Scrap and Junk Shop of Mr. Manuel Lijauco

An endorsement from the Sangguniang Bayan was forwarded to our Office on 28 February 2003 requesting for an investigation regarding the operation of the "Scrap and Junk Shop" of Mr. Manuel Lijauco located within the Zavalla Village I, a residential subdivision. Investigation was conducted on 03 March 2003 and findings are as follows:

Findings & Observations:

1. The area being utilized for buying and selling of scrap materials is a vacant lot within Zavalla Village I in Brgy. Market Area, Santa Rosa, Laguna. The area is classified as a residential area as per certification issued by the Office of the Zoning Administrator.

2. The scrap materials range from wood, metals and metal chips, and plastics. Such materials were segregated inside an improvised warehouse adjacent to the owner's house.

3. No toxic/hazardous waste materials noted.

4. A separate warehouse adjacent to the warehouse in Zavalla Village I was observed. However, the warehouse was within the bounds of Cataquiz Subdivision. Residents of Cataquiz Subdivision are complaining the same scrap facility. However, no written and formal· complaint was filed. Complaints were made thru phone. Mr. Manuel Lijauco also manages the above warehouse.

5. The second warehouse is a storage area for cartons and plastics. Volumes of cartons were noted which are susceptible to fire.

Notice of Violation

' Initial investigation conducted on 18 November 2002 revealed that you are operating a scrap facility at Cataquiz Subdivision without the necessary permits. The activity is a fire hazard due to voluminous flammable materials in the area as well as an eyesore since the area is classified as a residential subdivision.

In view of the above, you are hereby advised to institute measures pursuant to Section 48 (Prohibited Acts) of Republic Act 9003 series of 2000 which states that:

(2) Undertaking activities or operating, collecting or transporting equipment in violation of sanitation operation and other requirements or permits set forth in or established pursuant to this Act;

(13) Transport and dumping in bulk of collected domestic, industrial, commercial and institutional wastes in areas other than centers or facilit ies prescribed under this Act;

(14) Site preparation, construction, expansion or operation of waste management facilities without an Environmental Compliance Certificate required pursuant to Presidential Decree No. 1586 and this Act and not conforming with the land use plan of the LGU;

In view of the foregoing, you are hereby ordered to show cause within seven (7) days from receipt hereof why a no Cease and Desist Order be imposed against you.

1st Notice of Violation

This is in connection with the "buy and sell" of scrap materials you are presently undertaking which was located in Zavalla Village I.

If you will recall, during one of our monitoring activities done last August 27, 2002, we informed you of the prohibited acts of burning of solid wastes and non­conformity of your scraping business with the land use plan of the municipality.

Moreover, we received a complaint letter from Mr. Vergel Regencia, President of the Zavallc!- Village I Homeowners Association, regarding this scrapping business. Attached herewith is the letter.

Please be informed of the provis10ns of R.A. 9003 or the Solid Waste Management Act of 2000 which states that:

Chapter VI Section 48. Prohibited Acts - the following acts are prohibited:

The petitioners, through its Board of Directors, appeal once more to your good office for legal appropriate action to totally get rid of the scrap operation in our sul:>division . Not only it is a fire hazard but also an environmental risk. What was once a quiet, clean and healthy neighborhood has now depreciated.

Please allow us to enumerate the actions we have initiated: 1. In 2001, the attention of the owner of the "scrap depot" was called to

solve the problem. Mrs. Pettie Lijauco informed then President Mrs. Carmen Altura that their business will move once they have scouted for a suitable location.

2. On Sept. 12, 2002, our President, Mr. Vergel Regenci~ filed a formal letter of complaint at the office of the Mayor against this "scrap depot" (Please see attached copy).

3. Last Monday (Feb. 10), at our Homeowners Association Board of ,.. Directors meeting, Mr. Manoy Lijauco was called to discuss again the

problem but he now claims that their "scrap depot" has "operating permits".

Regrettably, to this date, the "scrap business" of Mr. and Mrs. Manoy Lijauco has eve~ expanded.

Hence, it is our prayer that this petition be given due course and resolved by the Sangguniang Bayan through appropriate legal means provided by the law.

At upang mabigyan ng dagliang solusyon ang bawa 't problei:i1a ay marapat Jamang na gumawa kami ng tig-isang liham sa bawa' t problema upang inyong maiparating sa kinauukulang tanggapan o departamento para magawan kaagad ng madaliang _aksyon.

Isa po sa mga suliranin o problemang ito ay

Ang negosyo po ng nabanggit na mag-asawa ay humak.ot ng mga scrap materials sa mga kumpanya sa Sta. Rosa at paligid nito. Ito ay kanilang ibinebenta para kumita. Wala po kamiug kwestyon dito dahil ito n;µnan . ay legal at marangal na hanapbuhay. Ang problema po ay ang mga sumusunod :

a) Ang Village po namin ay hindi nakalaan sa ganitong negosyo. b) Pangit sa panigin ang marumi at nagkalat na basura at may panahon din na mabaho ang amoy ng mga bagay na nakaimbak dito. c) Madalas po na mapako ang gulong ng sasakyan ng mga dumadaan sa tapat nito dahi1 po sa nag kakalat na pako galing sa mga binak]as na paleta at kahoy-kahoy. d) Dito sila nag susunog ng mg basura na lumilikha ng masangsang na amoy. e) Maingay kapag may trak na nag baba at nag sasakay ng mga. bagay-bagay. maingay din kapag nag babaklas at nag puputol ng mga paleta at kaboy.

Ang mga opisyal po ng samahan ay nagtungo na sa kanHang tahanan at naJdusap na ayusin ang suliraning ito upang hindi maging masakit sa mata at di makaabala sa nakakarami. Sinulatan na rin po namin sila at nangako naman na aayusin ang mga ito. ng':}nit sa tingin namin ay lalo pa nila itong pinalalaki at pinalalawak.

Ang ganito po bang hanapbuhay ay naayon sa patakaran ng Munisipyo ? Sana po ay mapalipat ito sa ibang lugar na malayo sa mga kabahayan dahil maari din pag- simulan ito ng sunog at paglaganap ng sakit.

Umaasa po ang buong samahan na sa lalong madaling panahon ay mabigyan ng kalutasan o aksyon ang mga idinulog naming mga problema sa inyong taggapan . . .,
