Information about your policy

Your car insurance contract is made up of:

• this policy booklet;• your schedule which has details of your excesses, your car and the cover provided;• your current certificate of motor insurance which gives details of who may drive your car and what your car can be used

for; and• your statement of facts which shows all the information you have provided us with. We have based the cover given, on

this information.

You should keep a record (including copies of letters and emails) of all the information you supply us with, in relation to this insurance.

The following policy is a contract solely between you and QIC Europe Limited (the insurer). It is not our intention that the Contracts (Rights of Third Parties) Act 1999 gives anyone else any rights under this policy or the right to enforce any part of it.

You agree to pay the premium for the period of the insurance and to keep to the terms and conditions of the policy. We agree to provide insurance, under the terms set out in this policy, for injury, loss or damage occurring during the period of insurance.

Under European law, you and we may choose which law will apply to the contract. Unless you and we have agreed otherwise, English law will apply.

We will communicate in English throughout this contract.

Meaning of words

The following definitions have the same meaning wherever they appear in your policy or your schedule. They will always appear in bold font.

Accessories Parts or products permanently fitted to your car and designed for your car.

This includes: - audio equipment; - multi-media equipment; - sat nav equipment; and - cameras.

Approved repairer A repairer from our network of contracted repairers, who is approved by us to repair your car, following a claim under Section 1 or Section 2 of this policy.

Certificate of motor insurance

The proof of motor insurance you need by law. The certificate shows: - what car is covered; - who is allowed to drive the car; and - what the car can be used for.

Courtesy car A small hatchback authorised by us. This car should keep you mobile but may not be the same as your car in terms of its size, type, value or status.

Endorsement A clause which changes the terms of the policy. Any endorsements which apply will be shown on your schedule.

Excess The part of the claim that you must pay.

Hazardous goods Explosive substances, gases, flammable liquids, flammable solids, toxic substances, infectious substances and radioactive material.

Market value The cost of replacing your car in the United Kingdom with one of a similar make, model, age, mileage and condition, immediately before the loss or damage happened.

To assess the market price at the time of the loss, we may take advice from a suitably qualified, independent motor engineer or refer to publications such as Glass’s Guide with an allowance made for the mileage, condition and circumstances at the time of your original purchase.

Period of insurance The period you are insured for, as shown on your schedule.

Territorial limits Great Britain and Northern Ireland and while your car is being transported between these places by sea, air or land.

Schedule The latest document that we have issued to you detailing the cover in force, the car we are insuring, the excess which will apply if you need to make a claim on your policy, and any endorsements.

We, us, our Stabilis (a trading name of QMetric Group Limited) on behalf of QIC Europe Limited.

You, your The person named on your schedule as the policyholder.

Your car Any car that’s covered under this policy and specified on your schedule and certificate of insurance. This includes: - accessories; - spare parts; and - car seats; whilst in or on your car or in your locked, private garage.

To be covered by this policy your car must be registered in the United Kingdom.

Your partner Your husband, wife, civil partner, or person you are living with as if you are married to them.

Claims procedures and conditions

1. Making a claim. Call us as soon as possible

For any claims, including glass claims, please call us as soon as possible.

Whether you believe you are at fault for an incident or not, it should be reported to us. The sooner an incident is reported to us, the better we can manage the claim. If something has been stolen from your car, it has been vandalised or lost, you should start by calling the police. You will need a crime reference number for the incident.

If you’ve been involved in an accident, do not apologise or admit fault.

Don’t negotiate or settle any claims made against you, unless we have given you consent to do so.

Try to capture the following information, which will help us speed up your claim:

Registration numbers of all vehicles involved and pictures of other vehicles, including the areas that are damaged.

Contact details of the other drivers and their insurance company details.

Number of occupants in the other vehicles.

If the Emergency Services were called to the scene, please collect their details and let us have them.

If your car is not safe to drive, we will arrange to collect it from the scene of the accident.

If your car can’t be taken to a repairer straight away, we will arrange for it to be taken to your home, or a safe storage place.

If your car is safe to drive, we will arrange to collect it at a convenient time.

You do not need to get any estimates. We will agree the costs of the repairs with our approved repairer. Repairs can begin immediately after we have authorised them.

Once we have decided that your car can be repaired by our approved repairer, we will provide you with a courtesy car for the duration of the repairs.

When the repairs are finished we will pay for the reasonable cost to return your car to your home address.

All repair work by our approved repairer is guaranteed for three years. This means anything that goes wrong as a result of poor workmanship by the repairer in this period, will be put right.

2. How we deal with your claim

The first thing that needs to be established after an incident covered by this policy is whether your car is going to be repaired.

If your car is going to be repaired, we will repair it at one of our approved repairers.

If you choose to use a repairer not approved by us, we will negotiate costs directly with them. However, the limit we will pay for those repairs is the amount that we would have paid to have the car repaired at one of our approved repairers.

If you use a repairer of your choice you must give us full details of the incident and we must approve the detailed repair estimate before the work begins. Any repairs carried out by your own repairer are not guaranteed by us, even though wemay pay for those repairs directly.

3. Dealing with your claim

Your obligations:

You must tell us about any insurance related incident, regardless of fault as soon as possible.

If someone makes a claim against you after an accident, you need to let us know as soon as possible. This is so a suitable defence can be arranged or settlement made on your behalf, as well as appointing solicitors to act on your behalf.

You must send any court documents to us as soon as you receive any and tell us at once if you are charged with an offence, receive any notice of prosecution or inquest.

You or any other person who claims under this policy must not make any admission, offer, promise or payment, unless you have our written agreement.

You or any other person who claims under this policy must give us all the relevant information, documents and assistance we require to be able to validate any claim and help us achieve a settlement or pursue a recovery.

Our rights:

In dealing with any claim under the terms of this policy we are entitled to:

a. carry out the defence or settlement of any claim and choose the solicitor who will act for you in any legal action;b. take any legal action in your name or the name of any other person covered by this policy;c. admit negligence for any accident or claim on your behalf or any person claiming indemnity under the policy, where

appropriate.

We will investigate your claim and exchange information with other parties involved. However, we will treat your information carefully and only disclose it where necessary.

Things not covered under the policy

This policy does not cover the following:

1. Any injury, loss or damage occurring while your car is being:

a. driven by or is in the charge of any person not shown on your certificate of motor insurance; b. used for any purpose not shown on your certificate of motor insurance; c. involved in an incident as a result of a deliberate act or omission by anybody insured by the policy, except to the extent

that your insurer is obliged by law to provide insurance under the Road Traffic Act;d. used on a prepared course, race track or circuit or for any competition, rally, trial, track day, performance test, race

or speed trial. This exclusion applies whether (or not) the event is on private land or the public road and regardless of whether it is authorised by the police or another relevant authority; or

e. used on any derestricted toll roads. Derestricted toll roads are roads the public can pay to have access to and where speed restrictions are temporarily or permanently suspended (including the Nurburgring at Nordschliefe).

However, your car is covered:

a. if it is with a member of the motor trade for the purpose of maintenance or repair;b. when being parked by an employee of a hotel, restaurant or car-parking service; orc. if the injury, loss or damage occurred while your car had been stolen.

2. Any injury, loss or damage occurring while your car is being driven by or in the charge of anyone who:

a. does not have a valid driving licence;b. is disqualified from driving; orc. has not held a driving licence or is prevented by law from holding one; andd. does not meet the terms and conditions of their driving licence as required by DVLA/DVANI rules and any relevant law.

3. Liability you have under any other agreement, unless you would have had the liability if the agreement did not exist.

4. Loss, damage, injury or legal liability directly or indirectly caused by, resulting from or in connection with:

Invasion, war, revolution or any act of terrorism regardless of any other cause or event contributing concurrently or in any other sequence to the loss, except where such liability is required to be covered by the Road Traffic Act. The definition of terrorism shall follow the interpretation as set out in the Terrorism Act 2000 or subsequent amendments there to or by any act deemed by the Government or a UK Court of Law to be an act of terrorism. This exception does not apply were we need to provide the minimum level of cover required by law.

5. Loss, damage, injury or legal liability caused directly or indirectly by:a. ionising radiation or radioactive contamination from any nuclear fuel or from any nuclear waste arising from burning

nuclear fuel; orb. the radioactive, poisonous, explosive or other dangerous properties of any explosive nuclear equipment or part of that

equipment.

6. Any accident, injury, loss, damage or liability arising while your car is in a place used for the take-off, landing, parking or movement of aircraft, including the associated service roads, refuelling areas and ground equipment parking areas.

7. Any decision or action of a court outside Great Britain or Northern Ireland, unless the decision is made or action is taken in a foreign court because your car was used in that country and that country is in the European Union or is mentioned by name in section 5.

8. Any liability for death, injury, illness, or loss of or damage to property, arising directly or indirectly from pollution or contamination, unless it is directly caused by an event that is sudden, identifiable, unintended and unexpected. We will provide cover where the whole event happens at a specific time and place during the period of insurance.

We will treat all pollution or contamination arising from one incident as having happened at the time of the incident.

This policy does not cover claims arising from pollution or contamination which happen as a result of deliberately releasing substances or as a result of leaks from your car caused by failure to properly maintain it.

This exclusion does not apply where we need to provide the minimum level of cover required by law.

9. Any loss or damage resulting from the impoundment or confiscation of your car by Customs and Excise, the police or any other government or public authority.

10. Any accident, injury, loss, damage or liability while your car is:a. towing a trailer which is unsafe or has an unsecure load;b. being driven with a load or a number of passengers which is unsafe or greater than the manufacturer’s specifications;c. being used for any criminal purposes.

11. Any accident, injury, loss, damage or liability while your car is outside the territorial limits unless allowed under section 5. 12. Loss or damage or liability which is the responsibility of the person driving or steering any vehicle being towed by your car or being towed by a vehicle being driven by you.

13. Legal liability when a caravan, trailer or broken-down vehicle is being towed for profit.

14. If any of your car’s safety features were disabled or turned off at the time of the accident.

General conditions

You must comply with the following conditions to have the full protection of your policy. If you do not comply with them, we may at our option cancel the policy or refuse to deal with your claim or reduce the amount of any claim payment.

1. Providing accurate and complete information

When taking out, renewing or making changes to this policy, you must take reasonable care to provide accurate and complete answers to all questions. We may ask you to provide further information or documentation to ensure that the information you provided was accurate and complete.

It is a criminal offence under the Road Traffic Act 1988 to make a false statement for the purposes of obtaining a certificate of motor insurance.

2. Changes to your circumstances

You must tell us straight away if any of the information shown in your statement of facts, schedule or certificate of motor insurance is incorrect or if any of your circumstances change during the period of insurance.

If you do not tell us about any incorrect information or any change in circumstance it may result in your policy being cancelled or treated as if it never existed, or in your claims being rejected or not fully paid.

When we are informed of a change we will tell you whether we can accept the change and if so, whether the change will impact the terms of the policy or premium charged. Any changes will be subject to our agreement and may not be acceptable.

Here are some examples of the changes you must tell us about. This is not a complete list and you should contact us if you are unsure about whether you need to tell us of a change.

i) You must tell us if any of the following details change before you need cover to start:

a. You change your car.b. You alter your car from the manufacturer’s standard specification. Alterations include optional extras and any changes

to bodywork. Examples of alterations include: - changes to the bodywork, such as spoilers or body kits; - changes to suspension or brakes; - cosmetic changes such as alloy wheels; - changes affecting performance such as changes to the engine management system or exhaust system; - changes to accessories.

c. You would like to change the people who need to be insured under this policy.d. The owner of your car changes.e. You change the way in which your car is used. For example, you begin to use your car for business purposes.f. You wish to change your cover.

ii) You must tell us as soon as possible if any of the following details change:

a. You change your address.b. Your or any insured drivers change occupation.c. Your or any insured driver’s driving licence is revoked either temporarily or permanently, or the status of driving licence

has changed. For example if you or any insured driver has passed their driving test.d. You or any insured drivers are involved in an accident, no matter how trivial and regardless of blame.e. You or any insured driver suffers a physical or medical condition that must be notified to the DVLA.f. You or any insured driver receive any motoring conviction including driving licence endorsements, fixed penalties and

pending prosecution.g. You or any insured driver receive a criminal conviction.

3. Other insurance

If any liability, loss or damage is covered by any other insurance, we will only pay our share of the claim. This condition does not apply to section 4—personal accident—which we will pay in full.

4. Taking care of your car

You or any insured driver must take all reasonable steps to:

a. Protect your car from loss or damage.b. Maintain your car in an efficient and roadworthy condition.c. Ensure you have a valid MOT certificate for your car if one is needed by law.d. Keep all the tyres within the legal requirements at all times.e. Ensure any security device fitted to your car is operational when your car is left unattended.

We have the right to examine your car at any reasonable time.

5. Car sharing

Your policy covers you for carrying passengers as part of a car-sharing arrangement for social or similar purposes, in return for payment to cover your fuel expenses.

But we will not cover you if:

a. the car is constructed or adapted to carry more than eight passengers;b. the passengers are being carried as part of a business;c. you are making a profit for carrying the passengers.

6. Fraud

You must not act in a fraudulent manner.

If you or anyone acting for you:

a. mislead us or your insurer in any way (for example who is the main user of the car), in order to get insurance from us, to obtain more favourable terms or reduce your premium; or

b. make a claim under the policy knowing the claim to be false or fraudulently exaggerated in any respect; or c. submit a document in support of a policy or claim knowing the document to be forged or false in any respect; ord. make a claim in respect of any loss or damage caused by your wilful act or with your involvement.

Then we may do the following:

a. not pay the claim;b. not pay any other claim which has been or will be made under the policy;c. cancel or declare the policy void;d. recover from you the amount of any claim already paid under the policy;e. not return any premium;f. inform the police of the circumstances.

We have the right to recover from you you our (or our representatives’) costs in investigating any fraudulent claim.

7. Victim of crime

If you have been the victim of crime, you must report the details to the police as soon as practicable. You must fully cooperate with all resulting police enquiries and any resulting prosecution of offenders.

8. New business validation

A premium discount is available dependent on the number of years’ no-claim discount you state you have. Proof of this no-claim discount must be provided in writing from your last insurer immediately prior to this policy or your policy may be subject to revised premium or terms, or may become invalid.

Your no-claim discount must have been earned in the United Kingdom within the previous two years, on a private car policy.

To support the information you have supplied on your policy application, it is also a condition of your policy that you supply us with documents such as copies of driving licences, a V5 vehicle registration document or recent utility bills if we ask you to.

9. Compliance with policy conditions

If we find that:

a. you have not complied with a condition under this policy; andb. your compliance would normally reduce losses;

then we may avoid a claim or reduce the amount we pay (depending on the circumstances), unless, you can prove to us that your failure to comply with the condition would NOT have increased the risk of the loss occurring in the circumstances that it arose.

10. Sanctions limitation and exclusion clause

We shall not provide cover nor be liable to pay any claim or provide any benefit hereunder to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose us or any member of our group to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions, laws or regulations of any country.

Section 1. Accidental damage to your car (except that caused by fire or theft)

What is covered?

If your car is damaged in an accident whilst in the United Kingdom we will pay for:

a. your car; andb. accessories that are fitted by your car’s manufacturer or an approved dealer.

If you fit new accessories in your car which are not on your manufacturer’s list, we will only cover you for the cost of replacing the manufacturer-fitted equipment.

Section 2. Fire and theft cover

What is covered?

If your car is lost or damaged whilst in the United Kingdom by theft, attempted theft, fire or lightning we will pay for:

a. your car; andb. accessories that are fitted by your car’s manufacturer or an approved dealer.

If you fit new accessories in your car which are not on your manufacturer’s list, we will only cover you for the cost of replacing the manufacturer-fitted equipment.

Section 1 and 2. Damage to your car irrespective of cause

What is not covered?

a. the excess shown for the relevant section on your schedule;b. the young or inexperienced driver excess where appropriate, as explained below;c. loss or damage more specifically covered under section 8;d. loss of use of your car (including the cost of hiring another vehicle) or any other indirect loss, such as travel expenses

g. damage to your tyres caused by braking, punctures, cuts or bursts;h. your car losing market value after it has been repaired or any other loss of value;i. loss of or damage to your car as a result of someone acquiring it by deception claiming to be a buyer or agent;j. your car being repossessed by its rightful owner or having to pay compensation to the rightful owner;k. loss or damage if your car is being driven by anyone who is not keeping to the terms of their driving licence.l. any amount greater than the manufacturer’s last list price for replacing any part or accessory lost or damaged.m. loss of or damage to your car while:

(i) the ignition keys (or other devices which unlock your car) have been left in or on your car; or (ii) your car has been left unattended with the engine running; or (iii) your car has been left unlocked; or (iv) the car windows or sunroof have been left open; or (v) any security device fitted to your car was not operational when your car is left unattended.

n. repairs or replacements which improve the condition of your car;o. deliberate loss or damage to your car by anybody insured by the policy;p. your car being confiscated or destroyed by or under order of any government, public or local authority;q. loss of or damage to your car when your car is taken or driven without your permission by your partner, a member of

your immediate family, a person living in your home or anyone known to you, unless you report that person to the police for taking your car without your permission and assist the police in a prosecution;

r. costs of importing parts or accessories or storage costs caused by delays, where the parts or accessories are not available from current stock in the UK;

s. damage to your car if you or any person entitled to drive (as specified by your current certificate of motor insurance) is convicted of an offence involving alcohol or drugs, or was driving when under the influence of alcohol or drugs, when the accident happened;

t. loss or damage to your car as a result of racing or whilst your car is being used in any rallies;u. loss or damage to any trailer or caravan when it is being towed by or attached to your car;v. loss or damage to your car caused by the wrong type or grade of fuel being used;w. this policy does not cover any non-standard parts (modifications) or manufacturer’s optional extras unless they have

been declared to and accepted by us; If you have not declared any modifications or manufacturers options to your car and make a claim, we will only pay the cost of replacing parts needed for your car to meet the manufacturer’s standard specification;

x. loss of or damage to your car as a result of malicious damage, vandalism, alleged theft or alleged arson, where you have not reported the incident to the police;

y. loss or damage to your car caused by frost unless you have followed the manufacturers instructions to avoid liquid freezing in your car.

Young and inexperienced driver additional excess

Under the following circumstances you will have to pay an additional excess. This amount will apply on top of any other excess shown on your schedule:

a. the first £295 when your car is being driven by or is in the charge of any person who is under 21; orb. the first £195 when your car is being driven by or is in the charge of:

(i) any person aged 21 to 24; or (ii) any person aged 25 or over who holds a provisional licence or who has not held a full UK or EU/EEC driving licence for at least one year.

Whilst your car is with a member of the motor trade for servicing or repairs this additional excess will not apply.

How your claims are settled

For loss of or damage to your car we will decide how to settle your claim and will either:

a. pay for any necessary repairs;b. replace your car; orc. pay you a cash amount equal to the cost of the loss or damage.

Under section 2, we will not pay a cash sum for audio/visual equipment you are claiming for. We will settle a claim for audio/visual equipment by repairing it or replacing it with a similar piece of equipment.

Repairs

Recycled parts or non-original parts and equipment may be used in repairs or taken into account in the claims settlement.

We will also pay reasonable costs to protect your car and take it to the nearest suitable approved repairer or a place of storage and where appropriate, return it to your address after it has been repaired.

If the car isn’t being repaired (a total loss)

If the decision is taken not to repair your car we will assess its current market value.

We calculate the market value by looking at what the cost would be to replace your car like for like (similar mileage, age and model). We will also take into account the condition of the car before the accident.

If you are still paying for your car under a hire purchase or leasing agreement we may pay the finance first and any remaining balance will be transferred to you.If the market value of your car is less than the amount you owe, you may have to pay the balance.

Once we have paid out the market value of the car it will belong to us, so make sure you let us know if your car has a private registration so you can retain this.

If your car is a total loss, we may put it in free and safe storage until your claim is settled.

New car replacement

If your car is less than one year old after its first registration, and it is:

a. stolen and not recovered; orb. damaged - where we estimate it costs more than 60% of the manufacturers current retail price (including taxes) to

repair it;

we will (if you and any other interested parties agree) replace it with a new car of the same make, model and specification as long as:

a. you have owned your car since it was first registered as new; andb. your car is not an import and was sourced and supplied as new in the United Kingdom; and c. the replacement car is available in the United Kingdom within 6 weeks from the time of the loss.

If a car of the same make, model and specification is not available, new car replacement will not apply and we will pay you the market value of your car, including accessories at the time of loss or damage (this is not necessarily the value you declared when the insurance was taken out), less any excess that may apply.

Costs you may be liable for

a. If we accept your claim and we identify any changes to your policy since it started that you did not tell us about we may reduce any claim settlement offered.

b. If your claim is settled on a total loss basis under this policy and you do not replace your car, you will be liable for your full annual premium. This means that you will still have to continue paying your direct debit payments until the premium is paid in full. If you paid in full at the start of your policy, there will be no refund of the premium. We reserve the right to deduct any outstanding premium from your claims settlement.

c. If we do not accept your claim under this policy, you may be liable to repay costs already incurred by us. These may include, but are not limited to engineer’s fees, vehicle recovery charges, and vehicle storage charges.

Section 3. Liability to third parties

What is covered?

1) Cover provided for you

We will indemnify you for any legal liability for

a. the death of or injury to any person; or b. damage to someone else’s property caused by:

(i) you using or being in charge of your car; (ii) you using your car to tow any single trailer, broken-down vehicle or caravan while it is attached to your car and if allowed by law, provided it is not being towed for profit.

2) Driving other cars

When you are personally driving any other car this policy will provide the same cover as point (1) above, if your certificate of motor insurance says so, as long as the other car is:

a. not owned by you (and used with the permission of the owner); or b. hired to you under a hire purchase agreement; or c. leased to you under a leasing agreement; ord. provided to you as a courtesy car; and e. not owned or hired or lent to you by your employer or partner.

We will not pay:

a. For loss or damage to the car you are driving.b. If you are covered by any other policy of insurance to drive the car.c. If you do not have the owners permission to drive the car.d. If the vehicle is being used outside the territorial limits of this policy. e. Unless a current and valid policy of insurance is in force for the vehicle being driven.f. For recovery of any vehicle which has been impounded by, or on behalf of the police or local authority.g. If your car has been disposed of or has become the subject of a total loss.

3) Cover for other people using your car

If you ask us to, we will also provide the same cover as point (1) above for the following people:

a. any person driving your car with your permission (as long as your certificate of motor insurance shows that he or she is entitled to drive your car and has complied with the terms of this policy);

b. any person using (but not driving) your car, with your permission, for social, domestic and pleasure purposes;c. any passenger travelling in, or getting into or out of your car;d. the employer or business partner of any person who is driving or using your car for their business, providing your

certificate of motor insurance shows you have the appropriate business use cover.

4) Cover for legally appointed representatives

If anyone covered by this section dies as a result of an event covered by this section, their legal representative will have the benefit of the cover provided under this section.

5) Costs and expenses

If there is an accident covered by this section of the policy and we give our written permission, we will pay for the reasonable legal costs and expenses to:

a. provide representation at any coroner’s inquest, fatal accident inquiry or court of summary jurisdiction; andb. defend a charge of manslaughter or causing death by dangerous, careless or inconsiderate driving.

We will also cover the cost of emergency treatment fees under the Road Traffic Act. If we make a payment for these costs only, it will not affect your no claim discount.

What is not covered?

a. any injury, loss or damage occurring while your car is involved in an incident as a result of a deliberate act by anybody insured by the policy, except where we must provide insurance under the Road Traffic Act;

b. death of or injury to anyone while they are working with or for the driver of your car except where we must provide cover by law;

c. loss of or damage to your car or any attached trailer, broken-down vehicle or caravan;d. loss of or damage to property owned by or in the care of the person claiming under this section;e. loss of or damage to property that is being carried in or on your car or is in a trailer or vehicle being towed by your car;f. loss, damage or accidental injury, arising whilst your car is being used in any rallies;g. the death or injury to any person driving your car or in charge of it for the purpose of driving it;

h. anyone driving your car who you know does not hold a licence to drive the vehicle or is disqualified from driving. This exception does not apply if the driver has held a licence and is not disqualified from holding or getting one;

i. your car being driven by or in the charge of any person who is not named as entitled to drive on your certificate of motor insurance;

j. any person who has insurance covering the same liability;k. legal costs or expenses related to charges connected with speeding, driving under the influence of alcohol or drugs, or

for parking offences;l. Any amount exceeding:

(i) £20 million for loss of or damage to other people’s property including any related indirect loss or damage; and (ii) £5 million for legal costs and expenses arising from loss of or damage to other people’s property; that arises from any claim or series of claims caused by one event;

m. In the event of any accident involving cover for more than one person insured under this section, any limitation by the terms of this policy or any endorsements relating to the maximum amount payable shall apply to the aggregate amount of payments on behalf of all such persons covered and your liability shall be settled in priority.

Section 4. Personal accident

What is covered?

If you or your spouse or civil partner are accidentally killed or injured while getting into, travelling in or getting out of your car (or any other car you do not own), we will pay you or your legal representatives the compensation below should the accident result in:

a. death; orb. total and permanent loss of sight in an eye; orc. total physical loss of a limb at or above the ankle or wrist;

that occurs within 90 days of the accident.

What is not covered?

a. more than £10,000 in any one accident; b. if you or your partner have more than one policy with us, we will only pay out under one policy;c. benefit for death or injury occurring while the driver is under the influence of alcohol or drugs;d. death or loss caused by suicide or attempted suicide;e. death or loss to any person not wearing a seat belt when they have to by law; andf. any benefit if the policy is held in the name of a corporate organisation, a company or a firm.

1) Compulsory cover outside the territorial limits

This policy provides the minimum cover required by the relevant law to enable you or any person named on the certificate of motor insurance to drive or use your car in

a. any country which is a member of the European Union; and b. any other country which agrees to follow European Union directives on motor insurance and is approved by the

commission of the European Union.

2) Full policy cover outside the territorial limits

We will also provide the cover shown on your schedule for up to 90 days for any one trip in the period of insurance whilst you or any person named on the certificate of motor insurance drive or use your car are:

a. any country that is a member of the European Union; andb. Channel Islands, Isle of Man, Iceland, Norway, Switzerland, Liechtenstein, Andorra, Monaco, San Marino, Gibraltar and

Serbia.

Cover also applies while your car is being transported by air, sea or rail between any of these countries, including loading and unloading, subject to the limitations detailed above.

If you intend to use your car for more than 90 days for any one trip in these territories, you must first contact our customer service department to obtain agreement and pay any additional premium we ask for.

Unless you inform us prior to travel, only the minimum cover required by the relevant law will apply (liabilities for third parties). This would mean no cover for any loss or damage to your car.

This policy does not cover events occurring in a country that is not listed in this section unless you tell us before you leave, get our written agreement and pay any additional premium we ask for. If we agree to your request we will issue you with an International Motor Insurance Certificate (Green Card) as legal evidence of this cover.

Cover in this section only applies if:

a. your permanent home is in the United Kingdom; andb. your car is registered and normally kept in the United Kingdom; and c. your visit abroad is temporary.

How your claims are settled

In the event of a claim, you will be required to evidence your travel.

We will settle claims as set out in sections 1 and 2.

If we have to pay for your car to be delivered to you after repairs, we will only pay for it to be delivered to you while you are in the country where the loss or damage occurred.

Section 6. Medical expenses

What is covered?

If you or anyone in your car is injured in an accident involving your car, we will pay for emergency medical expenses, as set out in the Road Traffic Act, of up to £250 per person.

What is covered?

We will cover personal belongings which are in your car and are lost or damaged by accident, fire or theft.

The most that we will pay is £150 for any one claim.

What is not covered?

a. money (including credit and cash cards), stamps, tickets, documents or securities;b. jewellery;c. goods, samples or tools carried in connection with any trade or business;d. wear and tear;e. property insured under any other policy;f. loss of or damage to laptops, mobile phones, smart phones, tablets or electronic navigational equipment;g. theft or attempted theft of personal belongings if your car has been left unlocked, left with the keys in it or left with a

window or roof open;h. any items stolen unless they are kept out of sight in the locked boot or glove compartment of your car; andi. any claim where the keys (or other device needed to unlock the car) are left on your car or unattended.

How your claims are settled

We will pay the cost of the item less an amount for wear and tear, to you or the owner of the property.

We may require documentary evidence to substantiate your claim or may require sight of the damaged item.

What is covered?

We will pay for

a. broken glass in the windscreen or windows of your car, including the costs to recalibrate your windscreen; andb. any scratching to your car’s bodywork as a result of the broken glass.

What is not covered?

a. the excess shown for this section on your schedule (the excess must be paid direct to the repairer or replacement company); and

b. panoramic sunroofs.

How your claims are settled

We can choose whether to:

a. pay for the glass to be repaired; orb. pay for the glass to be replaced; orc. if it is uneconomical to repair or replace the glass, only pay up to the market value of the vehicle.

If you do not use our approved glass company when making a claim under this section, the maximum amount we will pay will be the amount it would cost us to use our preferred supplier.

Any payment made under this section alone will not affect your no claims discount.

1) No claims discount

If no claims are reported during the current period of insurance, when you renew the policy a discount will be included in your premium. You may not transfer this discount to another person.

Any payment we make under section 8 (Windscreen and glass damage), or for emergency treatment under section 3 (Liability to third parties) will not affect your no claims discount.

2) Protected no claims discount

The following cover will only apply if shown on your schedule.

If you make no more than 2 fault claims in any three year period, you will keep your no-claim discount.

If you make more than 2 fault claims in any three year period, then at the next renewal date your no-claim discount will be reduced to:

a. 2 years no-claim discount (if you have made up to 3 fault claims); orb. 0 years no-claims discount (if you have made more than 3 fault claims).

Depending on the circumstances of your claim, we may increase your premium.

Section 10: Uninsured driver promise

In the event that you are involved in an accident and the driver of the vehicle that hits you is not insured, you will not lose your no claims discount or have to pay any excess, provided:

a. we establish that the accident was not your fault; andb. you tell us the vehicle make, model and registration of the third-party car that caused the damage to your car and

where possible, the other drivers name and address.

Section 11. Child seat cover

What is covered?

If you have a child’s car seat or booster seat fitted in your car and your car is involved in an accident covered by this policy, we will pay up to £100 for the cost of a replacement of a similar model and standard even if there is no apparent damage.

Unless stolen, the child’s car seat or booster seat should be made available for inspection.

Section 12. Overnight accommodation and onward transport following a claim

If we have accepted a claim for loss of or damage to your car under sections 1 or 2 of this policy and you are unable to continue your journey as a result, we will either:

a. pay for travel expenses for you and your passengers to get back home or any other destination within the UK; orb. if you can’t complete your journey until the next day, we will pay for overnight accommodation.

The maximum we will pay is up to £50 per person (£350 maximum for all occupants of the car).

You will have to pay for the accommodation or travelling expenses yourself and submit receipts for us to reimburse you. There will be no cover for newspapers, drinks, telephone calls and meals.

This cover will not apply outside the territorial limits of the policy.

Cancellation

This section contains important notes about your and our rights of cancellation.

To cancel this policy, you should contact Sure Thing! customer service on 0344 335 5555.

Your right to change your mind

If you decide that, for any reason this policy does not meet your insurance needs, you may cancel it at any time by letting us know.

If you cancel this policy you will be charged an administration fee. The fee will vary dependent on whether you decide to cancel before 14 days, or after the 14 day cooling off period. You will receive a refund of premium for the cover you have not used, unless you have made a claim under the policy. If a claim has been made, there will be no refund of premium and if you paid for your insurance by instalments, you must pay any outstanding balance in full. Delayed payments will incur additional charges.

The effective date of cancellation will be the date that you tell us of your wish to cancel. We cannot backdate cancellation to an earlier date.

Our cancellation rights

We have the right to cancel your policy at any time if there is a valid reason for doing so (for example, if you haven’t met one of the general conditions), by sending you 7 days’ notice in writing. We will not give you notice if you have committed fraud.

We will send a cancellation notice by email to the latest email address we have for you. If we do not have a valid email address we will write to you at the address we have on file for you.

We will set out the reason for cancellation in the email or letter. We will not cancel your policy without a valid reason for doing so. Some examples are:

a. where we have been unable to collect a premium payment or your credit agreement is cancelled. In these circumstances: - we will contact you requesting payment by a specific date; - if you do not pay by that date we will cancel your policy with immediate effect and notify you accordingly;

- we may refuse your claim or take the balance of any outstanding premium due to us from any claim payment we make to you. This may mean that we pay claims (as required under the policy) to a third party but seek full recovery of any payment made under your policy, directly from you;

b. where you advise us of a change in your circumstances which results in us no longer wishing to provide cover;c. you refuse to allow us reasonable access to your car when you have a claim;d. where you are required in accordance with the terms of this policy to co-operate with us, or send us information or

documentation and you fail to do so in a way that materially affects our ability to process your policy or a claim;e. if, by law or other reason, we are prevented from providing cover under this policy; .f. if you break any of the General Conditions set out in this policy, for example if you do not take reasonable care of your

car.

If we cancel the policy, you will be entitled to a refund of premium for the cover you have not used, unless you have made a claim.

If we cancel the policy we may charge a fee to cover the administrative cost of providing this policy.

If this policy is cancelled, we will automatically cancel all other insurance policies that were bought with it (for example Motor Legal Expenses cover).

We may also cancel this policy without giving you notice and without refunding your premium if you:

• make or try to make a fraudulent claim under this policy or where we reasonably suspect fraud; or• use threatening or abusive behaviour or language, or intimidate or bully our staff or suppliers.

In these circumstances, even if you have made a valid claim before the policy is cancelled, we will still cancel your policy.

Where our investigations provide evidence of fraud, we may backdate the cancellation to the date of the fraud, or when you provided us with incomplete or inaccurate information. This may result in your policy being cancelled from the date you originally took it out.

If you do not pay for your insurance, you must show these details to the person who paid on your behalf.!

Travelling abroad

Important guidelines when travelling abroad

Please see section 5 for details of where this policy covers you and full details of foreign use. You do not need a green card to travel in the EU and the countries specified in section 5 but you must first contact our customer service department to obtain agreement if you intend to use your car for any one trip that is more than 90 days or you intend to visit countries not specified.

If you do not contect us, only the minimum cover required by the relevant law will apply.

If you have an accident abroad, follow the procedure below

1. Immediately report the accident to the police if anybody involved in the incident is injured or if there is a disagreement with the other driver. Get details of the police team that attended the scene or who the accident was reported to.

2. Give your name and address, and our name and address to the other party and produce your certificate of motor insurance.

3. Get the name and address of the other driver, details of their motor insurer (including policy number) and information about the registration and ownership of the other vehicles involved. In some countries (such as Greece, Portugal, Italy and France) the insurer of the vehicle is displayed on the windscreen disc.

4. Call the claims helpline number: +44 800 953 1114 as soon as possible.5. Never make any statement or sign any document without the advice of a lawyer or competent official.6. If you have a camera, take photographs showing the layout of the scene and positions of the vehicles from various angles.
