of Planning Consultant for Land Use Code Update Phase 1 in accordance with Associated

BACKGROUND REVIEW: In March 2017 it was identified by Town Council and Town staff that

the Town of Hayden land use code was in need of some updates and revisions. Several

developers and business people in Hayden have made several comments that the land use

code and process was confusing, redundant, cumbersome, and slightly outdated.

Responding to this need Town staff applied for a technical assistance grant from AGNC which

has a category for land use planning and community projects. Staff broke the project out into

two phases (2017 and 2018 work) and worked with current planning to establish a scope of

work list for phase one. Phasing was used to break up the costs between 2017 and 2018.

On May 2nd 2017 the Town of Hayden was notified by AGNC that it was awarded $2,500.00

for a two phase land use code update (see attached award letter). The total budget for phase

one is $10,000. As part of the grant the Town was required to seek three proposals from

qualified firms to assist the Town with the land use code update. Firms were sent the following

proposed scope of work for phase one which is what the proposals are based on:

1. Conduct assessment of current code, prepare assessment memo and discuss list of

known corrections and desired revisions with Staff

2. Propose revised outline and format of Development Code to streamline the code.

3. Prepare Draft 1 of revised Development Code.

4. Discuss Draft 1 of Development Code with Town Staff, revise and prepare Draft 2 to

incorporate staff comments.

5. Present Draft 2 of Development Code to Hayden Planning Commission at work

session (2 meetings).

6. Revise Draft 2 per Planning Commission work sessions, prepare Draft 3.

7. Conduct notice and public hearing for Draft 3 of Development Code before Planning

Commission (2 meetings).

8. Planning Commission makes recommendation to Town Council.

9. Conduct notice and public hearing for Town Council to adopt Development Code by

Ordinance (2 meetings).

10. Firms were requested to list similar experience on projects, team members, and cost

of the work.

Below staff has listed the firms that submitted proposals along with breakdowns of cost and

analysis of each person/firm. Staff recommendation follows the breakdown.

Heil Law & Planning LLC: Mr. Eric Heil was referred to staff by the City Manager of Avon CO.

He is AICP certified (American Institute of Certified Planners) and is a land use attorney for

several rural and mountain clients in Colorado. Mr. Heil’s resume illustrates his experience as

both working in law and planning work for communities. He currently sits on the AICP Board

of Colorado and has written several articles on land use cases. Mr. Heil has participated in

both land use code updates and drafted one as well. His resume and bio are included along

with his email that has his proposal of $10,000.

Safebuilt Colorado LLC: Safebuilt is the current firm representing the Town as the building

department and also has a planning division. Safebuilt submitted their proposal via email

which is attached with several proposed pricing line items based on what was submitted that

range from $10,000 to $125,000. There email illustrates some of the different approaches they

took.

RG and Associates Inc: RG is the current planning company contracted by the Town for three

years and Ross Culberson has been in his role now for 1.5 years as the Town’s planner. They

do both planning and engineering for rural and metropolitan area clients. The experience

level of RG is comparable with the other firms that submitted proposals and they do have

direct experience with the Town of Hayden. RG’s response is included for review. RG has

quoted a cost for phase one of $9,985.00.

After review of all of the proposals staff is not recommending Safebuilt Colorado Inc. They did

not respond to the requested information completely nor did they provide some of the other

things like team and project examples.

Mr. Heil is very qualified to do the work and staff was surprised that he will be able to do this

work for the cost. His experience in Avon and drafting code that is applicable to rural areas

was a huge plus. While staff is not recommending him as the firm to be selected if the PC was

more inclined to use his services we would be very comfortable working with him. In addition

he has worked with RG on several projects so he is familiar with our team.

RG included a very through proposal response to our request. They have a team in place,

work in Hayden now, and the cost proposed is within the budget that the Town has allocated.

While they don’t carry the legal experience I have confirmed that they would get review from

a legal professional to ensure the updates recommended would pass statute muster and the

Town’s attorney will also review the changes. Overall staff felt that this proposal was the most

comprehensive and responsive. Their scope is not exactly what we as staff requested but it will

get us to the ultimate goal of phase one which is a streamlined updated code on the first

phase. Due to that staff is recommending RG as the selected firm for this land use code

update.

RECOMMENDATION: Town of Hayden Planning Commission make a recommendation to the

Town Council that they hire RG & Associates for the phase one process of the update to the

Town of Hayden land use code and direct staff to make that recommendation and draft a

professional services agreement and resolution supporting the recommendation.

MANAGER’S RECOMMENDATION/COMMENTS: Staff concurs with the recommendation

above.

The AGNC Executive Committee has approved the Town of Hayden’s technical assistance grant request for the Hayden

Land Use Code Update in the amount of $2,500.00. Please be aware that AGNC receives the money for this technical

assistance under a grant from the Department of Local Affairs and is, therefore, bound by the grant

requirements. Consequently, as a recipient of funds from this grant, you must comply with this letter of

agreement. Please read, sign and return a copy of this letter to AGNC, PO Box 593, Grand Junction, CO 81502.

REQUIREMENTS OF A TECHNICAL ASSISTANT GRANT:

1. The staff person managing this grant should keep a separate file on it in the event that AGNC is audited. If we are

audited on this project you might need to present your file for inspection. The file should be retained for five years. Please

title the file “2017 AGNC Technical Assistance, EIAF grant # 8344” and the name of the project.

2. Expenses charged to the project may not be incurred prior to May 15, 2017. Please keep an accurate accounting of

expenses charged to the project in the file, including in kind expenses.

3. If you are hiring a contractor to do the work you must do so through a competitive process. Since your grant is

less than $10,000, you may simply document three verbal bids. The bids must be documented in writing in your file with

the amount of the bid, name of the bidder/contractor, date and signature of the person receiving the bid.

4. Your project must be complete by January 31, 2018. In order to receive payment for the project, you must submit

all invoices related to the project, proof of payment, and a one-page summary of the accomplishments of the project, no

later than January 31, 2018. We will not guarantee that you will be reimbursed for the project if the final report and

invoice are not received by January 31, 2018.

by your signature.

PROFESSIONAL OVERVIEW

Mr. Heil has 25+ years experience working with all aspects of land use regulations and local

government comprehensive plans, including representation of both local governments and private land

owners. In addition to drafting land use regulations, Mr. Heil regularly advises planning departments,

planning commissions and elected officials on the administration, interpretation, application and

enforcement of land use regulations. This first-hand experience with administering land use regulations

in Colorado enables Mr. Heil to focus on pragmatic and effective land use regulations and minimize

theoretical and bureaucratic approaches that may undermine community acceptance. In addition, Mr.

Heil’s broad experience with local government representation enables Mr. Heil to appreciate the

importance of many different local government service providers, such as fire, police, water, sewer and

recreation. Mr. Heil offers a balanced perspective of both a certified land planner and a licensed

Colorado attorney with decades of local government experience. Mr. Heil is actively involved the

Colorado Chapter of the American Planning Association as a board member, co-chair of the Legislative

Committee and President of the Planning Institute of Colorado.

REPRESENTATIVE PROJECTS

A short list of representative land use regulation projects for Mr. Heil includes:

Participated and reviewed drafting of Development Code for the Town of Avon along with

Clarion Associates.

Drafted Land Use Codes for the towns of Creede, Rico, Ophir and Sawpit.

Drafted regional water resource protection regulations for Cave Creek karst in Arkansas with

Wight Water Engineers.

Drafted water resource protection regulations for town of Silverthorne (which are cited by the

State of Montana as model regulations).

Drafted and negotiated new Planned Unit Development Plan for the Village (at Avon) as part of

litigation settlement over land use and financial matters.

PROFESSIONAL EXPERIENCE

Mr. Heil’s legal and planning career began in 1992 with the representation of the Town of Ophir, Mr.

Heil’s first client and Colorado’s smallest home rule municipality. Mr. Heil’s career has involved

representation of numerous municipal clients and other local government clients on a wide variety of

contracts, real estate transactions, public financing, public infrastructure construction, land use regulatory

matters and litigation. In addition, Mr. Heil has served an instrumental role in implementing solutions to

large-scale real estate projects and complex community growth issues. Mr. Heil offers 25 years of diverse

experience with local government representation ranging from some of the smallest municipalities in

Colorado to some of its largest cities.

Mr. Heil currently serves as the Town Attorney for the Town of Avon, CO and the City Attorney for

the City of Creede, CO. Mr. Heil also represents private clients on real estate transaction and land use

matters. In addition to his legal career, Mr. Heil has served as a community development planner, town

manager, project manager and grant writer. Mr. Heil is admitted to practice law in Colorado and is a

member of the American Institute of Certified Planners.

Eric Heil of Heil Law & Planning LLC is an attorney and certified land planner with 25 years of

experience representing municipalities and local governments in Colorado. Over the course of

his career Mr. Heil has served as a municipal attorney, community development planner, town

manager and project administrator. Mr. Heil has presented on the topics of Legal, Planning and

Environmental Issues Associated with Mining Claims; Annexation and Development

Agreements; Ethics for Planners; Brownfields Redevelopment Law; The Role of Non-Profits in

Town of Timnath, Colorado

While employed by the Town of Timnath as the Town Planner, TJ worked directly with the Community Development Director and Community Development Coordinator to review code content and process discrepancies regarding the town’s Land Development Code. The assessment came as a result of the Town Council’s desire to create a streamlined and business friendly development review processes and accompanying application requirements. The review team pulled from personal experience over the years in Timnath, council and community goals, and development pressures for business, retail, and residential land uses. With a goal to increase tax base and a fair and equitable development review process, the code requirements were assessed and amendments were recommended to the Planning Commission.

Town of Mountain View, Colorado

The Town of Mountain View, a small village boarding the western edge of Denver, has been faced with increased development pressures as homeownership affordability increased demand on the Town’s 1950’s bungalow and cottage homes. To ensure the community character was continued through the redevelopment process, the Town Board called for a code update process. While at a previous employer, TJ managed and oversaw the assessment of the Town of Mountain View Municipal Code. The assessment took national best practices, land use case law doctrines, and the community vision, goals and objectives to recommend updated policies, processes, and code organization. The recommendations were rooted in facilitating growth by creating clear and streamlined processes while also ensuring the proper review process for development applications. In addition to the assessment, TJ also worked directly with town staff to produce application checklists, review forms, template letters, and standardizing review processes to streamline development review.

City of Cheyenne, Wyoming:

While employed with the City of Cheyenne, Wyoming, TJ was tasked to analyze the city’s Sign Code and make recommendations to meet the increased political pressure to limit billboards, address electronic message signs, and allow for temporary sidewalk signs in the downtown core. The assessment of the Sign Code culminated with recommendations to remove inconsistencies between various chapters of the municipal code, reorganize the sign code regulations to be more usable and understandable and develop a streamlined sign permit application processes to increase efficiency. Since the recommendations impacted a variety of chapters of the development regulations, the city undertook a comprehensive re-write to address the widespread inconsistencies and inefficient processes encountered through the assessment process. The resulting Unified Development Code has subsequently been adopted by the city and is a model for other communities around the nation.

Jennifer Henninger, AICP

City of Sheridan, Colorado

RGA has been the City Engineer, City Planner, and Chief Building Official for Sheridan for over 10 years, providing a variety of engineering, planning, building inspection and business license on-call services. Our planners are the planning staff for the city and in that capacity facilitate the development review process, represent the city in meetings with landowners and developers and present all land use cases to Planning Commission and City Council. RG and Associates was instrumental in completing a municipal code review and revision in 2009, and updating the city’s Comprehensive Plan in 2015. Jennifer is currently tracking code updates for a re-write of the Zoning Code next year. Additionally, under Jennifer’s leadership, the city has been able to secure nearly a million dollars of grant funding; of which funds have been used on parks, trail connections and for the completion of the 2015 Comprehensive Plan.

City of Lakewood, Colorado

During Jennifer’s five years working as planner for the City of Lakewood, she was involved in several zoning code updates. She wrote the first residential design guidelines for the City, vetting them through staff and Planning Commission prior to formal adoption by Council. Jennifer also conducted extensive research on technology and best practices for telecomunications facilities which resulted in Lakewood’s adpotion of their first telecommunications ordinance. As a development review planner Jennifer was instrumental in tracking necessary code revisions and ensured the adoption and intergration of these revisions into the Lakewood Municipal Code.

Ross Culbertson

Town of Kersey, Colorado

As part of the RGA Planning Team, Ross contributed his community assessment analysis and technical writing skills to several sections of the 2016 Kersey Comprehensive Plan Update. RGA lead a robust community engagement process of which preference surveys, priority mapping, and land use strategies were used to formulate a Plan document with actionable steps for achieving a vibrant community. Ross used his analysis of the existing code, combined with the community input to create Chapter 5 – Image and Design, Chapter 6 – Housing, and Chapter 10 – Parks, Recreation and Open Space of the Kersey Comprehensive Plan. The recommendations found in these chapters have led to land use code revisions for the Town.

Approach

General Planning Approach:

The objective of this project is to assess the town’s Land Use Code (LUC), make recommendations on priorities, and implement Phase 1 of the LUC update to create a more modern ordinance which:

1. Utilizes best management planning practices, 2. Eliminates redundancies and conflicts, and 3. Streamlines the review and approval of development applications to better implement the

goals and policies of the Town of Hayden.

Stakeholder Involvement:

The town will solicit the Planning Commission, town staff, and a select group of stakeholder’s familiar with the LUC to offer guidance and feedback for this project. Public input gathered at previous planning efforts will be utilized to avoid “planning fatigue”.

Work Program:

Since a full, comprehensive update to the LUC is not feasible at this time, the resulting LUC Assessment Report will accomplish two important tasks. First, it will lay out a plan to tackle the more time consuming and complex updates which can be added to future budgets and implemented in phases. Second, it will identify the highest priority amendments needed to be made to increase the efficiency and usability of the LUC which can be implemented as a first phase of a multi-phase process.

Task 1 – Assessment

We will conduct an analysis of the town’s existing LUC. Potential conflicts or inconsistencies between the LUC, town policy, or state and federal laws will be identified and be classified as either “Housekeeping”, “Procedural”, or “Policy” depending on the level of conflict or amendment needed. These items will be identified in an easy to follow and readable table format. The assessment will be broken down into the following tasks:

• Task 1.1 – Identify Known Updates: Throughout our tenure providing planning services to the town, we have been compiling a list of conflicts, inconsistencies and general updates needed to be made to the LUC. This list will be memorialized in a format compatible with the ensuing assessment.

• Task 1.2 – Section-By-Section LUC Assessment: Each Article of Title 16 of the Town of Hayden Municipal Code will be reviewed and evaluated in a general context. The assessment will be organized around four general categories.• General Provisions & Layout: A review of the general statements and layout of the LUC

will be conducted to ensure the concepts and regulations are laid out in a logical order to optimize clarity and understandability of specific regulations and their consistency with town land development strategies.

• Zoning Districts and Uses: Evaluate the zoning districts and permitted use classifications to ensure they clearly describe the desired development patterns, densities, and uses desired within each district.

• Design Standards & Criteria: Review landscaping, parking, sign, architectural, infrastructure, and other site design criteria to ensure development standards are adequately provided and regulations are easy to understand.

• Development Review & Approval Processes: Evaluate review and approval procedures to ensure that approvals are given at appropriate levels to be consistent with the town’s desires for an efficient and effective approval processes.

• Task 1.3 – LUC Assessment Report: The assessment will culminate with a report identifying the inconsistencies found in an easy to follow table. The report will include a summary of assessment findings, analysis of potential impacts of major findings, and a proposed strategy for updating the entire LUC given realistic funding and staff time availability. The objective of the LUC Assessment Report is to support future grant applications, inform the town’s budget process, and recommend action steps for the town to implement needed updates to the LUC.

Task 2 – Phase 1 LUC Updates

We will take what we have identified as priority updates and clerical amendments within the LUC and prepare updates to the regulations.

• Task 2.1 – Draft LUC Updates: Based on the direction provided by town staff and the stakeholders group throughout the project, we will recommend changes to the LUC ordinance. It is anticipated that most of these updates will represent clerical, administrative, and layout updates as well as streamlining and simplifying the development review and approval processes. We will recommend an updated outline and format of the code to increase usability and effectiveness of the LUC. This may also include adding additional sections to address land uses not currently contemplated in the LUC such as tiny home developments. The draft updates will be presented to town staff to provide comments and ask questions.

• Task 2.2 –Planning Commission Work Session: The draft updates, including staff recommendations, will be presented to the Planning Commission in a work session where we will present the recommended LUC updates, priorities, and implementation strategy.

• Task 2.3: Approvals: We will facilitate the public hearing process as outlined in the Town Charter. It is anticipated that this process will include one public hearing in front of the Planning Commission and two readings in front of the Town Council with the second meeting being a public hearing.

• Task 2.4 – Post Approval Codification: Following the Town Council’s decision on the ordinance updating the LUC, we will make any needed updates to the ordinance and finalize documents for the update to be published and codified.

Optional Services:

Graphics, diagrams, or models can be created and inserted within the LUC for an additional fee of $500 per graphic, diagram, or model. Examples of models which could be utilized to enhance the usability and understandability of regulations or standards are: fence height and location, architectural design standards, property setbacks, building form standards, or streetscape design.
