BUILDING PROJECT Approve the renewal of Lakewood High School’s program addressing the California Health Science Capacity Building Project. Lakewood High School is proposing to continue to augment its Small Learning Community, LASER (Lakewood Academy of Sports Medicine, Exercise Science, and Recreation) with renewal funds from the grant project. The California Department of Education has preliminarily approved continuation of the Health Science Capacity Building grant funding of $50,000 to LBUSD for next school year (2014-15). Accountability

The Governing Board recognizes its responsibility to ensure accountability to the public for the performance of district schools. The Board shall review the effectiveness of the district’s programs, personnel and fiscal operations, with a focus on the district’s effectiveness in improving student achievement. The Board shall establish appropriate processes and measures to monitor results and to evaluate progress toward accomplishing the district’s vision and goals.

The Board and the Superintendent shall agree upon appropriate measures of district, school and student performance and shall establish a schedule for providing regular reports to the Board and the public regarding district progress.

Opportunities for feedback from students, parents/guardians, staff and community members shall be made available as part of the review and evaluation of district programs and operations and as part of the development or annual update of the Local Control and Accountability Plan (LCAP).

Indicators of district progress in improving student achievement shall include, but not be limited to, the Academic Performance Index (API) established by the state’s accountability system, measures of Adequately Yearly Progress (AYP) and/or School Quality Improvement Index (SQII) required under the federal accountability system or federal waiver and measures aligned to the LCAP.

Evaluation results may be used as a basis for revising district or school goals, updating the LCAP or other comprehensive plans, identifying and developing strategies to address disparities in achievement among student subgroups, implementing programmatic changes, determining the need for additional support or assistance, awarding incentives or rewards, and establishing other performance-based consequences. Numerically significant subgroups include ethnic subgroups, socioeconomically disadvantaged students, English learners, students with disabilities, homeless and foster youth, when the subgroup consists of at least 20 students with a valid test score or 15 foster youth.

Alternative schools serving high-risk student population, including continuation high schools, opportunity schools, and community day schools, shall be subject to an alternative accountability system established by the Superintendent of Public Instruction. (Education Code 52052)

STUDENTS BP 5141.3 Health Examinations The Governing Board recognizes that periodic health examinations of students may lead to early detection and treatment of conditions that impact learning. Health examinations also may help in determining whether special adaptations of the school program are necessary. The superintendent or designee shall verify that students have complied with legal requirements for a comprehensive health screen, an oral health assessment, and immunizations at school entry. In addition, the district shall administer tests for vision, hearing, and scoliosis as required by law. Parent payments fund the program. We are located on 10 school sites: Bixby, Cleveland, Cubberley, Emerson, Fremont, Gant, Henry, Lowell, MacArthur, and Prisk. Our current tuition rate is $5.00 per hour with a minimum usage of 2.4 hours per school day (approximately 12 hours/week = $60.00/week). The rate for winter/spring/summer breaks is $35.00/full day, 6:30 a.m. to 6:30 p.m. According to the Children’s Home Society of California, the average tuition rate for Los Angeles County is $127.20 per week (with a maximum reimbursement rate of $155.25 per week). This data was prepared by the County of Los Angeles Child Care Planning Committee (2006 Child Care Needs Assessment). The agencies that serve the local schools with Kids’ Club sites are the YMCA and the Jewish Community Center, which have an average rate of $5.60 per hour. The average for the daily rate (winter, spring, summer breaks) is $47.50 per day. The last rate increase occurred in 2011-12. RECOMMENDATION: In order to maintain current child care standards and to continue to provide a high quality program we recommend an increase in tuition rates for the 2014-2015 school year from $5.00 per hour to $5.50 per hour. The full day rate for the winter, spring and summer break programs will increase from $35.00 per day to $40.00 per day. The last rate increase was in 2011-2012. The initial hourly rate increase is to take effect September 2014. Despite our rate increase, Kids’ Club’s tuition rates remain competitive with the local averages for regular care and summer camp. Parents will be notified by written documentation no later than June 2014. *Note: It is customary amongst local child care agencies to increase their rates approximately 5% each year in order to maintain cost of living expenses. BACKGROUND:

The Polytechnic High School Auditorium AB 300 Project (“Project”) includes seismic upgrades to the Auditorium Building that will provide code-required updates for fire, life and safety, and accessibility. The upgrades will extend the life of the Auditorium while preserving, as much as possible, the historical elements that the Polytechnic High School possesses. The Project improvements will comply with the Secretary of Interior Standards for Rehabilitation, per the Code of Federal Regulations Section 67.7, and will meet current building and safety codes, in addition to meeting District and State Educational Standards. For classroom use within the Auditorium and the Band room during construction, students and staff will be temporarily relocated to interim housing on site. In accordance with the California Environmental Quality Act (CEQA), an Initial Study (IS) was completed for the Project. The IS determined that a Mitigated Negative Declaration (MND) was the appropriate level of environmental documentation because all potential project impacts could be mitigated to a level of less than significant with mitigation incorporated into the Project. The MND was made available for review and comment by the general public, and public agencies, for 30-days from February 24, 2014 to March 25, 2014. No comments were received on the document or the Project. A Mitigation Monitoring and Reporting Program has been prepared which lists the measures that will be implemented to mitigate or avoid significant effects on the environment

WHEREAS, the Long Beach Unified School District (“District”) owns the real property located at

1600 Atlantic Avenue in Long Beach, California and operates a High School known as the Polytechnic High School; and

WHEREAS, the District has adopted the Facility Master Plan to guide the development, renovation and/or replacement of schools; and

WHEREAS, the Polytechnic High School Auditorium was identified on the Seismic Safety Inventory of California Public Schools, and is one of the AB 300 projects identified as a priority in the Facility Master Plan; and

WHEREAS, the proposed Polytechnic High School Auditorium AB 300 Project (“Project”) includes seismic updates for Fire, Life and Safety, and Accessibility. The upgrades will extend the life of the auditorium while preserving, as much as possible, the historical elements that the Polytechnic High School possesses. The Project improvements will comply with the Secretary of Interior Standards for Rehabilitation per the Code of Federal Regulations Section 67.7, and will meet current state building and safety codes, in addition to meeting District and State Educational Standards; and

WHEREAS, pursuant to Public Resources Code Section 21151.8(a), the District contracted for the completion of a Phase I Environmental Site Assessment (Phase I ESA) Report and consulted with the California Department of Toxic Substances Control (DTSC) to determine if the Project site constitutes a hazardous substance area as described in Public Resources Code Section 21151.8(a). Based upon the initial findings of the Phase I ESA, DTSC advised conducting supplemental assessments, results of which were summarized in a Phase I Addendum Report. The Phase I ESA report and Phase I Addendum report together constituted a Preliminary Endangerment Assessment (PEA) Equivalent submission to the DTSC. The above-mentioned assessments/investigations resulted in the conclusion that the Project site does contain minor hazardous substances that require remediation before the Project begins, but does not constitute a hazardous substance area as described in Public Resources Code Section 21151.8(a); and

WHEREAS, pursuant to Public Resources Code Section 21151.8, the District and its environmental consultants have consulted with the administering agency for accidental hazardous materials release prevention and the governing air pollution control district, the South Coast Air Quality Management District (SCAQMD) requesting identification of facilities located within one-fourth of a mile of the Project site which might be reasonably anticipated to emit hazardous air emissions or handle acutely hazardous materials, substances, or waste, and this consultation with the administering agency and SCAQMD resulted in the conclusion that no such off-site facilities have been identified; and

WHEREAS, pursuant to Public Resources Code Section 21151.8, the District and its environmental consultants have determined that the Project site is not located within 500 feet of a freeway or busy traffic corridor, or within one-fourth mile from a large agricultural operation or railyard; and

WHEREAS, the District contracted for the completion of a Mitigated Negative Declaration (MND) dated April 2014 (Exhibit A) to make an informed determination as to the environmental impact of the improvements at the Project site to meet current seismic building code and educational standards; and

WHEREAS, the determinations and findings of the MND are incorporated herein; and

WHEREAS, the District has, as lead agency for the Project, made the MND available for review and comment by the general public and public agencies for 30-days from February 24, 2014 to March 25, 2014; and

WHEREAS, no written comments were received on the MND; and

WHEREAS, the MND has been prepared pursuant to CEQA Guidelines and the District has reviewed and considered the MND for the Project; and

WHEREAS, a Mitigation Monitoring and Reporting Program (Appendix A of the MND) (MMRP) has been prepared, which lists the measures that will be implemented to mitigate or avoid significant effects on the environment.

NOW THEREFORE BE IT RESOLVED that the Long Beach Unified School District Governing Board makes the determinations and findings and takes the actions as referenced below pursuant to all applicable Education Codes, State Codes, Public Resources Codes and CEQA Guidelines:

• The foregoing recitals are true and correct; and

• Each and all of the findings and determinations contained herein are based upon competent and substantial evidence, either oral, written, or both, contained in the entire administrative record relating to the Project; and

• That the Board reviewed and considered the information contained in the MND including, without limitation, the Initial Study, the MMRP, and any comments made at the public hearing or contained in the administrative record for the Project prior to approving the Project.

The Board hereby certifies the following with respect to the MND:

• That the MND prepared for the Project contains a complete and accurate reporting of the environmental impacts associated with the Project; and

• That the MND has been completed in compliance with CEQA Guidelines and the State Public Resources Code and is hereby adopted as adequate and complete; and

• That the MND was presented to the Long Beach Unified School District Governing Board and that Board reviewed and considered the information contained in the MND prior to approving the project; and that the MND reflects the independent judgment and analysis of the District; and

• The District, if it proceeds with the Project, will incorporate the specific mitigation measures, best management practices, project conditions, coordination with providers, recommendations and other items contained in the MND; and

FURTHER, BE IT RESOLVED that the Long Beach Unified School District Governing Board hereby adopts the determinations and written findings that the Project site meets the requirements of Public Resources Code Section 21151.8(a) with regards to hazardous substances and pipelines,

hazardous off-site facilities, and distance from freeways or busy traffic corridors, large agricultural operations and railyards; and

FURTHER, BE IT RESOLVED that the Long Beach Unified School District Governing Board hereby adopts the MND which includes the Mitigation Monitoring and Reporting Program, attached as Exhibit A; and

FURTHER, BE IT RESOLVED that the Long Beach Unified School District Governing Board hereby approves the Project; and

FURTHER, BE IT RESOLVED the Long Beach Unified School District Facilities Development and Planning staff is hereby directed to: (i) prepare for filing with the appropriate governmental agency(ies) a written notice memorializing the Board’s determination of the MND adoption as to the Project and approval of the Project (“Notice of Determination” or “NOD”); and

FURTHER, BE IT RESOLVED that the Superintendent of the Long Beach Unified School District or his representative is authorized to initiate such steps as appropriate and necessary to: (i) prepare final construction plans, specifications and estimates; (ii) implement the mitigation measures identified in Exhibit A, (iii) obtain necessary permits and approvals for the construction of the Project, (iv) take such other steps as may be necessary to construct the Project; and (v) bring back to this Governing Board any appropriate recommendations to further implement the foregoing.

FURTHER, BE IT RESOLVED that the location and custodian of records with respect to all of the relevant documents and any other material which constitute the administrative record for the MND are as follows: Executive Director, Facilities Development and Planning Branch, Long Beach Unified School District, 2425 Webster Avenue, Long Beach, CA 90810.
