1. INTRODUCTION

1. The Regional Roads Development Project (RRDP) is being implemented in four provinces of Indonesia, namely West and North Kalimantan; Central and East Java, envisaged to address important national or strategic road corridors in northern Kalimantan and southern Java to encourage economic growth in the less developed and poorer areas of Indonesia. The rehabilitation, capacity expansion and new construction of roads will improve connectivity and access to services. Specifically, improved road infrastructure in southern Java is necessary for increased economic growth to improve access to markets and to attract investment in that area. Road network development in Kalimantan will ensure that economic development will occur in less developed and remote areas.

2. The Project is a four-year undertaking by the Director General of Highways (DGH or Ditjen Bina Marga) of the Ministry of Public Works and Public Housing (MPWPH) purposely to rehabilitate, improve or newly construct about 476 km of roads and bridges where of the 476 km sub project roads, about 3,860 m will involve rehabilitation or replacement of bridges and 40 km will be construction of new roads in agricultural areas with existing earthen tracks in some sections.

3. Project financing is with the Asian Development Bank (ADB) and the Islamic Development Bank (IDB) as approved 24 November 2011 by the ADB Board. The Government of Indonesia and ADB signed the loan agreement on 07 May 2012. The ADB- financed component covers 399 km of road (3,390 of which are bridges) while the IDB- financed component includes 77 km of road (470 m of which are bridges).

1.1 Background

4. RRDP is divided in to eleven (11) construction packages. Land Acquisition and Resettlement Plans (LARP) were prepared in October 2011 and uploaded on to the ADB website (Table 1).

5. As stipulated in the Loan Agreement:

Schedule 5, Para 5: The Borrower shall, and shall cause the Project Executing Agency to ensure that any involuntary resettlement and / or activities impacting ethnic minorities be carried out in accordance with the agreed LARAPs, ADB Safeguard Policy Statement (SPS), and the Borrower’s relevant laws. In case of differences between Borrower’s laws and regulations and the SPS, the SPS shall prevail. In case of such involuntary resettlement, the Borrower shall ensure (a) the Project Executing Agency shall be responsible for internal monitoring of resettlement activities, including engagement of an external monitoring agency 1 month before commencement of the resettlement activities. The internal and external monitoring reports shall be submitted to ADB every quarter and uploaded on

DGH's website within 2 weeks of their submission; and such monitoring and reporting activities shall be carried out until resettlement has been completed; and (b) the timely provision of counterpart funds for resettlement in order to satisfy the requirements and objectives of resettlement.

Schedule 5, Para 8: The Borrower shall, and shall cause the Project Executing Agency to ensure that ADB’s SPS requirements are applied and implemented for all Project components regardless of financing source.

6. As such, internal monitoring reports are prepared to determine the extent the LARP documents have been implemented in the field and identify constraints and problems encountered during the implementation process. Specifically, this report intends to cover the following concerns:

Compensation and/or other entitlements are provided as per Final LARP, with no discrimination according to gender, vulnerability, or any other factor;

Livelihood restoration measures are designed and implemented including modifications in the programs and provision of additional cash and in-kind assistance to the participating affected households as and when necessary;

Public information, public consultation and grievance redress procedures are followed as described in the Final LARP;

Capacity of AP to re-store/re-establish livelihoods and living standards. Special attention given to severely affected and vulnerable households.

Affected public facilities and infrastructure are restored promptly; and

The transition between relocation or site clearing and commencement of civil works is smooth and that sites are not handed over for civil works until affected households have been satisfactorily compensated, assisted and relocated.

1.2 Timelines

7. Key time lines (Table 2) are pertinent to note under social safeguards as Project management transitions to more relevant and comprehensive documentation of forthcoming monitoring periods.

1.3 Land Clearance/Civil Works Schedules

8. Table 3 provides a summary of affected households as monitored viz-a-viz land clearing within the Civil Works being conducted within the Project sites during the monitoring period.

9. As reported in the previous monitoring report, there were several private properties within the existing ROW of Simpang Tanjung - Aruk section in CW-07. CTC need to identify potentially affected households and prepare a short RP. The number of AHs will be updated once the short Resettlement Plan for this segment is completed.

Note : ADB approved in-principle, the inclusion of the road section connecting Sambas-Tanjung Harapan (missing link, length 12.8 km) under CW-06. The Resettlement Plan was approved in February 2017; and subsequently the Civil Works were formally included under Addendum No. 3 for which ADB NOL was issued on 15 March 2017.

1.4 Funds Availability and Sourcing and Limitations to LARP Implementation

10. Table 4 summarizes availability and source of funds for LARP implementation and the associated cost. LARP budget is drawn from national budget. In both Kalimantan and Java provinces, timely release of funds was a constraint despite assurances from local governments.

11. In Central Java Lot 2: CW-02 (Griwoyo-Duwet) is currently experiencing constraints that may impinge on progress of civil works in as much as 7 Ahs refuse to accept the compensation package now kept with the court. One package in West Kalimantan require the preparation of short RP as the severe not covered in the original LARPs produced in 2011.

2. GENERAL PROGRESS IN LARP IMPLEMENTATION

2.1 West Kalimantan

12. Monitoring of LARP implementation of road packages in West Kalimantan was conducted during 5-10 April, 2017.

13. Sosok-Tayan; Tanjung – Batas Kota Sanggau. Payment of compensation to the affected households (AHs) has been implemented by the Government of Sanggau on 2013 and 2014. The existing ROW in this road section was 30 m, so no private land will be affected. The unit cost for stuctures are calculated based on determination of the appraisal team and negotiation with the AHs on August 2012. In the first payment of compensation, the LAC applied depreciation of age and structure when calculated the compensation which this practice was not comply with the entitlement in the approved resettlement plan. According to the resettlement plan, payment of compensation or affected asset should be based on the full replacement cost. However in December 2013, the depreciation amount have been paid to AHs by the LAC, to make it comply with the project policy. The local government have implemented income restoration program to the affected households. The programs was integrated with the local government’s programs for economic empowerment delivered since 2013. The CTC will closely monitor the programs implementation to get clear picture of participation the affected persons in the program.

14. Tebas-Singkawang-Sambas Bypass; Galing - Tanjung Harapan ; Aruk (Bts. Serawak)-Sp. Tanjung. Compensation value of affected asset was determined by the Regent's Decision based on the assessment of Data Collection and Negotiation Team for Awarding Compensation of Provincial and National Roads Improvement. According to the implementation report, all compensation payment for AHs in Sambas District have been completed in 2011, while payment for additional AHs located in Singkawang City was paid in December 2015 (see QLARP Dec 2015 to February 2016).

15. Tanjung Harapan – Sambas (Missing Link). Originally, the road section connecting Sambas - Tanjung Harapan in West Kalimantan located between packages CW-06 and CW- 07 was not included under the Project as this was intended to be implemented under RRDP II. However, to ensure connectivity of the road sections in West Kalimantan, this section was subsequently proposed to be included under the current RRDP. ADB therefore approved the inclusion of this section under a contract variation of package CW-06 on 15 June 2016, with condition that the original LARP (produced in October 2011) will need to be updated. The Detailed Measurement Survey (DMS) was carried out from 2-5 August 2016 by the Core Team Consultant (CTC) safeguard team in collaboration with the Local Government of Sambas District. The updated RP for the missing link was approved by ADB on 28 February 2017, and disclosure to the affected persons was conducted in April 2017. 16. Disclosure in the form of distribution of PIB was conducted during CTC safeguard field visit. Prior to the distribution of PIB, the team (DSC, PPK Staff and Contractor) held a socialization visit to the village officials and some AHs in the village office explained content of the PIB in detail. CTC also attended that socialization (see Photo 1 in Appendix 1). Distribution of PIB continued by the contractor to all AHs. The safeguard team found that compensation payment for affected structures in two villages (Kartiyasa and Sepadu) have been delivered in December 2016, before the RP was approved, and the backup of payment was given by Dinas Bina Marga and Tata Ruang to the team. According to the backup, compensation amount paid was much lower than the amount indicated in the approved RP. Comparison of the compensation amount provided by the LG and the amount indicated in the approved RP are shown in Appendix 2. The Sambas LG/Bappeda also informed that IRP for additional packages have been allocated by several agencies in their APBD 2017 (copy of RKA are shown in Appendix 3). Most of

the access concrete bridges to houses have been built by the Contractor as per entitlement in the approved RP. 17. Simpang Tanjung - Aruk. As reported in the previous Monitoring Report, considering longer process to get permit or release status of protection forest, the DGH decided in February 2017 to change it back into 2 lanes and the construction will be done in the existing 14 meters of the ROW.

18. According to the initial measurement done by the DSC and the Contractor, it was reported that there are several assets belong to local people found in the ROW of the said segment. Identification of potential affected assets wil be conducted and a short Resettlement Plan will be prepared by the CTC Safeguard Team and will be reported in the next Quarterly Monitoring Report.

2.2. North Kalimantan

19. Site visit to all packages in North Kalimantan was carried out by CTC Safeguard Team on 13-17 March 2017. According to the monitoring there are no significant progress of the pending issues related with the LARP as reported in the previous monitoring report.

20. Bulungan. There are 2 packages in Bulungan District specifically CW-08 34-RCP-01 and CW-09 34-RCP-02. The LG Bulungan assigned a team from PRONA to the Land Certification Program to provide new Certificates for the AHs as per project loss. In accordance with the new regulation, target end of compensation was by end of 2015 after which the project ownership is transferred from DGH to the Local Government. As of this monitoring period, the team got information from the Secretary of Bappeda Bulungan that Local Government of Bulungan District had a budget cut for land certification program, because until the end of 2016, the land ownership data of AHs is still being processed by the village and sub-district. So, there is no evidence of land ownership which will be used as the basis of land certification in accordance with applicable provisions.

21. Compensation. Compensation for AHs has been completed at a rate of 98.37%. Project impacts revolve around loss of crops and structure, none on land. There are 123 AHs and up to the end of 2014, the LG has paid compensation for 80 AHs. By the end of December 2015, the LG paid compensation for 121 AHs (See Appendix 4). As mentioned in the previous monitoring report,there are 2 AHs have not received the cash compensation for their affected strucuture, i.e. Mr. Dwi Sugiyanto (location in Panca Agung Village) and Mr. Suryanto (location in Sekatak Bengara Village). As of this monitoring period (specifically 13-17 March), it was reported that

Mr. Dwi Sugiyanto have been agree compensation of affected fuel shop will be given in the form of backfilling and compacting of his yard to be used as car parking for the guests who coming to his house which now run as a hotel.. Part of his house now rented as a hotel.

Mr. Suryanto still had not agree with the compensation determined by the Committe and demanded for more. Therefore according to PPK Staff (Pak Andi) and Contractor, they have made adjustmen of the design on that location, no drainage was built but the contractor filled both sides of his affected area with embankment so that its surface is level with the road surface. Mr. Suyanto have agreed with this adjusment.

22. Since the letter Issued by Secretary of Bulungan stated compensation to households affected by RRDP have been completed, the AHs along Sta 0+000 to 3+400 which were not covered by the LG were handled by the Contractor. Based on the consultation, the AHs agreed compensation was given in the form of rebuilding of their affected assets. Table 5 provides the detailed name, location and type of compensation.

23. As of this monitoring period, one AH namely Eliezar location in sta 17+000 rejected their land to be used for project (for drainage). Therefore the design was optimized using the existing ROW by shifted the road allignment/centre line to the right and they contstruct unpaved drainage ditch.

24. Income Restoration. Secretary Bappeda Bulungan District further explained that since they have limitation on budget, the LG will be more focussed to allocate budget for development infrastructure, and cut budget of program to address income restoration. The safeguard team need to closely communicate with other possible program for the IRP from other Local Government agencies.

25. Nunukan. For Nunukan District, there is no compensation for affected land, crops and structure. Packages CW-10 and CW-11 are almost entirely within Palm Oil Plantation. Ownership of these assets are largely corporate and some individual Property. The road is flanked by palm oil plantation in both sides. Entitlements include assistance in moving the crops, provision of access road and “Tapak Rumah”. The Contractor assists the AHs to prepare their land in terms of excavation or backfilling so AHs can rebuild their houses or other structures. CTC have been determined cost for Tapak Rumah (see QLARPJune-August 2016 para 24) and found these to be more than satisfactorily addressing compensation rates as demonstrated in the table 6 to table 8 below.

26. As per interview by safeguard team to several AH (who were selected randomly), all of them expressed that the compensation have been given as per entitlements and gave positive response to the road development.

2.2 East Java

27. Compensation payment for affected trees and livelihood restoration program for affected persons have been delivered as reported in the previous monitoring report.

2.3 Central Java

28. Lot 1: CW-01 Tambakmulyo - Wawar - As recommended in the due dilligence report, the CTC conduct a thorough review of related compensation information to the additional AHs brought about by improvements on a separate road connecting to Tambakmulyo-Wawar to enhance access and to see if the implementation is in accordance with the LARP. The summary of the review and recommendation could be seen in the Table 8 below.

29. The aid program for AHs have been undertaken by the Government of Kebumen Regency such as: Housing Development Aid to the Underprivileged Society (P2MKM), Program to Increase the Role of Women in Rural Areas, Social Assistance for Students Scholarships for Underprivileged Families, and Program of Allocation of Village Funds (ADD). In particular, the ADD program was a commitment at LARP preparation. Some programs have women as direct beneficiaries, like the Program to Increase the Role of Women in Rural Areas in Klirong Sub District, covering villages: Tanggulangin, Jogosimo. The CTC will closely monitor to get more complete documentation of income restoration activities conducted by the local government

30. Lot 2: CW-02 Giriwoyo - Duwet - As reported in the previous monitoring report, the DGH proposed solution to use existing alignment to avoid 7 AHs which rejected the compensation. The proposed solutions have been discussed and IDB have no objection on the technical decision as long as the DGH endorsed the solution with regards to the safety and technical matters. The DGH Road Safety Directorate has reviewed and endorsed the solution and will inform to IDB. Continuous monitoring along this segment

during construction is still strongly recommended as well as generation/completion of impact documentation, including monitoring of compensation payment for 2 Ahs impacted by the realigned segment of about 4.8 km at STA 13.050

31. Lot 3: CW-03 Congot - Wawar - All affected households (estimated 2,663 households) have been completely paid from 2005-2007, and the records have been reported in the due dilligence report.

3. OUT STANDING ISSUES ON RESETTLEMENT, CORRESPONDING PLAN OF ACTION AND STATUS

3.1 West Kalimantan

32. As per the Draft Aid memoir of the ADB mission of May 2017, the compensation amount for the affected structure paid was much lower than the amount indicated in the approved LARP and agreed by the Sambas Regent. Comparison of compensation amount given by Sambas LG and the amount as per LARAP prepared by CTC can be seen in the Appendix 2. The mission requested the Local Government to demonstrate the detailed calculation of the unit rate of the affected structure and top up the compensation payment to meet replacement cost principle. The DGH assisted by the CTC need to communicate this to Sambas LG. The compensation payment for the remaining affected structures be refer to the rate indicated in the approved LARP. All the remaining outstanding issues from West Kalimantan are summarized in the Table 6 below.

3.3 East Java

34. The outstanding issue need to be monitored is related with payment of forestland to replace land owned by PT. Perhutani at Malang District to Bondowoso District; Delayed payment partly due to limited APBD budget of Malang District. As of last monitoring, it was reported the land acquisition for the replacement of the forestry land used for the project only about 20.28 Ha or 14% of all plots.

3.4 Central Java

35. Lot 1: CW-01 Tambakmulyo – Wawar: As described in the para 20, CTC conducted a thorough review of related compensation information to the additional AHs Lot 1, to see if the implementation is in accordance with the LARP. The summary of the review and recommendation follow up could be seen in the Table 8 below.

4. OTHER CONCERNS AND NOTATIONS

4.1 Internal and External Monitoring

37. With respect to internal monitoring, it is currently being addressed by DGH and reports from 2016 being completed, and this report being the second of the quarter of 2017.

38. External monitoring on the other hand will have to commence soonest as only one has been conducted to date, when it should be a semi-annual undertaking. DGH has to coordinate the different units tasked with this undertaking. Due to delays in engagement of the EMA in timely fashion, DGH will propose that, the services of the EMA will be engaged through the CTC Consultancy Contract whereby, an external consultant or an NGO will be procured by CTC. The CTC will only act as the conduit for procurement and administration, whereas the tasks and the scope of work of EMA will be completely independent from CTC. CTC will prepare the TOR for EMA

4.2 Disclosure, Consultation, Participation, and Grievance

39. With respect to grievance, no written complaint has been lodged with the Project implementers to assess the efficacy of the project grievance redress mechanism.

40. According to the ADB mission, it was noted that some AHs along the missing link have not received the PIB yet, CTC need to ensure the disclosure was given to all related stakeholders, include all AHs.

4.3 Contractor Workforce

41. According to the consultation with PPK and the Contractor during the site visit in West Kalimantan and North Kalimantan, it was noted that the Contractors generally recruited engineer and skilled workers from Java, while they prioritize to recruit unskilled labor from the communities along the road. Basically the Contractor are willing to hire women as staff as long as their skill are meet the requirement. Women do not work in the road construction although the Contractor hire women to perform functions such as cooking, soil testing. Appendix 9 presents the data of local labor in the packages CW-06, CW-07, CW-08 and CW-09. It was noted also that some of the labor listed are affected households, for example there were six AHs affected by the missing link (CW-06) hired as unskilled labor of PT. Brantas Abipraya and Kimpeng who affected by the CW-07 hired as an public relation of PT. Waskita Karya.
