employee took a leave of absence. A new person was assigned to her position. When she returned, she assigned to a new position which involved a transfer to another gym. She complained this was not an equivalent position. She was subsequently terminated. She is suing FOL in NY federal court claiming it violated the federal Age Discrimination in Employment Act (“ADEA”) and that she was terminated in retaliation. FOL claims her position was equivalent and that she was terminated because of poor performance.Please prepare a memo on ADEA claims and what FOL will need to show to prove it did not violate the ADEA.
