ACTION REQUESTED Approve the First Amendment to Consultant Services Agreement CN028222 with Stantec Consulting Services, Inc., and authorize the Director of the Department of Public Works and Facilities, or designee, to execute the amendment, for additional easement alignment analysis in the amount of $182,950, for a total contract amount of $369,950, funded in the FY 2017-18 Proposed Budget by the Capital Projects Fund, Project No. 04511 - Emigrant Trail Study. BACKGROUND The concept of a Memorial Overland Emigrant Trail (MOET) over Donner Summit to celebrate the pioneering wagon trains of the 1850's has been supported by the National Park Service and California Department of State Parks (CDSP) at various times since the early 1950's. In 2009, Placer County began to resurrect the MOET concept through a series of well attended and well received public workshops in the Donner Summit area. The concept envisioned a re-created segment in the vicinity of the original covered wagon route from Donner Memorial State Park over Donner Summit to Kingvale. The Sugar Bowl Ski Corporation began cooperating with the plans through dedication of public trail easements and construction of trail segments through their development projects, and in late 2012, Placer County received rights to a 50' wide public trail easement running east to west through the 3,000 acre Royal Gorge property in acknowledgment of a County contribution of $300,000 toward the purchase of Royal Gorge by the Truckee Donner Land Trust. In order to finalize the trail easement through Royal Gorge and determine best alignments on segments to the west, your Board approved a Consultant Services. Agreement with Stantec Consulting Services, Inc. for $187,000 on January 20, 2015 to perform an alignment analysis and environmental studies ("Agreement"). During the initial work, it was determined that the trail would be about 2 miles longer than originally anticipated due to steep topography and avoidance of sensitive habitats, and the work was split into two phases due to delays in authorization to perform work on federal property. The added length and phasing resulted in additional costs of $35,990 in order to complete the work through Royal Gorge. In 2016, Placer County was approached by CDSP to discuss realignment of original portions of the Historic Overland Emigrant Trail owned by Placer County through Donner Memorial State Park (DMSP) and the future alignment of the MOET through DMSP. Out of those discussions came a tentative agreement that if Placer County would provide initial design, environmental review, and permitting of the MOET through DMSP, State Parks would coordinate construction of the trail and accept the DMSP portion of the trail into their inventory for ongoing operation and maintenance. A Memorandum of Understanding to formalize these terms has been prepared and is being presented separately to your Board for approval. The cost for Stantec's services to

support design, environmental review, permitting , and public and agency outreach will be $146,960. Together with the $35,990 for additional length and phasing , this amendment will add $182,950 to the original contract amount.

ENVIRONMENTAL IMPACT The purpose of this contract amendment is to provide non-invasive studies that will be suitable for use in determining a preferred alignment for the multipurpose trail and for subsequent environmental review. Data collection and resource evaluation tasks are categorically exempt pursuant to CEQA Guidelines Section 15306 - Information Collection .

FISCAL IMPACT The total amended contract amount is $369,950. The initial $187,000 contract was funded through Park Dedication Fees. Sufficient funds were appropriated in the FY 2017-18 Capital Projects Proposed Budget, Project No. 04511 - Emigrant Trail Study, to provide funding for this First Amendment of $182,950 to the Agreement.
