Dear Mr. Bratcher,

Devon Energy Corporation has contracted Talon/LPE (Talon) to perform soil assessment and remediation services at the above referenced Ore Ida 14 Federal No. 10 release. The incident description, soil assessment, remediation activities and closure request are submitted herein.

Incident Date

May 11,2011

Background Information

The Ore Ida 14 Federal No. 10 is located approximately thirty (30) miles southeast of Carlsbad, New Mexico. The legal location for the site is Section 14, Township 24 South and Range 29 East in Eddy County, New Mexico. More Specifically the latitude and longitude for the release are 32.21520 North and -103.94946 West.

According to the soil survey provided by the United States Department of Agriculture National Resources Conservation Services, the soil in this area is made up of Stony and Rough broken land. The local surface and shallow geology is Holocene to Pleistocene in age and is comprised of eolian sands and piedmont deposits which includes silty soils under lain with hard caliche. The New Mexico State Engineer web site indicates the nearest ground water data to be in S16-T24S-R29E. The ground water in Section 16 is reported to be at an average depth of 11' below ground surface (bgs). The referenced groundwater data is presented in Appendix I .

The ranking for this site is 20 based on the as following:

Incident Description

On May 11, 2011 a flow line was damaged causing a release of one hundred (100) barrels of produced water onto the lease road. There were no fluids recovered. The well was shut-in, the flow line was repaired and well was returned to service. The initial release from the flow line is located approximately 355-feet south along the lease road from Ore Ida 14 Federal No. 10. The release flowed south along the lease road in an area approximately 1,200-feet long by 11-15 feet wide.

Remedial Closure Actions Taken

On August 26, 2011 Talon personnel mobilized to the site to begin excavation. The impacted soil from this release was excavated to a depth of 1-foot deep. Exceptions include the impacted area from S-l 1 to the end of the pooling are which was excavated to a depth of 2-feet deep. The excavated soil was transported to a NMOCD approved solid waste disposal facility.

Since the impacted area is an active lease road the excavated area was immediately backfilled after excavation using new material transported from a local borrow pit. The backfill material was contoured to match existing lease road. No confirmation samples were required, as per the approved work plan.

Conclusions and Recommendations

• Ground water in the project vicinity is 11-feet below land surface per the New Mexico State Engineer Database.

• The impacted area has been excavated to a depth of 1 to 2 feet deep.

• Horizontal delineation for chlorides on excavated sidewalls was completed by testing on location using the field titration test method for chlorides as approved in the work plan.

• Based upon the results of the sampling and analytical program, all chemical parameters tested for are reported to be less than their respective Recommended Remedial Action Levels (RRALs), below the excavated depth.

• Therefore, on behalf of Devon Energy Corporation, we respectfully request that no further actions be required and that closure with respect to this release be granted.

Describe Cause of Problem and Remedial Action Taken.* A truck had ran over an above ground poly line causing damage to the line releasing 100 bbls of produced water with 0 bbls recovered.

Describe Area Affected and Cleanup Action Taken.* Talon/LPE excavated the saturated soil from the impacted lease road to a depth of 1-2 feet deep and approximately 1,200-feet in length.
