THE REPEALING AND AMENDINGACT, 2015

AN

ACT

to repeal certain enactments and to amendcertain other enactments.

Be it enacted by Parliament in the Sixty--sixth Year of the Republic of India asfollows:—

1. Short title. — This Act may be called theRepealing and Amending Act, 2015.

2. Repeal of certain enactments.— Theenactments specified in the First Schedule

are hereby repealed to the extent mentionedin the fourth column thereof.

3. Amendment of certain enactments.— Theenactments specified in the Second Scheduleare hereby amended to the extent and themanner mentioned in the fourth columnthereof.

4. Savings.—The repeal by this Act of anyenactment shall not affect any Act in whichsuch enactment has been applied,incorporated or referred to;

and this Act shall not affect the validity,invalidity, effect or consequences of anythingalready done or suffered, or any right, title,obligation or liability already acquired, accruedor incurred, or any remedy or proceeding inrespect thereof, or any release or discharge ofor from any debt, penalty, obligation, liability,claim or demand, or any indemnity alreadygranted, or the proof of any past act or thing;

nor shall this Act affect any principle orrule of law, or established jurisdiction, formor course of pleading, practice or procedure,or existing usage, custom, privilege, restric-tion, exemption, office or appointment,notwithstanding that the same respectivelymay have been in any manner affirmed,recognised or derived by, in or from anyenactment hereby repealed;

nor shall the repeal by this Act of anyenactment provide or restore any jurisdiction,office, custom, liability, right, title, privilege,restriction, exemption, usage, practice,procedure or other matter or thing not nowexisting or in force.

Grant of Financial Assistance forPerformance of Funeral and Religious

Ceremonies related to last rites of aperson of SC Community under

“ANTYA SANSKAR SAHAY YOJANA”

1. Objective.— It is proposed to grantFinancial Assistance for conducting funeralsand religious ceremonies related to last ritesof the deceased SC families to have funeral indecent manner. Every person feels he/sheshould not be abandoned and neglected afterhis/her death and desires to have a decent lastrite. Hence it is proposed to Grant of FinancialAssistance for Performance of Funeral andReligious Ceremonies of SC families under“ANTYA SANSKAR SAHAY YOJANA”.

2. Details of the scheme.— The SC familieswhose income is less than Rs. 2.00 lakhs canavail the benefit of the scheme. Rs. 20,000/-will be sanctioned as Grant of FinancialAssistance for Performance of Funeral andReligious Ceremonies of SC families.

3. Eligibility condition.— The followingdocuments should be enclosed to claim thebenefits under the scheme:—

(a) Caste Certificate issued by CompetentAuthority.

(b) Income Certificate.

(c) Death Certificate of the deceased.

(d) Receipt of bills/Proof of expenditure.

The claim may be made within 6 months fromthe occurrence of death in the family by thenext kin.

4. Target.— The target group under thescheme is SC family in whose families deathhas occurred and whose income does notexceed Rs. 2.00 lakhs per annum. They shouldbe resident of Goa State for the last 15 years.They are not covered under any other schemeof Government.

5. Identification.— The Directorate of SocialWelfare on receipt of the applications forfinancial assistance and after verifying allthe bills and receipt will reimburse onlythose items which are admissible. Theapplications received under the schemewill be released under first come first termbasis.

6. Release of Financial Assistance.— Releaseof Financial Assistance will be released tonext of the kin of the deceased. The upper limitof finance assistance under the scheme isRs. 20,000/- or actual cost whichever is less.The financial assistance will include last riteof death and required to be performed on the12th day of death or 30th day etc. dependingon the religion and individual houses and holyplaces situated in Goa only. The SC familyshould restrict themselves only for those riteswhich are essential.

7. Monitoring of the scheme.— If there isany doubt in the matter of eligibility orfor operationalization of the scheme or ifany situation arises which is not envisagedat the time of formulation of the scheme,the same would be resolved by theMonitoring Committee whose decision willbe final.

Financial Assistance for Construction ofNew Houses and Repairs“ATAL ASRA YOJANA”

1. Introduction.— Housing is one of the basicrequirements of human survival. For a shelterless person, own house provides significanteconomic and social security and status in thesociety. Cost of housing has gone very high inthe State of Goa. There are many SC families

who do not have Pucca House and many othersdo not have their own house. There are twohousing schemes at present implementednamely Indira Awas Yojana (IAY) and RajivAwas Yojana (RAY). While Indira Awas Yojanais for BPL families, the Rajiv Awas Yojana is forpoor families with annual income upto Rs.1.5lakhs. The amount sanctioned under theschemes is inadequate to construct the houseand supplementary finance from Banks comesat very high rates. Therefore there is a need toextend further financial assistance over andabove the assistance provided under the RajivAwas Yojana or Indira Awas Yojana.

2. Objective.— The objective of the scheme“Atal Asra Yojana” is to provide supplementaryfinancial assistance for construction andrepairs of houses to SCs which is in additionto the amount sanctioned under Rajiv AwasYojana so that cost of borrowing is reducedfor construction of houses by the poor SCfamilies.

3. Eligibility criteria.— The SC families whohave been sanctioned benefit/eligible forbenefit under the scheme of Rajiv Awas Yojana

or Indira Awas Yojana will be entitled for thebalance additional financial assistance subjectto the limit of maximum financial assistanceprescribed under this scheme.

4. Benefit under the scheme.— FinancialAssistance for construction of new house isup to Rs. 2.50 lakhs and for repairs of existinghouse is up to Rs. 1,00,000/- including financialassistance under IAY or RAY as the case maybe.

5. Priority in selection of beneficiaries.— Thepriority for selection of beneficiary targetgroup is as below:—

(1) BPL SC families will be considered onfirst priority.

(2) SC house hold headed by widow orunmarried women.

(3) Physically disabled person.

(4) SC household affected by flood, fireand other natural calamities.

(5) Forest Dwelling SC Community.

6. Conditions of sanction.— (a) Constructionof the house in accordance with the BuildingPlans and construction Bye Laws as applicablein the area.

(b) Sanitary requirements shall be observedfor the house constructed.

7. Application & Procedure for sanctioningamount.— Prescribed Application along withthe required documents be submitted to thecompetent authority as prescribed underIndira Awas Yojana (Project Director of RDA)or Rajiv Awas Yojana (Director of Panchayatsin Rural area and the Director of Social Welfarein Urban areas). In addition to the documentsrequired under the scheme, the Applicationshould also be supported with the detailedestimate of the construction or of the repairsof the existing house in respect of whichfinancial assistance is sought.

Once the sanction order is issued to the SCfamily on the basis of such sanction order, thesupplementary amount as assessed by thesanctioning authority under the scheme IAYor RAY as the case may be, the Directorate ofSocial Welfare will release amount to suchsanctioning authority, which in turn willrelease the entire amount of IAY/RAY includingthe component of the Social WelfareDepartment.

8. Monitoring of the scheme.— Monitoring ofthe scheme: for issues relating to the eligibility,operationalization, or issues on account of newsituation, not envisaged at the time offormulation of the scheme, would be resolvedby the Monitoring Committee, whose decisionwill be final.

The Committee is consisting of:–

1. Secretary, Social Welfare : Chairman

2. Joint Secretary, Finance : Member3. Project Director, RDA : Member4. Director of Panchayats : Member

5. Director of Social Welfare : Member.

9. Reports.— Reports in the prescribedproforma should be submitted to theGovernment in respect of the “Atal AsraYojana”.

(i) A monthly progress report to be furnishedby 10th of every succeeding month by thesanctioning authority to the Director of SocialWelfare.

(ii) A detailed Annual Progress Report to besubmitted by 25th April of the succeeding yearby the Director of Social Welfare to theGovernment.

10. Evaluation of the scheme.— Scheme willbe implemented for five years. Performance ofthe scheme will be evaluated after two yearsof its implementation and if required schemewill be suitably modified to meet the newchallenges/requirements so as to achieve theset objective.

1. Introduction.— (a) SC Community studentsin Goa mainly hails from remote forested areasand the place of education is far away fromtheir home. Many students therefore stay inrented houses or stay as paying guest whilethey have to complete their education fromschools/colleges and few others get hostelaccommodation in the educational institutions.Many students cannot afford to pay high rentalcharges or paying guest accommodationcharges which result in the drop out from thecourses. The others who travel long distanceswaste their valuable study time and that affecttheir educational performance.

(b) Thus whether a student is a day scholaror Hosteller he need to spend expenses on foodand refreshment and/or paying guestaccommodation. The day scholar commutinglong distances is also need to spend expenseson travel. These students therefore needadditional financial assistance to meet theseexpenses which are not sufficiently providedunder the Post Matric scheme.

(c) There are poor SC students withdisability who need additional allowance tocover the expenditure on Reader for blind,escort to severely handicap, attendant etc. The

financial assistance provided under the PostMatric scholarship is very much inadequate dueto high cost of living in the State of Goa.Financial assistance under this schemeis therefore given to SC students withdisability.

(d) The Post Matric Scholarship, a centrallysponsored scheme by which entire non--refundable course fee is given as a financialassistance to the student and monthlymaintenance allowance is given at the ratesdepending upon on the group of course of studyand whether the student is day scholar orhosteller. Maintenance allowance for the dayscholar ranges from Rs. 230/- to Rs. 550/- p.m.and in case of the Hostellers it ranges fromRs. 380/- p.m. to Rs. 1200/- p.m. Any SCstudent whose family income is less than 2lakhs and pursuing Post Matric course iscovered irrespective of percentage of Marksscored in the exam.

This scheme therefore provides for additionalfinancial assistance to the poor SC students tosupport educational expenses on paying guestaccommodation, food, travel etc.

2. Objective.— To provide additionalfinancial assistance to the SC students as themaintenance allowance given under the PostMatric Scholarship is inadequate to meet theexpenses on food and travel. It also aims toprovide additional allowance to cover theexpenses of SC students with disability as thedisability allowances given under the PostMatric Scholarship is not sufficient to meet theexpenses of disabled students.

3. Target population.— Students belongingto SC Community pursuing full time post--matriculation courses through recognizedinstitutions in India and have availed or eligiblefor benefit under the centrally sponsoredPost Matric Scholarship during the currentacademic year.

4. Eligibility criteria.— SC students musthave availed or eligible for centrally sponsoredPost Matric Scholarship during the currentacademic year.

5. Benefit under the scheme.— (a) Additionalmaintenance allowance of Rs. 750/- p.m. forDay Scholar and Rs. 1500/- p.m. for thosestaying in Hostel during the academic year(for ten months).

(b) Additional disability allowance ofRs. 750/- p.m. during the academic year(for a period of ten months) is given.

6. Condition for grant of assistance.—Conditions as prescribed from time to time,under the scheme of Post Matric Scholarshipsto the students belonging to SC Communityfor studies in India.

7. Mode of application.— Application in theprescribed Form for availing Post MatricScholarship along with necessary documentsis to be submitted to the Director of SocialWelfare, through the Head of the EducationalInstitution.

8. Sanctioning Authority.— Director of SocialWelfare will sanction the amount of benefitunder the scheme. Amount of benefit will be

transferred electronically to the Bank Accountof the student along with the amount of thecentrally sponsored Post Matric Scholarshipamount.

9. Monitoring of the scheme.— All issuesrelating to eligibility, operationalization of thescheme or situation not envisaged at the timeof formulation of the scheme, would be resolvedby the Monitoring Committee, whose decisionwill be final.

Scheme for Construction of MultipurposeCommunity Halls in Areas inhabited

by Social Community

“SANSKRITI BHAVAN”

1. Introduction.— The SC Community peopleare downtrodden section of the society mostlyresiding in forested areas or remote interiorvillages. These areas lack infrastructurefacilities like marriage hall, community hall forundertaking Socio Cultural activities or otherpublic activities at village level. SC Communityin need of marriage hall has to spend highamount on rental and transportation to thehalls at places far away from their village.

2. Objective.— The scheme aims to help theSC Community by providing the most neededinfrastructure of Multipurpose Community Hallsin Villages dominated/inhabited by SCCommunities. These Multipurpose CommunityHalls will serve as marriage hall, facilitationpoint for organizing awareness programmes,conducting trainings, seminars, holdingmeetings of Forest Right Committees and otherSocio Cultural events.

3. Target Areas.— Areas habited by the SCpopulation are classified under three classesof SC habitations for the purpose ofsanctioning Community Hall for the populationof the villages.

Class A: The SC areas in the village/ssituated within the Forest areas whereForest Right Act is implemented.

Class B: The SC areas in the village//Hamlet which has the habitation of SCpopulation for more than 40% of thepopulation in that village/Hamlet.

Class C: The areas in the villages habitedby SC population with density less than 40%of the population of the village.

4. Criteria for sanctioning MultipurposeCommunity Halls in SC Community areas.— Forevery 5 Community Halls sanctioned,—

* First 2 Community Halls will besanctioned in Class ‘A’ areas.

* Next 2 Community Halls will besanctioned in Class ‘B’ areas and

* Next 1 Community Hall will besanctioned in Class ‘C’ area.

5. Details of the scheme.— (1) SanskritiBhavan will be used as a MultipurposeCommunity Hall by the local population.

(2) It will have facility for—

(a) Special Anganwadi.(b) Reading room.(c) Recreation room.(d) Hall with a seating capacity of 200 to

300 people.

(3) The total cost of the project includingthe cost of land shall not exceed Rs. 50.00lakhs.

(4) The land free from all encumbrancesshould be made available by village communityor Village Panchayat or by NGOs or group ofpersons.

(5) Any land suitable for the purpose ofbuilding the infrastructure may be acquired bythe Government in the public interest as perthe provisions of the Land Acquisition Act.

(6) Land may also be transferred in favourof Government by Gif t Deed by privatepersons.

6. Application procedure.— (a) Applicationto the Social Welfare Department in prescribedForm may be made by Village Panchayat orgroup of SC’s or NGO working for thebetterment of SC’s in Village Panchayatarea. Application format is annexed asANNEXURE I.

(b) The following documents shall beattached with the application form:–

(i) Details of the land including copies ofownership documents.

(ii) NOC from owner of the land, if any.

(iii) Resolution of the Village Panchayat.

(iv) In case the request is made by a groupof SC’s, signatures of at least 100 personsbelonging to SC Community.

(c) Directorate of Social Welfare may get thework executed through an Executing Agency.

7. Sanctioning Authority.— Applicationsreceived in the prescribed manner will bescrutinized by the Social Welfare Departmentand will be placed before the State LevelCommittee for approval.

8. Release of funds.— The entire cost of theproject will be deposited with the ExecutingAgency after the detailed estimate, drawingof the project is approved by the State LevelCommittee and the construction license isobtained for the project.

9. Maintenance of the Multipurpose Hall.— Aseparate long term Maintenance Agreementwill be entered with the Executing Agency forthe maintenance of the Sanskriti Bhavan//Multipurpose Community Hall.

10. Management of the hall.— The Panchayatmay grant use of the facility at the rate fixedby the Government from time to time. Thisamount will be credited into the maintenancefund of the hall.

11. State Level Committee.— At the Statelevel there shall be a committee under theChairmanship of the Minister of Social Welfarewith the following members. This Committeewill sanction the projects in terms of clause (8)and monitor the implementation of the schemeon regular basis.

This scheme may be called as “Merit BasedAward and recognition of high performancein the Board Exams of SSC and HSSC in the

State of Goa”.

1. Introduction.— (a) Generally it is observedthat the academic performance of SC studentsis poor when it is compared with theperformance of general students. High rankholders are very few in the Class X and ClassXII who belong to SC Community. For theoverall development of the SC population, extraefforts are required for improved performanceby the SC students.

(b) Majority of these students live withouteconomic means. There is a need to instill

competitive instinct amongst the SC studentsright from the childhood. SC students needsmotivation to excel in their academicperformance. High performance of SCstudents therefore needs to be recognizedso that these students strive for higheracademic performance and start competingwith the high performers of entire class ofstudents.

2. Objective.— To motivate students bygiving merit based Award based on thebenchmark of the performance and to providefinancial incentive to high performing studentswho are economically weak.

3. Target population.— Students belongingto SC who have qualified for SSCE BoardExamination/HSSCE Board Examination of GoaBoard or any recognized Board which hasconducted SSCE/HSSC Exams for the studentsin the State of Goa.

4. Eligibility & Benefits proposed under thescheme.— (A) Felicitation of Rank HoldersStudents:- Under the scheme, amongst the SCstudents, First Five Rank Holders of SSC, FirstFive Rank Holders of HSSC Board exams(separately for all the streams of Science,Commerce, Arts and Vocational) will befelicitated in public function. Certificate ofAppreciation will be given at the time offelicitation. Financial award of Rs. 20,000/- willbe transferred electronically in the BankAccount of the Rank Holder Students. Thereis no restrictions on the basis of incomeceiling.

(B) Merit based Award:- For SC studentswhose annual family income is less thanRupees two lakhs having secured the requisitebench mark percentage.

(a) Students securing marks in the range(between 50% to 59.99%) will be given afinancial award of Rs. 5000/-.

(b) Students securing marks in the range(between 60% to 69.99%) will be given afinancial award of Rs. 8000/-.

(c) Students securing marks in the range(between 70% to 74.9%) will be given afinancial award of Rs. 10,000/-.

(d) Students securing 75% marks andabove will be given a financial award ofRs. 15000/-.

5. Mode of application & Pattern ofassistance.— Application to be made in theprescribed format of Merit Based Award forSC students along with the attested copyof marksheet. Amount will be releasedelectronically in the bank account of thebeneficiary. Students will be eligible based onperformance at the Board exams for an awardof highest amount.

6. Sanctioning Authority.— Director of SocialWelfare will sanction the amount of benefitunder the scheme.

1. Introduction.— SC Community population in Goa has not travelled and exposed to theoutside world is one of the causes of their backwardness. They do not want to move out of Goaand compete at national level in getting benefits earmarked for SC Community population. It istherefore imperative to help them get exposure to the outside world which will broaden theirhorizons.

2. Objective.— To provide financial assistance to the educational institutes in the SC dominatedareas to conduct Study Tours/Excursions across the country to cover places of historic, culturaland educational importance during school vacations.

3. Benefit under the scheme.— Financial Assistance to the Educational Institutes for an amountup to Rs. 1.00 lakh to conduct Study Tours/Excursions and will cover following expenditure:

(a) Actual travelling cost of students upto 40 students and two teachers by Rail (Second ClassSleeper Non AC) and/or by Bus. Duration of the Tour shall be for a period of six days or more.

(b) Entry fees/passes to visit the monuments/cultural sites.(c) Expenditure on lodging and boarding for a minimum period of 6 days.(d) Any other expenditure not mentioned above or which has exceeded the limit prescribed

as above shall be borne by the individual student/by the educational institution.

4. Eligibility.— Educational Institutes in Goa recognized by Goa Board/CBSE having SCCommunity students can seek financial assistance to conduct Study Tours/Excursions for SCCommunity students.

5. Conditions for conducting the study tour under the scheme.— (i) The scheme is restricted toSC Community students studying in class VIII to class XII.

(ii) Tour should be commenced only with prior written permissions of the Education Department,Social Welfare Department and with confirmed rail/bus tickets of the students/guide teachers.

(iii) The tour should be conducted during vacations like Diwali, Christmas and summervacations.

(iv) Two teachers of the school having some experience in excursion should be accompaniedwith students on the tour.

(v) The school authorities should utilize the concession given by railways to students & teachers.

(vi) Entire responsibility of conducting the tour shall lie with the school management. Theyshould undertake the tour with utmost care. The rail/bus reservation to and fro should beconfirmed well in advance.

(vii) The tour is restricted to SC Community students who are willing to undertake the journey.The school authorities should not force the students to join the tour. An undertaking from parentsof the child who desires to go on tour shall be taken in the prescribed form enclosed.

(viii) The school authorities should direct/guide the students about the materials theyshould carry for the tour and precautions to be undertaken by the students.

(ix) The school authorities should settle the account within one month on the completion ofthe tour.

(x) The tour should start from the nearest railway/bus station to the school.

(xi) Brief study/experience sharing report on the tour conducted should be submitted by the guideteachers accompanying the students within 15 days of the completion of the journey.

6. Application procedure and sanctioning authority.— (a) Head of the Educational Instituteshall submit application in prescribed Form along with brief report on the purpose of excursion,expected outcome of the tour, list of students in the prescribed proforma.

(b) Application should be submitted at least one month in advance.

(c) After scrutiny of the application, Director of Social Welfare will sanction the benefit underthe scheme.

7. Monitoring of the scheme.— All issues relating to eligibility, operationalization of the schemeor situation not envisaged at the time of formulation of the scheme, would be resolved by theMonitoring Committee, whose decision will be final.

The Monitoring Committee shall consist of:

(1) Secretary, Social Welfare : Chairman

(2) Joint Secretary, Finance : Member

(3) Director, Education : Member

(4) Director of Social Welfare : Member.

8. Evaluation of the scheme.— Performance of the scheme will be evaluated after two years ofits implementation and if required scheme will be suitably modified to meet the new challenges//requirements so as to achieve the set objective.

Financial Assistance to purchase Dwelling House of Mundkarunder the scheme “MUNDKARACHE GHAR”

1. Introduction.— As per the provisions of the GDD Mundkar Act, Mundkars have right topurchase dwelling house from the Bhatkars at the price determined by the Mamlatdar. MundkarAct came into force since the year 1975 however there are many Mundkars who belong to SCCommunity, have not exercised their right to purchase mundkarial dwelling house due to poorfinancial condition. Because the dwelling house is not owned by them they have to face difficultiesin carrying out repairs/renovations to their dwelling houses.

2. Objective.— To provide financial assistance to the needy Mundkars of SC Community toenable them to exercise their right to purchase dwelling house at the price determined by theMamlatdar under the provisions of the GDD Mundkar Act.

3. Eligibility Criteria.— (a) Person should be of SC Community.

(b) The family income from all sources should not exceed Rs. 3.00 lakhs per annum.

(c) Person should be declared or registered as Mundkar of the dwelling house.

(d) Order to determine purchase price is passed by the Mamlatdar under the provisions ofthe Goa Daman and Diu Mundkar Act.

(e) No pending appeal against the Order of the Mamlatdar and that it has reached to itsfinality.

(f) All cases where orders determining purchase price of the dwelling house have beenpassed by the Mamlatdar on or after 1-4-2012 will be covered for giving benefit under thescheme.

4. Benefit under the scheme.— (a) Financial assistance of entire amount at the rate/purchaseprice determined by the Mamlatdar for the Mundkarial dwelling house subject to the land areaceiling of 200 square meters in Urban area and 300 sq. meters in Rural area or the area of thehouse with five meters around the house as per the option of the Mundkar in the purchaseproceeding before the Mamlatdar under the provisions of Mundkar Act.

(b) The land price for the area exceeding the land ceiling prescribed by the Mundkar Act to beborne by the beneficiary from his own sources.

(c) Maximum financial assistance under the scheme for purchase of dwelling house isRs. 30,000/-.

(d) If the beneficiary under the scheme is also eligible for benefit under the schemes likeIndira Awas Yojana or Rajiv Awas Yojana or Souchalaya Suvidha, he may avail such benefits inaddition to benefits under the scheme “Mundkarache Ghar”.

5. Condition for grant of Financial Assistance.— Mundkar or his heirs will not sell the dwellinghouse area purchased under the Mundkar Act. Endorsement will be made on the survey recordsof the property that the dwelling House area is purchased with the assistance under the schemeMundkarache Ghar and the land is non-transferable except with the permission of the Collector.

6. Mode of Application.— The application in the prescribed Form to be submitted to theDirectorate of Social Welfare through Mamlatdar/Joint Mamlatdar after the order passed by theMamlatdar/Joint Mamlatdar determining the purchase price.

Application to be supported with—

(i) SC Community certificate issued by Competent Authority.

(ii) Income Certificate issued by Competent Authority.

(iii) Order of Registration as Mundkar or Order of declaration as Mundkar.

(iv) Form I & XIV of the Land.

(v) Demarcation plan of dwelling house purchased by the Mundkar.

(vi) Order passed by the Court of Mamlatdar/Joint Mamlatdar which has determined thepurchase price of the dwelling house.

(vii) House Tax Receipt.

(viii) Information furnished by the Mundkar in the application made for financial assistance tobe verified and certified by the Mamlatdar/Joint Mamlatdar as correct as per his record in theMundkar case proceeding maintained in his office.

(ix) Affidavit of the Mundkar that the dwelling house is used for his own habitation and hisfamily members and that the dwelling house will not be transferred to any person except withthe prior permission of the Collector.

7. Sanctioning Authority.— Director of Social Welfare will sanction the amount of benefit underthe scheme. Upon sanction of amount of benefit under the scheme, amount will be transferred//deposited with the concerned Mamlatdar for making the payment to the Bhatkar. After effectingthe payment of purchase price in terms of the provisions of the GDD Mundkar Act, Mamlatdarwill forward the papers to the Deputy Collector and SDO for issue of Mundkar Sanad.

Immediately upon issue of Mundkar Sanad, the concerned Certifying Officer shall issue processfor the mutation of the records in favour of the Mundkar with endorsement in the record that thedwelling house is purchased with the financial assistance under the scheme “MundkaracheGhar”.

8. Monitoring of the scheme.— Issues regarding eligibility or operation or of a new situationwhich is not envisaged at the time of formulation of the scheme, would be resolved by theMonitoring Committee, whose decision will be final. Committee will also have regular meetingsevery three months for monitoring the implementation of the scheme. The Monitoring Committeeis consisting of:

Scheme to support Orphan child/children of Widow belonging to SC Community

1. Introduction.— In the SC dominated areas, there is high incidence of early death of thebread earner in the family due to illness or accident. This has led to a situation where a largenumber of children do not have father or both parents. It is becoming extremely difficult for thewidows who have to work on daily wage and maintain her children. Orphan have to depend ontheir close family members and do not get proper education or nutritious food. Grant ofmaintenance allowance to such children is therefore envisaged under the scheme.

2. Objective.— To give financial support to the orphan children and the children of widows formeeting the expenditure on food, clothing and shelter till the children attains the age of 18years.

3. Benefit under the scheme.— (A) Fixed maintenance allowance of Rs. 1500/- per month, perchild of a widow.

(B) Fixed maintenance allowance of Rs. 2000/- per month, per child who is an orphan.

4. Eligibility.— (1) Any widow who is a DSSS beneficiary belonging to SC Community andhaving minor children is eligible, subject to the benefit being limited to 2 children.

(2) Any orphan who is under the care of a guardian, viz. grandparents or near relatives or in aprotective home/Dharmasala etc. upto the age of 18 years.

5. Application Procedures and Sanctioning Authority.— (A) For availing the benefits under thescheme, a widow who is a beneficiary of DSSS may apply in prescribed Application Form(Annexure A) to the Directorate of Social Welfare.

Director of Social Welfare will sanction the amount of benefit under the scheme, to thebeneficiary along with the benefits under the DSSS scheme.

(B) For availing the benefits under the scheme, the guardian of an orphan may apply inprescribed Application Form (Annexure B) to the Directorate of Social Welfare. After the scrutinyof the application, Director of Social Welfare will sanction the amount and the amount of benefitwill be transferred through ESC to the joint account of the orphan/guardian.

6. Monitoring.— The implementation of the scheme will be monitored by a Committeeconsisting of the following.

The Committee is consisting of:

1. Secretary, Social Welfare : Chairman2. Director of Social Welfare : Member3. Director of Women & Child Development : Member.

The Committee will also address problems/issues arising in implementation of the schemeand issue suitable directions in order to achieve the objectives of the scheme.

7. Evaluation of the Scheme.— Scheme will be implemented for five years. Performance of thescheme will be evaluated after two years of its implementation and if required scheme will besuitably modified to meet the new challenges/requirements so as to achieve the set objective.
