََرائَِض بِأَْهِلَها فََما تََرَكِت اْلفََرائُِض فَألَْولَى َرُجٍل ذََكٍر أَلْ " َعْن َرُسوِل َّللاَّ

Ibn Abbas (تعالی عنہ آله وسلم) reported Allah's Apostle (رضئ هللا as saying, give the (صلى هللا عليه و

shares to those who are entitled to them, and what is left from those who are entitled to it, goes

to the nearest male heir.


ْبُن ُحَمْيٍد، ْبُن َرافِعٍ، َوَعْبدُ دُ ْفظُ اِلْبِن َرافِعٍ -َحدَّثَنَا إِْسَحاُق ْبُن إِْبَراِهيَم، َوُمَحمَّقَاَل إِْسَحاُق َحدَّثَنَا َوقَاَل اآلَخَراِن، أَْخبََرنَا َعْبدُ -َواللَّ

اِق، أَْخبََرنَا َمْعَمٌر، َعِن اْبِن َطاُوٍس، َعْن أَبِيِه، زَّ ِ صلى هللا عليه وسلم الرَّ اْقِسُموا اْلَماَل بَْيَن " َعِن اْبِن َعبَّاٍس، قَاَل قَاَل َرُسوُل َّللاَّ

ِ فََما تََرَكِت اْلفََرائُِض فَألَْولَى َرُجٍل ذََكٍر . "أَْهِل اْلفََرائِِض َعلَى ِكتَاِب َّللاَّ

Tawus narrated from Ibn Abbas (رضئ هللا تعالی عنہ) that the Apostle of Allah (صلى هللا عليه و آله وسلم)

said, ‘distribute the property among Ahl al-Fara'id, according to the Book of Allah, and what is

left out of them goes to the nearest male heir.


َعِن ابْ َوَحدَّثَنِيِه ْبِن أَيُّوَب َعْن يَْحيَى، ْبُن ُحبَاٍب، َزْيدُ ، َحدَّثَنَا ْبُن اْلعَالَِء أَبُو كَُرْيٍب اْلَهْمدَانِيُّ دُ بَِهذَا اإِلْسنَاِد ُمَحمَّ نَْحَو .ِن َطاُوٍس،

.َحِديِث ُوهَْيٍب َوَرْوحِ ْبِن اْلقَاِسِم

There is another chain of narrators for this Hadith through Tawus through Wuhaib and Rowh bin

Qasim.


CHAPTER (2)

باب ِميَراِث اْلَكالَلَِة

ِد ْبِن، اْلُمنْ ِد ْبِن بَُكْيٍر النَّاقِدُ، َحدَّثَنَا ُسْفيَاُن ْبُن عُيَْينَةَ، َعْن ُمَحمَّ ِ، قَاَل َمِرْضُت فَأَتَانِي َحدَّثَنَا َعْمُرو ْبُن ُمَحمَّ َكِدِر َسِمَع َجابَِر ْبَن َعْبِد َّللاَّ

ِ صلى هللا عليه وسلم َوأَبُو بَْكٍر يَعُودَانِي ِ َرُسوُل َّللاَّ أَ ثُمَّ َصبَّ َعلَىَّ ِمْن َوُضوئِِه فَأَفَْقُت قُْلُت يَا َرُسوَل َّللاَّ َماِشيَْيِن فَأُْغِمَي َعلَىَّ فَتََوضَّ

ُ يُْفتِيكُْم فِي }َكْيَف أَْقِضي فِي َماِلي فَلَْم يَُردَّ َعلَىَّ َشْيئًا َحتَّى نََزلَْت آيَةُ اْلِميَراِث {اْلَكالَلَةِ يَْستَْفتُونََك قُِل َّللاَّ

Jabir bin Abdullah (رضئ هللا تعالی عنہ) reported, ‘I fell sick and there came to me on foot Allah's

Apostle (صلى هللا عليه و آله وسلم) and Abu Bakr (رضئ هللا تعالی عنہ) for inquiring about my health. I

fainted. The Prophet (آله وسلم performed ablution and then sprinkled over me the (صلى هللا عليه و

water of his ablution. I felt some relief and said, Allah's Apostle (وسلم آله و عليه هللا how ,(صلى

should I decide about my property? He said nothing to me in response until this verse pertaining

to the law of inheritance was revealed - يُْفتِيكُْم فِي اْلَكاَللَِة ۚ إِِن اْمُرٌؤ هَلََك لَْيَس لَهُ َولَدٌ َولَهُ أُْخٌت فَلََها ُ يَْستَْفتُونََك قُِل َّللاَّ

ا تََرَك ۚ َوإِْن َكانُوا إِْخَوةً ِرَجااًل َونَِساًء فَِللذََّكِر ِمثُْل نِْصُف َما تََرَك ۚ َوهَُو يَِرثَُها إِْن لَْم يَكُْن لََها َولَدٌ ۚ فَإِْن كَ انَتَا اثْنَتَْيِن فَلَُهَما الثُّلُثَاِن ِممَّ

ُ بِكُل ِ َشْيٍء َعِليمٌ ُ لَكُْم أَْن تَِضلُّوا ۗ َوَّللاَّ about Kalalah (a man (ملسو هيلع هللا ىلص They ask you (O' Prophet] َحظ ِ اأْلُْنثَيَْيِن ۗ يُبَي ُِن َّللاَّ

who dies childless). Say, Allah has given a decision in the matter of inheritance. If a man dies

and leaves no child behind but have a sister, she will get half of what he owned, as he would

have done the whole of what she possessed if she had died childless. In case he has two sisters

then they will get two-thirds of the heritage. But if he has both brothers and sisters, the male will

inherit a share equal to that of two females. Allah makes this manifest to you, lest you wander

astray, for Allah has knowledge of all the things.] (An-Nisa - 176).


ٍد، َحدَّثَنَا اْبُن ُجَرْيجٍ، اُج ْبُن ُمَحمَّ دُ ْبُن َحاتِِم ْبِن َمْيُموٍن، َحدَّثَنَا َحجَّ ِ، قَاَل َحدَّثَنِي ُمَحمَّ قَاَل أَْخبََرنِي اْبُن اْلُمْنَكِدِر، َعْن َجابِِر ْبِن َعْبِد َّللاَّ

بَِماءٍ فَدََعا أَْعِقُل فََوَجدَنِي الَ يَْمِشيَاِن َسلََمةَ بَنِي فِي بَْكٍر َوأَبُو النَّبِيُّ صلى هللا عليه وسلم فَأَفَْقُت َعادَنِي ِمْنهُ َعلَىَّ َرشَّ ثُمَّ أَ فَتََوضَّ

ِ فَنََزلَْت فَ ُ فِي أَْوالَِدكُْم ِللذََّكِر ِمثُْل َحظ ِ األُْنثَيَْينِ }قُْلُت َكْيَف أَْصنَُع فِي َماِلي يَا َرُسوَل َّللاَّ {يُوِصيكُُم َّللاَّ

Jabir bin Abdullah (عنہ تعالی هللا وسلم) reported Allah's Apostle (رضئ آله و عليه هللا and Abu (صلى

Bakr ( عنہرض تعالی هللا ئ ) visited me on foot in Banu Salama and found me unconscious. The

Prophet (صلى هللا عليه و آله وسلم) called for water and performed ablution and sprinkled out of it (the

water) over me. I felt relieved. I said, Allah's Apostle ( علي وسلمصلى هللا آله و ه ), what should I do

with my property? And this verse was revealed - ِاألُْنثَيَْين َحظ ِ ِمثُْل ِللذََّكِر أَْوالَِدكُْم فِي ُ َّللاَّ Allah] يُوِصيكُُم

commands you concerning your children: for the male, what is equal to the share of two

females]. (An-Nisa – 11)



ْحَمِن، الرَّ ، َحدَّثَنَا َعْبدُ ْبُن عَُمَر اْلقََواِريِريُّ ِ ٍ -َحدَّثَنَا عُبَْيدُ َّللاَّ اْلُمْنَكِدِر، قَ -يَْعنِي اْبَن َمْهِدي ْبَن دَ ُسْفيَاُن، قَاَل َسِمْعُت ُمَحمَّ اَل َحدَّثَنَا

ِ صلى هللا عليه وسلم َوأَنَا َمِريٌض َوَمعَهُ أَبُو بَكْ ِ، يَقُوُل َعادَنِي َرُسوُل َّللاَّ ٍر َماِشيَْيِن فََوَجدَنِي قَدْ أُْغِمَي َعلَىَّ َسِمْعُت َجابَِر ْبَن َعْبِد َّللاَّ

ِ صلى هللا عليه وسلم ثُمَّ َصبَّ َعلَىَّ ِمْن َوُضوئِ أَ َرُسوُل َّللاَّ ِ فَتََوضَّ ِ صلى هللا عليه وسلم فَقُْلُت يَا َرُسوَل َّللاَّ ِه فَأَفَقُْت فَإِذَا َرُسوُل َّللاَّ

.َكْيَف أَْصنَُع فِي َماِلي فَلَْم يَُردَّ َعلَىَّ َشْيئًا َحتَّى نََزلَْت آيَةُ اْلِميَراِث

Jabir bin Abdullah (رضئ هللا تعالی عنہ) reported ‘while I had been ill Allah's Apostle ( صلى هللا عليه و

was with him, and they both came walking on (رضئ هللا تعالی عنہ) visited me and Abu Bakr (آله وسلم

foot. The Prophet (صلى هللا عليه و آله وسلم) found me unconscious. Allah’s Apostle ( صلى هللا عليه و آله

performed ablution and then sprinkled over me the water of his ablution. I felt relieved (وسلم

regained my consciousness) and found Allah's Apostle (صلى هللا عليه و آله وسلم) there. I said, Allah's

Apostle (صلى هللا عليه و آله وسلم), what should I do with my property? He gave me no reply until the

verse relating to the law of inheritance was revealed.


دُ ْبُن دُ ْبُن َحاتٍِم، َحدَّثَنَا بَْهٌز، َحدَّثَنَا ُشْعبَةُ، أَْخبََرنِي ُمَحمَّ ِ، يَقُوُل دََخَل َعلَىَّ َرُسوُل َحدَّثَنِي ُمَحمَّ اْلُمْنَكِدِر، قَاَل َسِمْعُت َجابَِر ْبَن َعْبِد َّللاَّ

أَ فََصبُّوا َعلَىَّ ِمْن َوُضوئِِه فَعَقَْلُت فَقُْلُت يَا ِ صلى هللا عليه وسلم َوأَنَا َمِريٌض الَ أَْعِقُل فَتََوضَّ ِ إِنََّما يَِرثُنِي َكالَلَ َّللاَّ فَنََزلَْت .ةٌ َرُسوَل َّللاَّ

ِد ْبِن اْلُمْنَكِدِر .آيَةُ اْلِميَراِث ُ يُْفتِيكُْم فِي اْلَكالَلَةِ }فَقُْلُت ِلُمَحمَّ قَاَل هََكذَا أُْنِزلَتْ {يَْستَْفتُونََك قُِل َّللاَّ .

Jabir bin Abdullah (رضئ هللا تعالی عنہ) reported ‘while I had been ill, Allah's Apostle ( صلى هللا عليه و

وسلم وسلم) came to me and found me unconscious. The Prophet (آله آله و عليه performed (صلى هللا

ablution and sprinkled over me the water of his ablution. I regained my consciousness and said,

Allah's Apostle ( آله وسلم صلى هللا عليه و ), my case of inheritance is that of Kalala. Then the verse

pertaining to the inheritance (of Kalala) was revealed. I (one of the narrators) said, I said to

Muhammad bin Munkadir, do you mean this verse? - ْيُْفتِيكُم ُ فِي اْلَكاَللَِة ۚ إِِن اْمُرٌؤ هَلََك لَْيَس لَهُ يَْستَْفتُونََك قُِل َّللاَّ

ا تََرَك ۚ َوإِْن َكانُوا إِْخَوةً ِرَجااًل َولَدٌ َولَهُ أُْخٌت فَلََها نِْصُف َما تََرَك ۚ َوهَُو يَِرثَُها إِْن لَْم يَكُْن لََها َولَدٌ ۚ فَإِْن َكانَتَا اثْنَتَْينِ فَلَُهَما الثُّلُثَاِن ِممَّ

ُ بِكُل ِ َشْيٍء َعِليمٌ َونِسَ لَكُْم أَْن تَِضلُّوا ۗ َوَّللاَّ ُ يُبَي ُِن َّللاَّ فَِللذََّكِر ِمثُْل َحظ ِ اأْلُْنثَيَْيِن ۗ اًء [They ask you (O' Prophet ملسو هيلع هللا ىلص) about

ْبُن اْلُمثَنَّى، َحدَّثَنَا َوْهُب ْبُن َجِريٍر، كُلُُّهْم َحدَّثَنَا إِْسَحاُق ْبُن إِْبَراِهيَم، أَْخبََرنَا النَّْضُر ْبُن ُشَمْيٍل، َوأَبُو َعاِمٍر اْلعَقَِديُّ ح َوَحدَّثَنَا ُمحَ دُ مَّ

ِ فَنََزلَْت آيَةُ اْلفَْرِض .ِريٍر فَنََزلَْت آيَةُ اْلفََرائِِض فِي َحِديِث َوْهِب ْبِن جَ .اِد َعْن ُشْعبَةَ، بَِهذَا اإِلْسنَ َولَْيَس .َوفِي َحِديِث النَّْضِر َواْلعَقَِدي

.فِي ِرَوايَِة أََحٍد ِمْنُهْم قَْوُل ُشْعبَةَ اِلْبِن اْلُمْنَكِدِر

This Hadith is transmitted on the authority of Shu'ba, with a slight variation of words.


دُ ْبُن اْلُمثَنَّى، ، َوُمَحمَّ دُ ْبُن أَبِي بَْكٍر اْلُمقَدَِّميُّ ا قَتَادَةُ، قَاالَ َحدَّثَنَا يَْحيَى ْبُن َسِعيٍد، َحدَّثَنَا ِهَشاٌم، َحدَّثَنَ -َواللَّْفظُ اِلْبِن اْلُمثَنَّى -َحدَّثَنَا ُمَحمَّ

يَْوَم ُجُمعٍَة ْبَن اْلَخطَّاِب، َخَطَب ْبِن، أَبِي َطْلَحةَ أَنَّ عَُمَر ْبِن أَبِي اْلَجْعِد، َعْن َمْعدَاَن َساِلِم ِ صلى هللا عليه وسلم َعْن نَبِيَّ َّللاَّ فَذََكَر

ِ صلى هللا عليه وسلم فِي َشْىٍء َما َراَجْعتُهُ َوذََكَر أَبَا بَْكٍر ثُمَّ قَاَل إِن ِي الَ أَدَعُ بَْعِدي َشْيئًا أَهَمَّ ِعْنِدي ِمَن اْلَكالَلَِة َما َراَجْعُت َرُسوَل َّللاَّ

ْيِف الَّتِي فِي يَا عَُمُر أاَلَ تَْكِفيَك آيَ " فِي اْلَكالَلَِة َوَما أَْغلََظ ِلي فِي َشْىٍء َما أَْغلََظ ِلي فِيِه َحتَّى َطعََن بِإِْصبَِعِه فِي َصدِْري َوقَاَل ةُ الصَّ

.َوإِن ِي إِْن أَِعْش أَْقِض فِيَها بِقَِضيٍَّة يَْقِضي بَِها َمْن يَْقَرأُ اْلقُْرآَن َوَمْن الَ يَْقَرأُ اْلقُْرآَن . "آِخِر ُسوَرةِ الن َِساِء

Abu Talha (عنہ تعالی هللا عنہ) narrated that Umar b. al-Khattab (رضئ تعالی هللا delivered a (رضئ

sermon on Friday and made a mention of Allah's Apostle (صلى هللا عليه و آله وسلم) and he also made

a mention of Abu Bakr (رضئ هللا تعالی عنہ) and then said, I do not leave behind me any problem

more difficult than that of Kalala. I did not refer to Allah's Apostle (صلى هللا عليه و آله وسلم) more

repeatedly than in case of the problem of Kalala and he never showed more annoyance to me

than in regard to this problem, so much so that he struck my chest with his fingers and said,

Umar (رضئ هللا تعالی عنہ), does the verse revealed in summer season, at the end of Sura al-Nisa not

suffice you? Umar (رضئ هللا تعالی عنہ) (then) said, if I live I would give such verdict about (Kalala)

that everyone would be able to decide whether he reads the Qur'an or he does not.


ح َعُروبَةَ، أَبِي ْبِن َسِعيِد َعْن عُلَيَّةَ، اْبُن إِْسَماِعيُل َحدَّثَنَا َشْيبَةَ، أَبِي ْبُن بَْكِر أَبُو ْبُن َوَحدَّثَنَا َوإِْسَحاُق َحْرٍب، ْبُن ُزهَْيُر َوَحدَّثَنَا

اٍر، َعْن ُشْعبَةَ، ِكالَ .هَُما َعْن قَتَادَةَ، بَِهذَا اإِلْسنَاِد نَْحَوهُ إِْبَراِهيَم، َواْبُن، َرافِعٍ َعْن َشبَابَةَ ْبِن َسوَّ

This Hadith has been narrated on the authority of Qatada with the same chain of transmitters.

CHAPTER (3)

باب آِخِر آيٍَة أُْنِزلَْت آيَةُ اْلَكالَلَِة

The last verse to be revealed was the verse of Kalalah



يَْستَْفتُونََك }آِخُر آيٍَة أُْنِزلَْت ِمَن اْلقُْرآِن َحدَّثَنَا َعِليُّ ْبُن َخْشَرٍم، أَْخبََرنَا َوِكيٌع، َعِن اْبِن أَبِي َخاِلٍد، َعْن أَبِي إِْسَحاَق، َعِن اْلبََراِء، قَالَ

ُ يُْفتِيكُْم فِي اْلَكالَلَةِ {قُِل َّللاَّ

Al-Bara' ( نہرضئ هللا تعالی ع ) reported that the last verse revealed in the Holy Qur'an is - يَْستَْفتُونََك قُِل

َولَ لَهُ لَْيَس يُْفتِيكُْم فِي اْلَكاَللَِة ۚ إِِن اْمُرٌؤ هَلََك ُ لََها َّللاَّ يَكُْن يَِرثَُها إِْن لَْم فَلََها نِْصُف َما تََرَك ۚ َوهَُو َولَهُ أُْخٌت َولَدٌ ۚ فَإِْن َكانَتَا اثْنَتَْيِن دٌ

دُ ْبُن َجْعفٍَر، َحدَّثَنَا ُشْعبَةُ، َعنْ دُ ْبُن اْلُمثَنَّى، َواْبُن، بَشَّاٍر قَاالَ َحدَّثَنَا ُمَحمَّ أَبِي إِْسَحاَق، قَاَل َسِمْعُت اْلبََراَء ْبَن َعاِزٍب، يَقُوُل َحدَّثَنَا ُمَحمَّ

.ْت بََراَءةُ آِخُر آيٍَة أُْنِزلَْت آيَةُ اْلَكالَلَِة َوآِخُر ُسوَرةٍ أُْنِزلَ

Abu Ishaq narrated that he heard al-Bara' bin Azib (رضئ هللا تعالی عنہ) say, ‘the last verse revealed

is pertaining to Kalala, and the last sura revealed is Sura al-Bara'a (At-Tawba).


أَْخبََرنَا ِعيَسى، ، اْلَحْنَظِليُّ إِْبَراِهيَم ْبُن إِْسَحاُق يُونَُس -َحدَّثَنَا اْبُن آِخَر، -َوهَُو أَنَّ اْلبََراِء، َعِن إِْسَحاَق، أَبِي َعْن َزَكِريَّاُء، َحدَّثَنَا

ةً ُسوَرةُ التَّْوبَِة َوأَنَّ آِخَر آيٍَة أُْنِزلَْت .آيَةُ اْلَكالَلَِة ُسوَرةٍ أُْنِزلَْت تَامَّ

Abu Ishaq narrated that he heard al-Bara' bin Azib (رضئ هللا تعالی عنہ) say, ‘the last complete sura

revealed (in the Holy Qur'an) is Sura Tawba (al-Bara'a) and the last verse revealed is that

pertaining to Kalala.


اٌر، -يَْعنِي اْبَن آدََم -َحدَّثَنَا أَبُو كَُرْيٍب، َحدَّثَنَا يَْحيَى، َعْن أَبِي إِْسَحاَق، َعِن اْلبََراِء، بِِمثِْلِه َغْيَر أَنَّهُ قَاَل -َوهَُو اْبُن ُرَزْيٍق -َحدَّثَنَا َعمَّ

.آِخُر ُسوَرةٍ أُْنِزلَْت َكاِملَةً

Abu Ishaq reported this Hadith on the authority of al-Bara bin Azib (عنہ تعالی هللا with a (رضئ

slight variation of words, viz. ‘the last complete sura that was revealed’.



، َحدَّثَنَا َماِلُك ْبُن ِمْغَوٍل، َعْن أَبِي، السَّفَ بَْيِريُّ .ِر َعِن اْلبََراِء، قَاَل آِخُر آيٍَة أُْنِزلَْت يَْستَْفتُونََك َحدَّثَنَا َعْمٌرو النَّاقِدُ، َحدَّثَنَا أَبُو أَْحَمدَ الزُّ

Al-Bara' (رضئ هللا تعالی عنہ) reported that the last verse revealed was - ۚ يُْفتِيكُْم فِي اْلَكاَللَِة ُ يَْستَْفتُونََك قُِل َّللاَّ

َولَهُ َولَدٌ لَهُ لَْيَس َولَدٌ ۚ فَإِْن َكانَتَا اثْنَ إِِن اْمُرٌؤ هَلََك لََها يَكُْن يَِرثَُها إِْن لَْم فَلََها نِْصُف َما تََرَك ۚ َوهَُو ا تََرَك ۚ أُْخٌت تَْيِن فَلَُهَما الثُّلُثَاِن ِممَّ

تَِضلُّو أَْن لَكُْم ُ يُبَي ُِن َّللاَّ اأْلُْنثَيَْيِن ۗ ِمثُْل َحظ ِ فَِللذََّكِر َونَِساًء ِرَجااًل إِْخَوةً َكانُوا َعِليمٌ َوإِْن َشْيٍء بِكُل ِ ُ َوَّللاَّ ا ۗ [They ask you (O'

Prophet ملسو هيلع هللا ىلص) about Kalalah (a man who dies childless). Say, Allah has given a decision in the

matter of inheritance. If a man dies and leaves no child behind but have a sister, she will get half

of what he owned, as he would have done the whole of what she possessed if she had died

childless. In case he has two sisters then they will get two-thirds of the heritage. But if he has

both brothers and sisters, the male will inherit a share equal to that of two females. Allah makes

this manifest to you, lest you wander astray, for Allah has knowledge of all the things.] (An-Nisa

- 176).

CHAPTER (4)

باب َمْن تََرَك َمااًل فَِلَوَرثَتِِه

Whoever leaves behind wealth, it is for his heirs Sahih Muslim Vol 4, Bk 23, Hadith # 018

ِ، ح َوَحدَّثَنِي َحْرَملَةُ ، َعْن يُونَُس األَْيِلي قَاَل أَْخبََرنَا -َواللَّْفظُ لَهُ - ْبُن يَْحيَى، َوَحدَّثَنِي ُزهَْيُر ْبُن َحْرٍب، َحدَّثَنَا أَبُو َصْفَواَن األَُمِويُّ

ِ ْبُن َوْهٍب، أَْخبََرنِي يُونُُس، َعِن اْبِن، ِشَهاٍب َعْن أَ ِ صلى هللا عليه َعْبدُ َّللاَّ ْحَمِن، َعْن أَبِي هَُرْيَرةَ، أَنَّ َرُسوَل َّللاَّ بِي َسلََمةَ ْبِن َعْبِد الرَّ

ُجِل اْلَمي ِِت َعلَْيِه الدَّْيُن فَيَْسأَُل َث أَنَّهُ تََرَك َوفَاًء صَ . "هَْل تََرَك ِلدَْينِِه ِمْن قََضاٍء " وسلم َكاَن يُْؤتَى بِالرَّ "لَّى َعلَْيِه َوإاِلَّ قَاَل فَإِْن ُحد ِ

ُ َعلَْيِه اْلفُتُوَح قَاَل . " َصلُّوا َعلَى َصاِحبِكُْم ا فَتََح َّللاَّ أَنَا أَْولَى بِاْلُمْؤِمنِيَن ِمْن أَْنفُِسِهْم فََمْن تُُوف َِي َوَعلَْيِه دَْيٌن فَعَلَىَّ قََضاُؤهُ َوَمْن "فَلَمَّ

. "َوَرثَتِِه تََرَك َماالً فَُهَو لِ

Abu Huraira (ru reported that when the body of a dead person having burden of debt was brought

to Allah's Apostle (وسلم آله و عليه he would ask whether he had left property enough to (صلى هللا

clear off his debt, and if the property left had been sufficient for that (purpose), he observed

funeral prayer for him, otherwise he said (to his companions), ‘you observe prayer for your

companion. But when Allah opened the gateways of victory for him, he said, I am nearer to the

believers than themselves, so if anyone dies leaving a debt, its payment is my responsibility, and

if anyone leaves a property, it goes to his heirs.’



َوَحدَّثَنِي ح عُقَْيٌل، َحدَّثَنِي ي، َجد ِ َعْن أَبِي، َحدَّثَنِي اللَّْيِث، ْبِن ُشعَْيِب ْبُن اْلَمِلِك َعْبدُ ْبُن َحدَّثَنَا يَْعقُوُب َحدَّثَنَا َحْرٍب، ْبُن ُزهَْيُر

بَِهذَا اإِلْسنَاِد هَذَ ا اْبُن أَِخي اْبِن ِشَهاٍب، ح َوَحدَّ إِْبَراِهيَم، َحدَّثَنَ ،ِ ْهِري نَُمْيٍر، َحدَّثَنَا أَبِي، َحدَّثَنَا اْبُن أَبِي ِذئٍْب، كُلُُّهْم َعِن الزُّ ا ثَنَا اْبُن

.اْلَحِديَث

This Hadith has been narrated by az-Zuhri through another chain of transmitters.


نَاِد، َعِن األَْعَرجِ، دُ ْبُن َرافِعٍ، َحدَّثَنَا َشبَابَةُ، قَاَل َحدَّثَنِي َوْرقَاُء، َعْن أَبِي الز ِ ِ صلى هللا عليه َحدَّثَنِي ُمَحمَّ َعْن أَبِي هَُرْيَرةَ، َعِن النَّبِي

قَاَل ا " وسلم َعلَى إِْن بِيَِدِه ٍد نَْفُس ُمَحمَّ َمْوالَهُ َوالَِّذي فَأَنَا َضيَاًعا أَْو دَْينًا تََرَك َما فَأَيُّكُْم بِِه النَّاِس أَْولَى أَنَا إاِلَّ ُمْؤِمٍن ِمْن ألَْرِض

. "َوأَيُّكُْم تََرَك َماالً فَإِلَى اْلعََصبَِة َمْن َكاَن

Abu Huraira (ru reported that Allah's Apostle (وسلم آله و عليه هللا said, ‘by Him in Whose (صلى

Hand is the life of Muhammad (صلى هللا عليه و آله وسلم), there is no believer on the earth with whom

I am not the nearest among all the people. He who amongst you (dies) and leaves a debt, I am

there to pay it, and he who amongst you (dies) leaving behind children I am there to look after

them. And he who amongst You leaves behind property, that is for the inheritor whoever he is.


اِم ْبِن ُمنَب ٍِه، قَاَل هَ اِق، أَْخبََرنَا َمْعَمٌر، َعْن هَمَّ زَّ َرافِعٍ، َحدَّثَنَا َعْبدُ الرَّ ْبُن دُ ِ صلى َحدَّثَنَا ُمَحمَّ ذَا َما َحدَّثَنَا أَبُو هَُرْيَرةَ، َعْن َرُسوِل َّللاَّ

ِ ص ِ َعزَّ َوَجلَّ فَأَيُّكُْم " لى هللا عليه وسلم هللا عليه وسلم فَذََكَر أََحاِديَث ِمْنَها َوقَاَل َرُسوُل َّللاَّ أَنَا أَْولَى النَّاِس بِاْلُمْؤِمنِيَن فِي ِكتَاِب َّللاَّ

. " َمْن َكاَن َما تََرَك دَْينًا أَْو َضْيعَةً فَادْعُونِي فَأَنَا َوِليُّهُ َوأَيُّكُْم َما تََرَك َماالً فَْليُْؤثَْر بَِماِلِه َعَصبَتُهُ

Hammam bin Munabbih reported that this is what Abu Huraira (رضئ هللا تعالی عنہ) narrated to us

from Allah's Apostle (وسلم آله و عليه ,And he narrated many Ahadith, and one was that .(صلى هللا

Allah's Apostle (صلى هللا عليه و آله وسلم) said, I am, as per the Book of Allah ( ََّعزَّ َوَجل) nearest to the

believers of all the human beings. So whoever amongst you dies in debt or leaves behind

destitute children, you should call me (for help), for I am his guardian. And who amongst you

leaves property, his inheritor is entitled to get it, whoever he is.



أَنَّهُ َسِمَع ،ٍ َعْن َعِدي ُشْعبَةُ، َحدَّثَنَا ، َحدَّثَنَا أَبِي، ْبُن ُمعَاٍذ اْلعَْنبَِريُّ ِ ِ صلى هللا َحدَّثَنَا عُبَْيدُ َّللاَّ أَبَا َحاِزٍم، َعْن أَبِي هَُرْيَرةَ، َعِن النَّبِي

. " تََرَك َكالًّ فَإِلَْينَا فَِلْلَوَرثَِة َوَمنْ الً َمْن تََرَك َما " عليه وسلم أَنَّهُ قَاَل

Abu Huraira (ru reported that Allah's Apostle (وسلم آله و عليه هللا said, ‘he who leaves (صلى

property, that is for the inheritors; and he who leaves behind destitute children, then it is my

responsibility (to look after them).


ْحَمِن َوَحدَّثَنِيهِ ٍ -أَبُو بَْكِر ْبُن نَافِعٍ، َحدَّثَنَا غُْندٌَر، ح َوَحدَّثَنِي ُزهَْيُر ْبُن َحْرٍب، َحدَّثَنَا َعْبدُ، الرَّ قَاالَ َحدَّثَنَا ُشْعبَةُ، -يَْعنِي اْبَن َمْهِدي

. " َوِليتُهُ َوَمْن تََرَك َكالًّ " َغْيَر أَنَّ فِي، َحِديِث غُْندٍَر .بَِهذَا اإِلْسنَاِد

This Hadith has been narrated on the authority of Shu'ba with the same chain of transmitters.
