INTRODUCTION

على النبي الأمي الكریمالله الرحمن الرحیم. و صلى الله بسم

All praise is due to Almighty Allah, Peace and Blessings

upon our Noble Master Nabi Muḥammad صلى الله عليه وسلمThe purpose

of this booklet is to highlight the great disservice some

Muslim organisations and associations have done to the

Deen of Allah Ta‘ala.

These organisations have watered down important

injunctions of the pristine Deen of Allah Ta‘ala and we

have sound evidence to show that in the process they

have committed Istikhfaaf (taken certain order of the

Shari’ah as insignificant).

Actions such as these fall under the ambit of this verse of

the Glorious Qur’ān in Surah Āl-e-Imrān, Verse 187:

““And remember (when) Allah took a covenant from the

People of the Book, to make it known and clear to

mankind, and not to hide it; but they threw it away

behind their backs and purchased with it some miserable

gain! And vile was the bargain they made”!”

This verse was revealed regarding the evil scholars from

the people of the Book (Jews and Christians) who

withheld the true Message of Allah Ta‘ala and changed

HIS commandments to suit people’s wishes and popular

opinion - and this for a meagre worldly gain!

Foreword Bismillahir Rahmaanir Raheem

All praises are due unto Allah, Most High.

Whomsoever Allah Guides, no one can mislead, and

whomsoever Allah misleads, no one can ever guide.

May Allah’s Mercy perpetually cascade down upon our

Beloved Nabi Muḥammad صلى الله عليه وسلم, his noble family and his

august companions for eternity.

It is an indisputable fact that this Ummah of our

cherished Nabi Muhammed صلى الله عليه وسلمis undergoing an

unparalleled and colossal crisis. This is mostly a crisis of

Knowledge.

The propagation of Knowledge depends on having

reliable information. Coupled with courage, honesty and

sincerity, the immense task of disseminating knowledge

becomes much simpler and effective.

Speculation, conjecture and guesswork leads to the

obfuscation of the Truth.

An example of such corruption of truth is evident in the

following statement:

This public pronouncement issued by the Jamiatul Ulama

(based in Fordsburg), makes several grievous allegations:

1. There is a sustained disinformation, malicious

ratcheting campaign led by anonymous detractors

and sources against them (henceforth referred to as

“The Jamiat”).

2. Due to this, there is much confusion within the

Ummah, leading to an erosion of trust and

confidence in the Ulama.

3. “The Jamiat” would like to assure all its members,

associates, affiliates and the general Muslim public

that the Ulama body remains the same in thought,

practice and dedicated service, through leading,

guiding and representing the Muslim’s interest in

the affairs of Deen, for nearly a century.

Had they been left unanswered, these allegations could be

easily deemed as factual and truthful.

However, with the fadl of Allah Ta’ala, this humble

kitāb”” is presented to the esteemed reader, who at the

end will hopefully have gained a fuller picture and better

opportunity to make up their own minds as to the where

the Truth lies.

On the specific issue of naming and exposing the one who

misguides others, Imāaam Abu Hanifah (Rahmatullah

alayh) said to his Student, Imaam Abu Yusuf

(Rahmatullah alayh):

“When you are aware of the evil of a person, then do not

speak/mention this about him, but search for goodness

from him, and speak about it, except in the matter of

Deen. If you are aware of it (evil) in his Deen then mention

him to the people, so that they do not follow him and so

that they stay away from him.

Rasulullah صلى الله عليه وسلم said:

‘Mention the faajir with that in which he indulges, so

that the people stay away from him even if he is a man of

status and position.’

And the person in whom you see corruption of the Deen,

mention that (to the people) and do not be concerned about

his status, for verily, Allah Ta’ala is your Aid, and your

Helper.” (Wasayāā Imaam A’zam, p. 25)

Furthermore, there are ‘Ulama who may have unwittingly

adopted or supported certain views which, in hindsight,

they may modify and alter after reading this Kitab.

As for those who knowingly follow such misguidance, no

force of persuasion can alter the path of such a hopelessly

lost soul, whose mission is unambiguously focussed on

self-sabotaging his Imaan.

For such people, there can only be but one du’á:

‘O Allah guide them, for they “do not know”

Friday June 11, 2010 was a calamitous, disastrous day in

the history of South African Muslims – and should forever

be recorded as such!

This day was the Friday when an Aalim purportedly

representing South Africa’s Muslims abandoned Jumu’ah

Salaah in the Masjid in favour of attending the World Cup

soccer!

Why was this such a terrible event for South African

Muslims? The answer is that, without perhaps

comprehending the gravity of what he was doing, ALLAH

MOST HIGH WAS CHALLENGED WITH A HOST OF

SINS!

And we are duty-bound to endeavour to strive towards

the Shari’ah” (Moulana Bham)

“Furthermore, giving full support and backing and

encouraging the World Cup is going against the directives

of Islam and Shari’ah. This is challenging Allah Ta’ala.

This is directly or indirectly expressing disapproval of

Allah Ta’ala’s Laws and Nabi’s (Sallallaahu ‘alayhi wa-

Sallam) teachings.”

After making this clear and decisive statement, Moulana

then enumerated the following sins which are prevalent at

soccer games:

1. Missing Salaah

2. Hero worship

3. Music

4. Zina (Adultery)

5. Wastage and corruption

6. Alcohol consumption

7. Lewd, immoral dressing

8. Mixed gatherings

screaming, music, drink and other sins are being engaged in simultaneously, should think for themselves of what a display of hypocrisy they make. Because that is exactly

what it is: Hypocrisy”

sports games. These include indisputable sins like

gambling, corruption, alcohol consumption, nudity,

singing, dancing, wasting of time, squandering of wealth,

abandoning Salaah in the Masjid, neglecting the family,

forgetting Allah, The Most High, and forgetting about

Maut (death).

Each match is a disaster for a Muslim.

Following the attempted assault on renowned Zimbabwean

scholar Mufti Ismail Menk, secretary general of the Jamiatul

Ulama South Africa Moulana Ebrahim Bham has voiced his

concerns about the incident.

ML BHAM told Radio Islam:

“This particular aspect of extremism which has reared its

head in our community perturbs me tremendously,”

THEN ML BHAM said people do feel entitled and passionate

about expressing their views regarding the Qur’an, the

EATING FROM A TABLE

Question: Some people are of the view that it is not a

Sunnah to sit and eat on the floor. Please comment on

this with the necessary references.

Answer: Hadhrat A’isha Radiallahu Anha says that the

Messenger of Allah never ate while reclining and would

say:

““I eat as a slave eats and I sit as a slave sits.” The Hadith

continuous with: “I am a slave of Allah. Pride does not

suit a man. And I eat with humility and humbleness.

(Mishkaat)

The above Hadiths clearly depict the great Sunnah of

removing the shoes and sitting and eating with

humbleness and humility on the floor.

Rasulullah Sallallahu Alayhi Wasallam sat on the floor

his entire life and humbly ate his meagre meals.

And in Rasullullah Sallallahu Alayhi Wasallam, do the

true lovers find an excellent example.

IMITATING OTHER NATIONS

Rasulullah عليه وسلم :said صلى الل

“Whoever imitates a nation will be counted among

them” [Abu Dawud]

Once Rasulullah عليه said that a time will dawn وسلمصلى الل

when Muslims will follow the Jews and the Christians metre

by metre, centimetre by centimetre, right “into the lizard’s

home”.

In other words, the emulation of the Kuffaar by Muslims will

take place gradually until it is eventually total. In other words,

every evil and filth of the Yahood and Nasaara will slowly and

surely be regarded as honourable and progressive. We are

today living in that predicted age.

Excerpts from a book entitled “Universities”

Written by an anonymous Muslim Professor

“Apart from the [lack of] modesty of dress, the campus

environment encourages a manner of behaviour that is

completely devoid of any sense of modesty.

Students tend to behave very flirtatiously with all members of

the opposite sex, irrespective of whether it is done with

romantic intentions or not.”

AND ON MUSLIM STUDENT ORGANISATIONS:

“One such area is that of Muslim student organisations that

claim to represent the interests of Muslim students on campus.

While the intention is noble, we find that the method is often

riddled with flaws. There is open intermingling and flirting

between members of the opposite sex to the extent that

marriages have taken place and been broken with in

such organisations.”

ON MISSING SALĀĀH

“On the other hand, Salah is often neglected in order to

host some events. It is vital that we question our motives

when joining such organisations and that we ensure that

we do not become vehicles for perpetrating Haraam

Islam under the banner of Islam.”

the propagation of deviant sects that claim to be within the

fold of Islam.”

Hasan Nadwi Rahmatullahi alayh where he had written

Darya e Kabul se Darya e Furaat Tak. (From the river of

Kabul until the river of Furaat).

And in there, Moulana says he went to Kabul where there

was a great influence of communism. He went to the

university to speak to the female lecturers about their

doubts about Islam.”

THAT’S IT.

NO QURAANIC VERSES CITED, NO AHAADITH,

NO IJMA, AND NO QIYAAS.

NOT EVEN A SHRED OF SHARÍ EVIDENCE.THE

ENTIRE SHARIAH IS SIMPLY PLACED UNDER

LOCKDOWN BY MOULANA BHAM.

EVIDENCE FOR HIJAAB, AND WHAT ḤIJĀB

SHOULD LOOK LIKE:

Some pieces of fine Egyptian linen were brought to the

Prophet of Allah (sallallahu alayhi wasallam). He gave

me one and said: “Divide it into two (pieces); cut one of

the pieces into an upper garment and give the other to

your wife for a veil.”

Then when I turned away, he said:

“And order your wife to wear a garment below it and not

to reveal her figure”. [Abu Dawud]

Yahya related to me from Malik from Hisham ibn Urwa

that Fatima bint al-Mundhir said:

“We used to veil our faces when we were in ihram in the

company of Asma bint Abi Bakr as-Siddiq.”

[Al Muwatta by Imam Maalik book 20, Hadith 16]

QARDAWI’S NO-HIJAAB DOCTRINE

In his first

public

address on

Friday

evening at

the

Newtown

mosque

in Johannesburg where the Imamat was led by

Moulana Ebrahim Bham, Sheik Yusuf al Qardawi laid

his finger on one of the most contentious issues in the

north by questioning the absence of women.

Qardawi pointed out that he could not complete his talk

since the women were absent.

And you won’t believe it. I jumped onto this plane…And

as I went on – Subhn-Allahi – you know there are

pilots…they are flying us…they are doing us a favour –

right – flying us. (Mufti Menk seems to have forgotten

that we do pay for the tickets!)

There was a woman who came out from the front. She

had proper Hijaab – proper Hijaab! She was covered

correctly.

She was very well dressed. She carried herself in a very

respectful way.

She addressed the people in a very respectful way.

And I saw her come in and go out”.

Our comment:

Subhanallah! Whatever happened to the following

Aayah:

“And tell the Mumineen men that they should lower their

gazes and guard their chastity. This is purer for them.

Allah is informed of what they do.”

having pictures on it. The colour of his face underwent a

change. He then took hold of that curtain, TORE IT, and

then said:

“THE MOST GRIEVOUS TORMENT FOR THE

PEOPLE ON THE DAY OF RESURRECTION

WILL BE FOR THOSE WHO TRY TO IMITATE

ALLAH IN THE ACT OF CREATION.” (Muslim)

2) Nabi sallallahu alayhi wasallam said:

BE PUNISHED MOST SEVERELY BY ALLAH””

Mufti Mahmūd says:

A person sought permission to take a photograph of me (Mufti

Mahmood). I did not permit him and told him that photography

is impermissible. This person responded saying:

Person: The impermissibility is with regards to idols.

Mufti Sahib: Hadhrat `Aaisha (Radiallahu Anha) had hung a

curtain with pictures on it in her apartment. On seeing it, Nabi

عليه وسلم tore it and said that the people to be inflicted صلى الل

with the worst punishment will be those who draw pictures.

(Bukhaari Shareef, Vol 2, Pg. 880) In this incident, there were

no idols, yet Nabi tore the curtain with pictures and expressed

his displeasure.

Person: This (digital picture) is only a reflection, similar to a

person’s image reflected on water. One does not play any role

in it.

Mufti Sahib: Man does play a role in it, for the simple reason,

that the camera does not capture the picture out of its own

accord. The entire process is commenced by man’s action.

Then man also completes the developing of the photo as well.

Hazrat Moulana Husain Ahmad Madani:

“I never ever had my photo taken knowingly and

voluntarily. That takes place when I am unaware, and I

do not consider it permissible.

Those who do that [i.e. take other peoples’ pictures]

are responsible for their actions.”

Why did Allah Ta’ala prohibit

photography?

One reason is quite clear; that it was the

origin of Shirk (polytheism):

Going down the passage of history, we find

that mankind was introduced to idol worship

due to Shaytaan’s efforts in leading mankind

astray.

So due to his whispering encouragement,

people began to draw and sketch their pious

predecessors, thinking that their faces and

images will be a source of inspiration; an

incentive to also follow in their footsteps of

piety.

However, it was the means by which many

began to worship those pictures, and

thereafter carved such idols; and idol worship

came into vogue.

Statement Voicing the Haq regarding Photos and Videos

by Hadhrat Maulana Qaari Muhammad Haneef Jalandhari Mudda Zilluhum, the Secretary-General

of Wifaaqul Madaaris Al-Arabiyya Pakistan

Hadhrat Maulana Shabbeerul Haq Kashmiri Rahmatullah

Alayh (Ustaad of Hadith at Jaamia Khairul Madaaris,

Multan) passed away on Thursday night on the 3rd of

Shabaan. His Janaazah Salaah was performed in a massive

stadium the next day.

On that occasion, Hadhrat Maulana Qaari Muhammad

Haneef Jalandhari Daamat Barakaatuhum gave a momentous

speech. Amongst other issues, he touched on the following:

“Hadhrat Maulana Anwarul Haq had chaired the meetings of

Wifaaqul Madaaris in the preceding days. Mufti Taqi

Uthmaani was also present. The topic of prevalent videos was

discussed at the sessions. All the delegates agreed that even

though the prevalent videos are debated by the Ulama, we have

to stay away from it. Those occupied with Deeni Ilm should

take special care not to video their programmes.”

Thereafter he said:

Henceforth no video will emanate from Jaamia Khairul

Madaaris. I plead to all Asaatizah and students to leave it once

and for all. I make Istighfaar for whatever transpired until

today.

From now no one should come to my office and say I want to

take a photo with you. If anyone does so and I decline, he

shouldn't feel bad.”

Even more stunning were the following words by Hadhrat

Maulana Muhammad Haneef:

“In future, any graduate of Khairul Madaaris who is guilty of

making videos has nothing to do with us, we disassociate from

him...”

Maulana Muneer Ahmad Munawwar Saheb interjected:

“In view of being forbidden non autem ipsum it is necessary

to leave it.”

Hadhrat Qaari Saheb commented:

“100%, Jazakallah”

I cannot express adequately my, happiness, joy and peace of

mind at having heard this public statement of Haq from

Hadhrat Maulana Muhammad Haneef.

It is difficult to give this public statement the due appreciation

it deserves. This is the heartfelt cry of every passionate person.

This was passionate cry raised by Hadhrat Maulana

Saleemullah Khan Rahmatullah Alayh at the end of his life.

The two major Darul Ulooms of the country, Jaamia Uloome

Islaamia Binnori Town and Jaamia Farooqi Karachi previous

stance was the same as this public statement.

Two and half months ago Jaamia Daarul Uloom Karachi had

effected the same rules applicable in the Daarul Uloom

premises. Students are not allowed to use camera phones. I

have even heard that they have only given limited permission

to use button phones.

This year the Khatame Bukhari Jalsah of Daarul Uloom

Karachi was only via live streaming instead of live video.

Today the Jumuah Bayaan of Jaamia Khairul Madaaris,

Multaan by Hadhrat Qaari Saheb was only broadcast via live

streaming without video.

The truth of the matter is that videos and pictures have

deprived us of a lot.

Students pursuing the highest form of knowledge, the

knowledge of Qur'aan and Hadith at the Madaaris have been

deprived of safeguarding their souls, hearts and eyes by

viewing videos and having a presence on social media which

is vital and integral to pursing this knowledge.

Paying attention and focussing on the lessons has become

extremely rare. Intellect and capability have been affected....

the number of failures in examinations has risen.

Social media has alienated students from their Asaatizah. It

has created rebelliousness and pride in students besides

involving the students in futility.

We witness that wherever cameras are used, all its evil

corollaries and dictates are prevalent.

May Allah Ta'ala forgive us, some of the programmes in the

Masaajid have the feel of wedding halls.

Furthermore, videos have affected our peaceful lives. Video

makers don't think that some people are sick whilst others are

ill. They haven't even left the dead alone.

They have discarded everything to do with precaution in their

quest for more likes on their Facebook pages and views on

their YouTube channels. Al Majaalisu Bil Amaanah

(Discussions are confidential) has been torn to pieces.

Under these circumstances, Hadhrat Maulana Qaari

Muhammad Haneef Jalandhari Daamat Barakaatuhum’s

public announcement disassociating himself from pictures and

videos sets a precedent for change. He has done so without any

hesitation and without any fear of criticism.

We shouldn't only receive this with open arms but rather we

should spread the contents of this statement of Haq as much as

possible by implementing it in our Madaaris.

May Allah Ta'ala bless the Akaabir with goodness and

blessings on account of this decision and may Allah Ta'ala

grant us firmness on this. Ameen

CLARIFICATION REGARDING RECENT UUCSA STATEMENTS نحمده و نصلي على رسوله الكريم Issued: 3 May 2020/10 Ramadhan 1441

This clarification has been necessitated due to the vast number

of queries received over recent days, regarding the last two

statements issued by UUCSA.

Over two decades ago, certain Ulama bodies in South Africa

felt the need for mutual co-operation on matters of common

interest. Thus, UUCSA was formed as an umbrella body,

which currently has 9 affiliates. The aim has been to work

together on specific affairs and matters, most commonly on a

national level.

UUCSA does not hold hierarchical superiority over its

affiliates. Hence, decisions taken at UUCSA do not bind any

of the affiliates. Each affiliate retains its autonomy and

independence.

With respect to the case of Mahomed and two others v The

President and two others GDP CASE NO.: 21401/2020,

UUCSA initially invited feedback from its affiliates as to

whether it should join as a ‘Friend of the Court’.

The Jamiatul Ulama KZN did not support this proposal.

Hence, when UUCSA eventually joined the proceedings, it did

not do so with the endorsement of the Jamiatul Ulama KZN.

Therefore, at no stage was the Jamiatul Ulama KZN party to

the proceedings, neither directly or by delegation.

UUCSA has recently released two statements dated 24/04/20

and 01/05/20.

The Jamiatul Ulama KZN was not consulted regarding these

statements, and hence is not party to them. We hope this

clarifies the matter, but should there be any further queries,

then please do not hesitate to contact our offices.
