WHEREAS, the UNITED STATES ENVIRONMENTAL PROTECTION AGENCY, a duly constituted agency organized under the laws of the United Stetes of America and having a regional office at 5 Post Office Squara, Suite 100, Boston. MA 02109 - 3912 ("EPA"), has identified a disposal sits, known as the "Nvanza Chemical Waste Dump Superfund Site" (the "Site*), as a result of the release of hazardous substances, as those terms are defined in me Comprehensive Environmental Response, Compensation, and liability Act of 1880, aa amended ("CERCLA"), 42 U.S.C. 9601 ej sag... and consequeniy placed the Site on the National Priorities Ust, set forth at 40 C.F.R. WHEREAS, the MASSACHUSETTS DEPARTMENT OF ENVIRONMENTAL PROTECTION, a duly constituted agency organized under fiw laws of the Commonwealth of Massachusetts and having an office at One Winter Street, Boston, MA 02108 ("MassDEP"), as a result of the reteass of oH and/or hazardous materials at the Site, as those terms are defined in the Massachusetts OB and Hazardous Materials Release. Prevention and Response Act, M.G.L. c. 21E {"Chapter 21E"), has placed the Site on the Massachusetts Ust of Confirmed Disposal Sites and locations To Be Investigated, pursuant to Chapter 21E, and has assigned to the Site MassDEP Release Tracking Humbet 3-0216, pursuant thereto;

WHEREAS, EPA regulates activities at disposal sites pursuant to CERCLA and the National Contingency Plan, 40 C.F.R. 300400, et sag., as amended (the "NCP"), and MassDEP regulates activities at disposal sites pursuant to Chapter 21E and the Massachusetts Contingency Plan, 310 C.M.R. 40.0000, as amended (the "MOP"), respecovefy;
