Study of Non-Public Referrals & Services In accordance with Minnesota statute, Hopkins Public Schools is required to provide services to non public schools within our boundaries in five areas: Guidance and Counseling, Health, Textbooks and tests, Title I, and Special Education. This report describes each of the five categories of services. Located within the boundaries of Hopkins Public Schools are seven non-public education programs. They include: Breck, Blake, International School of Minnesota (ISM), Minnetonka Christian Academy (MCA), St. Johns, Good Shepherd, and Immaculate Heart of Mary (IHM). Each school has the option of using the services provided under statute. Guidance and Counseling The purpose of the Guidance and Counseling program is to monitor student progress and guide them in the areas of career and post-secondary planning, financial aid information, interest inventories and guiding students through the assessments needed for college admission. Funding for non-publics is derived using a per-student formula. For the 2011-12 school year, the entitlement is $203.65 per student and there are 1,061 students enrolled in grades 7-12 in non-public schools. Thus, the total budget for Guidance and Counseling is $216,072.65. This amount is divided among the schools based on their individual student count. $115,754 is spent on salaries and benefits to provide Guidance and Counseling services and $100,319 is spent on materials and supplies. Since the funding is specific for non-publics, if any of the allotment is not used, it does not remain with Hopkins Public Schools, but instead is retained at the state level. This chart shows a breakdown of the funding allotment for each of the non-public schools accessing counseling and guidance services.

Title I Services The purpose of Title I services in the non-public schools is the same as that of all our schools: to ensure all children have a fair and equal opportunity to reach proficiency on established academic achievement standards. The difference in a non-public school is that the achievement standards may be set by the individual school rather than by the state or federal department of education. If we provide these services in the public schools, we are mandated to do so in the non-publics, however, the non-public school can choose to decline these services. Students who participate in all Title I programs are selected on the basis of academic need and this remains true for the non-public schools. Funding for Title I services follows the same formula as that for the public program. It is based on the number of students who receive Free/Reduced lunch within the boundaries of Hopkins Public Schools. The 2011-12 funding for Title I services is $475 per pupil after the Title I “set-aside” was calculated. While we have 7 non-public schools within our boundaries, three of these schools have no Free/Reduced lunch students in attendance. Two schools decline services even though there are 2-3 students who would make them eligible for funding. Minnetonka Christian Academy and St. Johns have students who generate funding, however, MCA does not have

any students who have an academic need for services. Therefore, only St. John’s has students (8) being served under Title I funding for the 2011-12 school year. The Title I program is managed and implemented by Hopkins. Each year we consult with the non-public schools to come to agreement about what the program design will look like. Hopkins hires and supervises the Title I teacher and manages all aspects of the program including curriculum used. Right now the Title I program at St. Johns is very small with students receiving one hour of extra instruction per week. Were the number of students generating money to increase, the amount of instruction should also increase for qualifying students. Consultation with leadership at St. Johns and our Title I coordinator in Hopkins reveals that direct teacher instruction is the ideal model if there are enough dollars to hire a teacher to provide consistent instruction. Text Books Minnesota Statute 123B.42 directs that a school district that provides curriculum to resident students must purchase, acquire or loan instructional or cooperative learning materials and standardized tests on behalf of students in non-public schools. In the case of a home-schooled student this includes both physical and electronic materials. These materials must remain within the school district boundaries and may be kept in the non-public school site. The cost for these materials must not exceed the statewide average expenditure per pupil. The allotment is $81.40 per student for the 2011-12 school year. With 2676.5 students, the total budget will not exceed $217,867.10. Health Services The mandate of a school nurse is to assure student health and a safe environment so that all students are able to benefit from the educational efforts of the school. Minnesota Statute 123B.44 Subd. 4 addresses the requirement to provide health services to non-public schools. The allotment of funds is not to exceed the average expenditure per public school student for the same services. The

Department of Education provides a formula for this allotment and for the 2011-12 school year, the amount is $58.29 per student enrolled as of September 15 of the current school year. This results in a total Health Services budget of $159,744 to be distributed among the 7 non-public schools located within the boundaries of Hopkins School District. Hopkins Public Schools provides one full time licensed school nurse to consult and provide direct nursing services in the non-public schools. Screening and assessment programs were conducted following guidelines established by the Minnesota Department of Health. Screenings are accomplished using a combination of non-public nurse, parent volunteers, and health paraprofessionals. A total of 1886 students were screened for hearing and vision and 38 referrals were made for parent follow-up. The chart below summarizes the majority of the services provided and the relative use of those services by the non-public programs.

125A.18. “No resident of a district who is eligible for special instruction and services … may be denied instruction and service … because of attending a non-public school…” Funding for Special Education services provided in non-public schools is required to be proportionate to that provided for students with disabilities in the public schools. During the 2010-11 school year, the special education department experienced an audit of its special education finance practices and we were found to be in compliance in this area. It should be noted that the school district must assure that the student is able to access these services and so transportation must be provided if the services are to occur in a public school site. Below is a chart detailing the services being provided by Hopkins Special Education staff to students in non-public schools.

These services are dictated by the IEP team, which includes a parent, the student’s teacher, a representative of the public school

district and the service provider(s). The team is charged with the responsibility to design an educational plan that assures adequate educational progress for the student. Many districts in our area choose to provide transportation back to a public school site for services. Hopkins Public Schools has determined that this model would be unnecessarily expensive since we service so many schools and in such a variety of areas. A recent survey of the districts located in the West Metro area reveals that of 15 districts responding, 30% provide all services within the non-public (as does Hopkins), 20% provide services in a combination and 50% provide services only in the public setting. Summary The services provided to the non-public schools by Hopkins Public Schools is reported to be appropriate, effective and efficient by the providers, non-public administrators and parents. Our counselor, Title 1, and nurse provider are excellent representatives of the district and do not recommend any changes in service model. In the area of special education, there is no recommendation to change the location of services, however, the staffing model will continue to be reviewed to assure equity in service provision as well as workload for the individuals providing the specific services.

123B.44 PROVISION OF PUPIL SUPPORT SERVICES.

Subdivision 1. Provided services. The commissioner of education shall promulgate rulesunder the provisions of chapter 14 requiring each district or other intermediary service area: (a) toprovide each year upon formal request by a specific date by or on behalf of a nonpublic schoolpupil enrolled in a nonpublic school located in that district or area, the same specific healthservices as are provided for public school pupils by the district where the nonpublic school islocated; and (b) to provide each year upon formal request by a specific date by or on behalf of anonpublic school secondary pupil enrolled in a nonpublic school located in that district or area,the same specific guidance and counseling services as are provided for public school secondarypupils by the district where the nonpublic school is located. The district where the nonpublicschool is located must provide the necessary transportation within the district boundaries betweenthe nonpublic school and a public school or neutral site for nonpublic school pupils who areprovided pupil support services under this section if the district elects to provide pupil supportservices at a site other than the nonpublic school. Each request for pupil support services mustset forth the guidance and counseling or health services requested by or on behalf of all eligiblenonpublic school pupils enrolled in a given nonpublic school. No district or intermediary servicearea must not expend an amount for these pupil support services which exceeds the amountallotted to it under this section.

Subd. 2. Location of services. Health and guidance and counseling services may beprovided to nonpublic school pupils under this section at a public school, a neutral site, thenonpublic school or any other suitable location. District or intermediary service area personneland representatives of the nonpublic school pupils receiving pupil support services must hold anannual consultation regarding the type of services, provider of services, and the location of theprovision of these services. The district board or intermediary service area governing board mustmake the final decision on the location of the provision of these services.

Subd. 3. Guidance and counseling; exclusions. Guidance and counseling services providedto nonpublic school pupils pursuant to this section shall not include the planning or selection ofparticular courses or classroom activities of the nonpublic school.

Subd. 4. Health services; allotment. Each school year the commissioner shall allot to theschool districts or other intermediary service areas for the provision of health services pursuant tothis section the actual cost of the services provided for the pupils in each respective nonpublicschool for that school year. The allotment must not exceed the average expenditure per publicschool pupil for these services by those Minnesota public elementary and secondary schoolswhich provide health services to public school pupils, multiplied by the number of pupils inthat particular nonpublic school who request these health services and who are enrolled as ofSeptember 15 of the current school year.

Subd. 5. Guidance and counseling services; allotment. Each school year the commissionershall allot to the school districts or intermediary service areas for the provision of guidanceand counseling services pursuant to this section the actual cost of the services provided for thepupils in each respective nonpublic school for that school year. The allotment for guidance andcounseling services for the secondary pupils in each nonpublic school must not exceed theaverage expenditure per public school secondary pupil for these services by those Minnesotapublic schools which provide these services to their secondary pupils, multiplied by the numberof secondary pupils in that particular nonpublic school who request these services and who areenrolled as of September 15 of the current school year.

Subd. 6. Computation of maximum allotments. For purposes of computing maximumallotments for each school year pursuant to this section, the average public school expenditureper pupil for health services and the average public school expenditure per secondary pupilfor guidance and counseling services shall be computed and established by the department byFebruary 1 of the preceding school year from the most recent public school year data thenavailable.

2011 Minnesota Statutes123B.42 TEXTBOOKS; INDIVIDUAL INSTRUCTION OR COOPERATIVE LEARNINGMATERIAL; STANDARD TESTS.

Subdivision 1. Providing education materials and tests. The commissioner of educationshall promulgate rules under the provisions of chapter 14 requiring that in each school year,based upon formal requests by or on behalf of nonpublic school pupils in a nonpublic school, thelocal districts or intermediary service areas must purchase or otherwise acquire textbooks,individualized instructional or cooperative learning materials, and standardized tests and loan orprovide them for use by children enrolled in that nonpublic school. These textbooks,individualized instructional or cooperative learning materials, and standardized tests must beloaned or provided free to the children for the school year for which requested. The loan orprovision of the textbooks, individualized instructional or cooperative learning materials, andstandardized tests shall be subject to rules prescribed by the commissioner of education.

Subd. 1a. Curriculum; electronic components. A school district that provides curriculum toresident students that has both physical and electronic components must make the electroniccomponent accessible to a resident student in a home school in compliance with sections120A.22 and 120A.24 at the request of the student or the student's parent or guardian, providedthat the district does not incur more than an incidental cost as a result of providing accesselectronically.

Subd. 2. Title to education materials and tests. The title to textbooks, individualizedinstructional or cooperative learning materials, and standardized testing materials must remain inthe servicing school district or intermediary service area, and possession or custody may begranted or charged to administrators of the nonpublic school attended by the nonpublic schoolpupil or pupils to whom the textbooks, individualized instructional or cooperative learningmaterials, or standardized tests are loaned or provided.

Subd. 3. Cost; limitation. (a) The cost per pupil of the textbooks, individualizedinstructional or cooperative learning materials, and standardized tests provided for in this sectionfor each school year must not exceed the statewide average expenditure per pupil, adjustedpursuant to clause (b), by the Minnesota public elementary and secondary schools for textbooks,individualized instructional materials and standardized tests as computed and established by thedepartment by February 1 of the preceding school year from the most recent public school yeardata then available.

(b) The cost computed in clause (a) shall be increased by an inflation adjustment equal to thepercent of increase in the formula allowance, pursuant to section 126C.10, subdivision 2, fromthe second preceding school year to the current school year.

(c) The commissioner shall allot to the districts or intermediary service areas the total costfor each school year of providing or loaning the textbooks, individualized instructional orcooperative learning materials, and standardized tests for the pupils in each nonpublic school.The allotment shall not exceed the product of the statewide average expenditure per pupil,according to clause (a), adjusted pursuant to clause (b), multiplied by the number of nonpublic

No resident of a district who is eligible for special instruction and services under this sectionmay be denied instruction and service on a shared time basis consistent with section 126C.19,subdivision 4, because of attending a nonpublic school defined in section 123B.41, subdivision 9.If a resident pupil with a disability attends a nonpublic school located within the district ofresidence, the district must provide necessary transportation for that pupil within the districtbetween the nonpublic school and the educational facility where special instruction and servicesare provided on a shared time basis. If a resident pupil with a disability attends a nonpublicschool located in another district and if no agreement exists under section 126C.19, subdivision 1or 2, for providing special instruction and services on a shared time basis to that pupil by thedistrict of attendance and where the special instruction and services are provided within thedistrict of residence, the district of residence must provide necessary transportation for that pupilbetween the boundary of the district of residence and the educational facility. The district ofresidence may provide necessary transportation for that pupil between its boundary and thenonpublic school attended, but the nonpublic school must pay the cost of transportation providedoutside the district boundary.

Parties serving students on a shared time basis have access to the due process hearing systemdescribed under United States Code, title 20, and the complaint system under Code of FederalRegulations, title 34, section 300.660-662. In the event it is determined under these systems thatthe nonpublic school or staff impeded the public school district's provision of a free appropriateeducation, the commissioner may withhold public funds available to the nonpublic schoolproportionally applicable to that student under section 123B.42.
