Jane Doe 1: April 10, 2016

• April 2016: Defendants meet 32-year-old Jane Doe 1 at a restaurant in Newport Beach.

• April 10, 2016: Defendants and victim at party in Newport Beach then go to Robicheaux’sapartment; Jane Doe 1 intoxicated.

• Multiple drugs given to the victim by defendants who then rape and orally copulate her

• April 11, 2016: Jane Doe 1 contacted the Newport Beach Police Department (NBPD), tested positive for multiple drugs.

Jane Doe 2: October 2, 2016

• Oct. 2, 2016: Drinking alcohol with Jane Doe 2 at a bar in Newport Beach. Jane Doe 2 becomes unconscious.

• Robicheaux’s apartment: sexual assault with intent to commit rape.

• Jane Doe 2 awoke and screamed for help until a neighbor called NBPD.

(a) Rape is an act of sexual intercourse accomplished with a person not the spouse of the perpetrator, under any of the following circumstances:

(3) Where a person is prevented from resisting by any intoxicating or anesthetic substance, or any controlled substance, and this condition was known, or reasonably should have known by the accused.

Penal Code Section 288a(i)Oral Copulation of an Unconscious Person

(a) Oral copulation is the act of copulating the mouth of one person with the sexual organ or anus of another person.

(i) Any person who commits an act of oral copulation, where the victim is prevented from resisting by any intoxicating or anesthetic substance, or any controlled substance, and this condition was known, or reasonably should have been known by the accused, shall be punished by imprisonment in the state prison for a period of three, six, or eight years.
