Riverhead Town may have beeifluoridating its water supply illegally during the' past seve.years, according to informatioireceived Tuesday by the RiverheatTown Board.
Councilman Elmer A. Stotzkread a communication from theSlate Department of Audit an'Control which stated that thitown board did not have the righto adopt a resolution directing theaddition of fluorides to the wateisystem back in 1954.
Mr. Stotzky had written to thedepartment asking if the townboard , "sitting as the water com-missioners, may resolve to discon-tinue the fluoridation of the waterwithout a public hearing," and if"the permission of the commis-sioner of health is needed prioito discontinuance?"
In his reply, George F. Whalencounsel to the comptroller, stated :"This department has held thatfluoridation of water supply hasno relation to the potability ofthe water nor to its use for sani-tary or other purposes.
"It is our opinion that specificstatutory authority would be re-quired before a water districtcould purchase and use fluorida-tion apparatus. In other words thetown board did not have the rightto adopt a resolution directing theaddition of fluoridation to the wa-ter system."
Last month the town board vo-ted to accept the offer of anotherstate agency, the health depart-?nent , to undertake a four-month.survey of the Riverhead WaterDistrict. Home owners have com-plained repeatedly about the badtasting water and the rust contentwhich ruins laundry.
The State Health Departmentplans on finding measures to elim-inate the rusty condition and todemonstrate that there is no rela-tionship between fluoridation andthe taste and quality of the town'swater supply.
In reply to another query ofMr. Stotzky, the Department ofAudit and Control informed himthat a town may expend moneyfor sodium fluoride treatment ofthe teeth of pre-school children inthe town and may also distributefluoride tablets to children in thetown.
According to Town AttorneyJacob Harding, the statementfrom the Department of Audit andControl regarding the legality ofthe fluoridation of the water ,"can 't be taken at its face valuebecause it appears to be tooshocking." The statement, he ad-ded , is not clear and needs inter-pretation . Mr. Harding said thathe would take immediate steps toclarify the board's position.
A public hearing had been heldprior to the adop tion of the reso-lution in June of 1954 , and thepermission of the state commis-sioner of health was obtained.But , the letter from the Auditand Control Department seems toindicate that specia l state legisla-tion is required before a munici-pality can fluoridate its watersystem , Mr. Harding said.
