NOTICE OF COUNCIL ASSESSMENT PANEL MEETING
NOTICE is hereby given pursuant to the provisions of Section 83 of the Planning, Development & Infrastructure Act 2016 the meeting of the Wakefield Regional Council, Council Assessment Panel will be held in: the Phil Barry Chamber of Wakefield Regional Council, in Balaklava on Tuesday 26 February 2019 commencing at 6.30pm. A copy of the Agenda for the above meeting is supplied as prescribed by the aforesaid Section of the Act. The relevant reports and documents relating thereto have also been supplied for the Council Assessment Panel Members’ perusal.

PROPOSED DEVELOPMENT
The application is a retrospective application for Horse Keeping within a Township Zone.
BACKGROUND
This application was lodged in response to a request received from a prospective purchaser who wanted to ensure they could home their horses on the allotment. A response was provided to the prospective purchaser and the real estate agent advising that horse keeping was listed as non-complying within the zone. The current owner of the property then contacted Council to discuss how to address the horse keeping issue to enable the sale of his property in keeping with how it has been developed. RECOMMENDATION
A. The proposed development is not seriously at variance with the relevant Development Plan.
B. That the application by James Thomas and Rebecca Johnson for a retrospective application for horse keeping at Section 482, 22 Wray Road Owen as detailed in Development Application No: 373/008/19 proceed with assessment for a non-complying application.

PROPOSED DEVELOPMENT The proposed development involves the division of land to create two (2) Torrens title allotments from one (1) existing Torrens title allotment at 964 Pinery Road, Pinery. The proposed Allotment 1 will be approximately 1.34 hectares and contain a dwelling and associated outbuildings. Allotment 2 will be approximately 139.5 hectares and contain farming land involving the cropping and grazing of sheep and buildings and land previously used as an intensive animal keeping facility.
BACKGROUND The applicants have owned the subject land since 1998 when it was purchased from the family as an ongoing pig rearing and broad acre faming property. After many years of hardship in the pig industry, the piggery was closed down in 2006. Broad acre farming continued but the applicants had to find new employment off site and eventually share farmed the broad acre land for cropping purposes.
The proposed plan of land division divides the existing allotment into two, to create a separate 1.3 hectare allotment to include the existing homestead, farm outbuildings and access way on the corner of Pinery Road and Port Lome Road. The boundary of proposed Lot 1 follows an existing fence line separating the main farm buildings with another small paddock which contains existing sheds of the former piggery complex. The rest of the subject land, which is comprised in Lot 2, is cleared farming land used for cropping and grazing and has an area of approximately 139.5 hectares.
RECOMMEMNDATION A. That Development Application 373/D008/18, that seeks approval to Create Two (2)
Torrens Title Allotments From One (1) Existing Torrens Title Allotment at 964 PineryRoad, Pinery – proceed with the assessment against the Wakefield Regional CouncilDevelopment Plan (Consolidated 9 February 2017) pursuant to Regulation 17 (3)(b) ofthe Development Regulations 2008 (the Regulations).
B. That Development Application 373/D008/18, be assigned as a Category 1development for public notification purpose in accordance with Schedule 9 Part 1 (5) ofthe Regulations as the division of land does not facilitate a change in the use of theland but maintains existing land uses which are, in the opinion of the WakefieldRegional Council Assessment Panel, consistent with the objective of the PrimaryProduction Zone of the Wakefield Council Development Plan, and will not change thenature or function of an existing road.
