Interpretation

1 In this regulation, “Act” means the Offence Act.

Ticket and summons

2 (1) A violation ticket, other than a violation ticket that is an eTicket, must be inForm A, Form H, Form K, Form L or Form O.

(1.1) A printout or display of an eTicket must be in Form P or Form Q.

(2) The instructions to be printed beside or on the reverse side of the copy of theviolation ticket given to the person alleged to have contravened an enactmentmust be as follows:

(a) in Form A.1 with respect to a violation ticket in Form A;

(b) in Form H.1 with respect to a violation ticket in Form H;

(c) Repealed. [B.C. Reg. 133/2019, App. 2, s. 2.]

(d) in Form L.1 with respect to a violation ticket in Form K or Form L;

(d.1) Repealed. [B.C. Reg. 133/2019, App. 2, s. 2.]

(e) in Form O.1 with respect to a violation ticket in Form O;

(f) in Form P.1 with respect to the printout of an eTicket in Form P;

(g) in Form Q.1 with respect to the printout of an eTicket in Form Q.

(3) The certificate of service to be printed beside or on the reverse side of theviolation ticket, other than a violation ticket that is an eTicket, sent to theInsurance Corporation of British Columbia must be as follows:

(a) in Form A.2 with respect to a violation ticket in Form A;

(b) in Form H.2 with respect to a violation ticket in Form H;

(c) in Form L.2 with respect to a violation ticket in Form K or Form L;

(d) in Form O.2 with respect to a violation ticket in Form O.

(3.1) The printout or display of an eCertificate of service must be in Form P.2.

(4) A summons and the certificate of service of a person serving the summons mustbe in Form B.

Warrants

3 A warrant issued under section 36 (b) of the Act shall be in Form C.

Promise to appear

4 A promise to appear and the certificate of service of a person serving a promise toappear shall be in Form D.

Appearance notice

5 An appearance notice and the certificate of service of a person serving an appearancenotice shall be in Form E.

Affidavits

6 (1) An affidavit under section 15 (10) of the Act shall be in Form F.

(2) An affidavit under section 16 (2) of the Act shall be in Form G.

(3) An affidavit under section 16 (3) of the Act must be in Form J.[am. B.C. Reg. 188/96, s. 2.]

Statement and written reasons

7 The statement under section 15.4 (1) (a) and written reasons under section 15.4 (1) (b)of the Act must be in Form M.

Certificates of evidence

8 A certificate of evidence under section 15.3 of the Act must be

(a) in Form N.1 for an offence under section 140 of the Motor Vehicle Act(speeding in a construction zone),

(b) in Form N.2 for an offence under section 146 (1) of the Motor Vehicle Act(speeding in a municipality),

(c) in Form N.3 for an offence under section 146 (1) of the Motor Vehicle Act(speeding outside a municipality),

(d) in Form N.4 or N.4.1, as applicable, for an offence under section 146 (3) ofthe Motor Vehicle Act (speeding against a highway sign),

(e) in Form N.5 for an offence under section 146 (7) of the Motor Vehicle Act(speeding against a municipal sign),

(f) in Form N.6 for an offence under section 147 (1) of the Motor Vehicle Act(speeding in a school zone), or

(g) in Form N.7 for an offence under section 147 (2) of the Motor Vehicle Act(speeding in a playground zone).

HOW TO PAY THE TICKET

REDUCE TICKETED AMOUNT BY PAYING EARLY If your ticketed amount is over $58 and you pay on or before the 30th day from the date of service of the ticket, your ticketed amount is reduced by $25.

PAY ONLINE PAY BY MAIL PAY IN PERSON

Mail your payment by cheque or money order payable in Canadian funds tothe Insurance Corporation of British Columbia at the following address:

Ticket Payment Processing, BAG #3505, VICTORIA, B.C. V8W 3N9 Do not send cash. A receipt will not be mailed. Your payment must be accompanied by a copy of the ticket or a note that contains the following as shown on the violation ticket:

• the violation ticket number; • your name, address, driver's licence number and date of birth; • the violation date and the name of the Act or regulation and section contravened.

If you do not provide these details or a copy of your ticket, it may not be possible to process your payment for the ticket. If this occurs, the ticketed amount will be unpaid.

Go to any driver licensing office, Service BC office or Provincial Court registry during regular business hours. Present the ticket, along with your payment.

WHAT HAPPENS IF YOU PAY THE TICKETED AMOUNT IN FULL? If you pay the ticketed amount in full, you are deemed to have pleaded guilty to the alleged offence and the offence will be added as a conviction to the records kept by the Insurance Corporation of British Columbia.

WHAT HAPPENS IF YOU PAY ONLY A PORTION OF THE TICKETED AMOUNT OR DO NOT PAY AT ALL? If, within 30 days of the date of service of the ticket, you (a) pay only a portion of the ticketed amount, or (b) do not pay the ticketed amount and do not dispute the ticket, you are deemed to have pleaded guilty to the alleged offence. This will have the following consequences: you will be subject to collection activity; the offence will be added as a conviction to the records kept by the Insurance Corporation of British Columbia; under section 26 of the Motor Vehicle Act, you may be refused a driver’s licence, a licence and corresponding number plates for a motor vehicle or trailer or a permit.

HOW TO DISPUTE THE TICKET

You can dispute the allegation set out in the non-shaded areas of the ticket or the fine or both by mailing a notice of dispute or appearing in person to give notice of dispute in accordance with the instructions below. Your notice of dispute must be mailed or given within 30 days of the date of service of the ticket. If you dispute the allegation, you or your agent will have to appear at a Provincial Court hearing. If you do not want to dispute the allegation but want to request a reduction in the fine or additional time to pay, you can avoid having to appear at a Provincial Court hearing by completing a Violation Ticket Statement and Written Reasons form. This form is available from gov.bc.ca or a Provincial Court registry. If you want to request a reduction in the fine or additional time to pay and do not complete a Violation Ticket Statement and Written Reasons form, you or your agent will have to appear at a Provincial Court hearing.

DISPUTE BY MAIL

You may mail a letter to the mailing address set out on the ticket saying that you want to dispute the ticket. The letter must (a) state whether you are disputing the allegation set out in the non-shaded areas of the ticket or the fine or both and (b) set out the address to

which the Provincial Court will send your notice of hearing. You must include a copy of the ticket with your letter, or your letter must contain the following as shown on the ticket:

• the violation ticket number;

• your name, address, driver's licence number and date of birth; • the violation date and the name of the Act or regulation and section allegedly contravened.

If you do not provide these details in the letter or a copy of the ticket, it may not be possible to process your dispute. If this occurs, you

will be deemed to have pleaded guilty to the alleged offence.

DISPUTE IN PERSON

You may deliver your notice of dispute in person to the location indicated on the ticket or to any driver licensing office, Service BC office or Provincial Court registry. You will need to bring the ticket and you may be required to fill out a Notice of Dispute form as provided at

that location.

WHAT HAPPENS AFTER YOUR NOTICE OF DISPUTE HAS BEEN RECEIVED?If you (a) disputed the allegation, or (b) submitted a request for a reduction in the fine or additional time to pay without including a completed Violation Ticket Statement and Written Reasons form, a notice of hearing will be sent to you in the mail from the Provincial Court registry. The notice will tell you the date, time and location for your Provincial Court hearing. If you or your agent do not appear at the Provincial Court hearing on the indicated date and time, the ticket is deemed not to be disputed and you are deemed to have pleaded guilty to the alleged offence. This will have the following consequences: the ticketed amount is immediately payable to the government; the offence will be added as a conviction to the records kept by the Insurance Corporation of British Columbia; under section 26 of the Motor Vehicle Act, you may be refused a driver’s licence, a licence and corresponding number plates for a motor vehicle or trailer or a permit. If you submitted a request for a reduction in the fine or additional time to pay and a completed Violation Ticket Statement and Written Reasons form, an order of a justice setting out the Court’s decision will be sent to you in the mail.
