The numbers arc large. but I don ·1 have th.: specific numbers. We share the same problems and we usually find out too late because \vc have a lot of these recourse loans.
Sen. Mccreadie: Somebody has lo pa~ for it down the road. When the bank absorbs the cost. do they pass tlmt on to the consumer''
Mr. Garcia: Their credit history initially and then the loss.
Sen. McCrcadic: Dol's it affect not just the individnal who g,11 into an accident and had their car towed, Wtluld this in the long run affect the entire community''
Mr. Garcia: It has a ripple effect. from the consumer's credit initially then the bank tuking a loss and perhaps the dealer.
Sen. McCreadie: The costs would go up to recoup that cost. so in the long run cveryhody kind of loses.
Mr. Garcia: Yes, for example. the case where the vehicle was stored for a hundred odd da, s. and we don "t know where the vehicles are at We hear it's there but we canmit get it: they deny that it"s there and we tf) to secure it. We are in favor of the bill and we want to make the process easier to give the tow companies time where Rev. and Tax could help them get that information if they can'l l!cl it Like Mr. Flores said, h's all thcr.: in 1hc registration.

We ar<e affected just as much cLs the banks and I don "t have a count of incidents and losses occuned. !\fost of the dealers operate rent-a-ear companies and we hme visitors on island who get into accidents and their vehicles get towed. It"s cilhcr on the consumer side or rcmal side. but we all get hit with the sam.:: situations. The towing industry is not always cooperative with releasing vd1icles when we know where they are. It is a challenging situation.

Mr. Gerling: Someiimes our own 'chides. We have customers who into an accident and the)' want it repaired hut the towing companies don ·1 want to release the ears so they get more storage ~cs,
Sen. McCreadie: Is everything accoumed for when you get the car back'
Mr. Gt'rling: 'Jc>! always. It's difficult to .iudge during the time ii was towed to the lot
Chairperson Ada: So what if they don't send the notice') ls there anything in the law that you 're a\\'ilfC 01'?
Mr. Garcia: Ifs perjury if they don't comply. lfwe find out !hey don't comply. we can inform the police.
Chairperson Ada: So it becomes a criminal offense on their pan''

Chairperson Ada: I need lo take a look further at the disincentin: or punitive part of what happens if they don't send out that notice, Whatever punitive measure in the law right now is prob<ibly not sufficient to catch the attention of the towing companies.
Mr. Flores: The towing companies are very dif!icult to work with. If there is a way to straighten the punitive measures. 1 · d certainly appreciate if that was done.
Senator James Espaldon: l;; there a prohlcm with the towing companies or it could be diflicult working with 1hem; what arc \\C trying lo rectif;, here'?
Mr. Garcia: There's a three hundred dollars ($300) charge, which is the max to hold the vehicles. They won't release the cars unless you pay tbc storage foes. which arc way in excess of three hundred dollars ($300).
Chairperson Ada: rm surprised that none of the towing companies are here. I would think it would be in their interest to he here also.
Mr. Gareia: Wc'\c tried pursuing legal action, hut ~\e've had some companic:s dose and start up another company, They know all the tricks of the trade.
Chairperson Ada: Bill l 9 l simply says that lhe towing companies has to send this notice to the bank if the car was towed without the owner's consent so we just \Vidcn the n~t. but it Jocsn 't gll to the heart of the problem of why the towing companies arcn 't sending it out Otherwise, we can widen the net as wide as we want.
Sen. l\lcCrcadie: Mr. Chair. pan of the prob km is the foci that ;he meter keeps running for the ltlwing storage and this bill would allow them tti have a cap. If }OU don't inform the banks or the dealers within 48 hmirs. Lhcn you would be.
Mr. Garcia: We were recommending some mih:stoncs r•r timetables in there.
Chairperson Ada: But it doesn'r c,ay anything nhnut what happens if they don't send it out in two days. the storage dock turns off'.
Sen. McCrcadie: So. on page 2. line 3. they would have to. The problem is that you're getting a hill for nine hundred (900) or a rhousmid (I .000) dollars and if it was only two \Vorking days of storage and you \Vere infiJrn1ed.

Chairperson Ada: Thi.> thing warrants a round table discussion because I would like to get the towing companies in to find out wha\"s the problem. The other stakeholder needs to be involved in the discw;sion.

Mr. Flores: You caught something that I didn't.
Sen. f:spaldon: I think the key is to shorten that amount of time and this may not do it hy including 1wu wvrking days.
Chairperson Ada: lfwc were to change that to 48 hours and they picked it up Friday night. the post office is not open. Ifs a loophok that we need to close. I understand where you guys arc coming from. but there's a lot of work that needs to be done in the bill. For me. here's the hoc)p that you have to jump through, but what if he chooses not to jump through it. Other tlmn that penalty ofpedury. it now hccomcs a criminal action and you gu:s have to file charges and take your numhcr in line \Vith the court. That could be a long wait for you guys.
Mr. Flores: We've had to have our mtomcys sue the towing companies. s,, if we could pm some punitive d:miage in there. it'd be fine from our point of view.

Veterans· Affairs and Procurement finds, based on the Public Hearing. on Novcmb.:r 6. 2015, the Committee requested !hat disincen!iw language be added to Bill l'\o. 191 to enforce the issue of lowing notice requirements within the allotted time (ramc. In addition. the Committee also pointed out that the lowing notice n:quircmcnt of rwo working dt(}s. is prnhlcmat.ic due to vehicles being towed on the weekends. delaying the towing notification to the legal owners. regislcred owners. insurers, and lienholders.
The Cnmmittee also finds. based on farnrnbk written testimonies from First l lawaiian Bank, Bank Pacific, and th.c Guam Automobih: Dealers Association, !hat§ 12104(a) of Chapter 12. BE IT ENACTED BY THE PEOPLE OF GUAM:
Section L Towing Notice Requirements. i 6 GCA §
amended to read:
"(a) Unless a vehicle is impounded under§ 3606 of Article 6, Chapter 3 of this
Title 16, after performing a tow truck service witheut tke vehicle O'•'>'fler'n lffiewledge,
the person operating the tow truck business shall:
(1) complete a vehicle condition report, as defined in § 12 l 0 l ( f) of this
Chapter;
(2} within one hour of arnving at the place of storage or impound of the
vehicle. contact the law enforcement agency having jurisdiction over the area
wt'"'n the v''"w"' was towc'd and notify the agency of the:
(A) of the
(Bl date, time, and location from which the vehicle was removed;
fC) reasons for the removal of the vehicle;
(D) person who reqm:osled the removal of the vehicle; and

(E) vehicle's description, including its identification number and
license number: and
(3) within two (2) working days of perfonning the tow tnick service,
send a certified letter to the last known address of the legal owner, registered
ow11er, vehicle insurer and lienholder, where applicable, of tlu; vehicle
(obtained from the DRT Division of Motor Vehicles), notifying them of the:
(A) location ofvehide;
(B) date, time, and location from which the vehicle was removed;
(C) reasons fix the removal of the vehicle;
( D) person who requested the removal of the vehide;
(E) vehicle's description, inc!utling its ltlentification number and
license number:
IF) costs and procedures to retrieve the vehicle; and
(G) a copy of the vehicle condition report required by Subsection
(a)( l) of this Section.
(4) For purposes of this Se1.'1ion, the Division of Motor Vehicles shalt
upon the presentation of a declaration made under penalty of perjury that a
vehicle has been towed and taken into the possession of a tow truck business,
provide tow truck businesses with the last known address of the legal owner,
registered owner, vehicle insurer, and lienholder, where applicable. of the
Vtc'hicle m question. The tow truck business shall fomish the Division of
Motor with a copy of the notice sent pursuant to Subsection (a)(3) of
this Secti1ln within two days via certified mail atler the release of the
addresses of the iegal owner, registered owner, vehicle insurer and iienho!der,

7 (I) complete a vehicle condition report, as defined in § i 210 I (fJ of this
8 Chapter;
9 (2) within one hour of arrhing at the place of storage or impound of the
10 vehicle, contact the law enforcement agency having jurisdiction over the area
11 from which the vehicle was towed and notify the agency of the•:

10 of a vehicle that is lawfully towed is responsible fbr paying the towing. impound, and
11 storage fees incurred by the tow truck business in towing. impounding, and storing
12 such vehicle in order to obtain its release; provided, however, that if the tow truck
l3 business has failed to comply with the requirements of§J2l 04 Sub'.Jeclitm (a)(3)_cmd
14 JLl2J 04J£t1~sQ£ii(}fl ( d} of this Section, all such fees shall be forfeited, and the vehicle
15 shall be delivered to said legal owner, registered owner, or lienholder immediately
16 upon demand. Any tow truck business or other person responsible for or authorizing
17 the towing. impounding or storage of a vehicle relative to this Section, but failing to
18 comply with § 12104 ~ (a)\ 3 Land § 12 .l 04 Subsectioo ( d) of this Section

The Guam Automobile Association hereby gives its full support to the proposed changes requiring companies that operate tow truck services to complete a vehicle condition report, inform the appropriate law enforcement agencies having jurisdiction of the vehicle location, time and date and reasons for removal of vehicle as well as the vehicle identification nwnber and license plate. And to further notify the legal owner of the vehicle through certified letter to the last known address of the legai owner, registered owner, vehicle insurer and lienholder.
It appears that this new legislation will allow for prompter response from legal owners to remove their vehicles from incurring unnecessary storage fees for their property for failure to know where their vehicle is stored.

A Round Table Discussion is scheduled for Wednesday January 27, 2016 from 10:00am to 12:00pm in the Legislature's Public Hearing Room. This Round Table Meeting is a follow-up to the public hearing held on November 6, 2015 for Bill No. 191-33, introduced by Senator Brant Mccreadie. The meeting will be an opportunity to review proposed amendments to BJll 191-33 and to receive further input from stakeholders.
The public hearing held on November 5th was attended by representatives of local finance companies and the Guam Automobile Dealers Association. There were no representatives from the local towing companies.
Because the towing companies are the focal point of Bill 191-33, and were not represented at the public hearing, it is imperative that representatives be present at the January 27th round table discussion.
We look forward to your attendance at the Round Table Meeting.
