The Blake family have been breeding horses for over100 years - Thoroughbreds, Draught Horses, Galloways,Ponies and Walers or Stock Horses as we know themtoday. It has always been impressed upon me that nomatter what breed of animal you breed - go for quality.With horses, quality usually follows through with ability.If you have the quality in your horses they can go outinto most fields of competition. When The AustralianStock Horse Society began it was an easy matter to getour horses registered as the quality and breeding wasalready available.

One of my main Foundation Mares was ROSEBROOKCEDAR, a rich brown mare, hence the name Cedar.ROSEBROOK CEDAR is a Foundation Mare with theSociety - her descendants in 2007 numbered 1,690.Cedar, foaled in 1960, was purchased from the late JimCallinan who owned Chan - she cost 100 pounds, quitean amount in the sixties. The Chan quality thatimpressed me the most was the head, neck andshoulders. The crest on the horses that went back to theChan breed was, and is still easy to pick.

I bred five foals from ROSEBROOK CEDAR, two ofwhom I kept as stallions - ROSEBROOK CEDARWOODand ROSEBROOK ABOU. I have never regrettedkeeping them both as the Stud sires and many top linehorses have been bred from both of them. Another sireson of ROSEBROOK CEDAR, ROSEBROOK CEDARRAY, was sold to New Zealand in the late 1970s and hehas had a tremendous influence in producing highquality polocrosse ponies in that country.

To follow ROSEBROOK CEDARWOOD andROSEBROOK ABOU I retained two Abou colts,ROSEBROOK SHANTUNG and ROSEBROOK BALOU,both of whom have proven themselves as sires of qualityand ability.

The Rosebrook horses have been successful in all fields- led, hack, sporting, working, polocrosse, polo andcampdrafting. One of my proudest experiences was atthe Werribee Polocrosse Nationals in Victoria in 1996when I found that eighteen horses that I had bred wereplaying there in state teams from all over Australia. Ihave a photograph of myself with fourteen of them linedup as proof.

past and now has two in England playing polocrosse.Jason Webb has a stallion, Risebridge Diesel, at stud inEngland who was sired by ROSEBROOK FALUTE.Jason does great promotional work with Diesel due tooutstanding temperament and ability.

To outcross my mares I purchased BOOERIE CREEKFLYING STAR by STAR BLACK MINSTRIL out ofHOMEVIEW FLIGHT (by RADIUS). He has provenhimself in many areas winning many led and workingclasses and is now a novice campdraft horse. The lastpurchase I made was COOLUM ARROW, by OCEANWAVE (by WARRENBRI ROMEO) out of STAR GAYFLIGHT (by STAR BLACK MINSTRIL). I knew hisgranddam, STRATHMUA SAPHIRE, who playedpolocrosse for Mark Field and she was a magnificentmare. OCEAN WAVE was a top campdrafter and a sireof quality horses.

People who have purchased our horses over the yearshave seemed happy with them. Many of these peoplehave returned to purchase other horses. Many of thehorses have gone on to success in their chosenperformance fields.

BOOERIE CREEK FLYING STAR

BOOERIE CREEK FLYING STAR, by the renownedSTAR BLACK MINSTRIL, is a very tidy type of horse.His dam, HOMEVIEW FLIGHT (by RADIUS), won quitea few campdrafts and his full brother, BOOERIE CREEKFLYING MINSTREL has won campdrafts as well.

Flying Star won the Working 3 Year Old at the NationalChampionships at Condobolin as a 2 year old. In 1998,he won the Working Class Under 4 Years and placedthird in the Open Working Stallion at Canberra Royal.

At the Hunter Branch Show in 1999 he won the 3 YearOld Snaffle Bit Futurity and was the Junior High PointHorse of the Show. He was also fifth overall in theNational Futurity at the Championships held atTamworth.

At the National Championships held at Hawkesbury in2000, he won the Time Trial section of the Maturity, theWorking Colt 4 Year Old and the Champion Working 4Year Old.

At Canberra Show in 2001 Flying Star won the SnaffleBit and the Champion Ridden Horse. At the 2001National Championships held at Scone, Flying Star wonthe Working Stallion Under 15hh and the ChampionWorking Stallion 5 Years and Over. (ROSEBROOKBALOU won Reserve to him)

Flying Star has been shown very successfully by GeraldO’Brien. This combination won the R.M. WilliamsTrophy Saddle at the 2003 Sydney Royal Easter Showand the Champion Ridden Horse at Melbourne Royal.

Flying Star was second in the Stallion Campdraft at theNational Championships held at Albury in 2005. He alsoplaced third in the Open Challenge. Flying Star hasbecome a novice campdrafter after multiple placings inmaiden, novice and open campdrafts.

At the 2007 Sydney Royal Flying Star won the Time Trialby over 10 seconds from the next placegetter and wassecond in the Station Horse.

In 2008 Flying Star returned to Sydney Show to performin the main arena entertainment. He won the WorkingStallion Class and was awarded the Champion WorkingAustralian Stock Horse of the Show. He was part of theRosebrook team who competed in the Teams Campdraftin the main arena winning this event for the third year insuccession. In 2009, won the Working ASH Stallion for athird time and has been retired from competition.

ROSEBROOK LANCER was named the 2006 LadiesRookie Polocrosse Horse for NSW after his firstsuccessful season. Played by Simon Parkinson during2010, he played in the Hunter Valley under 21yo teamwho won the Championship Mixed at the NSW ZoneChampionships.

ROSEBROOK SEQUOEA has been campdrafting reallywell after a highly successful show career for LorettaLawson. ROSEBROOK LISA won major horse prizes inSouth Australia for Polocrosse.

ROSEBROOK CORONA and ROSEBROOK BROWNIEare being played successfully by Chris Dunlop inWestern Australia. Flying Star’s progeny are going welland show their sire’s ability and keenness to learn.

ROSEBROOK BALOU

ROSEBROOK BALOU is a very successful horse, bothas a sire and as a performance horse. His sire,ROSEBROOK ABOU, I have given details about in theprofile on ROSEBROOK SHANTUNG.

Rosebrook Balou has been most successful in the showring winning led, hack and working classes. He has alsowon a maiden campdraft and has been placed on manyoccasions. The day he won the Maiden Campdraft healso won the Champion Led Stock Horse and theChampion Open Working Horse. His performancesinclude fifth in the National Maturity at Tamworth. At thesame event he won the 4 Year Old Led stallion, 4 Year

Old Hack and the Working 4 Year Old under threedifferent judges. At numerous shows he has won boththe led and working classes. At the 1999 CanberraShow he won the Working Stallion. In the same year atSydney Show he won the Led Stallion and the WorkingStallion classes and was Reserve Champion WorkingHorse. Balou excelled in Time Trial events and was theonly horse to go under 50 seconds at the NationalChampionships at Scone in 2001.

He has an excellent temperament, is a top walking horseand is a pleasure to ride. He was at the Official Openingof the Heritage Horse Ride at the Sydney Opera Houseand was also in the Welcome Segment of the OpeningCeremony of the Sydney Olympics.

Rosebrook Balou’s progeny are campdrafting andperforming well in the showring.

ROSEBROOK STERLING, ridden by Colin Parkinson,has played polocrosse for NSW winning the ChampionMen’s ASH at the Shell Cup at Warwick in 2006 andChampion Horse and Rider at the 2008 BarastocCarnival. He was Champion Horse of the Series in thePolocrosse at the 2007 and 2008 Sydney Show. Hewas also the NSW Open Men’s Horse for polocrosse for2006 in the ASH awards. Sterling finished off a great2008 season by representing NSW at the AustralianNational Polocrosse Championships in Perth. Sterlingwas played by Simon Parkinson and won ChampionIntermediate ASH at the 2010 Australian PolocrosseNationals at Ballarat. Sterling is a novice campdrafter.

ROSEBROOK CONCHITA was played by the USCaptain Robbie Shuttles at the 2007 Polocrosse WorldCup held at Warwick and awarded Champion Division 4Men’s ASH. In 2008 Conchita and Simon Parkinsonrepresented NSW at the Barastoc Carnival at Warwick inthe Intermediate mixed team. Conchita was played byBrandon Parkinson over the last two seasons andplayed in the winning NSW Junior Mixed team at theAustralian National Championships. He went on to winthe Champion Male Junior Horse and Rider Combinationat the Barastoc Interstate Carnival at Warwick.

ROSEBROOK MIKA is a very successful stallion forDon, Jenny and Ben Turner in Tasmania. Mika has wonall major awards at their Stock Horse and AgriculturalShows. He is also campdrafting for them. His progenyare performing well in many areas of competition.

ROSEBROOK BALOU ROSE had a great show at the2008 Sydney Royal. She won the Champion AustralianStock Horse Hack and the ASHLA class with Loretta

Lawson. Balou Rose was awarded the R.M. WilliamsTrophy Saddle for the High Point Horse of the Show.

ROSEBROOK FERRARI has won many Champion andSupreme Led and Ridden awards. She was theSupreme Led Exhibit at the ASH NationalChampionships held at Warwick in 2006. Played byBrandon Parkinson, she won the 2007 NSW JuniorOpen Horse, won the Best No 3 Horse in the JuniorPolocrosse at the 2008 Sydney Show and was amember of the unbeaten NSW Junior Mixed Team at theAustralian National Championships in Perth.

Ferrari has played sub-juniors for Brittany Parkinson andwon many horse awards, including: Best No 2 in theYouth Polocrosse at Sydney Show in 2010, severalChampion Sub-Junior ASH prizes and Champion Under13yo National ASHS Pointscore for Polocrosse in 2009.

Balou was injured in the paddock and put down underveterinary advice.

ROSEBROOK SHANTUNG

ROSEBROOK SHANTUNG is the son of ROSEBROOKMARQUISETTE, possibly the best mare I have everbred. A mare with a tonne of speed, with terrific stopand the ability to manoeuvre herself into any positionyou wanted. She won many positional horse prizes aswell as champion on many occasions. A very goodmare after cattle, as was her dam, Lisa.

Lisa has bred on with ROSEBROOK MARQUISETTEproducing ROSEBROOK SHANTUNG, ROSEBROOKMARQUITA and ROSEBROOK BEWITCHED, as well asthe next generations, ROSEBROOK VIENNA andROSEBROOK FERRARI. All these horses haveperformed extremely well at polocrosse, campdraftingand in the showring including Sydney RAS, NationalASH Championships and good horses to work on theproperty. Lisa, Marquisette, Bewitched and Viennamake up four generations who represented NSW and allplayed at Sydney Show.

Shantung’s sire, ROSEBROOK ABOU, won campdraftsand placed many times. He was also a very goodshowring horse having won champion stallion on manyoccasions. He was the most successful sire at theHunter Branch Show six times and at the EasternBranch Show five times. At the ASH NationalChampionships at Tamworth in 1999 he was the mostsuccessful sire once again. There are many goodperformance horses by Shantung.

ROSEBROOK PIPER placed third in the 2001 WarwickGold Cup for Robert Clark from Victoria.

ROSEBROOK SERENE placed at her only campdraftstart from a large field of horses. Serene won the 2002NSW Open Ladies Horse for Polocrosse. In 2007 shewon the Champion ASH of the Sydney ShowPolocrosse. She also won the Champion Ladies ASH atthe NSW Zone Championships at Grafton. She wonmany positional and champion awards in her lifetime.

ROSEBROOK MARIA has been a highly successfulpolocrosse mare for Bruce and Glenys McAlister inQueensland. This mare won the Champions VeteransHorse at the 2004 Albury Nationals and then again at theSydney Nationals in 2006. What a great achievement.

DALES SHAMELESS has been a very consistent marefor Ray Davis. She has represented Hunter Valley andNSW at polocrosse. She won the Champion Horse atthe 2007 Sydney Club Carnival.

ROSEBROOK CONCERTO won a maiden and novicecampdraft at her first start. She has played polocrosseand is going well. ROSEBROOK MECCANO owned bythe Turner Family in Tasmania has played polocrossefor Hunter Valley and NSW. He won the Best No 1Horse at Sydney Show in 2007.

Shantung sustained an injury in the paddock and, underveterinary advice, was put down on 1

stNovember 2007.

There are limited progeny still available for purchase.

COOLUM ARROW

COOLUM ARROW was purchased as a yearling at theNational Championships Yearling Sale at Hawkesbury.He was broken-in by Gerald O’Brien and was lightlyshown with success.

Arrow won the Led 3 Year Old Colt at Sydney Show in2002. At the National Championships in Albury thatyear, he won the Working 3 Year Old Colt and the 3Year Old Pleasure Hack. He was second in the Ridden3 Year Old Colt class and finished third in the Led 3 YearOld Colt. He finished eighth overall in the NationalFuturity.

His progeny are horses with good temperament andshowing ability. They are horses that would be at homein the showring, campdraft arena or playing polocrosse.They are quiet to handle and do anything with.

Arrow is bred for performance with WARRENBRIROMEO and STAR BLACK MINSTRIL in his ancestry.Both these horses have been prolific sires ofperformance horses. Horses sold by Arrow in ourprevious sales have been performing well in differentfields.

VENDOR’S RESPONSIBILITIESThe Vendor is responsible for the completion of theTransfer Application. The Transfer Application will beprovided at the sale and will only require the signature ofthe Vendor (nominee of the membership or authorisedagent). The Transfer Application must be signedimmediately after the horse has been sold.

The Vendor irrevocably appoints the Agent the Attorneyof the Vendor to sign on behalf of the Vendor (or itsnominee or authorised agent as the case may be) theTransfer Application in the event that the Vendor fails todo so as required by the preceding sub-rule.

VENDOR’S DUTY OF DISCLOSUREWindsucking, wobblers, roarers – should any horse beaddicted to windsucking or show any symptoms of beinga wobbler or a roarer, then this fact must be disclosed bythe Vendor to the Auctioneer prior to sale of the lot. TheAuctioneer will disclose these facts at the time of sale.

Cryptorchids and any horse being presented for saleshowing a visible deformity of the genitalia must bedisclosed by the Vendor to the Auctioneer prior to sale ofthe lot. The Auctioneer will disclose these facts at thetime of sale.

If the Vendor fails to make the said disclosure and the lotshall prove to have one of these symptoms within seven(7) days, then subject to the purchaser producing to theSociety written evidence signed by a qualified VeterinarySurgeon, certifying that the said lot has one of thesesymptoms, then:

Subject to the purchaser, at his own expense,returning the said lot to the place of sale or Vendor’sresidence (whichever being the closest for thePurchaser), the Purchaser may rescind the sale andany purchase monies paid by the Purchaser shallbe immediately refunded by the Vendor;

The Vendor may, at the discretion of the Board, beliable for suspension of the Vendor’s ASHSmembership for a period of up to 13 months, and afine of up to $500.00.

Where the Vendor has retained semen or embryos, thenthis fact must be disclosed by the Vendor to theAuctioneer prior to sale of the lot. The Auctioneer willdisclose these facts at the time of sale. If the Vendorfails to make the said disclosure, the Vendor’s signaturewill become invalid on any applications for any mating inrelation to the said horse which resulted after the sale ofthe said horse. As part of the disclosure, the vendormust disclose how many embryos or semen straws havebeen retained and whether the use is for commercial orprivate use.

The Agent, within 7 days of the sale, must advise anysuch disclosure to the Society, in writing.

CERTIFICATE OF REGISTRATIONVendors are responsible for checking that theinformation on the horse’s Certificate is correct at time ofnomination, i.e., sex, colour, brands, markings, etc.

The Certificate of Registration must be handed to theOrganiser prior to the horse being inspected on the dayof the sale.

Broodmares in foal must be pregnancy tested and aVeterinary Certificate produced, together with the ASHBreeding Certificate with service details duly completed.The Veterinary Certificate must indicate a minimum of 42days in foal and must be issued within 21 days prior tothe sale being held.

Broodmares with a foal at foot (foal must be less than 12months old) must produce the Foal’s Certificate ofRegistration, Foal Recording Certificate or ASHBreeding Certificate (with details of service and theresultant foal’s information duly completed).

Foals over twelve months of age must be registered andthe Certificate of Registration must be produced for theinspection.

Failure to provide the appropriate paperwork prior to theinspection of the horse will result in the horse beingrejected from the sale and nomination fees will not berefunded.

INSPECTION OF HORSESThe Organiser must select Society Inspectors to viewevery horse offered for sale. The Inspector/s mustcollect the Certificate of Registration, together with anyother appropriate paperwork, prior to the inspection ofthe horse. The registration papers and similardocuments remain the property of the Society. Horsesmay be REJECTED from events (including ApprovedSales) if the Society Inspectors responsible for checkingthe identity of the horse has identified a discrepancywhereby any other person could dispute the identity ofthe horse. Such discrepancies are as follows:

Any white marking on the horse (visible from a threemetre distance) has NOT been completed for thespecific body part.

A white marking on the registration is not evident onthe specific body part, excluding horses with a grey(white in colour) body coat.

A horse’s coat colour is incorrect (with exception ofclause 1.4.3.4).

None of the brands indicated on the horse’sCertificate of Registration are clearly visible on thehorse.

A brand indicated on the horse’s Certificate ofRegistration when compared to a visible brand on

the horse for the same body part, has differentcharacters.

A brand indicated on the horse’s Certificate ofRegistration when compared to the horse presentedfor inspection is located on the incorrect body part.

The Society Inspectors must REJECT a horse from anASH event (including an Approved ASH Sale) if theidentity of the horse is not acceptable under the Brandsand Markings Policies. The Brands and MarkingsPolicies stipulate the Society’s requirements andsituations whereby a horse would be REJECTED froman ASH event.

After the completion of the inspection of sale horses, thesale organiser and/or the Society Inspector must reportto the agent any lot rejected or not presented forinspection. The agent must refuse to offer any such lotfor sale under any circumstances.

GENERALOrganisers should provide an opportunity for prospectivebuyers to inspect all horses in good condition, witnessreasonable workouts, parades, demonstrations and thelike prior to the sale.

Stallions and Colts 4 years old and over must be SireRegistered. All Australian Stock Horse entires (2 yearsand over) must be double tied by a neck strap and halteron all showgrounds, at all times, when not in competitionor exercise (led and ridden) OR housed in suitable safeaccommodation, such as securely fastened panels of asuitable height or appropriate stables.

When being ridden or led, Australian Stock Horse entires(2 years and over) must have a bit in their mouth and beunder the control of the bit.

Under no circumstances are competitors under 18 yearspermitted to handle or ride stallions within the perimeterof the grounds.

To be sold as a broodmare, at the time of sale, the maremust be in foal or have a foal at foot less than 12 monthsof age.

The $45.00 transfer fee must be paid by the Vendorthrough the Agent as part of the nomination fee, ordeducted from the sale price.

Any person involved with handling the horse within theperimeter of the grounds; ie, strapper, handler, trainer,rider and the like must be a financial member of theSociety.

Youth under 18 years of age must wear an equestrianhelmet approved by the current Australian StandardsAssociation or International equivalent, which MUST besecurely fastened under the chin, when mountedanywhere within the perimeter of the grounds, includingall public areas, as well as leading or handling a horse.

First Cross – Horses accepted for First Crossregistration and later advertised for sale or standing atstud must be advertised as a First Cross AustralianStock Horse. First Cross Australian Stock Horses haveno competition restriction.

Second Cross – Horses accepted for Second Crossregistration and later advertised for sale or standing atstud must be advertised as a Second Cross AustralianStock Horse. Second Cross Australian Stock Horseshave no competition restriction.

Special Merit – Horses accepted for registration asSpecial Merit have Australian Stock Horse Stud Bookstatus and have no competition restriction.

Breeding Purposes – Horses accepted for BreedingPurposes Only are NOT entitled to compete in AustralianStock Horse events. Breeding Purposes Only horsesidentified as “BP-” have Stud Book status and horsesidentified as “B2” have Second Cross status.

Dogs should be on a leash and restrained at all times.

PURCHASER’S NOTICEThe Society strongly recommends that if a bid cardsystem is used, the bid card be obtained in the name ofthe purchaser (member or non-member), NOT in thename of an agent acting on behalf of the purchaser.

The purchaser is responsible for inspection of any lotprior to sale and such inspection should include adviceby any qualified person, if deemed necessary. Each lotis offered with all faults, if any, except those conditionsstated under the Vendor’s Duty of Disclosure, unlessdisclosed by the agent at time of sale. The purchase ofany lot with such a condition (windsucking, wobblers,roarers, cryptorchids, visible deformity of the genitalia)must be reported to the Society in accordance with theregulations within seven days of purchase.

Any person at his or her own expense may arrange aveterinary inspection with the vendor of any lot prior tothe horse being offered for sale. Under suchcircumstances, the vendor must have the horseavailable at the grounds on the day of the sale, aminimum of 4 hours prior to the commencement of thesale.

The vendor has the right to allow or decline any requestto ride or handle any lot prior to the sale. Any personwho rides or handles a lot at the sale does so entirely attheir own risk and the Society, its members or Branchesdo not assume or accept any responsibility or liability for

any accident, damage, injury to horses, riders orhandlers, beasts, ground, spectators, or any otherperson or property whatsoever. Any person requestingto ride or handle any lot must be a member of theSociety and suitably attired for riding a horse.

Comments in the catalogue relating to horses listed forsale are based on information supplied by Vendors.The Australian Stock Horse Society Limited is unable toestablish the accuracy or authenticity of such commentsand any purchaser should rely on their own enquiries inthis regard.

Under the Society’s Regulations, all horses beingoffered for sale at Approved ASH Sales are subject to aNo Prohibited Substance rule. Although the Societyconducts random drug testing at Approved ASH Sales,the Society is unable to guarantee that any specific lotwill be tested. Any purchaser at the fall of theAuctioneer’s hammer may request a swab or sample betaken from the subject horse at the expense of thepurchaser. If the purchaser so elects, the sale of theswabbed horse may be rendered null and void if thehorse returns a positive swab to any prohibitedsubstance.

A person bidding on any lot acknowledges that shouldthe lot be knocked down to the person as highest bidderat the fall of the Auctioneer’s hammer and “sale” or“sold” is declared, the person is responsible for paymentof the nominated price to the agent and transfer ofownership will be notified to the Society as recorded bythe sale clerk at time of purchase.

Any dispute in relation to any statements, guarantees orwarranties offered by the vendor shall be against thevendor only. Any dispute of this nature will be for thevendor and purchaser to resolve and is not theresponsibility of The Australian Stock Horse Society.

The Purchaser must complete the Purchaser’sInstructions in the back of the catalogue, indicating thecorrect membership name and number for the horse tobe transferred and hand it into the Agents before leavingthe sale.

If the Purchaser is a non-member, the horse’sregistration papers will be retained by the Society untilsuch time as the new owner becomes a member of theSociety. The horse’s registration will be suspended untilsuch time as the new owner joins the Society. Whenjoining the Society, we recommend that you indicateASH Approved Sale – Lot ##.

If the purchaser of a horse at an Approved ASH Sale isa non-member, the purchaser is entitled to a free fullmembership for the remainder of the currentmembership year, provided the purchaser has neverhad a previous membership with the Society. Such apurchaser must complete a Membership Applicationindicating: Approved ASH Sale – Lot ## (FreeMembership Incentive).

DRUG POLICYAll horses competing in Australian Stock Horse Society(ASHS) events or being offered at ASH Approved Salesare subject to a No Prohibited Substance rule. Thismeans that no Prohibited Substance is to beadministered to the horse in the time before an event orsale such that it, or any ingredient or metabolism of it,might be present in the horse, might be detectable in itsblood, saliva and/or urine samples, or might have anyeffect on its performance at the time of the event or sale.

Any substance is a “prohibited substance” if it containsan ingredient that is a stimulant, depressant,tranquilliser, local anaesthetic, psychotropic (moodand/or behaviour altering) substance, or drug whichmight effect the performance of the horse and mightinterfere with the prohibited substance testing process.The use of so-called herbal and natural products in thehorse could result in a positive prohibited substancetest. The plant origin of any ingredient does notpreclude it containing a pharmacologically potent andreadily detectable prohibited substance.

The following penalties shall automatically apply inrespect of a positive prohibited substance test: Owner’s1st Offence - Awards won by the horse in any class atthe event or show are forfeited. The ASHS membershipof the registered owner of the horse will be suspendedfor a period of 13 months and the owner must pay to theASHS a fine of $500.00. Horse Offence - A horse shallbe banned from entry into any event conducted by theSociety, events restricted to Australian Stock Horses orASH Approved Sales for a period of 13 months at anygiven suspension. Handler Offence - A penalty of$500.00 will be imposed on the rider/handlerresponsible for the performance of the horse.

Should any mare or filly presented for drug testing underthis policy be pregnant, it is the responsibility of theregistered owner and/or rider/handler of a horse toadvise the drug testing personnel of the mare’scondition and supply the name of the stallion and thedates of service or insemination of such mare or filly.This information must be recorded on the drug testingdocumentation prior to the owner and/or rider/handlersigning the documentation as a witness.

In relation to an ASHS approved sale (including thosesales conducted by Branches or ManagementCouncils), the Society or any purchaser, at the fall of theAuctioneer’s hammer, may request a swab or sample betaken from the subject horse at the expense of thepurchaser or Society as the case may be, so requesting.If the purchaser so elects, the sale of the swabbed

horse may be rendered null and void if the horse returnsa positive swab to any prohibited substance.

In the event that a horse, suspended from participatingin ASHS events or sales, changes ownership, thechange of ownership will not dissolve or shorten theterm of suspension. A transfer application will not beeffected until the suspension period has lapsed andfines are paid in full.

LIVESTOCK AUCTIONTERMS AND CONDITIONS OF SALE

CHAPTER ONE - PRELIMINARY1. (a) A vendor is bound by these terms and conditions by offering livestock

for sale.(b) An agent (which includes an auctioneer) is bound by these terms and

conditions by conducting a sale.(c) A buyer is bound by these terms and conditions by bidding at auction.

2. (a) In these terms the expression auctioneer, agent, buyer and vendorrespectively includes the servants, contractors, agents of them. Theauctioneer, agent, buyer and vendor shall be wholly responsible for theacts and omissions of their respective servants, contractors andagents. The term “auctioneer” includes, so far as the Act and contextpermits, the vendor’s stock and station agent.

(b) When used in these terms the expressions “companion animals”means all animals originating from a property on a particular day.Where lots are split and sent to multiple establishments, then all ofthese animals shall be regarded as companions.

3. These terms and conditions are subject to legislation or regulation in theState in which the auction is conducted and in the event of any conflictthen the legislation or regulation will prevail. The provisions of these termsand conditions are in addition to, and do not derogate from, the duties andrights of vendors, agents and buyers set out in legislation and regulation inthe State in which the auction is conducted.

CHAPTER TWO - STANDARD TERMS OF SALE4. Subject to any reserve price, and to the right, prior to the fall of the

hammer, of the vendor to withdraw any lot without declaring the reserve,the highest bidder shall be the buyer.

5. The auctioneer has the right to bid on behalf of the vendor provided thatright is notified prior to the commencement of the sale and is subject toState law,

6. A bid cannot be made or accepted after the fall of the hammer.7. The last price called by the auctioneer at the fall of the hammer shall be

the amount at which the lot has been sold.8. In the event of a disputed bid, the auctioneer is the sole arbitrator of the

successful bidder or the auctioneer may decide to put the lot up again. Theauctioneer’s decision is final.

9. The auctioneer may refuse to accept any bid which, in the auctioneer’sopinion, is not in the best interests of the vendor and need not givereasons for doing so. The minimum bid for liveweight selling is 0.2 of acent ($0.002).

10. A bidder shall be deemed to be a principal unless, prior to bidding, thebidder has given to the auctioneer a copy of written authority to bid for oron behalf of another person.

11. Successful bidders. The actual successful bidder at an auction sale mustgive to the auctioneer or an employee of the auctioneer at the fall of thehammer:(a) The purchaser’s name; or(b) The name of the person on whose behalf the successful bid was; and

the(c) PIC of destination.

12. The auction shall be conducted on the basis that the bid price shall beexclusive of Goods and Services Tax (GST). GST shall be added after thefall of the hammer for those sales subject to GST.

13. As soon as practicable after the fall of the hammer, the buyer shall signthe agreement for sale (if any).

14. If a buyer does not comply with any of these terms and conditions, whichincludes the requirements of State law, any stock knocked down to thatbuyer may be re-sold by public auction or private contract in whatever lotsand manner the auctioneer decides. The re-sale may be with or withoutnotice and shall be at the buyer’s risk. The buyer is responsible for all lossand expense arising out of a re-sale and is not entitled to any resultingprofit.

15. The buyer of livestock must pay the agent the full amount of the purchaseprice on receipt of a tax invoice. Payment is required prior to deliveryunless some other time for payment is specified in a written agreementbetween the buyer and the auctioneer that was made before the fall of thehammer.

16. No person may bid unless, prior to the commencement of the sale, thatperson has made arrangements satisfactory to the auctioneer for paymentfor stock purchased. If bids in breach of this condition are inadvertentlyaccepted, delivery shall not be given until the purchase money is paid andany law, rule or practice to the contrary is accordingly negatived as far aspossible.

17. (a) Cattle sold on a liveweight basis that are weighed pre-sale are at therisk and expense of the buyer upon the fall of the hammer.

(b) Cattle sold on a liveweight basis that are weighed post-sale are at therisk and expense of the buyer immediately after weighing.

(c) All stock other than cattle sold on a liveweight basis are at the risk andexpense of the buyer upon the fall of the hammer.

18. (a) Subject to this clause the sale is complete on the fall of the hammer.(b) The time for rejection is the time commencing at the fall of the hammer

and ending at the first of:(i) Delivery is taken by a representative of the buyer;(ii) Departure of the animal from the purchaser’s delivery pen; or(iii) One hour after the last animal is: • In the case of pre-sale

weighing, sold; or • In the case of post-sale weighing, weighed.(c) During the time for rejection the buyer may reject any animal which is

lame, blind or diseased where that condition existed prior to the fall ofthe hammer but could not be reasonably observed when the animalwas in the selling pen.

(d) If the purchaser rejects an animal during the time for rejection then thesale of that animal is cancelled and the animal is returned to thevendor or sold at such price as the purchaser and the agent mayagree.

(e) This sub-clause applies to cattle which are sold in Queensland atauction for slaughter. The agent has responsibility for the prevention ofloss or escape (but not death, sickness or injury) of those cattle fromthe time of the fall of the hammer, through delivery to and from thescales, to the buyer’s delivery pen and on to the buyer’s nominatedtransport. This responsibility ends at the earlier of those cattleboarding the buyer’s nominated transport or sunset on the day afterthe sale. This sub-clause does not apply if the agent makes anannouncement to that effect prior to sale.

19. (a) Subject to the right of rejection in Clause 18, all conditions andwarranties expressed or implied by law are hereby excluded from thesale to the extent that the law allows. All lots are open for inspectionprior to the commencement of the sale and are sold with all faults, ifany. No compensation shall be given for any faults, imperfections,errors of description, number in or of any lots sold or otherwise.

(b) Any claim or objection arising out of an error or misdescription in theprovision of relevant information in terms of legislation or regulationconcerning the National Livestock Identification Scheme (NLIS) mustbe made by 5:00pm on the seventh day after the fall of the hammer.No objection, requisition or claim against the vendor or agent inrespect of such error or misdescription can be made after that time.

(c) Any statements made by the vendor or the auctioneer whether inwriting or orally to the effect that any female has been pregnancytested or scanned positive shall mean and require only that acertificate in writing shall be supplied to the buyer signed by a qualifiedveterinary surgeon or certified scanner certifying that the said femalehas been tested or scanned on the date specified in the certificate andthat in the opinion of the surgeon or scanner the female was pregnanton that date.

(d) For cattle, the agent undertakes to make every reasonable effort toensure that any NLIS cattle device number is transferred from thesaleyard account to the purchaser’s account on the NLIS database nolater than midnight on the day of the sale.

(e) Where livestock have a food safety or market eligibility status derivedfrom the NVD and/or the NLIS/ERP database, the agent will inform thebuyers by presale catalogue in conjunction with vendor brandingand/or announce the status prior to the offering of those lots.

20. If delivery is made to, or possession obtained by, the buyer or itsrepresentative before full payment of the purchase money, then until fullpayment is received, the buyer:(a) Does not acquire title to the stock;(b) Holds the stock as bailee only for the vendor(c) Must act in a fiduciary capacity in its relationship with the vendor;(d) Must store the stock separately or so that they are readily

distinguishable from other stock owned by the buyer;(e) Is responsible for the safety and well being of the stock;(f) May make a bona fide sale for market value of any or all of the stock.

As between the buyer and the subsequent buyer, the sale shall bemade by the buyer in its own name and not as agent for the vendor,however as between the vendor and buyer, the sale shall be made asbailee and agent for the vendor; and

(g) Must keep and account for the proceeds of any subsequent saleseparately from its other money and hold those proceeds, togetherwith the benefits of any rights against subsequent buyers, on trust forthe vendor.

21. In addition to clause 20, if payment is not made according to clause 15, butdelivery has been made to, or possession obtained by, the buyer or itsrepresentative:(a) The vendor or its agent may repossess and resell the stock and enter

property owned or occupied by the buyer or its representative ifnecessary to do so; and

(b) Interest may be charged at the rate usually charged by the agent foroverdue accounts on any amounts which remain owing at any time.

22. The buyer may not make any claim against the vendor for actions by thevendor under clauses 20 or 21 and indemnifies the vendor against anyloss, damage, costs, expenses, penalties, fines or claims suffered by thevendor or any person or entity arising from the vendor exercising its rightsunder clauses 20 or 21.

23. Wherever the auctioneer pays the vendor before being paid by the buyer,the auctioneer is the del credere agent of the vendor and the partiesacknowledge that all rights of the vendor as reserved hereunder are fullysubrogated to the auctioneer. Nothing in these terms and conditions shallrender the auctioneer in any way whatsoever liable to the buyer as vendornor entitle the buyer to set off against the auctioneer any right the buyermay have against the vendor or otherwise.

24. The auctioneer has been retained by the vendor as auctioneer for thepurpose of selling the livestock comprised in the lots. The terms ofengagement between the auctioneer and the vendor do not extend to theprovision of advice by the auctioneer to the vendor in relation to the safetyor otherwise of the sale ring, the saleyards and the surroundingenvironments.

CHAPTER THREE - WARRANTY FOR CORRECT PRESENTATION ANDDECLARATION25. This chapter applies only in the case of livestock and their companion

animals sold at auction for slaughter when the buyer is the slaughterer andthe livestock are transported direct from the sale yard to the meatworks atwhich they are slaughtered. This chapter does not apply if the buyer is atrader who subsequently resells the livestock to a slaughterer. Aslaughterer is any person who pays the AMPC Processor levy.

26. The warranty of a vendor is that livestock and their companion animalsoffered for sale at auction:(a) Pass AQIS and other regulatory authority requirements and

inspections at the time of slaughter;(b) Are of merchantable quality;(c) Carry an NLIS device in accordance with State law;(d) In the case where a representation has been made in the pre-sale

catalogue that the livestock have particular characteristics or are fit fora particular purpose or market, and such representations are based oninformation in the National Vendor Declaration, the livestock will havethose characteristics or will be fit for the particular purpose or market;and

(e) All information in any National Vendor Declaration provided by thevendor is true, complete and correct in all material respects.

27. In the event of a breach by the vendor of the vendor’s warranty andprovided such breach is notified by the buyer to the vendor’s agent by

5:00pm on the 7th day after the fall of the hammer then the buyer is notliable to pay the purchase price of such of the vendor’s livestock to whichthe breach applies.

28. However if the breach by the vendor is such that the livestock are notrejected outright but are instead downgraded then the buyer will pay thevalue of the livestock at their next highest and best use.

29. In the case of a breach by the vendor of the vendor’s warranty then thevendor will also be liable to the buyer for any further losses which thebuyer might establish but the buyer will take all reasonable steps incooperation with the agent and vendor to mitigate both the effect of thebreach and the amount of any loss.

30. Where a sentinel animal of a lot tests positive for chemical residue, andprovided such test is certified and notified as required by these vendorwarranty terms, then:(a) The buyer will be entitled to delay payment for the price of all livestock

in that lot; or(b) The vendor has the option, at the vendor’s cost, of collecting the

companion animals and returning them to the vendor’s property; or ofhaving the stock slaughtered in which event the risk of furthercondemnations will be that of the vendor. Where product integrity ispotentially jeopardised, the Processor has the right to refuse slaughterand send the livestock back to the consigning property at the vendor’scost.

31. The auctioneer is liable to the buyer in respect of any breach of thevendor’s warranty arising out of:(a) Any error, by the auctioneer, of transcription of information from the

National Vendor Declaration completed by the vendor to the presalecatalogue or the buyers post-sale summary;

(b) Any failure by the auctioneer to notify the buyer, prior to bidding, of anybreach by the vendor of the warranty of the vendor if the buyerestablishes that the agent knew of such breach prior to the sale; and

(c) Any failure by the auctioneer to disclose prior to bidding, and in thepre-sale catalogue, that the vendor has failed to provide a NationalVendor Declaration that is complete in all material aspects.

CHAPTER FIVE - NOTICES REQUIRED BY STATE LEGISLATIONNSW Legislation Property, Stock and Business Agents Act 2002 Warnings

Penalties for collusive practices. It is an offence against the Property,Stock and Business Agents Act 2002 for a person to do any of thefollowing as a result of a collusive practice, or to induce or attempt toinduce another person by a collusive practice to do any of the following:(i) To abstain from bidding; or(ii) To bid to a limited extent only; or(iii) To do any other act that might prevent free and open competition.

Severe penalties may be imposed on persons convicted of collusivepractices. The auctioneer has the right to make one bid on behalf ofthe vendor if the auctioneer clearly and precisely announces that factprior to the sale.
