The air is getting cooler and the days are getting shorter so it must be getting close to the fall season. As the kids go back to school I’m reminded of the

great impact that education has on all of our lives. We sometimes forget that all we are and will become originates with our educational experiences and developments.

We have all traveled various pathways to get where we are today. Some of us have grown up in the trades and have fathers, grandfathers or maybe even great grandfathers in the business. Others have had a more round about path either through other related industries, college or a complete career change to get to this point.

What concerns me about the future of our profession is being able to attract good young people into it. With all the computer age and video assisted careers, it seems harder and harder to get good young talented people interested in our great field of labor. I believe we, as a society, encourage a college education as a pathway everyone should take while we need to realize that not everyone is

destined to travel that path. I am sure we have some great tradesmen that are college educated, but I would have to guess they are a minority.

As all of you would probably agree, education in our field never stops. We must continue to learn ourselves and teach the younger tradesmen. Whether through continuing education or sitting around with some of the guys, our education is ongoing. In our area, even the inspectors like Steubenville’s John Shanley will quiz you on venting types and applications during the inspections.

We, as an industry, need to encourage and educate young people about our trades as a career choice that can be rewarding both financially and fulfilling as a career. I encourage all of us to talk up our respective trades any chance we get, to involve more young people and secure a steady stream of qualified craftsmen for years to come.

When PHCC was created, 125 master plumbers proved that their collective voice packed more power than their individual ones. 130 years later,

PHCC continues to reflect those same values by working to advance the plumbing and HVACR industry at all levels.

Change is coming fast to our industry in the form of new services, technologies, standards and regulations. Here are a few ways in which PHCC has uniquely positioned its members to break through to the next level with new tools, strategies, resources and representation:

More Legislative and Regulatory Influence PHCC has expanded its voice and representation for the

p-h-c industry on the federal, state and local levels. Here are some recent sample successes:

• Repeal of the 3 percent withholding tax was signed into law.

• Expanded grassroots efforts to successfully influence legislation and regulations, generating more than 4,600 letters from PHCC members to Capitol Hill and the Department of Energy.

• Effectively voiced concerns about the Environmental Protection Agency’s lead paint abatement rule and continued to lobby to repeal the death tax.

• Aggressively represented members’ interests in the regulatory arena—particularly with the U.S. Department of Energy—on an initiative that would establish potentially harmful workforce guidelines for the Weatherization Assistance Program.

Relevant Education Programs PHCC—National Association continues to collaborate

with the PHCC Educational Foundation, the PHCC enhanced service groups and state and local chapters to customize timely and relevant educational programs to meet our members’ changing needs. These range from the national seminars offered at the annual CONNECT event, to the technical and business management seminars offered by affiliated chapters. The Foundation expanded its popular bi-monthly webinars this year and continues to offer them free-of-charge to PHCC members.

Increased Industry Participation, Member Support

As your “in-house resource” for the latest installation technology, product standards and code interpretations, PHCC has increased participation on many industry levels this year. The association guides members on energy efficiency and water conservation topics, including a new water auditor certification program that launched at CONNECT 2012. It also offers expanded safety resources through our online library, provides regulatory updates on new energy standards and product limitations and collaborates with several industry groups to advance the efficient and sustainable use of water.

More Member Resources, Fresh New Looks PHCC members received a new member benefit this year:

information-packed member resource mailings that provide timely, insightful information and education on crucial industry issues. The first two topics were understanding overhead and risk management. The next ones you’ll receive will cover lead-free products and new water heater regulations.

Members also should have noticed a fresh, personalized look in PHCC communications, including the recently redesigned www.phccweb.org. And, the latest communications initiative is an exciting brand awareness campaign that will help us spread the word about the professionalism of PHCC contractors.

With the momentum that’s been building within PHCC and the positive impact we have on positioning our members as leaders in this changing industry, there’s no looking back! We’re moving forward with a well-thought-out strategic plan that will help us continue “Building Momentum” in the future. Be sure to check your mail for the printed 2011-2012 PHCC annual report to learn more specifics about all of the exciting initiatives that are underway.

Professional Employer Organizations are becoming more popular as employers search for ways to limit their financial

and administrative burdens in dealing with their employees. PEOs are employee leasing firms whereby the company’s employees become the employees of the PEO and are leased back to the original employer. The primary purposes in utilizing a PEO are to decrease workers’ compensation and other benefit expenses as well as reducing the traditional administrative responsibilities of an employer. As workers’ compensation expenses soar and programs to reduce those costs are eliminated by the state governments, some employers find that they have no alternative but to utilize a PEO in order to remain competitive.

The PEO customarily administers the payroll and benefit programs. Additional services include such things as human resource assistance, unemployment and workers’ compensation administration, and new hire screening and reporting. While it sounds like a “quick fix” for an employer’s financial and administrative burdens, these relationships can be fraught with perils.

Even though the PEO becomes the statutory employer of the employees, the original employer leasing back its employees can be held co-liable for claims advanced by those employees. The leasing relationship is actually a joint employment

relationship and for employment law purposes both the PEO and the company leasing its employees are “on the hook” for such things as unpaid payroll taxes, discrimination complaints and wage-hour claims. In addition, the original employer many times becomes subject to additional laws to which smaller employers are exempted. For example, the onerous Family and Medical Leave Act which provides 12 weeks of unpaid leave with medical benefits for certain health conditions and other reasons is not applicable to employers with less than 50 employees. But, by virtue of the employees of the original employer being pooled with the other employees within the PEO leasing company, the applicability of additional laws can be triggered and obligate the employer to do such things as accord FMLA leave to the leased employees although not previously obligated to do so.

Because the PEO assumes payroll administration, it assumes the responsibility to properly prepare the payroll and to timely remit payroll taxes. But, the original employer can also be held liable if the PEO fails to pay or report taxes. Therefore, it is imperative that the PEO is a well-established and financially sound organization. Sometimes the PEO subcontracts services like payroll to a traditional payroll company and the original employer may not have any say about this. An employer must scrutinize the PEO’s

subcontractors to ensure that they will responsibly perform the tasks assigned through the PEO.

Doing the cost/benefit analysis of a PEO relationship can be tricky as well. Do you know now what it costs to administer your human resource functions including payroll? How is the PEO intending to charge you? – customarily a percentage of gross payroll as a service fee along with the cost of benefits and payroll preparation. Will the employer be paying the administrative fee on overtime and bonuses paid? Will the owner/officers now be obligated to take workers’ compensation coverage? The PEO’s formula for costing its fees can be confusing and must be fully understood. Are there really sufficient savings to give up control of your employees?

Finally, you must be prepared to have an expert carefully review the PEO’s proposed service contract and negotiate several contract changes on your company’s behalf. Many of the contracts are 20 plus pages in length, intricate, and very one-sided. Most PEOs are willing to negotiate changes but you need to know what to request. Some of the more common contract provisions you would need to address are:• Lack of sufficient definition of services to be performed by

the PEO.

• The right of the PEO to terminate the contract if your company has just one OSHA violation.

• PEO indemnification of your company for its own negligence and wrongdoing – some contracts do not have such a provision.

• The right of the PEO to order your company to pay salary continuation to a workers’ compensation claimant for up to 90 days at your expense so the PEO avoids some of the costs of the claim.

• The right of the PEO to settle workers’ compensation and other employment claims without your permission and against your best interests utilizing their own attorneys and third party administrators. While your company may very well find benefit to a PEO

relationship, it is not an easy process to select a PEO and negotiate a fair contractual relationship with it.

Continuing our discussion of the various retirement plan options available, this issue will focus on Individual Retirement Accounts (or, IRAs, for short). An individual

retirement arrangement (IRA) is a personal savings plan that offers specific tax benefits. IRAs are one of the most powerful retirement savings tools available to you. Even if you’re contributing to a 401(k) or other plan at work, you should also consider investing in an IRA.

The two major types of IRAs are traditional IRAs and Roth IRAs. Both allow you to contribute as much as $5,000 in 2012. You must have at least as much taxable compensation as the amount of your IRA contribution. But if you are married filing jointly, your spouse can also contribute to an IRA, even if he or she does not have taxable compensation. The law also allows taxpayers age 50 and older to make additional “catch-up” contributions of $1,000 in 2012.

Both traditional and Roth IRAs feature tax-sheltered growth of earnings. And both give you a wide range of investment choices. However, there are important differences between these two types of IRAs. You must understand these differences before you can choose the type of IRA that’s best for you.

Traditional IRAsPractically anyone can open and contribute to a traditional

IRA. The only requirements are that you must have taxable compensation and be under age 70½. You can contribute the maximum allowed each year as long as your taxable compensation for the year is at least that amount. If your taxable compensation for the year is below the maximum contribution allowed, you can contribute only up to the amount that you earned.

Your contributions to a traditional IRA may be tax deductible on your federal income tax return. This is important because tax-deductible (pretax) contributions lower your taxable income for the year, saving you money in taxes. If neither you nor your spouse is covered by a 401(k) or other employer-sponsored plan, you can generally deduct the full amount of

your annual contribution. If one of you is covered by such a plan, your ability to deduct your contributions depends on your annual income (modified adjusted gross income, or MAGI) and your income tax filing status:

For 2012, if you are covered by a retirement plan at work, and:

• Your filing status is single or head of household and your MAGI is $5,000 or less, your traditional IRA contribution is fully deductible. Over $68,000 it’s not deductible and MAGI in between is partially deductible.

• Your filing status is married filing jointly or qualifying widow(er), and your MAGI is $92,000 or less, your traditional IRA contribution is fully deductible. $112,000 or more it’s not deductible and MAGI in between is partially deductible.

• Your filing status is married filing separately, your traditional IRA deduction is reduced if your MAGI is less than $10,000, and you can’t deduct your contribution at all if your MAGI is $10,000 or more.

For 2012, if you are not covered by a retirement plan at work, but your spouse is, and you file a joint tax return, your traditional IRA contribution is fully deductible if your MAGI is $173,000 or less. If MAGI is $183,000 or more, then no deduction is allowed and if in between, a partial deduction may be taken.

What happens when you start taking money from your traditional IRA? Any portion of a distribution that represents deductible contributions is subject to income tax because those contributions were not taxed when you made them.

Any portion that represents investment earnings is also subject to income tax because those earnings were not previously taxed either. Only the portion that represents nondeductible, after-tax contributions (if any) is not subject to income tax. In addition to income tax, you may have to pay a 10 percent early withdrawal penalty if you’re under age 59½, unless you meet one of the exceptions.

If you wish to defer taxes, you can leave your funds in the traditional IRA, but only until April 1 of the year following the year you reach age 70½. That’s when you have to take your first required minimum distribution from the IRA. After that, you must take a distribution by the end of every calendar year until you die or your funds are exhausted. The annual distribution amounts are based on a standard life expectancy table. You can always withdraw more than you’re required to in any year. However, if you withdraw less, you’ll be hit with a 50 percent penalty on the difference between the required minimum and the amount you actually withdrew.

Roth IRAsNot everyone can set up a Roth IRA. Even if you can,

you may not qualify to take full advantage of it. The first requirement is that you must have taxable compensation. If your taxable compensation in 2012 is at least $5,000, you may be able to contribute the full amount. But it gets more complicated. Your ability to contribute to a Roth IRA in any year depends on your MAGI and your income tax filing status:

• If your filing status is single or head of household, and your MAGI for 2011 is $110,000 or less, you can make a full contribution to your Roth IRA. You can’t contribute at all to a Roth IRA if your MAGI is $125,000 or more. You can make a partial contribution if your MAGI is between the above amounts.

• If your filing status is married filing jointly or

qualifying widow(er), and your MAGI for 2011 is $173,000 or less, you can make a full contribution to your Roth IRA. You can’t contribute at all to a Roth IRA if your MAGI is $183,000 or more. You can make a partial contribution if your MAGI is between the above amounts.

• • If your filing status is married filing separately, your Roth IRA contribution is reduced if your MAGI is less than $10,000, and you can’t contribute to a Roth IRA at all if your MAGI is $10,000 or more.

Your contributions to a Roth IRA are not tax deductible. You can invest only after-tax dollars in a Roth IRA. The good news is that if you meet certain conditions, your withdrawals from a Roth IRA will be completely income tax free, including both contributions and investment earnings. To be eligible for these qualifying distributions, you must meet a five-year holding period requirement. In addition, one of the following must apply:

• You have reached age 59½ by the time of the withdrawal

• The withdrawal is made because of disability• The withdrawal is made to pay first-time home-buyer

expenses ($10,000 lifetime limit)• The withdrawal is made by your beneficiary or estate

after your deathQualified distributions will also avoid the 10 percent

with no taxes or penalties is a key strength of the Roth IRA. And remember, even nonqualified distributions will be taxed (and possibly penalized) only on the investment earnings portion of the distribution, and then only to the extent that your distribution exceeds the total amount of all contributions that you have made.

Another advantage of the Roth IRA is that there are no required distributions after age 70½ or at any time during your life. You can put off taking distributions until you really need the income. Or, you can leave the entire balance to your beneficiary without ever taking a single distribution. Also, as long as you have taxable compensation and qualify, you can keep contributing to a Roth IRA after age 70½. Note: You can have both a traditional IRA and a Roth IRA, but your total annual contribution to all of the IRAs that you own cannot be more than $5,000 for 2012 ($6,000 if you’re age 50 or older).

PHCC has been partnering with ACCA Greater Cleveland for the past 5 years and this year serviced over 50 homes. There are seven local chapters affiliated with PHCC Ohio: Akron, Cincinnati, Columbus, Dayton, Eastern Ohio, Northeast Ohio and Stark County. PHCC Ohio and our local chapters are affiliated with the Plumbing-Heating-Cooling Contractors national association. Together our Associations (local, state and national) form one of the nation’s largest and strongest trade organizations and they comprise the only organization working around the clock exclusively in the interest of Plumbing-Heating-Cooling Contractors.

On August 17, Akron PHCC and Stark County PHCC members attended an Akron Aero’s game attended by over 100 members, their families and friends.

PHCC has been working with Ohio’s Chief Plumbing Official, Ralph Reeb, and the State of Ohio regarding concerns about the Ohio Plumbing Code. In particular,

the focus has been on the lack of direct involvement of the plumbing industry in the code change process.

PHCC Ohio has created a Code Committee (Ron Schmitt, Herman Bohinc, Drew Neiman, Dana Williams, Rodger Sweitzer, Joe Schmitt and Jeff Heger) to work with the state, offer ideas and give input to the code change process.

PHCC needs your feedback. Please take a moment to send your concerns and/or

problems that you have experienced with the Ohio Plumbing Code. Concerns could include clarity and interpretation issues, or items that should be included or excluded (i.e. circuit vents, air admittance valves and shower drains). We would like to put together a “Top 10” list to submit before the end of the year.

Please share this email with your colleagues so that they will offer ideas and provide guidance for our industry. Thanks for your assistance in this matter. We will keep you posted on the results.
