QUALIFICATION AND ELGIBILITY RQUIREMENTS RESPONSE 1) Vanguard Communications Development Company LLC (VCD)

(www.vanguardcommdev.com) is comprised of the four founding members, associate companies in RF Safety, and RF/EMF Testing. Each is a specialist in their individual areas and combined they deliver a very unique perspective toward wireless facilities, the wireless industry as a hole, and the municipalities ability to control wireless growth. With over 100 years of experience we have been evolved with every phase of wireless site development, from the search ring selection to verification of FCC mandated compliance for modification of wireless sites. This very unique group has the ability to bring only what areas of expertise that is necessary to complete the task, without overburdening the client.

2) This composite team have been working in the wireless industry for over 20 years in acquisition management, site development and design, installation ,modification, maintenance contractor, RF Safety Instruction/management ( www.rfcomply.com), and RF/EMF testing( www.emfrf.com ). One of the team members is a lawyer who specializes in Municipalities. He is presently on retainer for some San Diego County municipalities as their legal council.

3) Two members of the team are also executives for BDR Communications, Inc. (www.bdrcommunications.com) out of Carlsbad California. BDR is well known in the wireless industry as a highly respected services contractor, for their high quality workmanship. BDR has a client base that includes Verizon Wireless, AT&T Wireless, Ericsson, and Emerson. They also have AT&T Certified Installation teams for switch room equipment installations, removals, DC Power systems, fiber installations, and QA Inspections.

4) Vanguard has partnered with RSI Safety ( www.rfcomply.com), to insure our clients have the latest compliant training available for Federal and State requirements and we receive the CPUC News Letter electronically on a monthly bases to keep up with the latest rulings and requirements.

5) One if the team members (Robert Ross) is the Vice Chairman for the Telecommunications Review Commission for San Diego County, former chairman of the Telecommunication Committee for Oceanside for over 20 years, and presently a member of the Planning Commission for the city of Oceanside. Mr. Ross was instrumental in the development and implementation of a new telecommunications zoning ordinance that is in place, a special ordinance for Armature Radio operations within the city, supplemental application form for wireless projects and distributed antenna systems(DAS), and right of way standard for telecommunications facilities. His first hand experience in the development of a Telecommunications Master Plan within a municipality, is extremely unique and brings a new dimension to any development process. He is a retired U.S. Marine with over 20 years military communications experience. Some of his notable accomplishments include, the N.A.T.O. Radio Frequency Management and Control School. Graduated in 1980. In 1983 he was stationed at The National Security Agency in Maryland, where he worked on the Development and Management of Computer Generated daily changing

KENNETH H. LOUNSBERY

Mr. Lounsbery attended the College of William and Mary where he earned a degree in Political Science. In 1965, he was awarded a Juris Doctor degree with honors from the California Western University School of Law. Upon admission to the bar Mr. Lounsbery began his career with the San Diego City Attorney's office. Upon promotion to the Civil Division, Mr. Lounsbery specialized in land use, redevelopment and utility regulation matters. Mr. Lounsbery later served as City Attorney in the Cities of Escondido and South Lake Tahoe. In 1976, Mr. Lounsbery was named City Manager of the City of Escondido. During his four year tenure as Manager he concentrated on the formation and direction of the City's redevelopment agency and negotiated the long-term lease of City-owned land for the development by Ernest W. Hahn of the North County Fair regional shopping center. Mr. Lounsbery left his municipal position in 1980 to join Higgs, Fletcher & Mack. As a resident partner in the firm's Escondido office, Mr. Lounsbery represented private clients in the areas of land use, development, construction and redevelopment law. In 1982, the Lusardi Construction Company hired Mr. Lounsbery to become its full time General Counsel; in 1983, he was also named Vice President. His responsibilities included the oversight of all legal aspects of construction matters and the handling of land use entitlements; including environmental approvals, project permitting, financing and completion. These included several industrial developments, one regional shopping center, a large mixed-use project and municipal solid waste facilities. In 1989, Lusardi named Mr. Lounsbery as President of a sister corporation, Servcon, which had the special purpose of obtaining approvals for developing and constructing municipal solid waste disposal facilities. Upon obtaining approvals for two such projects, in 1992 Servcon was sold and Mr. Lounsbery returned to Higgs, Fletcher & Mack. In 1996, Mr. Lounsbery formed the firm of Lounsbery Ferguson Altona & Peak where he served as the contract City Attorney for the City of San Marcos. He now specializes in land use entitlements, environmental law, project financing and municipal law. In 2010, Mr. Lounsbery joined Bruce D. Redmon, Stan Landess and Robert C. Ross in the formation of Vanguard Communications Development LLC for the purpose of managing real estate owned by cities for the purpose of wireless site developmen In the course of his career, Mr. Lounsbery has represented both public and private parties engaged in the provision of public services. He has represented cities for the purpose of negotiating the terms of franchise agreements with regional power utilities, and CATV operators. He has also represented the private interests of CATV operators, refuse collection operators and communication services providers in the process of negotiating franchise agreements with public agencies. As past president of the local Chamber of Commerce and a publicly elected director of the regional hospital district, Mr. Lounsbery has actively served the greater San Diego County community. He currently serves as a charter member of the President's Advisory Council for California State University, San Marcos and is the past President of the San Diego-Imperial County City Attorneys’ Association. In 1993, for the Pacific Telesis PCS marketing trial Stan Landess in five months time acquired 29 sites utilizing a temporary license contract. He also acquired 20 CDMA test sites for PacTel Cellular. Under exclusive contract for San Diego County during 1995 through June 1996 with AirTouch Cellular and was solely responsible for acquiring 25 cellular sites. In 1996 through early 1999 as Vice President of Real Estate and Director of Site Acquisitions for JNB Telecom, Inc. Stan Landess managed the Site Acquisition team in the joint venture of JNB Telecom, Inc. with Keith International, Inc. This was a contract with Cox Communications, Inc. for the acquisition, planning, and construction management for Riverside, San Bernardino, Ventura and completion of the San Diego project totaling over 120 sites in Southern California. Preface The Wireless Inspection Protocol (Protocol) explains the process by which independent evaluators gather, analyze, and report information regarding the performance and characteristics of existing and future wireless facilities within the city limits of Calabasas California for the purpose of verifying compliance with Federal, State, County, and city rules, regulations, and ordinances.

I. Introduction 

A. Wireless Telecommunications Facilities “Wireless Telecommunications Facilities” means and includes;

• Telecommunications Tower • Tower • Telecommunications Site • Personal Wireless Facility • Distributive Antenna site (DAS)

A structure, facility, or location designed, or intended to be used as, or used to support, antennas or other transmitting or receiving devices. This includes without limit, towers of all types and kinds and structures that employ stealth technology, including, but not limited to structures such as a multi-story building, church steeple, silo, water tower, sign or other structure such as artificial trees or rocks, that can be used to mitigate the visual impact of an antenna or the functional equivalent of such, including all related facilities such as cabling, guy wires, and associated anchors, equipment shelters and other structures associated with the site. It is a structure and facility intended for transmitting and/or receiving radio, television, cellular, paging, 911, Personal Telecommunications Services, commercial satellite services, microwave services and services not licensed by the FCC, but not expressly exempt from the cities siting, building, and permitting authority.

B. Overview of the Inspection Process The renewal / application process begins with the carrier submission to the city an Application for Renewal of a Wireless Facility (Application for Renewal). After the city has reviewed the Application for Renewal and determined that it is clear and complete, the carrier is notified of the Application for Renewal’s acceptance. The city contracts with an independent organization to conduct a detailed review of the carriers’ sites and records. The inspection organization assigns a team of specialists to conduct an inspection site visit and prepare a report summarizing the team’s findings regarding the carriers performance relative to its wireless site maintenance and the records review. During the site visit, RF data will be plotted utilizing a Narda RF monitor for later evaluation. The findings will be compared with the latest report provided by the carrier. Once all the reports have been completed and agreed upon, a final report will be issued for the individual site to the city.

Sources of Evidence The primary purpose of this Protocol is to describe the process used in conducting the wireless carrier inspection site visit and preparing the inspection report. The inspection report constitutes of existing city records that the carrier has provided per the application for the site usage and the survey records created by the consultant. Additional records may be required in order to create a base line from witch the site survey can be conducted. It may be necessary to request information from the carrier that is operating the particular site, all the information that would be

requested is the same information that is sent the FCC when the site is activated. Other sources of evidence include, but need not be limited to:

Federal Communications Commission authorizations: The FCC is the licensing authority for all wireless communications companies. Their rules and regulations guide these companies in all their activities. Compliance with these rules and regulations insures safe operations of equipment. Any inspections must take into account these rules and regulations.

City Planning Documents: Application and approval process for a wireless carrier is thorough and all documents generated by that process are relevant to the existence of the wireless facility. These documents must all be reviewed and salient information extracted for successful completion of a wireless facility inspection and generation of the resulting reports.

City Building Department Documents: The approved plans and specifications of the wireless facility must be used to ascertain that the resulting facility was constructed per the “as built” plans on file with the Building Department. As with the Planning Documents these documents are necessary.

Accountability Plan: Having a baseline documentation from prior inspections will assist in assuring accountability of the wireless carriers in the future. The initial wireless carrier site inspection and its thoroughness will set this baseline.

Annual reports: Annual site inspections confirming compliance with prior reports will create a record of compliance and safety.

Site visit reports: The site visit report will detail compliance with City Planning and Building documentation.

Other documents, data, and information Wireless Carrier Lease: The lease is the contract between the City and the wireless carrier and details the rights of both and needs to be reviewed as part of the process to assure compliance with all authorizations.

Site inspection report: The inspection process will include a complete review of pertinent City records so any previous site inspection reports will be helpful in establishing

Summary of Documentation Review The summary will determine the wireless carrier’s compliance with the rules, regulations and conditions of authorization of all levels of authority taking into account all of the above-listed documents, reports, data, and agencies requirements together with other information as appropriate will be the guiding documentation for the creation of the Site Inspection Report for its use in evaluating compliance with the various authorizations. The summary of review will be presented as a confirmation that all required documentation was available for use by the

independent site evaluation team to make their report complete at the time of the individual site visit

II. Planning and Scheduling the Wireless Carrier Inspection Site Visit

A. Role of the Wireless Carrier Inspection Site Visit

The site visit is the event the results of which utilizes all the information gathered in the documentation review to generate the Wireless Carrier Site Inspection Report. This report will document compliance with all authorizations and can be used in many ways from ascertaining that lease renewal options are viable to insuring public safety.

Document Inspection

The process of inspecting the documents detailed in Source of Evidence above will reveal site characteristics necessary to insure efficient use of time for the inspections. Grouping sites for scheduling site visits by common characteristics other than just geographic proximity are very helpful. Rooftop sites may require special authorizations for access and this might present a timing issue that can be dealt with early in the mobilization process instead of later when the time is important.

Preparing the Inspection Site Visit Schedule In the mobilization phase of the wireless carrier inspection process while gathering information from the City documentation site characteristics will be logged into a database to allow evaluation of logical groupings of sites for inspections.  Some of the commonalities used might be identification of the wireless carrier, location, type of facility such as a ground site, a rooftop, a “stealth” site (one which has design characteristics to disguise the site or the appearance of the antennas), or access issues.  The completion of the mobilization phase will also be the completion of the site visit schedule as well as completion of the requisite database and documentation package needed for each site visit. 

Overview of Site Visit Inspection Activities, Responsibilities, and Schedule

All Site Visits will be accomplished by a Principal of Vanguard Communications Development or a licensed professional provided by Vanguard Communications Development and identified in documentation provided by Vanguard Communications Development for the purpose of providing specific services which require a specific level of expertise subject to licensing. The evaluator on each site will be responsible for completing the information required by the Site Inspection Report. The schedule for the inspection process will break up the workflow into segments that will allow inspection and report generation in a logical grouping so that the project flows with completions of reports for

review, discussion and City acceptance throughout the project instead of at the completion of the project. When all the sites have been inspected and all reports submitted there will be a demobilization period for project wrap up which will include meetings for project review and evaluation of results and performance of Vanguard Communication Development in accomplishing the project goals.

III. Analyzing Wireless Carrier Performance

A. Wireless Carrier Site Inspection Report Structure

The Wireless Carrier Site Inspection Report will be a report with several components. The results of the mobilization process will generate a wireless facility database as input into a Site Inspection Report format. The mobilization process will identify each document used in the preparation of the database and Site Inspection Report format. These documents will be referenced by name and date of generation and approval, if any. These documents will be a part of the “Report” by reference. The main body of the report will be the Site Inspection Report completed on site at the time of the inspection with all comments made at that time by the evaluator. These reports will be in hard copy and digital form.

IV. Responsibilities of Vanguard Communications Development and the City This section briefly summarizes the significant responsibilities of the evaluation team and the contracting City. This summary is not intended to be comprehensive; the specific tasks undertaken by each participant will vary depending upon the authorizations, size, past history and performance, and unique characteristics of each wireless facility

A. Wireless Facility Inspection Organization and Team Responsibilities Prior to the inspection site visit, the inspection organization has the following responsibilities:

• Assemble a team of individuals whose professional backgrounds and expertise are relevant to the Request for Proposals’ purpose, work scope, qualification requirements, and the City’s Profession Services Agreement.

• Ensure that the number of team members is sufficient to perform a comprehensive review of the school, as required by this Protocol.

• Designate a team leader who will serve as the team’s point of contact with the City, coordinate the work of team members, and, if appropriate, lead the team’s work in preparing the inspection reports.

• Endeavor to accommodate reasonable requests from the City for minor changes to document production, plans or schedules.

• Ensure that all team members have familiarized themselves with this Protocol.

B. City Responsibility

Before the inspection site visits and during the mobilization phase, the City has the following responsibilities:

• Participate in meeting with Vanguard Communications Development. The inspection team, will be allowed to discuss any issues subject to this Protocol and Request for Proposals and the Professional Services Agreement.

• Provide the inspection team leader with the documents required by this Protocol, in electronic form (e.g., in email attachments or on a CD) when feasible, by the required date.

• As needed, work with the inspection team leader to develop the site visit schedule and inform if necessary the wireless carriers of the schedule and the team’s access requirements.

• Designate a first and second City contact person who will be available to respond to team inquiries and requests.

• Provide the team with comfortable, private, and secure working space.

• Provide Access to the sites.
