Assessable Frontage Review - 1380 Whispering Pines Lane: Director Kaiser reviewed his March 9,2018, memo. The owner of 1380 Whispering Pines Lane had requested that staff review theassessable frontage calculation for his property at 1380 Whispering Pines Lane. Director Kaiserstated that the frontage calculation was based on viewing the lot as a trapezoid and averaging thefront and rear lot line lengths, which resulted in an assessable frontage of 111.78 feet. He reviewedthree other ways of calculating the assessable frontage – using a modified trapezoid shape with anadjusted rear lot line that was parallel to the front lot line, using the lot width at the 25-foot setbackline, and dividing the lot area by the lot depth to calculate the average width. The assessable frontagewidths calculated with the four methods ranged from 90.30 feet to 113.81 feet. He noted that thetrapezoid method, as originally calculated, was used when the lot was previously assessed for thetemporary 2-inch asphalt mat. The consensus of the Committee was to confirm the original calculationand assign an assessable frontage of 111.78 feet for the lot. Since that was the measurement usedin the previously approved assessment report, no action was needed.
Assessable Frontage Review - 1589 Remington Road: Director Kaiser reviewed his memo of March9, 2018. The owner of 1589 Remington Road had addressed Council regarding the assessablefrontage for his lot. The lot has 135.11 feet of frontage on Nature Trail Drive and 310.56 feet offrontage on Remington Road. As a corner lot, the assessable frontage totals 345.67 feet. DirectorKaiser noted that the southerly two-thirds of the lot is delineated wetlands and unlikely to bedeveloped. He suggested that the assessment for the lot be calculated per ordinance but that theproperty owner be billed based on typical corner lot dimensions in the neighborhood of 110 feet x135.11 feet. That would reduce the billed assessable frontage to 155.04 feet. The difference betweenthe billed assessment and the calculated assessment would be held as a deferred assessment againstthe lot should the remainder of the lot be developed. Mayor Kaufert noted that he had been contactedby another property owner who also has a sizable quantity of wetlands on his property and wasseeking a similar adjustment to his assessable frontage. After discussion, the Committee directedstaff to review the remainder of the Eaglecrest Estates Plat to see if other lots are affected by similarcircumstances and bring all adjustment recommendations to a future Committee meeting.
Approval of Special Assessment Report:Committee reviewed the assessment report for installation of curb, gutter and HMA Pavement in theEaglecrest Subdivision. Director Kaiser noted that the estimated assessment rate of $80 perassessable foot was calculated as a combined project to construct the streets in the EaglecrestEstates subdivision and the streets in the Nature Trails subdivision.

City Attorney Godlewski reviewed potential action that could be taken to defer charges for this workuntil 2019. He noted that any action to defer charges should be done when Committee considers theFinal Resolution for the project.
Following discussion, Motion/Second/Carried Stevenson/Lendrum to authorize the Chairman tosign the assessment report for Preliminary Resolution No. 2018-09 for installation of curb,gutter and pavement on Kingswood Drive (Nature Trail to Shootingstar), Remington Road(Nature Trail to Shootingstar), Paintbrush Road (Kingswood to Remington) and ShootingstarDrive (Kingswood to Remington). All voting aye.
Public Works General Construction and Department Activity:1. Contract 8-17 (Commerce Court Pond) – Pipe installation is complete. The contractor has started
to work on expanding the detention pond. Excavated soil is being placed on the south slope ofBell Street.
2. Contract 1-18 (Andrew, Richard, Geiger, Whiting) – A pre-construction meeting was held onMarch 9. The contractor plans to mobilize on March 19 to start work on Geiger. St. GabrielParish/School contacts have been notified. Committee expressed concern that constructionactivities minimize interference with Holy Week activities at St. Gabriel Parish.
3. Contract 2-18 (Cecil, Adams) – A pre-construction meeting was held on March 9.4. Contract 3-18 (Nature Trails/Eaglecrest) – An informational meeting with Eaglecrest residents is
scheduled for March 12. The schedule currently calls for project advertising around March 21/28and bid opening on April 4.
5. City Hall Boilers – Proposals are being received for boiler replacement.6. Storm Water – Staff is preparing the annual storm water report to DNR, which is due at the end
of the month. Director Kaiser noted that this report will require the City to establish a firm path toachieve the required loading allocations.
7. Bergstrom Road Street Lighting – We Energies has started street light installation.8. Epoxy Pavement Marking - Traffic Engineer Merten has begun preparing the pavement marking
contract. Alderman Stevenson noted the Traffic-Outside Services budget carry-forward that willbe directed toward this work. Mayor Kaufert commented on the pavement marking conditionsaround schools and noted that he has asked staff to look at ways to enhance this budget so thatadditional marking work can be done.
Announcements/Future Agenda Items:Alderman Lendrum noted a recent accident where a driver drove off the end of Nicolet Boulevard.She requested that staff look at improving markings to enhance recognition of the end of the road.
Mayor Kaufert informed the Committee that staff is developing a fillable form for Street Use Permits.

Appeal of Prohibited Dangerous Animal Designation pursuant to Neenah Code §3-16 – Kimberlyand Jeffrey Machmueller, 973 Byrd Avenue: City Attorney Godlewski outlined the procedures tobe followed for the hearing. City Attorney Godlewski placed all potential witnesses under oath.The prohibited dangerous animal declaration was made following a bite incident involving the dog“Fritzy”. Fritzy is described as a male, tan Terrier mix owned by Kimberly and JeffreyMachmueller.
Chief Wilkinson made an opening statement. He reviewed the events leading to the ProhibitedDangerous Animal declaration. He stated that Fritzy was involved in a bite incident on June 27,2017, which resulted in him being declared a Dangerous Animal. He stated that the ownersindicated that they would pursue a Dangerous Animal license. He stated that the same animalwas involved in another incident on February 1, 2018. He stated that both Fritzy and Bailey, awhite dog also at the residence, escaped from their fenced yard and were each involved in biteincidents. Because of the prior declaration on Fritzy, ordinance required that Fritzy be declareda Prohibited Dangerous animal. This requires that the animal either be removed from the City oreuthanized.
Kimberly and Jeffrey Machmueller made an opening statement. She stated a request to allowher family to keep Fritzy in the City until their house is sold and they can move out of the City.She stated that the house would be going on the market in two weeks. She stated that she ismaking the request because the dog is a companion for her son who has ODD (oppositionaldefiant disorder) and she believes that it has a mental health benefit for him. She expressed thatFritzy is not a vicious dog. She acknowledged that she wasn’t a witness to the February 1 incidentbut stated that she had been on hand during the June 2017 incident, which she felt left Fritzytraumatized. She reiterated her request to keep Fritzy until the house was sold. Mr. Machmuellerindicated that he had also been present at the June 2017 incident and that the bite victim in thatcase had provoked Fritzy. He expressed that removing Fritzy from the house would bedetrimental to his step-son’s health. Mrs. Machmueller stated that she would present testimonialsfrom a number of relatives.
Community Service Aide Michael Gillson testified. He stated that he had responded to theFebruary 1 incident to support Community Service Aide Matthew McHugh. He stated that he hadinterviewed Andrea Detrie, 1142 Meadow Lane. She had told him that she had responded to thesound of dogs barking in front of her house. She stated that when she looked out of the frontwindow, she witnessed a dog biting a boy. Ms. Detrie told him that she had then been bitten butthe bite had not penetrated her boot. She had told him that the dogs had also reacted to a femalestudent who was walking home. He stated that there were two dogs, one brown and one white.

He stated that CSA McHugh had met with the female victim and that he had met with the malevictim, Seth Fishman. He confirmed that altogether, three people were bitten by the two dogs.CSA Gilson recounted Mr. Fishman’s statement. Mr. Fishman was walking home from highschool. When he approached the Meadow Lane intersection with Byrd Avenue, he noticed dogsbarking. One of the dogs approached and bit him. He then crossed to the west side of MeadowLane and continued to his home. CSA Gilson described Mr. Fishman’s injuries. Chief Wilkinsonshowed photos of Mr. Fishman’s injury to CSA Gilson. CSA Gilson confirmed that he had takenthe photos. The photos were entered into the record. CSA Gilson described each photo. Henoted that other photos were taken of the injuries to each of Mr. Fishman’s legs but that anequipment malfunction led to the loss of the photos of the more serious injuries on the right leg.The appellant viewed the photos. Using an aerial photo, CSA Gilson noted the locations of theMachmueller house, the Detrie house and Mr. Fishman’s walking route. He stated that onFebruary 2, he had followed up on checking the fencing arrangement at the Machmueller yard.He noted the area where the fence was breached as the probable location of the dog’s escape.Chief Wilkinson provided and CSA Gilson reviewed photos of the rear yard fences for theMachmueller and Detrie properties. The photos were entered into the record. CSA Gilson statedthat he was not involved in the dog license review for Fritzy. He stated that Fritzy was current onvaccinations on February 1 since the quarantine procedure for a vaccinated dog was followed.
Mr. and Mrs. Machmueller questioned CSA Gilson. CSA Gilson noted the fence section that wastipped over where he believes the dog’s escaped. He stated that he could not make a judgmenton whether or not the dogs were strong enough to tip the fence over. He stated that when he metFritzy on February 2, the dog was calm and that he was able to pet Fritzy.
Chief Wilkinson reviewed the fencing requirements for a dangerous animal. He stated that whenoutside, the animal is required to be in a double-walled fence.
Community Service Aide Ashley Burrows testified. She stated that she has been a CSA for 4years and has investigated dozens of dog bite incidents. She stated that she was involved in thisincident to take secondary photos of Mr. Fishman’s injuries because of problems in retrievingsome of the earlier photos. She stated that her follow up was several weeks after the bite incident.Chief Wilkinson showed photos of Mr. Fishman’s injury to CSA Burrows. CSA Burrows confirmedthat she had taken the photos. The photos were entered into the record. CSA Burrows describedeach photo. The appellant viewed the photos. CSA Burrows stated that she had been involvedin the 2017 bite incident involving Fritzy by delivering the dangerous animal letter to theMachmuellers. She described the process for delivering the dangerous animal letter. She statedthat she does not read the letter to the recipient since it is sealed. She stated that she instructsthe recipient to direct questions to Chief Wilkinson.
Seth Fishman testified. He stated that he was walking from the high school to his house onMelrose Court. Using the aerial photo, he described his typical walking route. He stated that theincident happened between 3 and 3:30 p.m. He stated that when he turned north onto MeadowLane from Byrd Avenue, he noticed a dog approach. He stated that the dog bit him on both legsat the northeast corner of the intersection. He stated that he then crossed to the west side ofMeadow Lane and continued home. He stated that this was his first encounter with the dogs.

He stated that both dogs approached him but that only the brown one bit him. Mr. Fishmanreviewed the photos previously entered into the record and confirmed the extent of his injuries.He described the treatment that he received for the injuries. He indicated that there are nolingering physical effects from the bite. He noted that he did not provoke the dogs. He stated thatthe brown dog snarled and growled right before the bite. He stated that the dogs did not followhim when he crossed the street. He did not see anyone else get bit that day.
The Machmuellers questioned Mr. Fishman. He stated that when he first saw the dogs, they werenear the Machmueller residence. The dogs then approached him.
The Committee questioned Mr. Fishman. He stated that he did not see anyone come out at thetime of the incident.
Andrea Detrie testified. She stated that she was in her living room at the time of the incident. Shestated that she heard dogs barking, looked out her window, saw two dogs run to the young manon the sidewalk, and saw the brown dog bite him at least twice. She stated that there was a noiseto the side of the house that distracted the dogs as the man crossed the street. She stated thatshe exited her house through the garage in order to tell her neighbor of the incident. She statedthat the brown dog bit the leather boot that she was wearing. She stated that the dog was growlingas it approached her. She noted that she was on her property when she was bit. As she tried toget the attention of someone at the Machmueller’s she warned a girl who was walking nearby onByrd Avenue. She stated that she was able to get Mr. Machmueller’s attention and he went tothe front door of the house and called the dogs. She state that the brown dog went in but that thewhite dog would not. She stated that she did not see the girl on the sidewalk get bit. She indicatedthat she has not had a prior threatening experience with the dogs. She stated that both dogs hadbeen harassing the girl.
The Machmuellers questioned Ms. Detrie. Mrs. Machmueller described prior history with dogsthat Ms. Detrie had owned. Ms. Detrie stated that the Machmueller’s dogs had been on herproperty before but had not approached her. She acknowledged that she had been screaming toget someone’s attention at the Machmueller house. She also acknowledged telling Mr.Machmueller that she was going to call the police.
Committee questioned Ms. Detrie. She stated that she had observed the dogs being unleashedwhen getting in and out of vehicles after the 2017 dangerous animal declaration.
Kimberly Machmueller stated that she did not have any witnesses to call.
Jacob Arneson, Mrs. Machmueller’s 12-year old son, read a statement. He described how Fritzyhelps to keep him calm when he is having stressful episodes. On questioning from Committee,he indicated that he had witnessed the bite incident in 2017. He described Fritzy’s demeanor asbeing calm and pleasant.
Joshua Arneson, Mrs. Machmueller’s 14-year old son, read a statement. He stated that neitherhe nor Jacob caused the breach in the fence. He stated the belief that the 2017 bite incident wasprovoked.

On questioning from Committee, he stated that this was the only time that the dogs escaped thefenced area. He stated that they use a leash to walk the dogs between the car and the house.He stated that since the 2017 incident they also use a muzzle on Fritzy.
Committee questioned the Machmuellers. City Attorney Godlewski reviewed the dangerousanimal letter with Mrs. Machmueller. She confirmed that they had not appealed the dangerousanimal declaration arising from the June 2017 bite.
Mr. Machmueller stated that they do not have the dangerous animal tag since they were awaitingcontact from the City regarding the documentation that they had provided. He confirmed that theyhad not purchased a 2018 dog license because they misunderstood the coverage period for thelicense. He reviewed the arrangements he took to get the required insurance. He described thevisit that he had with Seth Fishman’s mother after the incident. He stated that she was mainlyconcerned about the status of Fritzy’s shots.
Mrs. Machmueller stated that she wasn’t aware that a double-wall fence was required. She statedthat the insurance company had told them that their insurance would be dropped if they placed a“Dangerous Dog” sign in the front yard. She acknowledged that they hadn’t satisfied all of therequirements listed in the dangerous animal letter. Mrs. Machmueller described the measuresthat they take to leash Fritzy when moving him between the house and a vehicle.
Mr. Machmueller stated that he hadn’t come out of the house at the time of the incident becauseFritzy responded to his call and returned to the house. After Bailey did not come to the house hewent out to get her. He stated that he had not seen Bailey chase anyone before. He stated thatthe dogs had been out 5-10 minutes prior to the incident. He stated that after the dogs were inthe house, he checked the fence and made temporary repairs. He expressed the belief that thedogs could not have knocked down the section of fence where the breach was made. Hedescribed the general fence construction and the manner in which it abuts to Ms. Detrie’s fence.
Mrs. Machmueller reviewed the arrangements to place the house on the market. Chief Wilkinsonreviewed the process for notifying communities when a dog with a dangerous animal declarationis moved into another jurisdiction.
Mr. Machmueller stated that he had not been provided with a copy of the police report that wasprovided to the Committee. Committee discussed the process for providing information toappellants. Mr. Machmueller stated that he was unaware of Bailey’s involvement in a bite until aweek or two after the incident. He was not aware of the implications of the February bite incidenton his insurance.
Chief Wilkinson made a closing statement. He stated that he had intentionally avoided the June2017 bite incident in presenting his case since the dangerous animal declaration arising from thatcase was not appealed. He reviewed the ordinance requirements for a prohibited dangerousanimal declaration and noted that the requirements are satisfied in Fritzy’s case.

Mrs. Machmueller made a closing statement. She reviewed her history of homeownership atthis location. She noted that she had adopted Fritzy in 2015 as a rescue from a kennel inIndiana. She described the bond between her son Jacob and Fritzy and the comfort that Fritzyprovides to him. She expressed her concern with the impact that losing Fritzy would have onher son. She described public places where they have taken Fritzy without incident. Shestated that they have decided to sell their home so that they can keep Fritzy. She stated thather family is working to prepare the house for sale. She requested that Fritzy be allowed tostay with them until they can move. She stated that Fritzy would be on a leash and muzzledat all times when out. She expressed a willingness to submit to random checks to make surethat the conditions for keeping Fritzy are being satisfied. She presented the Committee withphotos of Fritzy and letters of support.
Motion/Second/Carried Stevenson/Hillstrom to convene into Closed Session in theCouncil Chambers, pursuant to Wis. Stat. §19.85(1)(a) for the purpose of conductingdeliberations regarding the Prohibited Dangerous Dog Designation Appeal by KimberlyMachmueller, 973 Byrd Avenue. All voting aye.
Motion/Second/Carried Lendrum/Stevenson to reconvene into Open Session toannounce result of deliberations on appeal of Prohibited Dangerous Dog DesignationAppeal by Kimberly Machmueller, 973 Byrd Avenue. All voting aye.
Upon reconvening, City Attorney Godlewski reviewed the Committee’s ruling. He stated thatthe Committee on a vote of 5-0 upheld the Prohibited Dangerous Animal declaration for Fritzy.He stated that the Machmueller’s would have until April 30, 2018, to comply with therequirements of the declaration. While Fritzy is in Neenah, the following conditions apply:
• Fritzy must be indoors at all times except when being let out to relieve himself or whenbeing transported;
• When Fritzy is outside he must be cage muzzled and restrained by a leash no longerthan six feet in length and controlled by an adult;
• Appellants are to inform Chief Wilkinson of where they will be moving.• Appellants accept spot checks to insure compliance with these conditions.
City Attorney Godlweski informed the Machmuellers that he would prepare the formal Findingsof Fact and Conclusions of Law document for their signature.

Re: Drone Replacement

The purpose of this memo is to respectfully request authorization to replacethe City of Neenah’s drone.
In 2017, two of our drone pilots were flying the drone at the request ofCommunity Development. The project included a flyover of our Downtownarea. The pilots stood on E Wisconsin Avenue and flew the drone west onWisconsin Avenue, toward Church Street. There were power lines at theintersection of W Wisconsin Avenue and Church Street within a few feet ofthe altitude chosen for the flight. These power lines were not visible fromwhere the pilots stood. One of the pilots is responsible for monitoring thevideo feed from the drone and when he saw the power lines, it was too latefor the pilot to react.
The damage to the drone was too much to repair and while the insurancecoverage includes liability, the property damage coverage has a $5,000deductible. The drone and the equipment damaged was worth $2,600.
Since this incident occurred, the pilots have discussed modifications to theirprocedures to increase the likelihood of avoiding a crash like this again.
We have obtained a new quote to replace the drone and the costs ofreplacement are as follows:
• DJI Inspire 1 – Minus Remote: $1,670.00• DJI Zenmuse Z3 7x Zoom Drone Camera: $881.02• Total: $2551.02
Recommendation: An appropriate motion would be to authorize thepurchase of a replacement drone for a total of $2551.02 using the City’sPerparedness Grand funds.

The body cameras have proven their usefulness time and again by granting usthe ability to pull up a video recording in response to citizen complaints, andas a training tool. As part of this contract, we have requested the addition ofSignal Units for the nine patrol squads. These units transmit a signal whenemergency lights are running that will activate all of the body cameras withinrange. Our goal with this is to minimize the important incidents that are notrecorded.
Through this contract, our equipment would be replaced three times in fiveyears. We would get new equipment the first year (2018), then replacementequipment two and a half years into the contract and once more on the fifthyear.

RE: Assessable Frontage Review – Eaglecrest Estates Plat 1585 and 1589 Remington Road
This memo is a follow-up to discussion at the meeting on March 13, 2018, where the Committee reviewed an adjustment for special assessment billing for 1589 Remington Road. As was noted, the owner of that property addressed the Council at the public hearing for the Nature Trails street construction project regarding the assessable frontage for his lot. Mayor Kaufert noted that he had received a similar request from a different property owner who has a large portion of wetlands on his property. Committee directed staff to review the plat to see if there are any other similar situations. Staff has done that and there are only these two - 1585 and 1589 Remington Road. In both cases, delineated wetlands impact the full use of the property. In the absence of options for mitigation or changes to wetlands development regulations, development of these areas is very unlikely. There is no specific ordinance provision that requires that wetlands be considered in determining assessable frontage for street improvements. However, it becomes difficult to consider this parcel in its entirety as benefitting from the public improvement. Because of that, I am requesting that Committee consider altering the typical assessment charge for this lot. 1585 Remington Road - This is Lot 2 of CSM 7158. This lot has an assessable frontage of 183.17 feet on Remington Road. The northerly half of the lot is delineated wetlands. 1589 Remington Road – This is Lot 3 in CSM 7158. Under standard practice this is considered a corner lot with a short-side frontage on Nature Trail Drive and a long-side frontage on Remington Road. The short-side frontage is 135.11 feet. The long-side assessable frontage, incorporating the corner lot adjustment in 13-5(i)(1)c of the municipal code, is 210.56 feet. Wetlands have been delineated over the southerly two-thirds of the lot. Staff suggests assessing these lots based on the calculation dictated by ordinance but charging the homeowners an amount in line with a typical lot. In the case of 1585 Remington, the charge would be based on 100 feet of frontage. In the case of 1589 Remington, the charge would be based on a corner lot with a long side of 135.11 feet on Nature Trail Drive and a short side of 110 feet on Remington Road for a total assessable frontage of 155.04 feet. In each case, the difference between the total calculated special assessment and the amount billed to the property owner would be held as a deferred assessment against the property should the

RE: Public Works General Activity
1) Contract 8-17 (Commerce Court Pond) – Pipe installation is complete. The contractor
has started to work on expanding the detention pond. Excavated soil is being placed on the south slope of Bell Street.
2) Contract 1-18 (Andrew, Richard, Geiger, Whiting) – We Energies started gas relocation work on March 19. The contractor has mobilized and started work on March 22.
3) Contract 2-18 (Cecil, Adams) – A pre-construction meeting was held on March 9. The contractor intends to start work on Adams Street after utility work on Contract 1-18 is complete.
4) Contract 3-18 (Nature Trails/Eaglecrest) – An informational meeting with Eaglecrest residents was held on March 12. The project was advertised for bid on March 21. The bid opening is scheduled for April 4.
5) City Hall Boilers – Three proposals have been received. Building Manager Fischer is reviewing the scope with the low cost proposer before a request is brought to Council.
6) Bergstrom Road Street Lighting - Street lights have been installed and are being wired.
7) Winnebago County Clean Sweep – On line appointments are being accepted for the clean sweep event to be hosted in Neenah on June 9. The web address is www.WinnebagoCountyCleanSweep.com. The link is listed on the city website.
