THE CHAIRPERSON

OF THE BOARD.

Authority’s Chairperson of the Board of Directors

“Take the first step in faith. You don’t have to see the whole staircase, just take the first step

nonetheless.” – Martin Luther King Jr.

As the curtains have descended on what has been productive, challenging and in some

cases rewarding 2019, let us constantly treasure, appreciate and perceive all obstacles not as

failures, but as learning curves and reasons to get back up.

As an Entity, we are now in our last lap of the current financial year, 2019/2020; I am

encouraged by our sheer determination, strength and tenacity. We have continuously

steadied the ship despite being visibly short-staffed. And with that I convey, express and

extend my deepest appreciation to each and every one of our officials.

The previous year called for us to adjust and intensify our responsibility of raising awareness of

the hazards of excessive and irresponsible liquor consumption, and ensure full compliance by

current liquor traders. The scourge of gender based violence has attracted provincial and

national attention, with our MEC, Ms Nomusa Dube-Ncube, spearheading programmes and

campaigns in an effort to raise awareness and bring the perpetrators to book.

We have continuously worked with law enforcement agencies, stakeholders and government institutions to identify those problematic

outlets and shut them down. We have also received pledges from our stakeholders to ensure the safety through installations of CCTV’s,

panic buttons and brighter streets lights for immediate and clearer visibility as part of the Gender Based Violence’s programme of action.

These projects have received a thumbs up from the MEC and are currently in the pipeline and being rolled out throughout the Province. I

am adamant, that these will no doubt also assist the KZNLA in the fight against violence that occurs in liquor outlets.

Let us commit to respond more timeously to our internal and external audit findings if we want to regain a clean audit status that we

achieved in the 2016 financial year. I encourage each one of you, irrespective of your rank and status to be more receptive and

responsive to customer enquiries and complaints. Although a prime function of the Liquor Licensing Business Unit is to deal with enquiries

relating to the licensing process – all of us must play a part in ensuring quality customer satisfaction. Let us work as a team. Let us not

pass the buck. Say to yourself “The buck stops with me”. That should be our daily mantra. To serve the client with care and diligence.

I am confident that all of us will rise to the challenges that we face as an entity, its leadership and Management team. These challenges

are certainly not insurmountable. We have a well-oiled team and together we can do so much more.

FIGHTING GENDER BASED

VIOLENCE ONE STEP AT A TIME

Scores marched in solidarity to raise awareness on

gander based violence.

In another bid and effort to raise awareness and

reduce the crippling scourge of gender based

violence havocking our province and country; the

KwaZulu-Natal Liquor Authority partnered with the Ray Nkonyeni and UGu

Municipalities to fight this ferocious and unjust.

Government officials, a male dominated crowed and willing private corporates

took to the streets of Port Shepstone on, 12 December 2019 to show their support

for 16 days of Activism Against Gender Based Violence (GBV) and in protest at

the wave of femicide which has swept the country.

The KwaZulu-Natal Liquor Authority was represented by its Chairperson of the

Board, Ms Mbali Myeni, Acting Chief Executive, Mr Bheki Radebe and various

Business Units, particularly the Social Responsibility Unit.

Delivering her keynote address, Chairperson, Ms Mbali Myeni thanked the Ray Nkonyeni and UGu District Municipalities for orchestrating

such an important and impactful programme; alluding to how the KZN Liquor Authority wouldn’t pass up an opportunity of this

magnitude to land a helping hand.

“The KwaZulu-Natal Liquor Authority wishes to extend our deepest appreciation for the opportunity rendered for us to partner and

collaborate with various other private and government institutions. As a liquor regulator, we fully understand our responsibility of raising

awareness on the negative effects of alcohol abuse and the role which it plays in contributing to the increased tally of reported house

hold violence [incidents].” said Ms Myeni.

“Through our various and committed business units, we will continue to ensure optimum compliance, education and properly regulated

liquor licence application processes. Our MEC, Ms Nomusa Dube-Ncube has also committed herself to rolling up her sleeves in the fight

against GBV. Programmes are currently in place, and we guarantee immediate impact once they have been implemented,” Ms Myeni

concluded.

During the march, candles were lit and a moment of silence observed in honour of all women who had died as a result of gender-

based violence, both on the South Coast and throughout the country.

Alcohol consumption and binge drinking continues to play and have a devastating impact on society and communities, more especially our youth.

While alcohol may contribute to the Province’s and country’s economy, the MEC for the KZN Department of Economic Development, Tourism and

Environmental Affairs, Nomusa Dube-Ncube acknowledges the responsibility bestowed on Local, Provincial and National Government, with emphasis

to the trusted National and Provincial Liquor Authorities.

“We have a huge responsibility to play when it comes to alcohol and consumption, and violence related to the product,” said MEC Dube-Ncube.

The MEC further cited and identified Inanda area as one of the problematic areas. Saying; “Alcohol consumption played a crucial role in the

widespread tragedy of rape in the area. Sadly, women fall victims to known perpetrator. The culture of If I buy you a drink, then you must sleep with me

has become a norm in most areas.

Other reports revealed that more than 52 420 Gender Based Violence cases were reported in 2018/2019 financial year; including but not limited to

rape, sexual assault, incest, statutory rape and sexual grooming of children.

Speaking during the programme, hosted on, 03 December 2019, Moses Kotane Institute’s Dr Simphiwe Buthelezi painted a vivid picture of how the

scourge of Gender Based Violence has impacted our society.

According to Dr Buthelezi, research has shown that alcohol consumption increases the

likelihood of sexual violence and other terms of gender based violence and crimes

against women and children.

Dr Buthelezi delivered the outcomes of a study undertaken on GBV in KwaZulu-Natal.

She said that when people were intoxicated, they focused on immediate, salient and

superficial cues.

“The cues that usually inhibit sexually aggressive behaviour such as a sense of morality,

empathy for the victims and concern for future consequences are likely to be less salient

than feelings of anger, frustration, sexual arousal and entitlement, especially among men

who are predisposed to sexual aggression,” she said.

However, not all was doom and gloom. MEC Dube-Ncube assured attendees and the

entire Province that local government was committed to using the advancements of the

Fourth Industrial Revolution (4IR) to end the scourge of gender based violence.

MEC Dube-Ncube said the CCTV cameras will be installed in 10 sites in Amatikwe in Inanda, which has the highest number of reported rape

cases in the country in the last financial year 2018/2019.

"I wish to inform the people of KZN that we have agreed on an urgent need to install CCTV cameras and flood lights in taverns, nightclubs, in

our streets, workplaces, recreational centres and other places as part of efforts to turn around the situation.

"We are in negotiations with Vodacom to ensure connectivity through ICT infrastructure. We want to use wi-fi operated CCTV cameras that

identify criminals through face recognition technology and their biometrics before even committing their next crime," the MEC said.

Delivering the Vote of thanks, Ms Mbali Myeni, KwaZulu-Natal Liquor Authority’s Chairperson thanked all in attendance, in particular all the

stakeholders that had made significant pledges on the day.

“We wish to acknowledge the tremendous contribution of our Honourable MEC, Ms Nomusa Dube-Ncube for initiating such an august

programme. A huge token of appreciation is also extended to our stakeholders and partners who have committed and pledged to assist and

partner with this programme moving forward,” She said.

The following were some of the pledges made on the day:

1. Aware.org - R6 million to assist to empower tavern’s, provide

training on proper conduct and compliance,

equipment (CCTV and lighting) and ensure a

continuous supportive system is provided.

2. SABMiller - R270 000.00

3. Edison and Power Group – R500 000.00 (This financial year alone). Sanitary

towels/equipment (R2.5 million).

4. KZN Slots and Kingdom slots – R200 000.00

In a joint venture with the South African Breweries, UMsinga Municipality, Department of Health, Social Development, Community Safety and

Liaison and the Department of Education, the KwaZulu-Natal Liquor Authority officially handed over five (5) portal laptop to Mpikayizekanye High

School, an impoverished learning institution in the rural heart of UMsinga.

Hosted on, 20 November 2019, with the purpose of encouraging smart and modern day education; the programme sought to close the gap

between the rural and urban schooling system, style, manner and conduct.

“Our learners deserve the best modern education there is. This programme and kind gesture will most certainly make a difference in not only

Mpikayizekanye, but the entire community. This restores hope, in not only our stakeholders, but the overall Municipality and our commitment to

education,” Her Worship, Mayor B.P Ngcobo said.

She further applauded to the commitment from the KZN Liquor Authority, who’s image and brand is sometimes dented and questioned; but their

strides and effort in ensuring education and awareness continues to show in their everyday programmes and engagements.

“The KwaZulu-Natal Liquor Authority has played a tremendous role in ensuring the success of this programme

Together with the South African Breweries and all represented stakeholders, they have gone beyond the call of duty and have most certainly

restored the hopes of students, educators and the entire community in our educational fraternity and system,” concluded Mayor Ngcobo.

Speaking on behalf of the KwaZulu-Natal Liquor, and in impeccable and fluent IsiZulu, Social Responsibility’s Acting Executive Manager, Mrs

Yasmin Bacus encouraged continuous partnerships between represented and other stakeholders – highlighting the importance of ensuring access

to education, awareness and the responsibility each stakeholder bares in warranting a bright future for our children.

“While we have continued to carry out our mandate of regulating and controlling the retail sale and micro-manufacturing of the liquor product

within our Province – granting and refusing liquor license applications in the process. The KZN Liquor Authority and our stakeholders have a

responsibility of ensuring that education and awareness is then easily accessible,” said Bacus.

She continued to elude to how the entity has gone across the lengths and breadths of the Province in ensuring that it forges sustainable and

productive relations with stakeholders.

Local leaders (Amakhosi) and the school principal all shared the podium in singing the chorus of appreciation to all stakeholders who have united

to ensure a better and sustained future for our children.

The Entity wishes to thank all stakeholders, with particular emphasis to the UMsinga Municipality for hosting us, and the South African

Breweries who pledged and donated the laptops to the school. Representatives of the Entity will also not go unnoticed. Each Business

Unit has done tremendously well in flying the KZNLA flag high.

WELLNESS DAY PROGRAMME As part of its annual initiative and commitment of promoting a healthy lifestyle,

the KwaZulu-Natal Liquor Authority hosted its Wellness Day programme on

Friday, 13 December 2019, as spearheaded by the Human Resources’ Unit, at

the Kloof Civil Hall

With the aim of providing a caring work environment where employees living with (or without) life limiting experiences that impact

adversely on their job performance, the programme sought to promote interaction amongst employees/colleagues, share experiences,

similar challenges and gain support from a dedicated team of trained wellness practitioners, fitness instructors, corporates and provide

employees with a day of relaxation and pampering.

Delivering the purpose and keynote address of the programme, KZN Liquor Authority’s Acting Chief Executive Officer, Mr Bheki Radebe

emphasized the importance of hosting such initiatives/programmes.

“The programme primarily focuses on quality of life by attending to the physical, emotional, social and spiritual needs of employees;

nurtures an individual as a totality, provides a change of environment from the office set-up, offers the opportunity to explore

complementary therapies to assist the employees to cope in the workplace e.g. massage, music and counselling and support,” said Mr

Radebe.

He further accentuated the importance of Unity and support. Encouraging employees to seize the opportunity of being outside the office

and make the most out of it.

“We’re mostly office bound, so such opportunities should be seized and made the most out of them. I truly and fully understand that we are

different and diverse, but it is those qualities that makes us unique and a well-rounded team of individuals. I trust that this programme provides

us with an opportunity to engage and interact with each other. More importantly, offer a helping hand where it’s needed.”

Keen to partake and participate in the festivities, Social Responsibility Practitioner, Mlungisi Dube said:

“An employee who is happy and healthy is more productive and motivated; and stays away from work due to illness less often…and that’s why

we welcome such an initiative with great anticipation and eagerness every year.”

Amongst other activities was an aerobics session, eye testing, manicure (nails and hands therapy), masseuse, chiropractor etc.

Thanking all in attendance and those that participated, Human Resources’ Manager, Mr Siyabonga Masikane said:

“The Entity is humbled and delighted with the turnout and the immense eagerness of every colleague. We acknowledge the presence and

wise words from the Acting CEO and every contributing party that played a significant role in ensuring the success of the programme. We hope

to grow each year.”

AUTHORITY LEADS NATIONAL

LIQUOR CAMPAIGN The KwaZulu-Natal Liquor Authority, in a joint effort with the National

Department of Trade and Industry, Provincial Department of Social

Development, KZN Transport, South African Police Services and other various

government institutions, euphorically hosted and led the KwaZulu-Natal leg of

the National Liquor Awareness Campaign, 18 – 19 December 2019.

The Campaign mainly sought to tackle and address the negative impact of

alcohol and its noncompliant trade, educate and create awareness amongst

the country’s citizens about the hazards and adverse effects of excessive

liquor consumption and encourage a safe and alcohol free festive season.

The theme of the campaign was Stay Sober 99. Provincial Department of Economic Development, Toursim and Environmental Affairs and

the Department of Health were also amongst the represented Institutions. Both playing a sterling and valuable role.

The Deputy Minister of Trade and Industry, Ms Nomalungelo Gina applauded Durban’s reception, the commitment from government

institutions, role of the Liquor Authority and the overall impact of the Campaign since its inception.

“Since the beginning of the Campaign in Soshanguve, Pretoria on 28 November 2019 officials from the Department of Trade and Industry

and provincial Liquor Boards have been visiting taxi ranks, marketplaces, taverns, shebeens and other related liquor outlets to spread the

message of responsible alcohol consumption by the citizens, and responsible trading by businesses,” said Gina.

She further elaborated that the campaign is being used as a platform to convey messages targeted at liquor traders and communities to

curb the scourge of excessive liquor drinking.

“The festive season is the time when the many citizens are on holiday having fun. Drinking, particularly during this time of the season, is

perceived as a common form of recreation and it is in instances of this nature that we experience high levels of road fatalities due to drink

and driving. Therefore, it is of utmost importance that we caution our communities about the dangers of over-indulgence,” she outlined.

According to Gina more often than not, liquor traders contravene their licensing conditions during this time of the year by exceeding their

trading hours and selling alcohol to minors and to already intoxicated people.

KZN MEC for the Department of Social Development, Ms Nonhlanhla Khoza sung the chorus of support for the Deputy Minister, introducing

new themes and phrases of “Ke Moja” and “YOLO”.

MEC said:

“These are not just phrases and themes we use, but have coupled with effort to introduce campaigns bearing these catchy phrases.”

KwaZulu-Natal Liquor Authority’s Acting Chief Executive Officer, Mr Bheki Radebe delightfully thanked the Deputy Minister, MEC and

representatives from each government institution for ensuring the campaign was a success.

“As we are about to take to the streets, allow me to extend a special and sincerest gratitude to the Deputy Minister, MEC, entire delegation

and representatives that have ensured the success of the briefing and campaign,” said Radebe.

The CEO further outlined the campaign map and also recognized SAPS for their role.

5 outlets were visits within the Durban front area, with one outlet requested to shut down due to appalling conditions consumers were

required drink under.

Another successful Festive

Season Campaign for the

KwaZulu-Natal Liquor

Authority. The Festive Season is a peak season in the calendar, with the majority of

the population being on vacation due to the closure of schools and

work places. For the retail liquor industry, the Festive Season is a busy

period with higher sales and demanding consumers which could entice

flouting their conditions of trade. The KZNLA through its Social

Responsibility, and the Compliance and Enforcement Units has identified

a need to raise awareness and heighten enforcement on the

implications as well as the effects of alcohol abuse and irresponsible

liquor trade during the Festive Season.

Partnering with the South African Police Services, Department of Economic Development, Tourism and Environmental Affairs, local and

provincial government, Municipalities and various other stakeholders, the KwaZulu-Natal Liquor Authority sought to address and decrease the

number of reported liquor incidences throughout the Province.

The annual campaign was scheduled as follows:

KwaZulu-Natal Liquor Authority’s Acting Chief Executive Officer, Mr Bheki Radebe applauded the sterling work from each Business Unit and

hoped to see the programme /campaign grow with each and every year that passes.

Parent associations and the Department of Education have welcomed the move.

KwaZulu-Natal Liquor Authority (KZNLA) acting chief executive Bheki Radebe said

there was confusion regarding the KZN Liquor Licensing Act 6 of 2010, which permits

taverns and bottle stores to be located no closer than a 500m from schools, churches,

mosques and temples.

In October, the Daily News reported that despite more than 200 residents from Seaview and surrounding areas supporting an objection to

a proposed bottle store opening 368 metres away from Seaview Primary School, the KZNLA had granted it. And residents living close to

Sarnia Road near Rossburgh and Hillary lodged an objection to a proposed bottle store opening near Seaview Primary School.

In the objection, residents cited the degeneration of the area as one of their concerns.

According to the KZNLA the bottle store would be 368m from Seaview Primary; 305m from the Seaview Congregational Church; 530m

from the RMC Church; and 291m from the Madressa and Seaview Musallah Mosque.

Before granting an application, the authority had to be satisfied that the proposed premises were not located within 500m of any religious

or learning institutions. Despite the close proximity to the school, churches and mosque, the KZNLA said a 500m circumference equated to

a 78.6m radius.

The authority uses 78.6 as a measure to consider applications as derived from a 2016 Shoprite Checkers Supreme Court of Appeal

judgment against the Department of Economic Development Tourism and Environmental Affairs (EDTEA) and the KZN Liquor Authority.

The judge found inconsistencies in the interchangeable use of the words circumference and radius in the legislation and ruled that the radius of a

500m circumference is 78.6m.

Radebe said the KZNLA and the EDTEA had met recently to review the legislation to propose amendments.
