He oversees the department’s right of way programs and statewide right of way project delivery operations. The Right of Way Division is also responsible for the regulatory control of outdoor advertising along state routes and the accommodation of utility infrastructure impacted by transportation projects. John served three terms as Chairman of the AASHTO Subcommittee on Right of Way and Utilities from June 2006 through June 2012. He was appointed to the Executive Board of the subcommittee in 2004 and appointed Chairman of the Subcommittee in 2006. John served a two year term as the Chairman of the IRWA’s International Transporta- tion Committee from July 2012 through July 2014. He served as Vice Chairman of the committee from July 2011 through July 2012 and has served as a Member at Large since 2009. John began in TxDOT's Dallas District as a right-of-way utility coordinator in 1989. While at the Dallas District, he was responsible for the successful completion of utility adjustments required to accommodate the reconstruction and expansion of the US 75 Central Expressway. Moving to Austin in 1993, he accepted the appointment as the depart- ment’s Chief Utility Engineer for the Right of Way Division where he managed statewide utility accommodations. Two years later, he was appointed Director of the Right of Way Division’s Engineering Section. John was later appointed as Director of the TxDOT Right of Way Division by Wes Heald, former TxDOT Executive Director, on February 1, 1999. MBA, with a Finance concentration, from the University of Texas at Dallas in 1992. He is a 1999 graduate of the Governor’s Executive Development Program at the LBJ School of Public Affairs at the University of Texas in Austin. John was licensed as a Texas Professional Engineer in 1991. He was a recipient of the TxDOT Journey Toward Excellence award in 1995. PARTNERSHIP WITH THE PUBLIC SECTOR

John P. Campbell is director of the Right of Way Divi-

sion of the Texas Department of Transportation (TxDOT).

He oversees the department’s right of way programs

and statewide right of way project delivery operations.

The Right of Way Division is also responsible for the

regulatory control of outdoor advertising along state

routes and the accommodation of utility infrastructure

impacted by transportation projects.

John served three terms as Chairman of the AASHTO

Subcommittee on Right of Way and Utilities from June

2006 through June 2012. He was appointed to the

Executive Board of the subcommittee in 2004 and

appointed Chairman of the Subcommittee in 2006.

John served a two year term as the Chairman of the IRWA’s International Transporta-

tion Committee from July 2012 through July 2014. He served as Vice Chairman of the

committee from July 2011 through July 2012 and has served as a Member at Large since

2009.

Dear Members:

Happy November!

It is almost Thanksgiving! Oh my, where has the year gone? Sweater time, pies, holi-

days! We have a lot to be thankful for. I cannot count my blessings there are so

many. I am sure that each and every one of you feels the same.

Thank you to everyone who attended the Annual Joint IRWA/AI meeting on October

13. We had a great turnout at Cacharel. Our Programs Committee provided two

informative and interesting speakers for the meeting: Judge Mark Riles of Parker

County and Mark McAnnally, MAI, Deputy Director/Chief Appraiser, Texas General

Land Office. Chapter 36 sends a huge thank you to both of them for their time! We

also would like to thank Ruth Kelton for obtaining approval for our TREC and TALCB

licensees to receive CE credits. Thank you to PDC for the IRWA CE credits and Pro-

grams for a job well done.

Don’t forget to check the Chapter 36 website for classes that your Education Com-

mittee has planned for you. It may be time to take that class for certification or

recertification. I cannot stress how important it is to continue your education. The

classroom settings are fun, interesting, interactive, and you benefit from the wisdom

and experience of the instructor and your colleagues. You cannot put a price on

the classroom experience. Make time in your schedule-it is well worth it.

Our Programs co-chair Jace Whatley reached out to John Campbell with TxDOT and

he has graciously agreed to speak at the November meeting. You will not want to

miss this meeting. Register early online. You do not have to have a PayPal account

to pay online.

During the November meeting, if you renew your IRWA membership we will add your

name to a drawing the day of the meeting. The winner will receive a nice gift from

IRWA Headquarters for renewing early. If you have already renewed, bring your re-

ceipt with you to the meeting and we will be happy to add your name to the fish-

bowl. You must be present at the meeting to win.

Even though the year is almost over for us, the fiscal year just began for the Chapter

Board members and committee members. I am happy to say we have a great

team working hard for you and each committee has set goals to make Chapter 36

shine even brighter.

Save the Dates:

December 3, 2015 - Year End Event will be held at Maggiano's Little Italy (North Park)

in Dallas. Please join us to help celebrate another successful year and to honor the

Chapter Professional of the Year, Employer of the Year and Young Professional of the

Year.

April 28 & 29, 2016 - the Annual Chapter 36 Spring Seminar and Golf Tournament;

details to follow.

Question: I am new to the right-of-way profession. Do I have

to be licensed by the State of Texas?

Answer: Yes. The Texas legislature, by statue effective June

1, 2003, requires “a person may not sell, buy, lease or transfer

an easement or right-of-way for another for compensation or

with the expectation of receiving compensation, for use in con-

nection with telecommunication, utility, railroad, or pipeline ser-

vice unless the person: (1) holds a license, or (2) holds a certifi-

cate of registration. Licensing and registration is handled by

the Texas Real Estate Commission (www.trec.state.tx.us). An

application for easement or right-of-way registration by a busi-

ness is form ERW AB-3 and the application for easement or right

-of-way agent registration by an individual is for ERW A1-4.

TREC also has other easement or right-of-way registration forms

available online or information by phone at 512-936-3000.

Recertification is required for both the Right of Way Professional

Certification (RWP) and the Senior Right of Way Professional

Designation (SR/WA). When taking class for recertification the

course exams are not required. If the exams are taken and

passed the course can be used for both recertification and for

a Specialist Certification Program. These programs include the

R/W-AC Appraisal Certification, R/W-AMC Asset/Property Man-

agement Certification. R/W-NAC Negotiation and Acquisition

Certification, R/W –RAC Relocation Assistance Certification, R/

W-URAC Uniform Act Certification and the Appraisal Cross Cer-

tification.

Chapter 36 Education Committee Newsletter Update- November 2015

Chapter 36 held its first Fall 2015 class on September 22-23. Charles

Stearman taught Course 400 Principles of Real Estate Appraisal at Halff

Associates in Richardson. We are fortunate to be able to have our

chapter’s 2014 Professional of the Year instruct this class!

Course 803 Eminent Domain Law Basics for the ROW Professional was

held October 7-8 at the Texas Department of Transportation (TxDOT) in

Fort Worth. James Kirk, a ROW Division Attorney for TxDOT, instructed

the course. James was able to incorporate many examples from his ex-

perience working at the State of Texas Office of the Attorney General,

which handles large volumes of condemnation proceedings. We

appreciate James traveling up to be a guest instructor for our chapter.

Rounding out the fall schedule are Courses 421 and 103.

Course 421 Valuation of Partial Acquisitions is an excellent four

-day course that really immerses the participant in appraisal

methodology. The class is being held November 17-20 at the

City of Irving. It will be taught by Donnie Sherwood. In Decem-

ber, Course 103 Ethics and the ROW Profession will be at Halff

Associates in Richardson. Scott Moran is teaching this class on

December 2. Contact Dalton Vann for more information

about these two classes.

become part of the IRWA Chapter 36 family.

Membership Status: Current membership count is 463.

As a reminder, annual dues renewal notices are currently being sent out to

all active members. To save time, you can renew online or by phone. If you

let your membership expire, so does any certification or designation you

may have through the IRWA. Please take the time to renew, and continue

to enjoy all the benefits membership has to offer. The deadline to renew is

December 31, so please be sure to get your renewal in by the end of the

year.

As discussed in the September newsletter, each new member to Chapter

36 receives a blue, “Texas shaped” badge. This badge identifies each new

participant as an active member of Chapter 36. There are also green

badges available to members that achieve a designation such as R/W-AC,

or, R/W – NAC, and red badges for our members that attain the highly elu-

sive SR/WA designation. If you would like a badge, please contact mem-
