“The reduction of revenue concerned by the ophthalmologists is neither covered by the scope of protection of the 'freedom to exercise a profession', nor by the protection of the established business enterprise in which the profession is exercised. These basic rights do not protect from unwanted competition. No exception can be made despite the professional exceptional position of doctors. Those very doctors cannot invoke provisions of the laws on non-medical practitioners as these do not serve the protection and interests of ophthalmologists in their professional exercise but exclusively the protection of public health and hence public interest.”
