APPLICANT The applicant wishes to sell the house and keep the remaining land.
ALR: The subject property lies within the Agricultural Land Reserve. Therefore, AgriculturalLand Commission approval is required. The applicant has applied for exclusion andinclusion and has submitted copies of the required notification and advertisements.
Note: Pursuant to the Agricultural Land Commission Act, an application may not beconsidered by the ALC unless the Regional Board authorizes the proposal to proceedto the ALC. This is intended to provide local governments with latitude to consider andweigh the local community interests of each application, in addition to its zoning andofficial community plan. Should the Regional District forward the application to theALC, the information and recommendation offered by the Regional District is takeninto consideration by the Commission but should not be construed as being binding onthe Commission’s opinions or decisions.
OCP: The subject property is designated ‘Medium Density Rural Residential (MDR)’ withinthe North Peace Fringe Area OCP Bylaw No. 1870, 2009. The minimum parcel size is16 ha (4 acres).Policy 15.9 states:2) The Advisory Committee of the North Peace Fringe Area Official Community Planis recommending that the Regional Board consider ALR Exclusion by pursuingpolicies i) and ii) for those areas designated for non-farm use in this OCP.Designations recommended for ALR exclusion are; ‘Residential’, ‘Commercial’ and‘Industrial as outlined below:

Policy i) Submit an ALR Exclusion application for all existing subdivision areasgenerally located in close proximity to the City of Fort St. John, Charlie Lake, alongRed Creek Road and those areas identified for sewer services, described in Sec. 11of the plan; andPolicy ii) Require that future subdivision proposals be excluded from the ALR, ratherthan accepting applications for subdivision within the ALR, for those lands that aredesignated for non-farm use in this OCP.Therefore an amendment to the OCP would not be required.
ZONING: The subject property is zoned R-5 (Residential 5 Zone) within the PRRD Zoning BylawNo. 1343, 2001. The minimum parcel size is 4 ha (10 acres).Therefore a zoning amendment would be required.
IMPACT ANALYSIS
AGRICULTURE: This proposal will reduce the agricultural capacity of this property.
CONTEXT: The subject property is located just north of the Alaska Highway and east of the City ofFort St John on the 257 Road. This is a mixed use area with residential properties to theimmediate north, south and west, and agricultural properties to the east.
POPULATION &TRAFFIC:
The proposed number of dwelling units is unknown but may increase the population ofthe area by 2.8 people and about 2 vehicles per dwelling.
