Approximately 61.5% of the current 6,500 bond is included in the application for Phase II release. For Phase III releases, Increment 3 has Bond #01I-001163 in the amount of $7,300. That entire remaining amount is included in the application for Phase III release. Increment 11 has Bond #01I-002047 in the mount of $9,000. That entire remaining amount is included in the application for Phase III release. Increment 14 has Bond #BP-08084-3 in the amount of $3,100. That entire remaining amount is included in the application for Phase III release. For Increments 1, 2, 4, 5, 6, 7, 9, 10, 12, 13, 15, 16, 17, 19, 22, 23, 24, 25, and 26, the entire bond amount remaining for each increment after Phase II release is included in the application for Phase III release. The following reclamation steps have been successfully achieved. For Phase I: The permittee has completed backfilling,regrading, topsoil replacement, and drainage control including soil preparation and initial seeding and mulching in accordance with the approved reclamation plan. This reclamation was completed in early 2015 or before. For Phase II: (1) Revegetation has been established in accordance with the approved reclamation plan and the standards for success of revegetation have been met. (2) The lands re not contributing suspended solids to stream flow or runoff outside the permit area or increment in excess of regulatory requirements. (3) With respect to prime farmland, the required soil productivity has been restored. (4) The provisions for sound future management of permanent impoundments have been implemented. The reclamation was completed in October 2014, awaiting further crop productivity data nd five-year liability expiration. For Phase III: (1) There has been successful completion of all surface coal mining and reclamation operations in accordance with the approved reclamation plan, such that the land is capable of supporting the approved postmining land use. (2) There has been achievement of compliance with the requirements of KRS Chapter 350, Title 405, Chapters 7 through 24, and the permit. (3) The expiration of the last five-year liability period occurred on 1 October 2019. Written comments, objections, and requests for a public hearing or informal confer- ence must be filed with he Director, Kentucky Department for Natural Resources (KDNR), Division of Mine Reclamation and Enforcement, 300 Sower Boulevard, Frankfort, Kentucky 40601, by M o n d a y , 2 N o v e m b e r 2 0 2 0 . A public hearing on the application has been scheduled for W e d n e s d a y , 4 N o v e m b e r 2 0 2 0 a t 9 : 0 0 A . NOTICE OF BOND RELEASE

The following reclamation steps have been successfully achieved. For Phase I:The permittee has completed backfilling,regrading, topsoil replacement, anddrainage control including soil preparation and initial seeding and mulching inaccordance with the approved reclamation plan. This reclamation was completedin early 2015 or before. For Phase II: (1) Revegetation has been established inaccordance with the approved reclamation plan and the standards for success ofrevegetation have been met. (2) The lands re not contributing suspended solids tostream flow or runoff outside the permit area or increment in excess of regulatoryrequirements. (3) With respect to prime farmland, the required soil productivity hasbeen restored. (4) The provisions for sound future management of permanentimpoundments have been implemented. The reclamation was completed inOctober 2014, awaiting further crop productivity data nd five-year liabilityexpiration. For Phase III: (1) There has been successful completion of all surfacecoal mining and reclamation operations in accordance with the approvedreclamation plan, such that the land is capable of supporting the approvedpostmining land use. (2) There has been achievement of compliancewith the requirements of KRS Chapter 350, Title 405, Chapters 7 through 24, and the permit. (3) The expiration of the last five-year liability period occurred on 1 October 2019.

Written comments, objections, and requests for a public hearing or informal confer-ence must be filed with he Director, Kentucky Department forNatural Resources (KDNR), Division of Mine Reclamation and Enforcement, 300Sower Boulevard, Frankfort, Kentucky 40601, by Monday, 2 November 2020.

A public hearing on the application has been scheduled for Wednesday,4 November 2020 at 9:00 A.M. at the Kentucky Department forNatural Resources (KDNR), Madisonville Regional Office, 625 HospitalDrive, Madisonville, Kentucky 42431-1683. The hearing will be cancelledif no request for a hearing or nformal conference is received byMonday, 2 November 2020.
