Activity undertaken by the Department of Industry

The Region of Sardinia promoted and coordinated the set up and implementation of OSSes.

There 53 OSSes in Sardinia (10 run by single municipalities and 43 run by small associations of

municipalities), 348 Municipalities were involved.

On the website of the Sardinia Region there is a section dedicated to the OSS with a link to the

thematic website (www.sardegnasuap.it).

The forms of the proceedings have been standardised.

A knowledge-management information platform with a discussion forum for the staff of OSSe and

third bodies has been developed.

A software enables the entrepreneur to entry the application (within the platform of Comunas) on-

line and to check via internet the progress of the proceeding.

Activities undertaken by the Department of Industry

In 2005 it was made an agreement with the Administrations involved in the issuance of the

authorizations for the applications submitted to the OSS.

Municipalities were provided with a qualified technical assistance when the regional network of

OSSes was being created.

Personnel responsible for OSSes was trained by the regional agency SardegnaIT to the use of

the software which enables the entry of the application by Internet.

Activities undertaken by the Regional Department for Industry

The whole legislation in force (laws, regulations, regional laws, acts, etc.) regarding the OSS has

been collected, in a coordinated way, into an operational manual for the Industry sector.

The Single Text containing the regional laws in matter of Tourism and Handicraft have been

updated and a coordinated Text for Trade (with regional and national legislation) was prepared.

With the Financial Law n.3/ 2008 (art. 1) it was approved a simplification rule regarding the OSS

which completely changed the procedures for the authorizations of the enterprise activities start-

up issued the Public Administration.

With the decision 22/1 of 11.04.2008 it was approved the act for the application of the rule

approved through the Financial Law.

Radical shift of the authorizations procedures to start a business

An important shift was made thanks to the planning and programming activity of the territory and

sector undertaken in 2004 which set:

clear and definite rules

protection of the public interest

certainty for the productive sector

New relations between Public Administration and Enterprises with a strong sense of

accountability of both parts within a context of collaboration and trust.

The OSS (SUAP) is responsible for all the administrative proceedings related to the economic

activities for the production of goods and services.

The would-be entrepreneur doesn’t have to wait for the authorization of the Public Administration.

PA and enterprises are now more aware and responsible for dealing with this issues (it is

foreseen a compensation for the enterprise).

The OSS (SUAP) is the only interlocutor of the entrepreneur in the all phases of business, the

applications submitted to the other Administrations will not be accepted whether they are under

the competence of the OSS.

To access to the services delivered by the OSS the would-be entrepreneur has to submit a self-

certification.

The self-certification allows the entrepreneur to start the business or the construction: so that it is

not important for the entrepreneur the time needed for the administrative proceeding, because of

the submission of the self-declaration enables him/her to start the activity after 20 days.

In case of construction, the professionals who have prepared the statement (self-certification) are

responsible for that – within 20 days it is possible to immediately start the business.

The documentation related to the new business activity will be submitted by the OSS, in 2 days, to

the other Public Administrations involved in the proceeding (by Internet), further integrations can be

required by 7 days and by 15 days it is possible to call for a meeting to have some clarifications

concerning the technical normative and the characteristics of the installation (the call for the

meeting doesn’t entail an interruption of the business activities already started).

In case of a discretional assessment by the Public Administration relating to specific aspects, as

stated in art. 1, point 24 of the Regional Law n. 3/2008 (in compliance with the landscape,

historical-artistic, archaeological and hydrologic requirements, environmental audits, installations to

be checked with regard to the danger of relevant accidents or the norms related to the prevention

and reduction of pollution), a meeting (Conference of Services) is convened by 7 days, and it takes

place by 15 days (except in the case further documents are required), in case the authorities do

not send their opinions within the deadline, they are considered as positively expressed.

The Conference ends with the approval of the final act of the proceeding as a result of the prevalent

positions expressed.

The final act substitutes, to all intents, any authorizations, permits or other acts of the

Administration participating in the Conference

The communication of the conclusions of works sent by the entrepreneur closes the proceeding.

The Communication includes a certification of the person responsible for the construction who

states the conformity of the project and its fitness for use.

Where it is necessary, a test is made by a professional or by an authorized technician.

The certification of the test allows the start-up of the installation.

In the case, the P.A. has not made the control by 60 days from the communication of the

conclusion of works and it is necessary to stop the business because some irregularities were

found, the entrepreneur has the right to obtain a compensation.
