6. UndertheArizonaConstitutionandArizonaRevisedStatutes,theelected

SheriffofMaricopaCountyhastheauthoritytorequestassistancefroma

volunteerpossetoassisttheSheriffintheexecutionofhisduties,working

underlawenforcementauthorityoftheMaricopaCountySheriff.

7. UponactivationbytheMaricopaCountySheriff,certifiedPossemembersare

empoweredtoactasiftheSheriffhimselfwerepresentwhencalleduponto

doso.PossemembersoftheMCSOaredelegatedtheirlawenforcement

authoritybytheMaricopaCountySheriff.

8. UnderthatactivationSheriffArpaiograntedfullylawenforcementauthority

oftheMaricopaCountySheriff’sOfficetoconductthisinvestigationandto

. InOctoberof2006,SheriffArpaioorderedthecreationoftheMCSOColdCase

Posse(CCP).AthispersonalrequestIacceptedappointmentascommander

ofthisunit.Ihaveservedinthiscapacityforthelastsevenyears.

10. ThepurposeoftheCCPwastoassistMaricopaCountySheriff’sOfficein

investigationsincludingactiveandColdCaseHomicides.Sinceitsinception,

theCCPhasbeenplacedundertheguidanceandcontrolofTheGeneral

InvestigationDivision.

11. TheMCSOColdCasePosseconsistsofhandselectedindividualswithdiverse

skillsconsistingofprofessionalexperiencesinconductinginvestigations,

includingindividualswithbackgroundsinLawEnforcement,Insurance

FraudInvestigations,MilitaryService,Physicians,ComputerInformation

Systems,CorporateCEO’s,aswellasattorneyswhohaveparticipatedin

criminalandorcivillitigation.

12. SheriffArpaioreferredthecomplainttohisColdCasePosse,directingmyself

asLeadInvestigatortoreviewtheevidence,todeterminewhetherandto

whatextentthecomplainthadmerit,toinvestigatefurtherinduecourseas

necessary,andtoreportdirectlytoSheriffArpaio.

13. Afive‐memberteamofexperiencedinvestigatorswasexpresslyselected.It

includedformerpolicedetectivesandattorneys(whomhavereceived

additionalinvestigationaltrainingbyMaricopaCountySheriff’sOffice)who

workedvoluntarilyandatvirtuallynoexpensetothetaxpayer.

InvestigationoftheComplaint

14. SheriffArpaioreferredthecomplainttohisColdCasePosse,directingmyself

asLeadInvestigatortoreviewtheevidence,andtodeterminewhetherandto

whatextentthecomplainthadmerit.Weweretoinvestigatefurtheras

necessary,andreporttoSheriffArpaio.SheriffArpaioexpressedthatitwas

hisgoaltoclearthedocumentasauthenticandmovethecountryforward.He

alsorequiredthattheinvestigationbethoroughandabsentofanypolitical

ideologies,andthatitbeperformedwiththeutmostcareanddiligence.

15. AttheSheriff’sdirection,theprincipalfocusoftheinvestigationwasthe

electronicdocumentorcomputerimageontheWhiteHousewebsitethat

PresidentObamahadpresentedasanauthenticimageofhislong‐formbirth

certificatetotheAmericanpeopleandtocitizensofMaricopaCountyata

WhiteHousepressconferenceonApril27,2011,whenhehadsaid,“We

providedadditionalinformationtodayaboutthesiteofmybirth...yes,infact,

IwasborninHawaii,August4,1961,inKapiolaniHospital.”

16. Theinvestigatorswerealsodirectedtoreviewallbackground

documentationprovidedbythepetitionersinrelationtotheircomplaint,and

toconsiderallotherinformationobtainedordevelopedduringthenormal

courseoftheinvestigation.

17. ThepetitionerssuggestedthattheSheriff’sOfficeshouldstartbycontacting

Dr.JeromeCorsi,aninvestigativejournalistwhohadwrittenabookinsearch



ofMr.Obama’soriginalbirthcertificatedocumentandhadamasseda

substantialbodyofevidence.Dr.JeromeCorsiwasunknowntothe

investigatorspriortothisinvestigation.Subsequently,wespent16hours

interviewingDr.Corsi,whoagreedtoturnovertousforreviewallofthe

informationhehadonfile.

18. AttheconclusionofDr.Corsi’sinterviewIdeterminedthatDr.Corsi’swork,

(withtheexceptionofacopyofthedownloaded.pdffilereleasedbythe

WhiteHouseonApril27,2011)wastobetreatedas“investigational

information”onlyandnottobeconsideredasevidence.

19. Thebasisforthisdecisionwasdueinparttothefactthatsomeofthe

informationpresentedbyDr.Corsiwasacompilationofresearchperformed

byotherindividuals.InadditionDr.Corsiwasincommunicationwiththese

individualspriortomeetingwithusandtheseindividualswereyetunknown

toourinvestigators.

20. TopreservetheindependenceandintegrityofourinvestigationDr.Corsi’s

informationwouldbeutilizedasinvestigativebackgroundinformationonly.

Dr.Corsiworkedcloselywithourinvestigationasaninformationalsource

untilJuly2012.

21. Dr.Corsisuggestedthatweshouldcontactanationallyrecognizedcomputer

expert,MaraZebest,whohasservedasacontributingauthorandtechnical

editorformorethan100booksonAdobeandMicrosoftsoftware.Ms.Zebest



wascontactedandinvitedtoparticipateinatwo‐dayinvestigationalmeeting,

towhichweinvitedfiveotherparticipants:investigators,attorneys,and

professionalsincomputerizedgraphicdesign,ITprofessionals,anda

physician.NonehadanypriorfamiliaritywiththeWhiteHousecomputer

imagedocument.

22. Duringthatmeeting,allaspectsofthedocumentwereexaminedwiththe

intentionofattemptingtodisprovetheallegationthatthedocumenthadbeen

fabricated.Thisincludedareviewoftheworkofanauthorbythenameof

JohnWoodman.JohnWoodman,astruggling,self‐describedcomputerexpert,

hadauthoredabookputtingforthexplanationsonhowcomputersoftware

automaticallycausedtheanomaliescontainedintheWhiteHousedocument.

Mr.Woodman’sworkhadbeencitedvigorouslybynumerousmediaoutlets

attemptingtodisqualifyallegationssuggestingthatthe.pdfdocumentoffered

byMr.Obamawasanythingbutauthentic.

23. ThetheoriessetforthinMr.Woodman'sbookwerethoroughlytestedby

investigatorsandfoundtobenothingmorethanpurespeculationand

supposition.TheinvestigatorsconcludedMr.Woodman'sworkwasnothing

morethanconjecturewithoutanyevidentiaryproofthathistheoriescouldbe

supported.

24. Wheninvestigatorsputhistheoriesintopracticalapplication,theycouldnot

successfullyreproduceanyoftheanomaliesfoundintheWhiteHouse



documentbyautomatedcomputerizedprocess.ThereforeMr.Woodman's

workwasdismissedasirrelevantandofferingzeroevidentiaryvalue.

25. Attheendofthetwo‐dayevent,allinvestigationalinformationconcerning

the.pdffilewaspresentedwasintenselytestedanddeliberated.

26. AllinattendanceagreedunanimouslythattheWhiteHousecomputerimage

.pdffilecontainedanomaliesthatwereunexplainableunlessthedocument

hadbeenfabricatedpiecemealbyhumanintervention,ratherthanbeing

copiedfromagenuinepaperdocument.Thisconclusionalsoservedto

contradicttheallegedchainofeventssurroundingtheproductionofthe

document,asputforthbytheWhiteHouseandtheHawaiiDepartmentof

Health.

27. InvestigationalfindingsthusfarwerereportedbacktoSheriffArpaio.Having

informedSheriffArpaiothatthedocumentappearedtobeafabricated

forgeryandthatviolationofArizonacriminalstatutesandfederalstatutes

mayhavetakenplace,itwouldbeessentialtocontinuetheinvestigation.

SheriffArpaioagreedandinvestigatorsbegantopursuefurtherinvestigation

ofthe.pdffileandrelatedeventssurroundingthecreationofthedocument.

28. Thisservesasanoutlineofourwork,preliminaryresults,andpreliminary

conclusionstodate.Asofthedateofthisreport,thisinvestigationremains



openandongoingandadditionalforensicevidencecontinuestobeuncovered

furthervalidatingtheoriginalinvestigationalfindings.

29. InvestigatorsstudiedMr.Obama’s“short‐form”Hawaiianbirthcertificate

thatbecamepublicin2008;the“long‐form”certificateendorsedbyMr.

ObamaataWhiteHousepressconferenceonApril27,2011,andthenposted

asanelectroniccomputerimageatwww.whitehouse.gov(nophysical

documentwasproduced);andtheselectiveserviceregistrationcardallegedly

signedbyMr.ObamaonJuly30,1980.

30. Weinterviewedseveralpersons,consultedmanyexperts,testedand

evaluatedcomputerevidenceusingrelatedsoftware.Inearlyin2012,I

informedSheriffArpaioofourpreliminaryfindings.Ireportedthatafter

extensiveexaminationoftheelectronicdocument,thecomputerimage

releasedbytheWhiteHouseonApril27,2011,andexaminationofMr.

Obama’sSelectiveServiceregistrationcard,thatwebelievedtherewas

probablecausetosuspectMr.Obama’sidentitydocumentswerein‐fact

forged.

31. TheSheriffheldapressconferenceonMarch1,2012,toannouncethe

findingsthatinvestigatorshadconcludedthatthedocumentreleasedonApril

27,2011,bytheWhiteHouseofMr.Obama’slongformbirthcertificatewasa

computergeneratedfraudcreatedexclusivelybyhumaninterventionandnot

bytheactionsofrandomcomputerization.Thepressconferenceservedto



attractfurtherevidence,andtogiveusanopportunitytopresentanoutlineof

ourreasons.

32. OnMarch1,2012,SheriffArpaioheldapressconferenceduringwhichhe

andIpresentedanoutlineofthoseaspectsoftheinvestigationthatwouldnot

compromisethesafetyofwitnessesortheintegrityandfuturecourseofthe

investigation.

33. Atthattime,weannouncedthatwehadconcludedthattherewasprobable

causethatforgeryandfraudhadbeencommittedinrespectoftwo

documents:1)thelong‐formororiginalbirthcertificatecomputerimage

presentedbyMr.,Obama,whichcontainedmultipleerrorsandanomalies,

manyofthemseriousand:2)theselective‐servicedocumentforMr.Obama,

whichcontainedatwo‐digityear‐stamp.Thiswascontrarytospecifications

issuedbyfederalregulationtotheeffectthattheyearofissueshouldbe

expressedasfourdigitsonthestamp,andalsocontrarytoanyother

selective‐serviceregistrationdocumentthatwehadbeenabletoexamine.

34. IvisitedHawaiitwiceandcontinuedourinvestigation.Afterfurtherin‐depth

computerizedtestinganddiscoveringadditionalinformation,weconcluded

inmid‐2012thatMr.Obama’sidentitydocumentswerenotonlyforged

beyondthelegalstandardofprobablecause,butduetoloopholesinthestate

ofHawaii’svitalstatisticsreportinglaws,therewasthedistinctevidence

suggestingthatHawaii’sstatutesappearedtobeinconflictwithfederal



immigrationlawandposedanindependentthreattothenationalsecurityof

theUnitedStates.

35. Afterthreemonthsoffurtherinvestigation,theSheriffheldasecondpress

conferencetoannounce,withmysupport,thattherewasnolongeraquestion

ofmeresuspicionbutthatofprobablecause.Itwasnowdemonstrated

beyondprobablecausethatthedocumentpresentedtothepublicbyMr.

ObamaandplacedontheWhiteHousewebsitewasanutterforgery.

36. Inaddition,SheriffArpaioreportedconcernsthatHawaii’sstatutesappeared

tobeinconflictwithfederalimmigrationlawandthebirthregistrationpolicy

inHawaiiposedathreattonationalsecurity.

37. SheriffArpaiostatedatbothpressconferencesthatwearenotinaposition

toconcludeeitherthatMr.Obamahimselfhascommittedanyoffenseorthat

hewasbornoutsidetheUnitedStates,northatheisconstitutionally

ineligibletoseekorholdtheofficeofPresidentoftheUnitedStates.

38. However,thefactthatmostifnotalloftheidentitydocumentsareforged

supportsthecomplainant’sallegationthatMr.Obama,inendorsingand

postingaforgedbirthcertificateimageontheWhiteHousewebsite,has

raisedlegitimatequestionsthatshouldnowbeinvestigatedbyCongress.

39. SheriffArpaioalsoannouncedthattheinvestigationwouldcontinue,andit

hascontinuedeversince.

TheOngoingInvestigation

40. Astheinvestigationcontinued,variousnationalandlocalmediaattemptedto

disqualifytheinvestigativefindingsbyfosteringalternativeexplanationsfor

thedocumentsirregularities.Opponentsmadenothingmorethan

superficialexplanationsallegingthattheObamadocumentsirregularities

weresimplycausedbynothingmorethantheautomationprocessesof

computersoftware.However,themediafailedtoputforthanyinvestigative

evidencetovalidatetheirtheories,whichweresoundlydefeatedbyover

ors.1,200independentcomputersoftwaretestsconductedbyinvestigat

41. Investigatorswantedtodeterminetheprobabilitythatadocument

containingtheplethoraofirregularitiesasfoundinthecomputerimage

Obamapresentedcouldstillbegenuine.

42. Takingitastepfurther,investigatorssoughtanindependentauthorityon

forensicdocumentexaminationthathadnopreviousconnectionwithour

inquiry.Investigatorscommissionedacourtcertifiedhandwritinganalyst

andforensicdocumentexaminerwithover20yearsofexperienceproviding

documentexpertisetolegalandlawenforcementcommunities,corporations,

financialinstitutionsandprivateindividualsforthistask.

43. Investigatorsrequestedanindependentreviewofourfindingsinrespectto

thelong‐formbirthcertificateimagethatfellwithinhisfieldofexpertise.

. Upontheconclusionofourexpert’sexaminationheissuedanindependent

40pageforensicreportinwhichheverifiedourinvestigationalfindingand

validatingconclusioninfullagreementwiththefindsofinvestigators.He

concluded:

x “…basedonmyobservationsandfindings,itisclearthatCertificateofLiveBirthIexaminedisnotascanofanoriginalpaperbirthcertificate,utadigitallymanufactureddocumentedcreatedbyutilizingmaterialbfromvarioussources.”and

x “Inover20yearsofexaminingdocumentationofvarioustypes,Ihaveeverseenadocumentthatissoseriouslyquestionableinsomany

abricated.”nrespects.Inmyopinion,thebirthcertificateisentirelyf

AuthenticityofWhiteHouseReleasedBirthCertificateImage

45. Investigatorshavedeterminedbeyondprobablecausethatthecomputer

imagereleasedonApril27,2011bytheWhiteHouse,andpurportingtobea

truecomputercopyofMr.Obama’slongformbirthcertificate,isnotascanof

anoriginalhardcopydocument.Itis,infact,anundeniablecomputer

generatedforgerycreatedwiththesoleintenttodeceivethepublicby

commissionoffeloniousfraudulentacts.

46. SheriffArpaio’sinvestigatorshavedeterminedthedocument(the.pdffile

releasedbytheWhiteHouse)wascreatedentirelybyhumanintervention,

andnotbytheactionsofrandomcomputerization.Assuch,theWhitehouse

computerimagecannotberelieduponasbonafidefactualrecordofthebirth

eventthatitattemptstodepict.

. Ourinvestigationhasalsoconcludedthatthemethodusedtofabricatethe

documentwasbymeansofhumanlogicandthedistinctmanualplacement

anddistributionofelectronicdatabetweenninedistinctcomputergenerated

“layers”.Thistypeoflayeringisentirelyuncharacteristicofapaperdocument

that,whenscanned,resultsinasimple,digitized,singlelayerphotographic

image.

48. Investigatorsinparticularfocusedontheregistrarstampbearingthe

signatureofHawaiiStatesRegistrarDr.AlvinT.Onaka.Thisstampwasfound

tobecomprisedofexternalobjectsthatwereimportedintothedocument,

createduniquelyfortheforgeryoftheObamabirthdocument,byan

intentionallydeceptivecut‐and‐pasteprocess.Thisfactaloneissufficientto

rendertheentiredocumentvoidofanyprobativevalue.

49. Ourinvestigationalfindingssoundlydefeatedtheonlytwoattempted

explanationsoftheanomaliesonthecomputergeneratedlong‐formbirth

certificateimageofferedforjustification:OCR(OpticalCharacter

Recognition)and/orOptimization(Compressionofthefilesinorderto

reducethefilesize).Investigatorsattemptedtorecreatetheanomaliesfound

inthecomputergeneratedimagebytediousimplementationofthesome

1200computerizedtests,andwereunabletorecreatetheanomalies

containedintheWhiteHouse.pdffile.Investigatorsclearlydemonstrated



thatneithercouldaccountforthemyriaddiscrepanciesfoundintheWhite

Houseimage.

50. Subsequently,thisissupportedbyanindependentexpertforensic

examinationconfirmedtheelectroniccomputerimageofBarackObama’s

longformCertificateofLiveBirth,releasedbytheWhiteHouseonApril27,

2011,isinfactaforgery,thussupportingtheinitialfindingsofour

investigation.

51. ThereforeMr.Obamahasinfactnotofferedanyverifiableauthoritative

documentofanylegalsignificanceorpossessinganyevidentiaryvalueasto

theoriginsofhispurportedbirthnarrativeorlocationofthebirthevent.

52. InadditioninvestigatorshavedeterminedthattheWhiteHouse.pdffile

displayingamanufacturedimageofMr.ObamaspurportedHawaiianbirth

certificatecouldnotsurvivejudicialscrutinyorbeofferedasdocumented

evidence,certifiedbytheStateofHawaii,asproofattestingtotheeventand

thereforecouldnotbeacceptedassuchinanyjudicialproceeding.

53. Assuch,thiscomputermanipulatedfraudulentimagecannotbedeemedas

acceptablelegalevidenceforthepurposeofvalidationorverificationof

identityorcitizenship,orserveasverificationofabirtheventbyany

SecretaryofStateintheconfinesoftheUnitedStates.

54. Mr.Obamahasnotreleasedanyevidenceotherthanamanufactured

computerforgerybyhumaninterventionanddesigninanefforttosupport



hisclaimofhisbirthtakingplaceatKapiolaniHospital,Honolulu,Hawaiion

August4,1961.

55. Additionally,HawaiiStateStatuesandHawaiiDepartmentofHealthpolicy

donotauthorizetheHawaiiDepartmentofHealthtocreateacomputer

generated.pdffileasanofficiallycertifieddocumentseveringasaverification

ofalivebirthevent.

56. Theverycreationthis.pdffilerunsindirectconflictwiththeHawaii

DepartmentofHealth’sownadmissiondeclaringtheyreleasedtwopaper

copiesofa“BirthDocument”tothePresident’sattorneyPerkinsCoiepartner

JudithCorleyonApril25,2011.

57. AccordingtocopiesoflettersreleasedbyWhiteHouseofficials,JudithCorley

initiatedtheprocessandtraveledtoHawaiitopickuptwophotocopiesof

Mr.Obama’slongformbirthcertificate,notanelectronic.pdffile.Thetwo

copiesreleasedtoJudithCorleyhaveneverbeenmadepublic.

58. Investigatorshavealsodeterminedthatthemuchtouted1961newspaper

announcementsareinfactutterlyunreliableasevidencetosupport

verificationoftheeventasdepictedinthe.pdfimageofthemanufactured

birthcertificatereleasedbytheWhiteHouseandattestedtomyMr.Obama.

Inadditiontheaforementionedannouncementscanbeofnosubstitutefora

HawaiiStateOfficialBirthCertificationandorCertificate.

. Insummation,investigatorsbelievethatthecomputerimagepresentedby

theWhiteHouseisanunabashedforgery,andthuscouldnotsurviveeventhe

lowestlevelofjudicialscrutinyinanyjurisdictionintheUnitedStates,and

doesnotserveasevidenceorcertificationofanysuchevent.

60. Furthermore,itcannotbeusedasanauthenticatedlegaldocumentforproof

ofcitizenship,orprooftoobtainalegitimatepassport,orlegitimateSocial

SecurityIdentificationNumber.Itmostcertainlycannotberelieduponas

legitimateproofandverificationofalivebirtheventbytheresidentsof

MaricopaCounty,theStateOfArizona,orinanyjurisdictionwithintheUnited

States.

Arizona’sVerificationAttemptsThwarted

61. ArizonaSecretaryofStateKenBennettrequestedverificationofMr.Obama’s

birthrecordsfromtheStateofHawaiiDepartmentofHealth:

62. “PleaseverifythattheattachedcopyoftheCertificateofLiveBirthforMr.

Obamaisatrueandaccuraterepresentationoftheoriginalrecordinyour

files.”

63. However,HawaiiDepartmentofHealthStateRegistrarDr.AlvinT.Onakadid

notverifytheWhiteHousecomputerimageasatrueoraccurate

representationoftheoriginalbirthrecord,onlyresponding,“theinformation

inthecopy…thatyouattachedwithyourrequestmatchestheoriginalrecord

inourfile.”

. Hawaiiofficialscleverlyfocusedontherepresentationofinformation

depictedinthefraudulentimagedivertingattentiontothefoundationofthe

requestofSecretaryofStateBennett.“Pleaseverifythattheattachedcopyof

theCertificateofLiveBirthforMr.Obamaisatrueandaccurate

representationoftheoriginalrecordinyourfiles.”

65. “Information”isnotaverificationofthedocument(.pdffile)asawhole.

66. Afraudulentlycreateddocumentoftentimescontainsmatchinginformation

onsomelevelwhencomparedtosomeotherdocumentofrecord,however,

thefactthatsomeinformationmaymatchinafiledoesnotverifythe

legitimacyofthedocumentasawhole.

67. Inthiscasethe.pdfimagepresentedbytheWhiteHousetothepublic,isin

theappearanceofwhattheunsuspectingpublicwouldperceivedtobeatrue

copyofanofficialdocumentandthereforeacceptedonfacevalue.Thisalso

includesthefabricationandappearanceofgreensecuritypaperbackground

thatonewouldexpecttobeusedonsuchanofficialdocument.Thecreation

anduseofthisbackgroundwouldsolelybeusedtogivetheperceptionof

authenticityinanofficialcapacity.

68. Further,Hawaiihasnotacknowledgedthattheyevercreatedorreleasedan

electroniccomputercreated.pdffilecontaininganimageoftheBarack

HusseinObamaIIHawaiiCertificateofLiveBirthtotheWhiteHouseortothe

attorneyforBarackHusseinObamaII.Theyalsodidnotverifyhowand



wheninformationmayhavebeenaddedordeletedfortheoriginalfileandfor

whatpurpose.

69. ThePDFfilepostedontheWhiteHousewebsiteshowsnoevidenceofascan

ofaphotocopieddocumentevertakingplace,butdisplaysalltheevidenceof

amanufacturedfile.Anelectronicimageofthephotocopieddocumentasit

wouldhavebeeniftheoriginaldocumenthadbeengenuinewouldnothave

possessedtheirregularitiesintheWhiteHouse.pdffilethat,inourforensic

experts’opinion,demonstratethattheimagewaspiecedtogether

electronicallyfrommultiplesources.

70. OneofourmostseriousconcernsisthattheWhiteHousedocumentappears

tohavebeenfabricatedpiecemealonacomputer,constructedbydrawing

togetherdigitizeddatafromseveralunknownsources.

IsolationOfTheRegistrar’sSignatureAndDateStamps

controversymighthurtthePresident’schancesofre‐electionin2012.

107. Mr.Abercrombie,whoisamemberofMr.Obama’spoliticalparty,said

thatthebirthcertificateissuewouldotherwisehave“politicalimplications”

forthepresidentialelection“thatwesimplycannothave.”

108. Mr.Abercrombiedidnotsubsequentlyreportthateitherheorthe

HawaiiDepartmentofHealthhadfoundMr.Obama’slong‐form,hospital‐

generatedbirthcertificate.Thegovernoronlysuggestedhisinvestigationto

datehadidentifiedanunspecifiedlistingornotationofMr.Obama’sbirththat

someonehadmadeinthestatearchives:“Itwasactuallywritten,Iamtold,

formerlyDirectorofHealthforHawaiihasmadeseveralstatementsof

interest:

115. InOctober,2008,shesaidHawaiianlawforbadetheissuanceof

certifiedcopiesoforiginalbirthcertificatestopersonswithnotangible

interestintherecord,butaddedthatsheandDr.AlvinOnaka,theRegistrarof

VitalStatistics,hadpersonallyseenandverifiedtheoriginalbirthcertificate

“inaccordancewithstatepoliciesandprocedures”.

116. Tothisday,Dr.Fukinoistheonlypersonwhohassaidpubliclythatshe

haspersonallyinspectedMr.Obama’sactualbirthcertificateinaboundbook

inavaultattheDepartmentofHealth.

117. Dr.Fukino’sstatementconfirmsGovernorLingle’sownstatementthat

shedidnotpersonallyverifytheexistenceoftheoriginalbirthcertificate,but

reliedsolelyontherepresentationsofDr.Fukino,whosestatementalso

impliesthatabirthrecordofsomekindexistsandthatsheinspectedit,

thoughsheprovidedneitheradescriptionofthedocumentnoranyverifiable

informationsaidtohavebeencontainedtherein.

118. Dr.FukinosaysshewasaccompaniedbyDr.AlvinOnaka,withwhom

sheviewedthedocument.WenotedthatDr.Onakahasneverpublicly

confirmedthathehadaccompaniedDr.Fukinoorthathehadverifiedthe



existenceofthedocument.Dr.Onakahasremainedsuspiciouslysilentonthe

mattertodate.

119. Underthesecircumstances,Dr.Fukino’sstatementtotheeffectofa

verificationofanauthentic“LongFormBirthCertificate”haslittleevidential

value.

120. Dr.FukinoalsogaveaninterviewtoCNNonApril26,2011,inwhich

shestatedthatshesimplywentintothevaultandinspectedMr.Obama’s

originalbirthcertificate.Byinference,then,itshouldhavebeennomore

difficultforGovernorAbercrombietolocateitaswell.

121. InJuly,2009,Dr.Fukinosaidshehadseen“theoriginalvitalrecords

maintainedonfilebytheHawaiiStateDepartmentofHealthverifyingBarack

HusseinObamawasborninHawaiiandisanatural‐bornAmerican.”Again

thisstatementhasnoevidentialvalue.

122. AsreportedbyFoxNews,Dr.Fukinosaidthatduringhertimeas

DirectorofHealthforHawaiiDr.AlvinOnaka,StateRegistrarofHawaii,had

movedMr.Obama'sbirthcertificatefromafilevault,whereboundbooks

containingvitalrecordslinetheshelvesinhandwritten,leather‐bound

ledgersandplacedinsidethevault's5‐ft‐tallgraymetalcombinationandkey

locksafethatholdsmoneyandothervaluables.Ifso,Dr.Onakacouldvery

easilyhavealertedGovernorAbercrombietoitswhereabouts.

beeneasilyobtainablefromtheDepartmentofHealthupontheGovernor’s

126. Dr.FukinoalsosaidthatMr.Obama'soriginalCertificateofLiveBirth

wasboundinaledgercontaining499othercertificatesofpeoplebornin

Hawaiiin1961.Therewere500sheetsperbook,and35volumesof1961

birthrecords.Thelastseriesofdigitsintheregistrationnumberfoundon

Hawaiianlongformandcurrentcomputerized‐formatbirthcertificates

indicateswhichnumberedvolumecontainstheoriginaldocumentinsidethe

healthdepartment’sfirst‐floorvault.

127. Sheexplainedthateachoftheboundvolumesforthe1960s,including

theonecontainingMr.Obama'sbirthcertificate,hadbrightorangeelasticized



canvascoverswiththebirthyearstampedclearlyonthespine.Different

volumeof500sequentially‐numberedcertificates,orthat,ifitispresent,it

didnotshowhimashavingbeenbornanywhereinHawaii.

134. Investigatorsfoundahighpotentialforfraudintheregistrationand

issuanceofHawaiibirthcertificationdocuments.Itwasdiscoveredtobe

evidentin:1)laxstatutoryregulationand2)throughobscureevidentiary

requirementsinestablishingfactualverificationoftheinformationrequired

inthereportingoflegitimatebirthsoccurringwithinthestateofHawaii.

135. In1982,Hawaiirevisedalongstandingstatute(§338.17.8)allowing

theissuanceofbirthcertificatestochildrenbornoutofstate.Hawaiideclares

theseforeignbornchildrentobeAmericancitizenssimplybyvirtueofan

applicationbyanyadultmakingrepresentationsonbehalfoftheparents,and



simplysupplyingdocumentationsubstantiatingtheparentshadresidedin

HawaiiandpaidincometaxtothestateHawaiiforoneyearpriortothebirth

ofthechild.Thus,bystatutoryprovision,Hawaiihasgranteduponitselfthe

uniquepowertoconfercitizenshiptochildrennotbornintheUnitedStates,

andtochildrennotborntoUnitedStatescitizenparents,buttochildren

actuallybornonforeignsoil.

[§338‐17.8]CertificatesforChildrenBornOutofState.

(a) Uponapplicationofanadultorthelegalparentsofaminorchild,theDirectorofHealthshallissueabirthcertificateforsuchadultorminor,providedthatproofhasbeensubmittedtotheDirectorofHealththatthelegalparentsofsuchindividualwhilelivingwithouttheTerritoryorStateofHawaiihaddeclaredtheTerritoryorStateofHawaiiastheirlegal

Statescitizenship.
