General Information

NON LIABILITY CLAUSE: the auctioneers nor any of their servants, will be responsible for any injury or damage to persons or property, however caused. The attention of vendors and exhibitors is drawn to the need to take great care of stock and equipment. Although security personnel are employed and every effort is made to protect property, the organis-ers take no responsibility for any loss.

IMPORTANT NOTICE TO VENDORSAll cattle must be accompanied by the relevant movement document and the relevant signed passport.

All sheep must be accompanied by the relevant movement documentation and all MV Ac-credited Sheep must be accompanied by an official MV certificate. All paperwork to be handed into the auctioneers on arrival at the market.

CONDITIONS OF SALE

All stock will be sold subject to the Auctioneers General Conditions of Sale, printed in this catalogue. Sheep will be sold subject to the Conditions of Sale for Breeding Sheep as approved by the British Association of Livestock Auctioneers and the National Farmers Union of England and Wales. Cattle will be sold subject to the Special Terms and Condi-tions of Sale recommended by the National Cattle Breeders Association. No animal may be sold privately prior to the sale but must pass through the sale ring. The sale of substi-tute animals is NOT PERMITTED.

Animals which fail to reach the ‘reserve price’ may be sold by private treaty after the auc-tion. Full commission will be charged on all such transactions which MUST BE conducted through the auctioneer.

SETTLEMENT: Settlement in full for stock purchased is due to the auctioneers immedi-ately at the close of sale. Prospective purchasers, who are not known to the auctioneer, are asked to provide details of their ability to pay before bidding.

CLEARANCE OF STOCK: No animal shall be removed from the sale premises without an official PASS obtainable only from the auctioneers upon settlement or application, and such pass MUST be presented to the auctioneers before loading.

Neither the Rare Breeds Survival Trust nor the auctioneer accepts responsibility for stock after it has passed through the auction ring. Whilst the auctioneers will endeavour to assist in the correct trucking of sold animals, purchasers are reminded that all risks in respect of such animals pass to them at the fall of the hammer. Purchasers are entirely responsible for any costs or expenses which may arise due to the wrongful or incorrect locating, trucking or removal of stock, and they shall be liable for all costs of returning such stock to its proper destination.

All livestock entries must be identifiable by ear tag, brand or tattoo which must corre-spond with the catalogue entry. Any animal not so identifiable will be REJECTED from the sale. Under no circumstances will substitute animals be allowed into the sale.

INSPECTION: All entries will be inspected for general health, soundness and freedom from defects. Certain breed societies may appoint officials to inspect entries for breed type and/or genetic or other defects or deformities. In all cases the right is reserved to reject any animal which does not conform to the accepted standards and the decision of the Inspector(s) is final. Animals so rejected must be removed from the sale area forthwith, at the vendor’s expense and will not be permitted to be sold.

BUYERS PREMIUM: A buyer’s premium of 5% plus VAT will be added to the purchas-er’s account.

COMMISSION: Cattle, sheep and pigs will be sold in pounds and the auctioneers will charge a commission of 5% on the sale price realised. Poultry and Waterfowl will be sold in pounds sterling (£’s) and the auctioneers will charge a commission of 10% on the sale price realised with a minimum commission of £1 per lot.

In the event of any animal(s) or bird(s) failing to reach the minimum Selling Price, Upset Price or Reserve Price (if any) fixed by the vendor, half commission will be charged on the said price.

This sale is licensed and authorised by the appropriate local authority and by DEFRA and will be organised and conducted strictly in accordance with the regulations and special requirements of those bodies.

All stock is to be removed from the sale premises on the day of sale, unless prior arrange-ment is made with the auctioneers.

A limited amount of straw bedding will be provided by the auctioneers free of charge. Ad-ditional straw may be purchased, if required. Poultry/Waterfowl cages will be provided with wood shavings. All vendors must provide their own feedstuffs and drinking utensils.

Inspection: All cattle forward for the sale will be inspected prior to the show by Dexter Cattle Society Field Inspectors. Animals which do not conform to the Breed Standard, or which have a serious fault will not be eligible for the Show, but will be sold in catalogue order. This will be identified by a red dot on the lot ticket number and the reason will be announced by the auctioneer as the animal enters the sale ring. Any animals showing symptoms of infectious or contagious diseases will be removed from the lines and will not be allowed to be sold.

Conditions of Sale: All registered cattle will be offered for sale subject to the terms and conditions of sale recommended by the National Beef Association. A copy of these terms and conditions will be displayed at the sale premises and will be available in booklet form for vendors and purchasers who may require them at the sale.Method of Sale: All cattle will be sold in strictly catalogue order, unless any alteration is announced by the Auctioneers.Transfers: If the purchaser requires official transfer of the pedigree, the Society Transfer fee of £10 will be added to the purchasers account and paid to the Society. Pedigree certificates will be retained by the Society for processing of transfer and forwarded to the purchaser after the sale.

WHY BUY A DEXTER:

• Dexter cattle are a compact and hardy breed given adequate shelter will stay out all year round

• Being truly dual purpose they are equally good at producing milk and beef

• Dexter beef is traditionally matured with excellent eating quality as recently seen on TV. Small, fine grained, well marbled joints are perfect for today’s consumer.

• On a small scale enterprise two Dexters can be kept for the cost of a larger ani-mal—thus ensuring fresh milk and beef all year round.

• Dexters make excellent mothers calving easily they will breed regularly for 14 years and more. Dexters can adapt to extreme climatic conditions and have been exported to all corners of the world.

Regulations for Sales held under the Auspices of theRyeland Flock Book Society Ltd

1. The sale will be as per the order of sale page

2. All animals must be earmarked in accordance with the Society’s regulations. Each animal presented for sale must be stenciled or marked with the appropriate lot number.

3. Any error of description in the catalogue will be notified and announced by the Auctioneer at the time of the sale.

4. Rosettes for the following: Champion, Reserve Champion, First, Second, Third, Fourth, and Special Prizes.

5. Halters must be provided for rams during judging and the purchaser of each animal must be supplied with a halter by the vendor.

6. Vendors must provide food for their sheep and wood chippings or shavings for the pens. NO STRAW.

7. Breeders are responsible for the registration of all entries in the Society’s Flock Book. There will be no refund of the registration if the animal is unsold and subsequently butchered.

8. Vendors should notify reserve prices to the Auctioneers prior to the commencement of the sale. Animals for which no notification has been given will be presumed for sale without reserve. The upset price for ram lambs is 50 gns.

9. Certificates of Pedigree for all sheep will be posted to purchasers after the sale

10. All NSP certificates to be collected from the vendors, not the Auctioneers or the Society office.

11. Vendors shall ensure that each entry is adequately prepared for sale.

12. No sheep are to be sold before they are inspected by a steward appointed by the Council, and they have the authority of the Council to reject unhealthy or sub-standard sheep. Vendors of sheep rejected by the inspectors have the right of appeal to the Show Appeals Committee. The decision of the Show Appeals Committee is final. Rejected sheep cannot be offered for sale. They will be identified with a red paint mark at the base of the neck and removed from the sale pens.

13. All animals entered or exposed for sale must be the bona fide property of the vendor at the time of entry to the sale and be free of liens, charges, and incumbents.

14. Each animal forward at the sale must be exposed for sale by auction before any private sale shall be permitted or recognised by the Auctioneers.

15. All animals must be forward for sale unless covered by a veterinary certificate.

16 All trophies won will be presented by the judge at the time of winning. All trophies to be returned to the Secretary with four weeks of the following year’s sale, or at the specific request of the Society.

17. All members presenting sheep for sale must have adequate public liability insurance

Additional Guidelines re Substitutions:

i) Substitutions are strictly only allowed to replace animals that have been taken ill, are injured, or have died.

ii) The Secretary must be notified as soon as possible. The pedigree certificate of the substitute must be forwarded to the office if time allows, or handed to the Secretary on the morning of the sale.

iii) The breeder can self certify ill health of the sheep or provide photographic evidence of the animal’s injury but the Society retains the right to insist on a veterinary certificate where deemed appropriate.

iv) In the event of the death of an animal, the breeder must provide a copy of the certificate of disposal or other appropriate evidence to the Secretary as soon as is practicably possible.

v) A sheep may be substituted for an original entry provided that any substitution is a sheep in the same class.

vi) The substitute must be clearly marked with a yellow dot at the base of the neck, at least one inch in diameter.

vii) The substitute’s pen must be clearly marked and include details of the animal’s dam, sire, grand dam and grand sire clearly available for potential purchasers to see.

xiii) The Auctioneers must be informed of the change so that a clear announcement can be made when the substitute animal enters the sale ring.

Additional Information:

BIO-SECURITY.Intending purchasers are requested to have livestock vehicles cleansed and disinfected and have waterproofs and wellington boots when coming into contact with livestock.

MOVEMENT LICENSESMarket Holding Number: 08/067/8019

Intending Purchasers should have their CPH number ready to supply the Auctioneers, so that the correct movement license may be issued before departure from the market.

Vendors and purchasers must comply with current DEFRA regulations for Animal Movements in force at the time of the Sale.

All licenses will be collected by stewards at the entrance to the market. No vehicles will be allowed in until this requirement has been met.

No sheep will be allowed to depart from the market without a license from the auctioneers office.

REFRESHMENTS Refreshments will be available.

Important Information for Vendors SHEEP MUST BE PENNED BY 8.30AM

• Sheepmustbeintheirallottedpensby8.30am.InspectionswillbecarriedoutbytheSociety’sapproved inspectors before 9.00am on the morning of the Sale. Animals not penned by this time will not be inspected, so cannot be offered for sale. Inspectors also reserve the right to refuse to inspect animals not clearly marked with their lot numbers.

• In endorsing your sheep for sale, the RFBS must be confident that they are fit for purpose and correctly marked. Before being offered for sale, ALL sheep will be inspected to ensure that they fulfil ALL of the following criteria:

1. They are correctly tagged or tattooed in accordance with DEFRA and RFBS regulations. Ear tag numbers MUST match the details listed in the catalogue and on the animal’s pedigree certificate.

2. They are fit for the purpose of breeding i.e. Their teeth are correctly positioned, Rams have 2 evenly sized testicles, females have an udder free from lumps and that all sheep are free from disease and in a good bodily condition.

3. They are legibly marked with their catalogue Lot number (preferably with a paint mark or alternatively a securely attached luggage label)

4. The length of the tail must comply with the DEFRA animal welfare regulations 2008.

• Entries that are deemed by the society inspectors to have not met all of these criteria will be omitted from the sale. These sheep will be marked with a red dot at the base of the neck and will be kept apart from those sheep offered for sale.

• Vendors are asked to make every effort to arrive as early as possible. Stewards will be in the market to assist you from 6.30am

• The decisions made by the Society Inspectors must be respected and will, in almost every case, be upheld. However in the event of an animal being rejected the vendor may appeal against the decision. The decision of the Appeals Committee is final.

• Substitute entries must be marked with a yellow dot at the base of the neck

• It is the responsibility of the vendor to supply any additional information on the pens of individual entries.

• Vendors who wish to place reserves on lots offered for sale must lodge them with the auctioneers office before the auction begins.

• It is the responsibility of vendors to ensure that they have adequate public liability insurance.

• Vendors are advised to bring plenty of bedding for the pens -wood shavings/chippings only (NO straw).

AUCTIONEER’S TERMS & CONDITIONS OF SALE

(Incorporating the Auctioneer’s Terms and Conditions)

1. The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.

2. The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.

3. Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.

4. All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.

5. All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.

6. All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.

7. Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.

8. No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.

9. Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.

10. If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter.

11. You have a right to know how we will use the information you have provided to us. We may share the information with other members of our group and may make this information available to relevant media groups and other interested parties on request. We and other members of the group may contact you by telephone, e-mail, post or fax to inform you of products or services available. If you do not want to be contacted for marketing purposes or do not wish your information to be made available to any other parties please notify us in writing.

NOTICE TO ALL VISITORS AND TRADERSPLEASE READ AND OBSERVE THE FOLLOWING

All visitors and traders on site will be responsible for ensuring that they and their employees or sub-contractors engaged by them comply with all legal requirements, including the Health and Safety At Work etc., Act 1974, The Management of Health and Safety At Work Regulations, The Provision And Use of Work Equipment Regulations, etc.

All visitors and traders will be responsible for ensuring that their operations in no way affect the integrity of the company or its fire, safety or security arrangements and in no way compromise the health and safety and welfare of other visitors to and or employees of Harrison & Hetherington.

Although it is the visitors and traders responsibility to ensure that plant, equipment and systems in work are safe, Harrison & Hetherington Limited reserve the right to ask any visitor or trader to leave the market for any breaches in the Health and Safety Rules and/or Regulations.

Vendors must inform Harrison & Hetherington Limited of any livestock due to attend the market whose temperament, behaviour or condition may call for additional precautions for its safe handling.

When loading or unloading livestock handlers must ensure that the dock and vehicle gates are securely fixed so as to prevent the escape of animals.

Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge.

Children must not be permitted in any area where they may be at risk from livestock or machinery.

In the case of bulls, during the period when the show/sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns.

Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity.

Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES.

The auction ring man escapes and refuges must be kept clear at all times.

All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.
