These are efforts in addition to counseling or representing those who cannot afford counsel. Of course, we take great pride in our Pro Bono Program—it is a model for other local bars. Next month the County Executive is rolling out a new pro bono initiative to complement our program. It will encourage representa- tion of children who arrive in the U.S. seeking refuge after escaping extreme violence, abuse and neglect in Central America, and you’ll hear more on it in a few weeks. But in addition to pro bono services, our association and its foundation have pioneered a number of public service ini- tiatives to leverage our members’ education, training, talents, interests and skills to the advantage of all Montgomery County citizens. Like Frank Lloyd Wright’s early 20 th century house designs, our bar is a part of its environment, and the challenge for us is to “grace” that environment rather than “disgrace” it. We are doing just that. Our members are in County high schools inspiring lawyers of tomorrow by coaching mock trial teams, and through the C-IT (“Creating an Improved Tomorrow”) program they are opening dialogues between students and prosecutors, defenders, victims, legislators and other advocates on urgent social issues. In the few years since its creation, C-IT has focused on issues of self- defense and the use of deadly force raised in the Trayvon Martin case (Florida v. Zimmerman), the criminalization of cyber-bullying and the growing epidemic of heroin and opioid addiction. C-IT motivates and equips students to understand the issues and look for solutions, rather than becoming victims. Immediate Past President Lynn Boynton’s award winning “Speak Up and Save a Life” program is helping to save lives. For younger citizens who may be at risk, our Youth Courthouse Project brings middle school- ers to the circuit courthouse for much more than just a building tour. Among the student partici- pants are some students who face a very different “first visit” to the courthouse. They meet the Clerk of the Court, and visit her Assignment office, the Trust Clerk’s Office, Land Records and other offices to meet our able court personnel and get a glimpse of their work. They are taken into the grand jury room to learn about the secret proceedings conducted there from prosecutors who conduct them. Most significantly, they hear from Judge Debelius and members of the Sheriff’s department in the courtroom and duck into the adjacent lockup—a highlight of their visit! These tours are educational for students, their guides and bar leaders (trust me on this) alike, but they may be life-changing for the students. On Law Day I mentioned ournew Strategic Plan, which willcontinue, expand and makemore visible and accessible the

many ways our members are serving the citizens ofMontgomery County. These are efforts in additionto counseling or representing those who cannot afford counsel. Jury Commissioner

It is with mixed emotions that weannounce the retirement of our JuryCommissioner, Chip Vogel, on June 1,2016. Chip began with the Court as anAppellate Secretary and has risen in theranks to Jury Commissioner. Chipexcelled in this role as even the most dis-gruntled jury patron, after having metChip, enjoyed their day and thanked us ontheir way out. Chip has spent many,many years doing valuable work for us,and now she can spend her time enjoyingher valuable interests. We are grateful forthe legacy she has left. We are pleased toannounce that Tina Cavallaro, from ourJury Office, will be stepping into the roleof Jury Commissioner upon Chip’s depar-ture. KIDS SPOT - Update

The Circuit Court celebrated our1-year anniversary of Kids Spot duringwhich time we served 1,139 children andtheir families. Kids Spot is a child wait-ing area in the South Tower, Room 1440

for children ages 2-12. Children aresupervised by two staff members fromFamily Services, Inc. Monday - Fridayfrom 8:00am to 12:30pm and 1:15pm to5:00pm. The center is closed for lunchbetween 12:30pm and 1:15pm. There areno fees associated with this service butParents and guardians must present

valid ID at both check-in and check-

out time and the Parents or Guardians

must remain in the Circuit Court

building while their children are in

MEMBERSHIP OPENINGS 2016-2017

The Montgomery County Inn of Court is devoted to developing the ethical andtrial advocacy skills of Montgomery County litigators. The Inn currently compris-es: 27 Associates, 27 Barristers, 54 Benchers, and 45 Judges & Masters.

Associates are recent law school graduates or attorneys licensed to practice lawin Maryland for not more than five years. Associates serve a one-year term andthere are 27 vacancies anticipated for 2016-2017. Barristers are attorneys licensedto practice law in Maryland for at least five years, are of good character, and seekto improve their skills as trial or appellate advocates. Barristers serve a three-yearterm and 9 vacancies are anticipated for 2016-2017.

Benchers are attorneys licensed to practice law in Maryland, who have demon-strated superior character, ability and competence as trial or appellate advocates.Benchers are honored with lifetime membership in the Inn, but vacancies occasion-ally occur, so applications for Bencher positions are also being taken.

The Montgomery County Inn of Court meets on the second Tuesday of themonth from September through May in Rockville, for a social hour and dinner, fol-lowed by an educational presentation in the Circuit Court. The Inn offers trial advo-cacy programs, accentuating legal excellence, civility, professionalism and ethics.

Usually, the Montgomery County Inn has been fortunate to have more qualifiedapplicants than available vacancies. While preference is given to MontgomeryCounty litigators, the Inn seeks to have a membership that reflects a rich diversityin race, gender, ethnic background, and practice areas. Scholarship funds are avail-able through the Salter Scholarship Fund.

In August – Our plan is to read anddiscuss Ragtime: A Novel, by E. L.Doctorow. Amazon writes that “Ragtimechanged our very concept of what a novelcould be. An extraordinary tapestry,Ragtime captures the spirit of America inthe era between the turn of the centuryand the First World War.”

A BALANCING ACT

Do you have a plan in place to make sure your law practice is covered if youare out of the office?

Everyone agrees that vacations are a necessary part of stress reduction.Sometimes, unexpectedly, we have to be out for family issues or health. Whetheryou are a solo or part of small or large firm, it is important to have a plan in placefor when you choose to be away or need to be away.

free booze, and the great company - I raninto Superior Court Judge Herbert Dixon(retired). I hadn't seen Judge Dixon inmany years and had a lot of fun hearinghim preview his trial court iPad presenta-tion that he was set to give the next day atthe DCBA.

What I learned: Clio is now theworld’s leading provider of online lawpractice management software forlawyers and law firms, outpacing evenRocket Matters and My Case and all therest who trail behind in a long and grow-ing stable of cloud based providers. Itsco-founder, Jack Newton, once but ayoung engineer who was asked to helpout a local firm with its software issues,is today standing atop the foremost cloudbased online legal software programacross the globe. So yea I’m going,when I get invited to hear from Clio’sFounder.

That said, you’d have to go a longway to find a more modest, self-effacing,firmly grounded guy than Jack. It wasvery cool when I got an inside peak atsome of the more notable, newly releasedfeatures Clio is now, or later this month,offering to lawyers. In addition to its verydeep, fully covered feature set of theusual expected elements: contacts, calen-dar, matters, billing, time keeping, etc.

Clio is soon to offer a newly expand-ed, highly secure, online credit card pay-ment portal. The portal will cover bothfees and retainers, providing fully auto-mated digital accounting and bookkeep-ing services. This feature will assist theclient and the attorney with recordingtransactions in operations accounts,escrow accounts, attorney fees and clientretainers. Nice!

Disclaimer: I’ve used Clio for aboutfour years now and have never regrettedthe very modest monthly subscription feethey charge, in exchange for the manyClio features I depend upon to run myoffice. And no, neither of these compa-nies is “incentivizing” me in any way,shape, manner or form…I wish!

The members of the MontgomeryCounty Bar have a colleague who has ledan extraordinary life.

Growing up in central New York, herfather, a District Attorney for the County,died when she was 13. Our colleague,Dena Feeney, says that not only was herfather very influential in her life, he is theperson she would most like to emulate.

As a very young girl, Dena wanted to bea lawyer. Dena went to work with her fatherand always thought the people waiting to seehim must be criminals. She was very muchher father's daughter and, since she wouldalways have been Jim Feeney's daughter, shedid not feel she could live up to his reputa-tion and the regard her town had for him, shedecided not to return home after law school.It is from her father that Dena inherited theinclination to become involved.

After college her math professorswanted her to go on and get a Master’sdegree and teach. They even had a job forher at a junior college. That just didn't seemto be the thing to do, so when Prof. Keefecame to interview for Catholic Universityof America Law School, and said the schoolwould give her a scholarship, she saw herfuture - despite her mother’s remarks thesummer before that she could never go tolaw school.

Dena has been a trail blazer for women.In law school, she was the only womanattending CUA Law School. The problemwas being part of the class, but not one of theboys. There certainly were a couple of pro-fessors who would have preferred that Denawasn't there! Her first job as an Estate TaxAttorney with the IRS found her to be theonly woman examiner. Later, Dena was oneof two female officers doing administrativework in the trust department of Riggs Bank,and then served as a VP of an insurancecompany before going into private practice.Dena was told that she could never be theChair of the MSBA Estates and Tax Sectionsince she was from Montgomery Countyand a woman. It gave her great pleasure toprove the naysayers wrong.

Those early math professors were cor-rect about Dena’s teaching abilities. She hastaught many CLE courses and was anAdjutant Professor at CUA Law for 15years. Dena has mentored and helped manyyoung lawyers along the way and, in spiteof her misgivings; she has lived up to herfather’s reputation.

Though not an undergraduate of

Catholic University, Dena has served asPresident of the University's AlumniAssociation, the University's Board ofRegents and, since its inception, the Boardof Visitors of the Law school. In the 90s shehad the pleasure of taking her Mother toRome with the Trustees of CUA and havinga private audience with the Pope, an unfor-gettable trip. (Another unforgettable eventwas when she managed a front row seat forPope Benedict's mass in Washington DC.)She has also served on Boards atProvidence Hospital for almost 30 years,and served as President of the FoundationBoard and the Center for Life Board.

Her awards include: an AlumniAchievement Award from LeMoyneCollege - where Dena serves on the Boardof Trustees; an Alumni Service Award fromCUA; the National Association of ItalianWomen named her one of "Three WISEWomen"; Honorary Life Bar Leader for theMontgomery County Bar Foundation; andDena is a fellow of the American College ofEstate and Trust Council.

As an expert in estates and trust law,she is a go-to person for colleagues whoknow her. Dena is a Past President of theMontgomery County Chapter of theWomen’s Bar Association, a past memberof the Board of Governors of the MarylandState Bar, and active in many MSBA andBAMC Sections and Committees. She is alifelong Republican, active Catholic and agreat friend.

Dena enjoys music, reading, movies,knitting and travel. Her travel includesAntarctica and the Falklands, Iceland,Kenya, Russia, Churchill – Manitoba,Canada, England, Wales, Scotland, Chile,

Argentina, Mexico, Costa Rica, Austria,Italy, France, Germany, Switzerland,Hawaii and the Caribbean Islands. Herfuture travel plans include the Arctic andGreenland.

Dena has had a long history of surviv-ing hardship. She has lost a husband, hashad two cancer operations and an extendedstay in the hospital when they weren't sureshe would make it.

One of the most poignant experiencesin Dena’s life is her brush with the criminaljustice system as a victim and a witness in ahorrific crime. She does not talk about itunless asked, but was willing to let me men-tion it here. Dena was kidnapped inBethesda in 1980 and was the victim of sex-ual assault and attempted murder by drown-ing in the Anacostia River near RFK stadi-um. At one point she prayed "God, if youwant me to survive I need your help." Denadid survive. Since the assailant pled out inDC, she was involved in the plea bargainbut she did not have to testify. She did testi-fy at trial in Montgomery County. When itas all over, Judge Cave told her that she wasthe best attorney witness he had ever had incourt. She credits Matt Campbell, theAssistant State’s Attorney on her case andthe fact that she had not been a litigator.Dena was intent on answering the questionsasked, not the questions she thought shouldbe asked.

While reluctant to give advice, Denawould suggest that all lawyers never stoplearning and that they take advantage of theCLE opportunities available.

An outspoken advocate with a causticwit and a heart of gold, Dena Feeney is anexceptional lawyer and friend.

The era of state-legal medicinal mari-juana in Maryland is upon us. During 2015,the amount of sales of legal marijuana in theUnited States totaled $5.4 billion, accordingto ArcView Market Research and NewFrontier Data, February 1, 2016.Nationwide, twenty-four states and theDistrict of Columbia currently have lawslegalizing marijuana in some form.1

In 2014, the Maryland legislatureenacted the Maryland Medical CannabisLaw (“the law”). (Maryland CodeAnnotated, Health General Article §§ 13-3306-13-3316.) COMAR regulations fol-lowed.2 In short, medical marijuana hasbeen legalized in Maryland.

The law and regulations provide a legalframework for the growing, processing, dis-pensing and use of medical marijuana inMaryland and exempt cultivators, proces-sors, and dispensers of medical marijuanawho are in full compliance with the statuto-ry scheme from arrest, prosecution, andboth civil and administrative penalty. Thecommission created to implement this leg-islation anticipated that legal medicalcannabis would be available in Marylandby the second half of 2016, but so manyapplications to obtain business licenseswere submitted that the timeline has beenextended to 2017. (“Sale of medical mari-juana in Maryland probably won’t com-mence until 2017”, The Washington Post,December 15, 2015.) 3

This article focuses upon the ethicalconsiderations that Maryland attorneysshould consider before performing legalservices in to this burgeoning cannabisindustry. The Maryland State BarAssociation’s Committee on Ethics(“Ethics Committee”) recently issuedEthics Docket No. 2016-10 (“EthicsOpinion”) that provides significant guid-ance as to two major issues, specifically:“Do the Maryland Rules of Professionalconduct prohibit attorneys from advisingclients seeking to engage in conduct pur-suant to Maryland’s Medical MarijuanaLaws?” And, “Do the Rules prohibitMaryland attorneys from having an owner-ship interest in medical marijuana business-es?” The Ethics Committee responded“No” to both questions, with “caveats.”

Interestingly, the Maryland Judicial

Ethics Committee came to the oppositeconclusion as relates to judges. In a pub-lished opinion issued March 31, 2016, thecommittee opined that a “judicial appointeemay not grow, process or dispense medicalcannabis in Maryland. (Opinion RequestNumber 2016-09.)4 The Judicial EthicsCommittee relied on Code of Conduct forJudicial Appointees, (“Judicial Code”)Maryland Rule 16-814, Rules 1.1 and 3.1,which provide, in relevant part: Rule 1.1:“A judicial appointee shall comply with thelaw, including the Rules in this Code ofConduct…”; Rule 3.1(c): “A judicialappointee may engage in extra-judicialactivities, except as prohibited by law orthis Code.”

The Judicial Ethics Committee rea-soned that Rules 1.1 and 3.1(c) were notlimited to Maryland law, but included fed-eral law. Thus, as long as federal law makesmarijuana possession, distribution and useillegal, judges may not participate in itsgrowth, processing or distribution. Even ifthe federal government were to legalizemarijuana, the Judicial Ethics Committeewent further and expressed the view thatjudges may nonetheless be prohibited fromparticipation in cannabis-related activitiesby reason of Rule 1.2(a), which requiresjudicial appointees to act “at all times in amanner to promote public confidence inthe… integrity…of the judiciary.” Id. at 2.

An ethical problem is created by a con-flict between the Maryland law and the fed-eral Controlled Substances Act (“CSA”), 21U.S.C. §801-904. Under the CSA, marijua-na is an illegal “Schedule 1” drug. (CSA§812). As long as marijuana remains illegalunder federal law, possession, sale, and dis-tribution of marijuana are federal crimes, asare conspiring with or aiding and abettingsomeone who possesses, sells or distributesmarijuana.

The risk of prosecution for violatingthe CSA may be theoretical, at least for thetime being. The Department of Justice(“DOJ”) has issued public announcements,most notably in August 2013, stating feder-al prosecutors would not target medicalmarijuana entities that are in strict compli-ance with the laws of their state, since thefederal government “has traditionally reliedon state and local authorizes [sic] to address

marijuana activity through enforcement oftheir own narcotics laws.”5

However, there is no guarantee that thepresent DOJ policy will remain the same.As long as a U.S. attorney could prosecutean attorney who is in full compliance withthe Maryland law, there will be attorneyswho will hesitate to represent clientsinvolved in the medical marijuana business.

In addition to the risk of committing afederal crime, Maryland attorneys could besubject to disciplinary proceedings for aviolation Rule 1.2(d) of the MarylandLawyers’ Rules of Professional Conduct(“MLRPC”), which provides:

“A lawyer shall not counsel aclient to engage, or assist a client,in conduct that thelawyer knows is criminal or fraud-ulent, but a lawyer may discussthe legal consequences of any pro-posed course of conduct with aclient and may counsel or assist aclient to make a good faith effortto determine the validity, scope,meaning or application of thelaw.”After parsing decisions of other states

that have grappled with this dilemma, theEthics Committee decided that there was noethical violation of Rule 1.2(d). In addition,it decided there was no violation ofMLRPC Rule 8.4, which provides:

“It is professional misconduct fora lawyer to: (a) violate or attemptto violate the Maryland Lawyers’rules of Professional Conduct,knowingly assist or induce anoth-er to do so, or do so through theacts of another; (b) commit acriminal act that reflects adverselyon the lawyer’s honesty, trustwor-thiness or fitness as a lawyer inother respects; (c) engage in con-duct involving dishonesty, fraud,deceit or misrepresentation; (d)engage in conduct that is prejudi-cial to the administration of jus-tice.” Likewise, the Ethics Committee felt that

an attorney should not be prohibited fromholding an ownership interest in a medicalmarijuana business either, as long as it com-plies with the law. (Ethics Opinion at 4.)

The Committee reasoned that legaladvice to businesses about licensing, estab-lishing and operating medical marijuanacompanies was the “natural and inevitableresult” of the passage of the law since itwas “clear from the provisions of the lawthat the legislature intended and expectedthat individuals and businesses would seeklicenses and take other action” to complywith the law. (Ethics Opinion at 1-2.)

However, the Ethics Committeewarned that its position is subject to limita-tions, principally “the federal governmentmaintaining its acquiescence of allowingstates to authorize the intrastate production,distribution and use of marijuana for medic-inal purposes without interference.” (EthicsOpinion at 5.) Other limitations on thisEthics Opinion are that it applies only to themedical marijuana law and nothing else and“should the DOJ alter its stance, the pro-posed conduct may no longer be appropri-ate.” (Id.) The Committee cautions attor-neys that it is not dispensing legal advice, isnot accountable for the shifting landscapeof medical marijuana laws and even sug-gests that the Court of Appeals should con-sider amending the MRPC on this issue.

Presently, among the 24 statesand the District of Columbia which havelaws legalizing medicinal marijuana, barassociations in some of those jurisdictionshave issued ethics opinions. Not surpris-ingly, they conflict. In addition to the posi-tions of Arizona, Washington, Illinois, andConnecticut on Rule 1.2(d) that are consid-ered in the Ethics Opinion, the state ethicsboard in Maine has taken the position thatattorneys must analyze on a case-by-casebasis whether the service they are beingasked to perform constitutes assistance inviolating a federal law. (MaineProfessional Ethics Commission, Opinion199 (2010.) Since it is a violation of feder-al law to aid someone who possesses, sellsor distributes marijuana, the opinion effec-tively seems to prevent attorneys from pro-viding any transactional legal assistance.

On the other hand, the ethics committeein Arizona decided that a “lawyer may ethi-cally counsel or assist a client in legal mat-ters expressly permissible under the ArizonaMedical Marijuana Act, despite the fact thatsuch conduct potentially may violate appli-cable federal law.” (State Bar of ArizonaCommission on the Rule of ProfessionalConduct, Opinion 11-01 (2011).)

LEGAL ETHICS

In an informal opinion, the State ofConnecticut Professional EthicsCommittee said, “Lawyers may not assistclients with conduct that is in violation offederal criminal law.” Connecticut BarAssociation Professional EthicsCommission, Informal Opinion 2013-02(2013). In a backlash to the opinion, theConnecticut Judicial Branch’s RulesCommittee changed the language of Rule1.2 to allow a lawyer to counsel a clientabout compliance with Connecticut law“provided that the lawyer counsels theclient about the legal consequences, underother applicable law, of the client’s pro-posed course of conduct.” 6

Colorado’s Standing Committee onthe Colorado Rules of ProfessionalConduct proposed a similar change to com-ment to Rule 1.2 as well as a proposal toallow lawyers to counsel clients on mari-juana issues without fear of disciplinaryaction. In March 2014, the ColoradoSupreme Court issued a change to theComment [14] to its Rule 1.2 of theColorado Rules of Professional Conduct,permitting lawyers to advise marijuanabusinesses operating under authority of thestate constitutional amendment legalizingthe drug for medical and recreational use.The comment advises that lawyers mustalso counsel clients on relevant federal lawand policy. 7 The Colorado equivalent ofMaryland’s Bar Counsel has publicly stat-ed that lawyers there should be allowed toadvise clients on marijuana-related issues,assuming they are in compliance withColorado law. (“Conflicting state and fed-eral marijuana laws create ethical compli-cations for lawyers” ABA.org/news.)

In June 2015, the BarAssociation of San Francisco issued anopinion in support of an attorney’s abilityto advise clients in state-sanctioned mari-juana-related business ventures.8 InAugust 2015, the Los Angeles CountyBar Association issued its opinion that “amember may advise and assist a clientregarding compliance with California’smarijuana laws provided that the memberdoes not advise the client to violate feder-al law or assist the client in violating fed-eral law in a manner that would enablethe client to evade arrest or prosecutionfor violation of the federal law…In sodoing, the member must advise the clientregarding the violation of federal law and

the potential penalties associated with aviolation of federal law.” 9

In the wake of the MarylandEthics Opinion, one conclusion seemsclear: lawyers can advice, prepare contractsand perform other legal services for indi-viduals and entities engaged in the medicalmarijuana business in Maryland, and evenhave an interest in medical marijuana busi-ness, as long as the DOJ’s position onenforcement does not change. Lawyersneed to counsel clients, however, that thesafe haven from federal prosecution andfrom disciplinary proceedings againstthemselves only exists for those in fullcompliance with state law.

Welcome Tina Cavallaro, from theJury Office, will be stepping into the roleof Jury Commissioner upon Chip’s depar-ture. Tina helped the jury office teamtransition to the new Jury + system lastyear and has been immersed in all thingsjury since her arrival. Random Screening: The court post-poned the implementation of the randomscreening program that was to start inApril. The random screening program isnow planned to commence before the endof May.

New Courtroom Docket

Procedures: The new procedures for thecourt calling of the criminal and traffic

dockets started at the beginning of May.Attorneys are encouraged to arrive incourt early for their hearings and every-one must check in with the courtroomclerks. The court is giving priority to pri-vately retained attorneys in their criminaland traffic cases. The new procedureswill work best with everyone’s coopera-tion.

Date on Pleadings: This has beenmentioned before, but it is important toremember to put the pending court hear-ing date on the caption of your pleadingsunder the case number. The clerk’s

On March 24, 2016 the WorkersCompensation section co-hosted a seminarwith the Workers CompensationCommission: “Opioids in WorkersCompensation: How We Got Here andWhere We’re Going”. The purpose was toaddress the opioid crises being faced bythe workers compensation communitywith an eye towards solutions.Approximately 200 people attendedincluding attorneys from both sides of theaisle, claims professionals, medical profes-sionals, and 9 Commissioners. Speakersincluded Scott Brown, M.D., Lisa Grant,M.D., David Maine, M.D., Lynn Staggs,M.D., and Richard Berwanger, Esq., whodiscussed what is pain, what are opioidsand how they work, pros and cons of opi-oid use, how to address habituation, addic-tion, and abuse, and ethical considerationsfor attorneys dealing with clients usingopioids. The Pro Bono Program providesFREE LEGAL SERVICES to low-income county residents in civil cases. ThePro Bono Program provides two means forresidents to receive free services – at alegal advice clinic or through the clientintake line for referral to an attorney vol-unteer for direct representation. The legal

advice clinics operate in five locationsacross the county and provide residents theopportunity to walk-in and meet with anattorney volunteer without scheduling anappointment. Eligible clients present theirlegal problems to an attorney and receivefree immediate legal advice and or referralto non-profit or government social serviceagencies that may be able to help. Theclient intake line operates out of the mainoffice where the staff screens calls frompotential clients. Our staff conducts allscreenings over the phone only. Casesreferred to attorney volunteers includefamily law, debt collection, bankruptcy,limited employment and limited immigra-tion, wills and power of attorney.

We are also seeking attorneys forcollaboration with Catholic Charities andKids in Need Of Defense (KIND), wherea MD-barred attorney will assist in thefamily law portion of a SpecialImmigrant Juvenile Status (SIJS) case.Please believe that your help to thosewithout resources will not go unnoticedespecially by our community residents.

We currently participate in three proj-ects. First, we participate in the Judicare

Project. Contested custody and complexfamily law cases are referred at a reducedfee to experienced family law attorneys.Attorneys can seek reimbursement of $80per hour with a cap of 20 hours per case.The Pro Bono Program requires that theattorney must accept a pro bono case for
