Jordan's offices in Portland, Maine, and we are prepared to make them available to you. E.G. Jordan has prepared a table of the data in their files, a copy of which is enclosed. It is my present understanding that the files include "Validation Reports" for all the data in the table, exceot Group 7 (which are contained in a report from Sanford Ecological Services) and certain data reports which are still to be sent from NUS. The latter should arrive at E.G. Jordan by the first of next week. E.G. Jordan also has "Data Packages" for all samples except the following: the Group 1 samples with the "case number" 4515; the Group 2 samples from the Army's Water Quality Lab: the Group 3 metals samples with the Case Number 5131 from Versar, Inc.; a portion of "ETR 9102" from Group 4 which is also still to be delivered from NUS; the Group 5 samples from Battelle and £31? and the Group 6 and Group 7 samples. I believe that the Army Water Quality Laboratory's documents have already been produced. The Battelle and £3! data packages which have not yet been produced will be made available in the same manner as E.G. Jordan. The other data packages will be made available as soon as possible. We have completed our review of the documents relating to NewBedford Harbor sampling at E.G. Jordan's offices in Portland,Maine, and we are prepared to make them available to you. E.G.Jordan has prepared a table of the data in their files, a copyof which is enclosed. It is my present understanding that thefiles include "Validation Reports" for all the data in the table,exceot Group 7 (which are contained in a report from SanfordEcological Services) and certain data reports which are still to besent from NUS. The latter should arrive at E.G. Jordan by the firstof next week. E.G. Jordan also has "Data Packages" for all samplesexcept the following: the Group 1 samples with the "case number"4515; the Group 2 samples from the Army's Water Quality Lab: theGroup 3 metals samples with the Case Number 5131 from Versar,Inc.; a portion of "ETR 9102" from Group 4 which is also still tobe delivered from NUS; the Group 5 samples from Battelle and £31?and the Group 6 and Group 7 samples. I believe that the ArmyWater Quality Laboratory's documents have already been produced.The Battelle and £3! data packages which have not yet been producedwill be made available in the same manner as E.G. In order to expedite our response to your request, we will alsomake available at E.G. Jordan certain non-privileged documentsfrom Region I's files which we have been able to identify as coveredby your request, which have not been, or may not have been, alreadyproduced. These include:

There are other materials still being assembled by the variousparticipants in the RI/FS. I hope to produce some additionalmaterials either when you go to B.C. Jordan, or subsequently atRegion I's offices in Boston, or both. At the moment, we arecollecting additional documents from the Corps of Engineers'Waterways Experiment Station and EPA's Narragansett Laboratory.You should be aware that much of the information relative to analysesat these laboratories is stored on computer. We will identify whatinformation is now available in bard copy documents; if you wish toobtain information stored on computer tapes, we will ask that youpay for copying the tapes or printing out the data, following thestandard policy set forth by EPA in 40 C.F.R. § 2.120.

I wish to emphasize that although we are making these documentsavailable at this time, EPA has not completed its RI/FS, andproduction of these documents should not be taken to imply a finaldetermination on any issue being investigated. These documentswill thus constitute portions of EPA's administrative records, butit should be clear that the record cannot be considered comoleteuntil the studies themselves and the remedy selection process arecomplete. EPA may, in the course of the RI/FS, conduct additionalanalyses and additional review or interpretation of these analysedescribed in the documents now being produced.
