5.Hours.16 4 (a) Forty-eight hours, exclusive of crib time, shall15 4 constitute a week 's work for surface workers. If more15 4 than one shift is worked on the surface the forty-eight

hours shall then be inclusive of crib time.(h) Forty-four hours shall constitute a week 's work

underground, including crib time.(c) On Mondays to Fridays inclusive eight hours, in-

cluding crib time, and on Saturdays four hours, exclud-ing crib time, shall comprise the week 's work for under-ground workers.

( d) A day 's work on the surface shall be deemed tobe satisfied if limo of duty he eight and three-quarterhours on five day, in each week and four and a quarterhours on one day.

(e) Six hours shall constitute a shift 's work in allrises or in sinking specially wet shafts and winzes andfor men engaged inside the gas or 'water spaces of any

16 4 boiler or flue in cleaning or scraping work and for then15 0 engaged in cleaning dust bins or dust flues. In case of16 2 boiler cleaners working broken shifts, one hour on the16 2 above description of work shall count as one hour and16 2 twenty minutes. In the case of Lancashire and Cornish16 4 boilers all time necessary for boiler cleaner to come out16 2 for a spell shall count as time worked in the boiler.

6.Overtime.(a) For work done beyond the hours of duty on any

ordinary day, payment shall be at the rata of time anda half for the first two hours and double time there-after.

(b) Work done on holidays shall be paid at doubletime, except work in connection with repairs to machi-nery which has broken down and caused a stoppage ofoperations.

(e) All work clone on Sundays shall be paid for atthe rate of time and a third, and any work done in ex-cess of eight hours shall be paid for at the rate oftime and a half for the first two hours and double timethereafter.

(d) These overtime rates shall not apply to excesstime due to private arrangement between the employeesthemselves, or which is necessary for effecting periodicalrotation of shifts, or which is owing to a relieving mannot coming on at the appointed time. The time forwhich any worker may he paid at ordinary rates insteadof overtime, due to a relieving man not coming on atthe proper tune, shall not exceed two hours, after theexpiration of which overtime rates shall apply for, thewhole shift.

(e) When computing overtime the district allowancesshall not be computed as, all addition to the clay's pay.

7.Wet places.In all wet or hot places eighteenpence extra per

shift shall be paid in addition to the rates set out. Thisextra payment shall not apply to Subelause (e) ofClause 5.

8.Dry Crushing Plants.No dry crushing plants shall be operated unless under

such conditions as obviate dust as far as is reasonablypracticable. It shall 'be the duty of the Inspector ofMines to make an examination of all dry crushing plantsin his district, once in each month, and at such othertimes as he may be requested so to do by the Secretaryof the Union. He shall examine and report to the StateCourt of Arbitration, and such report shall be primafacie evidence of the facts stated, therein.

9.Piece-workers.There shall be implied in every contract in which a

worker is engaged to perform any kind of work' at orfor a remuneration other than the rates fixed by thisAward:

(a) Where the engagement is for a period of timesuch period shall not be determined before the expira-tion thereof without the written consent of the worker.

(b) Where the engagement is to perform a specifiedquantity of work, the amount of work to be performedshall not be curtailed by a greater amount than fiveper cent.

(c) The rate of remuneration agreed upon shall notbe decreased during the engagement.

(d) The actual remuneration paid for the work doneshall not be less than the amount which the, worker wouldhave received for the, period of his work if he had beenworking for that period at the rate of wages fixed bythis Award for the work done.

(e) The price of any article supplied by the employerfor the use of the worker during the period of his en-gagement shall not lie increased during the period, andshall in no case exceed the cost or price of the articleto the employer at the place of supply.

(f) Where the work is to be carried out by a bodyof workers acting together, the number of workers to beemployed shall be specified in the contract. In theevent of the specified number of workers not beingpresent during any shift, the employer may provide a'substitute in the place of any worker absent, and shallpay such substitute wages at the rate fixed by thisAward, or by the contract, whichever shall be tpagreater, for the work done by him during the time heis so employed as a substitute, and may charge suchpayment against any money found due under the con-tract.

(g) Where any workers are employed to work -byor with the contractors at a wages remuneration, theemployer shall be entitled to pay the amount due tosuch wage workers for the period of their several em-ployment by the rate fixed by this Award, or the ratefixed by the contract, whichever shall be the greater,'and to charge the payment so made against the amountfound due to the contractors. A printed copy of theseconditions shall be kept exhibited in the Change Roomon the mine.

10.Holidays.The following shall be holidays: Christmas Day,

Easter Monday, and Labour Day. If Christmas Dayfalls on a Sunday, the following Monday shall be kept.

11.Casual Workers.Men employed for less than one week shall be con-

sidered casual, and shall receive one shilling per shiftabove the rates specified for the work.

12.Drinking Water.Cowl drinking water shall be supplied on all levels

where men are working, and kept cool and free fromdust.

13.Free Water.In all districts where free water is supplied by the

employer, single men shall get three gallons and marriedmen six gallons per day.

14.No Reduction.Any worker who -may he at the date of the signing of

this Award in receipt of a higher rate of pay for hisparticular class of work than is herein prescribed shallnot suffer by reason of this Award any reduction in theamount which such worker was receiving above the rateprescribed herein.

15.Mixed Functions.Any worker carrying out work classified at a higher

minimum than his ordinary rate for two hours in anyshift, shall be paid at the minimum rate for such workfor the whole of that shift, provided that such minimumis not lower than such worker's regular rate of pay.If he be employed for less than two hours at workclassified at a higher minimum than his ordinary rate,he shall be paid his ordinary rate for the *hole of theshift.

10.--Change Rooms.If more than four persons are employed underground

in any mine in one shift, sufficient accommodation shallbe provided above ground near the principal entrance tothe mine, and not in the engine room or boiler house,for enabling the persons employed in the mine to con-veniently dry and change their clothes, and in no caseshall men change their clothes upon a boiler.

17.Reduction of Hands.Should occasion arise to reduce the number of men

employed the, management, in selectiong those to be retabled, shall give full weight to the consideration otlength of service, and, all things being equal, shall re-tain those who have been longest in the employ of thecompany.

18.Accident Pay.In the event of an employee meeting with an accident

during the shift, or being required to attend to one whohas met with an accident, he shall be deemed to haverendered duty during the whole of the shift, and bepaid accordingly.

l9.Full Payment for Shift.(a) After beginning a shift workers shall not be paid

less than for a full shift, unless they leave of their ownaccord, or are dismissed for misconduct. This shall notapply in matters beyond the control of the management.

(b) If before an employee leaves the works at theend of his shift, and because he is not so informed, heattends at the next shift willing to work it, and thereis no suitable work which lie is allowed to perform, heshall be paid the wages he would have been entitled t,oif he had worked the shift he was ready and willing tc,work. This shall not apply in matters beyond thecontrol of the management.

20.Water Jets.Provisions of the regulations made under "The Mines

Regulation Act, 1906,' for the prevention of dust shallbe deemed to be ineorporated in this Award.

21.Payment of Wages.Pay day shall be in accordance with Section 55 or

"The Mines Regulation Act, 1906." Any workerleaving or being discharged shall be paid the full amountof wages due to him within one hour of ceasing work,or within one hour of the opening of the mine office, or,if such office was closed at the time of his ceasing work,or if the work done' requires to be measured or assessed,within two hours bf ceasing work.

22.Hours in Hot Places.No person shall be allowed to work for a longer period

than six hours in any part of the underground workingof a. 'nine when the temperature in that part, ascer-tained by the reading of the wet bulb thermometer, ex-ceeds 76 degrees Fahrenheit, for a period of four con-seentive hours. The reading of the thermometershall he ascertained at intervals of one half-hour, overfour hours, and the average of such readings shall betaken as the temperature during that period. The In-spector of Mines. shall take readings when required soto do by any worker, or by the Secretary of the Union.The Manager of the mine shall provide a wet bulbthermometer.

23.Annual Holiday.A fortnight's holiday, including twelve working days,

on full pay shall be granted once in each year to everyworker provided he has worked 298 shifts at ordinaryrates of pay, and should he have worked less than 298suet] shifts when the said holiday is taken, or at thetern:in:abut of his employment, he shall be paid for a.

'proportionate number of holidays. Payment for thesaid holiday shall be at the rate of pay the worker isreceiving immediately before the holiday is taken or em-ployment terminated. Provided further, that where theworker is dismissed for wilful misconduct he shall notbe entitled to the benefits of the provisions of thisclause. A piece-worker shall be entitled to be paid,when on holiday, the minimum rate for his grade.

24.Underground Workers.All men who have to go underground to work, and

the bracemen, shall work the same hours as miners.

25.Explosives.Any trucker using explosives where boring is necessary

shall be classed as a miner.

26. -Lime.Lime used in the reduction of ore shall not be mixed

in battery bins.

27.Definitions.'Wet Places."--Should any dispute arise as to

whether any place is wet, or especially wet, within themeaning of Clause 5, Subclause (e), such dispute shallhe referred to a Board constituted of a representativeappointed by the Employer and a representative ap-pointed by the Miners' Union of which the worker con-cerned is a member, with the Warden of the Goldfield inwhich such mine is situated as Chairman. The decisionof the Majority of the Board shall lie final.

"Timberman" (ordinary) .Tiinberman shall mean aworker engaged in underground timber work, but aminer timbering his own workings shall not be classedas a timinberman.

"Timberman" (shaft).A shaft timber man shallmean a worker engaged in shaft timbering or timberwork, but a miner timbering his own shaft shall not beclassed as a shaft timber 111:111..

"Bracemau" shall menu any worker in charge of acage at the mouth of a sha ft; if more than one cage,each worker shall be classed as a braceman, but shallnot include any worker who may be temporarily assist-ing a bracennta in loading.

"Platmall" or "Skipman" shall moan any worker incharge or a cage or skip; if more than one cage orskip, each worker so in charge shall be classed as a plat-man or skipman.

Leading Fireman" shall mean a fireman who attendsto feed pumps, feed water, gauge glasses, etc., and/orwhere only one fireman is employed on more than oneboiler, lie shall be classed as in charge.

"Hot Places" shall mean places underground wherethe temperature 'exceeds 76 degrees Fahrenheit using thewet bulb.

Notwithstanding that the rates above are expressed inweekly amounts, it is hereby declared that the contractof service is a daily contract, subject to Clause 16.

4. Hours for Day Workers.Forty-four hours shall constitute a week's work, to

be worked as follows :Eight hours on each day, fromMonday to Friday inclusive, and four hours on Satur-day: Provided, however, that at the employer 's optionas regards any department of the company's activitiesthe forty-four hours may be worked in five days ofhours 48 minutes each, or 40 hours in five days of Shours each may be worked one week and the fol-lowing week 18 hours in six days, at times to be mutuallyagreed upon : Provided, however, that where functionsare so closely associated that one cannot be carried onwithout the active assistance of the other (as, for in-stance, blacksmith and blacksmith's striker) this clauseshall not apply, and the hours of work shall be as here-tofore obtaining, subject to any future Award or indus-

trial Agreement. Should any dispute or question ariseunder this proviso it shall be referred to the Boardhereinafter appointed for decision.

5. Overtime.All work performed beyond the specified hours of

duty on any ordinary day shall be paid for at the rateof time and a half for the first two hours and doubletime thereafter. Work done on Sundays and .holidaysshall be paid for at the rate of double time.

6. Sub-contracting.(a) All the terms and conditions hereinafter set

forth as far as applicable to them respectively shallbe observed and carried out by the Company themselves,and by their sub-contractors, and also by the workers,anything which herein may be read to the contrary not-withstanding.

(b) For the more effectively securing the due ob-servance and performance of the last preceding clause,and the carrying out of the terms and conditions here-inafter mentioned, the Company, so far as concerns theirown acts, and so far as permitted by law, agree that nosub-contractors under them shall be allowed to operateon or use the lines, lands, and/or places under thecontrol of the Company for the purpose of supplyingfirewood without such person or Company first havingagreed in writing to the terms and conditions of thisAward.

(c) Before any sub-contractor shall be allowed to com-mence operations on or use any of the said lines, lands,and/or places controlled by the Company, lie shall notifyin writing the secretary of the Union whose membersare affected that such sub-contractor has agreed towriting to the terms and conditions of this Award.

7. Holidays.The following shall be holidays:Christmas Day,

Labour Day, and Easter Monday.

8. Annual Holidays.A fortnight's holiday on full pay shall be granted

once in each year to every worker provided he has workedon 298 working days at ordinary rates of pay, and shouldhe have worked on less than 298 workinc, days when thesaid holiday is taken or at the termination of his em-ployment he shall be paid for or allowed a proportionatenumber of holidays. Payment for the said holiday shallbe at the rate of pay the worker is receiving immediatelybefore the holiday is taken or employment terminated:Provided, further, that where the worker is dismissedfor wilful misconduct, lie shall not be entitled to thebenefits of the provisions of this clause.

Piece-workers shall be entitled to be paid, when onholiday, the minimum rate for their grade.

9. Stores and Supplies.The Company shall, during the currency of tlds Award,

sell stores and supplies to time workers at Kalgoorliecash prices, such prices to be revised from time to timeby the representative of the workers and the HeadStorekeeper on behalf of the Company on the basis ofinformation obtained by them from the Traders' Asso-ciation at Kalgoorlie, and the principal business firmsof Kalgoorlie. Meat prices to be similarly regulatedand revised on the basis of the cash prices as obtainedfrom the principal butchers of Kalgoorlie.

10. Feeder.'(a) Where 12 or more horses are in any camp a feeder

shall be employed.(h) Where the number of horses is more than two

and less than 12 a leading driver shall be employed forthe purpoSe at the rate of £5 15s. per week on a dailycontract of service.

11. Water.Good drinking water shall be supplied free to all

workers, and in the case of bush workers shall be de-livered into tanks along the line where the men areworking, and in no case shall the distance between eachtank be more than half a mile.

12. Piece-work.(a) Where workers are employed to work at piece-

work, the rates shall be in accordance with the attachedschedule, but in no case shall payment be less than theywould have received had they been working under a con-tract of daily service at the rates fixed in Clauses 3or 23 hereof (overtime, if any, not being included) :Provided, however, that in the case of a worker who hasnot had throe months' experience, the minimum rate

shall be such as may be mutually agreed upon betweenthe representative of the Union and the Bush Boss ineach case, and in the event of their disagreement maybe referred to the Resident Magistrate for the district.Each such inexperienced worker shall, during his periodof probation, be deemed to be an apprentice. At theend of each period of six months the Company shallfurnish the Registrar with a return showing the numberof workers employed under this proviso and the wagesand/or other payments made to each.

(b) For the purpose of ascertaining whether eachworker is receiving less than the minimum rate underthe preceding subclause, the total earnings of such piece-worker for the period of the last preceding two monthsshall he averaged.

13. General Conditions of Piece-work.(a) Except in the ease of wheel or curve blocks, the

minimum frontage shall be two chains for each man inany one party, with a maximum frontage of six chains,irrespective of time number of men in the party. Inthe case of double banking the original cutter shall havethe choice of ends.

(h) Cutting or splitting shall be left to the option of-the cutters so that they shall not be idle whilst firewoodis being carted from the back of their blocks.

(c) When a team or teams are carting wood for cut-ters who have cut out their blocks, such team or teamsshall not be withdrawn until all the firewood of thecutter has been cleaned up.

(d) If two or more parties of cutters require blocksat the same time, they shall draw lots for precedenceand the Bush Boss shall conduct the drawing andmeasure out the blocks and distribute them between thecutters. Subject to the order of drawing, cutters shallbe supplied with new blocks as soon as they have cut outtheir old blocks, provided their services be required. Nocutter shall take a block on his own authority.

(e) In the event of trees being Unsuitable to cutters,such trees need not be felled. If a dispute arises as towhat constitutes unsuitable trees, time Bush Boss and theworkers' representative shall decide the question. Ifthey cannot agree the trees in dispute shall be felledand cut and loaded by the cutter at the rate of twoshillings per hour.

(f) Camps shall be placed so that cutters shall nothave to walk more than a mile to the front of the blockwhere they are working. In the ease of large blocks.tanks shall be placed so that the water shall be availablewithin 13/4 miles from where the cutters are working.

(g) Wood shall be trucked within five weeks from thetime the blocks are cleaned up and, so far as possible,in time order in which they were carted.

(h) (1) Wood burnt on the line shall be paid for at7s. per load for green wood and 8s. per load for drywood to the woodcutters, and at the rate of ls. per loadfor green wood and ls. 3d. per load for dry wood to thedrivers.

(ii) Wood burnt on trucks shall be paid for at ton-nage rates based on the average weight of the rake.

(i) Wood belonging to each cutter or party to beloaded into trucks separately as far as practicable, ex-cept when cleaning up the line.

(j) Cutters shall peg their blocks from a point to aline as directed by the Bush Boss and time Company shallclear the tip.

(k) Cutters who are desirous of leaving their blocksshall give the Company notice, and their wood shall betrucked and paid for within four days after carting, andpayment forwarded, when necessary, by registered letterto any address left by time worker. This shall also applyto cutters who have severed their connection with theCompany.

(1) Cutters may obtain advances in cash or etoresfrom the Company up to 75 per cent. of the estimatedvalue of the sum coming to them for wood lying out ontheir blocks, or on the line; the value of such stores orsupplies shall be taken as payment or part payment forauy such firewood.

(m) (i) The wood shall be cut in accordance with thefollowing extracts from the mine specifications, viz., theCompany shall supply firewood of locally grown timber,other than black oak, in lengths of 5ft. with a diameter,if unsplit, of not more than 10 inches nor less than 3inches at either end, but if the firewood exceeds 10inches at both ends but does not exceed 12 inches atboth ends, the same shall be split in half, and .should thefirewood exceed 12 inches at both ends shall be split infour pieces.

(ii) All cutting shall be done in a face either fromthe back of the block inwards or from the front out-wards. All suitable timber shall be cut into firewoodlengths and sizes as specified herein.

(iii) In the event of the cutter having unsplittablelogs on hand, the price for same shall be arranged be-tween the Bush Boss and the workers' representative,who shall also decide, if necessary, the question ofwhether any log is unsplittable or not.

(n) (i) Drays shall be supplied to clean up blocks assoon as possible after they have been cut out. If cuttersare idle for more than one day whilst waiting for draysor to shift camp, tho Company shall find work for suchcutters for which they slall be paid at the rate of16s. 6 0/11d, per day of eight hours. In the event of theCompany being unable to find work for such cutters,the cutters shall nevertheless be entitled to receive 16s.6 6/11d, per day of eight hours for each day thus keptwaiting for drays or to shift camp after the expiry ofthe first 24 hours..

(ii) Cutters shall be supplied with two teams if cart-ing beyond a mile, provided the block is cut out satis-factorily.

(iii) In the event of cutters being required to walkmore than three miles to load wood they shall receivean extra is. 2d. per day for each additional mile or partof a mile over three. If called out to load on Sundayscutters shall be allowed wages at double the ordinaryrates.

(iv) Woodcutters in culled bush shall be paid at therate of 3d. per ton extra. Culled bush shall mean anyblock adjacent to a Government railway line from whichmining firewood has previously been cut and removedby contractors or others.

(o) Engine wood cutters shall have their blockscleaned up at least once per month.

(p) Horse-drivers' camp shall be so situated that thedrivers shall not have to travel more than one mile fromthe camp to the ,front of the block.

(q) (i) Facilities shall be provided for wateringhorses at crib time on the job.

(ii) If drivers are required: to travel more than aquarter of a mile from the front of the block to watertheir horses at crib time, travelling time to be paid bothways at the rate of twenty minutes to the mile.

(r) The cutter shall place his wood in heaps con-venient for the driver.

(s) Horses shall be supplied to the drivers in a fitcondition to do the work.

(t) Tips to be cleared and levelled by the Company.(u) The Company shall provide a sufficient number of

trucks for loaders. For any time lost owing to an in-sufficiency of trucks, loaders shall be paid waiting timeat the rate of 2s.. per hour, and the Check Clerk shallkeep an account of the time so lost, but this clauseshall not apply in the case of a breakdown or for anyother cause beyond the control of the Company.

(v) A van or truck shall be attached to trains tobring loaders home from work.

(w) Loaders prevented from loading by wet weathershall be returned to the home camp as early as possible.

(x) Loaders shall not travel more than six miles fromthe camp to the place of working.

(y) The Company shall deliver all stores requiredthree times per week. Present arrangements for deliveryto camps shall continue. in any place where stores areleft at or near the railway line to be taken delivery orby the workers, a suitable safe or other receptacle shallbe provided for the reception and protection of suchstores.

(z) Loads shall be tipped not closer to the nearestrail than 3 feet and not further away from the saidnearest rail than 18 feet.

14. Mixed Functions.Any worker carrying out work classified at a higher

minimum than his ordinary rate shall be paid at therate of such work for the whole of that shift.

15. Casuals.All men not employed for the full working week shall

he considered casuals and shall receive 10 per cent, inaddition to the rate specified. This clause shall notapply to piece-workers.

16. Full Payment for Shift.(a) After beginning a shift a worker shall not be paid

for less than a full shift unless he leaves work of hisown accord or is dismissed for misconduct.

(b) If before an employee leaves the works at theend of his shift he is not informed that his services are

not required, and because he is not so informed hoattends at the next shift willing to work it, and thereis not suitable work which he is allowed to perform,he shall be paid the wages he would have been entitledto as if he had worked the shift lie was willing to work.This shall not apply in matters beyond the control ofthe management.

17. Payment of Wages.Pay day for day workers shall he at least once every

!minth not later than the 12th. Any worker leaving orbeing discharged shall be paid the full amount of wagesdue to him within one hour from the time of his appli-cation at the Company's office during office hours.

18. New Classes of Labour.Should men be employed on a class of labour not speci.

fled in the schedule, the amount of wages to be paid forthat class of work shall be mutually arranged betweenthe Company and the Union.

19. Existing Customs.All existing customs and conditions prevailing at the

time of this Award, and not altered by this Award, shallnot be varied unless by mutual consent of the partiesthereto, and the workers and the Company shall not bedeprived of any privileges or rights hitherto enjoyed,nor shall any new conditions detrimental to the interestsof either of the parties be imposed unless specificallymentioned herein.

20. Settlement of Disputes.Any minor dispute arising as to the working of any

portion of this Award, same to be referred to a Boardconsisting of a representative of the Australian Workers'Union and the Company. Should they be unable toagree, they shall refer the matter to an independentchairman for settlement, such person to have a practicalworking knowledge of the work in dispute. In the eventof the parties being unable to agree as to the chairmanto be appointed, the Industrial Magistrate at Kal-goorlie shall be the chairman.

21. Weighing of Wood.The Company shall cart the wood to the railway line

and load it into wagons. Wagons shall be taken acrossthe weighbridge and weighed in the presence of theworkers' representative. The weight then ascertainedshall be taken as final. Delivery between the cuttersand the Company shall be completed when the woodhas passed the weighbridge and the weight has beenascertained unless otherwise agreed to.

22. Spark Arrestors.In order to safeguard the wood from being burnt, the

Company shall employ men as spark arrestors.

23. Under-rate Workers.Any worker who by reason of old age or infirmity is

unable to earn the minimumu rate prescribed by thisAward may be paid such lesser rate as may from timeto time be agreed upon in writing between the employerand the secretary of the Union, or, failing such agree,-'tient within twenty-four hours after such worker shallhave applied in writing to the secretary of the -Unionstating his desire that such wage should be agreed upon,such wage as shall be fixed by the most convenient Resi-dent or Police Magistrate, upon the application of suchworker, after twenty-four hours' notice in writing shallhave been given by him to the said secretary, who shall,if he so desires, be heard by the Magistrate upon suchapplication. After having given notice to the secretary,and after lodging the application mentioned and pendingthe Magistrate's decision thereon, the worker shall beentitled to work for and be employed at the proposedlesser rate. The determination of the Magistrate shallhave effect for the period of six calendar months fromthe date thereof, and after the expiration of the saidperiod, until the wage shall have been again fixed atthe instance of the said secretary in the manner pre-scribed. The secretary of the Union may by writingunder his hand appoint an agent or substitute to repre-sent the Union at the hearing of the application beforethe Magistrate.

24. First Aid.The Company shall provide at Kurrawang and at each

Main Camp, first aid equimnent, and keep same fullyand efficiently supplied. The Company shall also, wher-ever it may be done without loss or expense or undue
