Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:

A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary.

As of 2015/10/26, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC.

Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

As of 2015/10/26, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 36 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment.

As of 2015/10/26, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards.

I am a qualified person and have the qualifications required by section 5 of the regulation.

I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

PHASE TWO CONCEPTUAL SITE MODEL

The subject site is located northeast of the intersection of Fletcher Road and Binbrook Road West in the

City of Hamilton, Ontario. The subject site is an irregular-shaped shaped parcel of land with an area of

20.6119 hectares (50.93 acres) in size and is currently utilised as agricultural land. There is no known

municipal address associated with the Phase Two Property.

Potentially contaminating activities (PCAs) that have occurred on the Phase Two property include the

presence of a 508mm diameter crude oil pipeline running adjacent to the northern boundary of the

Phase Two Property, the historical presence of a 1000L aboveground storage tank in the former metal

storage shed and potential application of pesticides. In 2001 the crude oil pipeline ruptured releasing

approximately 95,400L of crude oil. Remediation of PHC-impacted soil was carried out by Stantec

(formerly ESG International) entailing the recovery of approximately 35,000L of crude oil, the excavation

and disposal of approximately 52,178 tonnes of PHC-impacted soil and the installation of a biotreatment

cell in the base of the excavation. An RSC was acknowledged for the area impacted by the oil spill and

this area is not part of the Phase Two Property.

The main subsurface structure adjacent to the Phase Two Property which may affect groundwater

transport is the oil pipeline which runs west to east along the northern boundary of the Phase Two

Property.

The Phase Two property was assessed using the MOE Table 2 Standards for a Residential/

Parkland/Institutional (RPI) land use with fine textured soil in a potable groundwater condition from the

MOE document “Soil, Ground Water and Sediment Standards for Use Under Part XV.1 of the

Environmental Protection Act” (April 15, 2011).

According to the Ontario Base Map- Topographic Map website, published by First Base Solutions

Geospatial Experts, the Phase Two Property appears to be relatively flat at an approximate elevation

ranging from 218 to 224 metres above sea level. Lake Ontario is approximately 20km north and Lake

Niapenco is approximately 3km south of the Phase Two property.

According to the Ontario Geological Survey OGS Earth Bedrock Geology of Ontario Map, published by

the Ministry of Northern Development and Mines, the bedrock in the vicinity of the phase two property

is of the Guelph Formation and generally consists of sandstone, shale, dolostone or siltstone. OGS Earth

Surficial Geology Map depicts the Phase Two Property in an area of massive to well-laminated fine-

textured glaciolacustrine deposits consisting of silt and clay with minor sand and gravel.

Stratigraphy on the Phase Two Property consists of approximately 80mm of topsoil overlying native

clayey silt. Bedrock was encountered between 25.0 and 26.5 meters below ground surface.

Groundwater levels measured in the upper clayey silt groundwater unit on-site ranged from 0.22 to 5.42

meters below ground surface. Groundwater elevations in the shallow clayey silt groundwater unit

indicate a generally westerly to southwesterly groundwater flow.

The subject site is neither an environmentally sensitive area nor is it located within an area of natural

and scientific interest. During the Phase Two study, soil samples were collected and analyzed for pH. The

results show that pH is within the acceptable range for the application of the MOE Table 2 Standards.

The subject site is not a shallow soil property as defined in Section 43.1 of the regulation. The subject

site does not include all or part of a water body, is not adjacent to a water body and does not include

land that is within 30 m of a water body.

The Phase Two investigation consisted of soil and groundwater sampling on the subject site. Soil

samples were analysed from eight boreholes and groundwater samples were analysed from three

shallow overburden monitoring wells and two bedrock monitoring wells. A total of 32 boreholes were

drilled on the subject site, however, additional boreholes were used for geotechnical purposes and not

sampled for environmental purposes. Soil and groundwater samples were collected for analyses of

metals and inorganics, VOCs, PHCs, PAHs and organochlorine pesticides. The purpose of the deeper well

and some of the boreholes were for geotechnical and hydrogeological purposes. Samples were

collected from the deep wells, however, they were not used for delineation purposes as the upper

groundwater unit was analyzed and met the Standards. Soil and Groundwater was sampled and

analyzed from BH13-3, BH14-103, BH14-104, BH14-105, BH14-106, BH15-05, BH15-06, BH15-07, B15-08,

MW 14-3S, MW14-3D, MW14-2D, MW14-2S and BH14-3.

Grain size analysis was completed for three soil samples. The results indicated that on site soil is

comprised of between 68 and 92 percent fine and medium particles by mass.

Soil and groundwater analyses on the property were compared to the Table 2 RPI Standards with fine-

medium grained soils from the Ministry of the Environment (MOE) document “Soil, Ground Water and

Sediments Standards for Use Under Part XV.1 of the Environmental Protection Act” (2011).

Chemical analyses were conducted by AGAT Laboratories. AGAT is a member of the Canadian

Association for Laboratory Accreditation (CALA) and meets the requirement of Section 47 of O.Reg.

153/04 certifying that the analytical laboratory be accredited in accordance with the International

Standards ISO/IEC 17025 and with standards developed by the Standards Council of Canada.

Soil and groundwater results met the MOE Table 2 RPI Standards for fine-medium grained soils for all

parameters analysed.
