This is the 19th year the group has created the popular greeting cards which is quite a milestone for the group. The guest of honour on the evening was Senator Darragh O’Brien (FF), who was on hand to launch the cards and the occasion attracted a good crowd. Chairperson of Lusk Tidy Towns, Pat Kelly told the County Leader that she looks forward to the card launch and enjoys preparing for it in the busy run up to Christmas: “We’re always delighted to launch our Christmas cards,” she said. “And with so many people emigrating and living aboard, it is a lovely to have a reminder of home on their mantelpieces at Christmas.” Local councillor, Ken Farrell (Lab) also said a few words on the day and the event was also attended by the local priest. The cards are of Lusk scenes and have been very popular with people both at home and away. This year, a one page calendar has also been produced, which contains a picture of the well know Clay Cottage in Lusk, which received a top prize at the recent Cleaner Communities awards. The cards cost 1, with all proceeds going to the local group. Cards and the calendar are available in local shops. “We would just like to thank everyone involved in making the cards, and all the local businesses throughout the community for donating the lovely spot prizes,” she concluded. If permis- sion is granted, it will be the second Lidl outlet in the town, following the opening of the first shop on Rathbeale Road last year. The proposed new development is planned for Dublin Road in Swords, close to Pinnock Hill Roundabout. But the fact that it is in close proximity to a residential area, local residents have safety and traffic congestion issues, and are up in arms about the proposed new super- market in this area. Local councillor, Darragh Butler (FF), told the County Leader that he is inundated with complaints from locals in the area, who have very genuine concerns about the planned development going ahead. “I have been approached by residents from Dublin Road, as well as from Carlton Court, who feel that the siting of a Lidl supermarket so close to them, will only add to the already chronic traffic problems on Dublin Road. They maintain that it is extremely diffi- cult to get in and out of Carlton Court as things stand, but it will be impossible if the Lidl outlet goes ahead,” he said. The residents also maintain that this is an already busy road with regular traffic tailbacks, a school, a petrol station. and is just off the very busy Pinnock Hill roundabout. They maintain that the fact that four existing houses and associated buildings are being demolished to make room for this store and the 94 car parking spaces, suggests that this is a more residential area, and unsuitable for such a venture.” Butler however, welcomes the creation of new jobs in the area and the increased commercial activity in the town. He also welcomed the plan- ning application for a new Aldi shop at Rivervalley Shopping Centre. “A new Aldi here will have the effect of revitalising the entire Rivervalley area, and while residents will have the same concerns regarding road safety and increased traffic flow, the overall benefits are to be welcomed,” he concluded. The news that the County Council has decided to allow free parking in all towns in the North County for three Saturdays in December has been given a broad welcome. This will apply in all towns in the North County, where there is a Pay and Display system in operation. The free parking will apply on Saturdays, 7th, 14th and 21st December and is expected to provide a pre Christmas bonanza for local busi- nesses at this crucial trading time. Local councillor, Tom Kelleher (Lab) was delighted with the council’s decision and told the County Leader that he thinks this will make a significant difference to hard pressed retailers, as well as to shoppers., “I welcome this decision by the council, which will go a long way to promoting business, particularly in Swords, where there is clearly not enough parking spaces, “ he said. President of Malahide Chamber, Trish Murtagh was thrilled with the news. She told the County Leader, “We’re very happy with this announcement. Last year, we had the last two Saturdays free and it made a huge impact on footfall in the village, so with the extra Saturday this year, we are expecting a really positive impact on business. Six seats havebeen reserved forcommunity represen-tatives on theBalbriggan CommunityPolicing Forum board.Three of these seatsare now up for elec-tion. Issues that have beenpresented by thepublic, include suchthings as anti-socialbehaviour, burglaries,parking, speeding,

signage problems,drug dealing onestates, drug taking,vandalism to name buta few. The BalbrigganCommunity PolicingForum is an indepen-dent body which aimsto build communitycapacity, develop linksand further enhancec o m m u n i c a t i o nbetween the residentsof Balbriggan, stateagencies, localauthority and AnGarda Siochana.

Every Yard CountsAt Skerries SchoolFriday last, 22ndNovember will live long inthe memory of pupils andteachers at Realt na Mara National School in Skerries. Itwas the day the school came to a halt, due to the

endeavours of former pupil, Barry O’Brien to raisefunds for a new school yard. Barry and a number of

friends and supporters, including Michael Hodnett,decided to undertake a full marathon run around theperimeter of the school. The project was called ‘EveryYard Counts’ and it received tremendous support fromthe entire community of Skerries. At around 2.30pm,there were hundreds of schoolchildren, parents andfriends cheering loudly, as Barry and his supporterscrossed the finishing line.Realt na Mara’s motto is ‘Ní Neart Go Chuir le Chéile’,which means Unity is Strength and this was never more

in evidence at the schoolthan on Friday. Deputyprincipal, Bernie NíChionnaith spoke to theCounty Leader about thepride that Barry and hishelpers brought to theschool. “It speaks for itself.The support from thecommunity was extraordi-nary and it reflects thespirit of the Skerriescommunity, whosupported us in theirdroves. This day was allorganised by Barry and theParents’ Association, whodeserve a huge thank you.The good will could be felteverywhere on this historicday,” she said.The funds received willhelp to resurface the

school yard and result in a softer surface, which is saferfor the children to play.

available at the Pavilions shop-ping Centre (first two hours free)and at the Seatown Road CarPark. Rush Community Council areswitching on their l ights onSaturday 30th November at 5pm,and Donabate are also turningon their lights on the same dayat 4.30pm. The four North County pupils areamong the talented bunch of 44youngsters ranging in age fromseven to 14, who’ll be performingover the six weeks. We’ve no doubtthey will put on a spectacular perfor-mance.

Newman Wants Ant-SocialBehaviour Dealt WithLocal Swords based activist, Joe Newman has called on the localpolicing committee and the County Council to tackle the issue of anti-social behaviour in Rivervalley and the greater Swords area. Newmanattended the recent Fingal Joint Policing Committee meeting inDonabate and raised the issue, saying that he had been contacted bya number of concerned residents who wish to see this dealt with assoon as possible. He told the County Leader:“Residents have told me that they have been pestered by teenagerscongregating in the vicinity of their homes during the day and also onFriday and Saturday nights. These teenagers are generally in an intox-icated state, and some have stole bins and used threatening behav-iour towards them,” he said. According to Newman, some residents are “living in fear” because ofthis behaviour and he says a greater effort is needed to combat this.“It is not good enough to simply send a car up now and then, what weneed is a concentrated effort from the Council and Gardai to take

effective action to deter these teenagers from congregating outsidethe homes of residents.”“The Gardaí and County Council promised me at the meeting thatthey will take serious steps to deal with this, and I’ll be following up tomake sure this happens,” Newman concluded.

This newinvestment is expectedto create 100 new jobs.The Wright Group,which has a chain ofnine bars and restaurants and one nightclub,already employs over 350 people,. including the

Skerries Educate Together National Schoolheld a very large Anti-Bullying event recently.Over 100 pupils and teachers attended fromlocal schools and wider community. Some ofthe students are now proudly known as ‘AntiBullying Ambassadors’ after being involved inthe programme. This event is called the Diana Award Anti-Bul ly ing Ambassador Training, and theprogramme trained the young people to beAnti-Bullying Ambassadors. It gave SkerriesNational School the knowledge, inspirationand practical ideas to make a difference insociety today. Deputy principal, Jean Timminssaid the school was eager to be involved inthe event, so as to empower the students and

ensure that they were aware of what bullyingis, and how they might go about preventingit. “We are working very hard on the issue ofanti-bullying and we wanted to see what’sout there in terms of events that the childrencould get directly involved in. We wanted toempower them to become ambassadors andgive them strategies to prevent it.”“What we’re doing now is trying to preventbul ly ing in the school , fu l l stop,” shecontinued. “Last month was anti-bullyingmonth in the school, so this event was a greatway to bring that to a nice finish, but we’realso using it as a springboard for all the workwe’ll be doing on the issue for the rest of theyear.”

What do our District Courts doand why do we need them?

Over the last few years, as we allknow, there has been severe cutsmade to every level of public lifeand the legal services has alsocome under the radar. I can tellyou that unfortunately, ourDistrict Courts are at risk of beingclosed whilst under thecuts/austerity radar. So what do our District Courts doand why do we need them?North County Dublin is servicedmainly by District Courts inSwords, Balbriggan andBlanchardstown three districtcourts:Swords District Court – North StreetBalbriggan District Court – Town centreBlanchardstown District CourtThe District Courts deal withwhat are sometimes unfortu-nately referred to as “MinorMatters”.In criminal law, the District Courthas a wide discretion to deal withmost matters and has asentencing power of up to twelvemonths imprisonment. TheDistrict Court cannot deal withsuch as Murder, Rape or highvalue drug charges. With manyother charges, the discretion isnow exclusively with the Directorof Public Prosecutions (DPP) asto whether a charge stays in theDistrict Court, or is prosecuted inthe Circuit Court. It is muchcheaper for the DPP, the Stateand ultimately us, the taxpayerto leave cases in the DistrictCourt. Naturally, the DPP hassought to keep as many of thecases in the District Court aspossible. The accused or theirlegal advisors do not protest tothis policy, as there is a lesserexposure to lengthy prisonsentences.All District Courts deal with civilmatters. Swords and Balbriggandeal with civil matters one day amonth in Swords, usually on thethird day of the month. The Courtis currently limited to deal withclaims less than €6500.00. Thereis legislation in the offing toincrease its monetary jurisdictionup to €15,000.00. The Courtdeals with debt collectionmatters, contract disputes and“minor” tort matters, such asmaterial damage to a car. Theobvious disadvantage is themonetary limit which as stated isabout to be increased.The Court deals with small claimsand has an effective procedure todeal with relatively straightfor-ward matters. Finally, the Court deals withfamily law matters, such as

Guardianship applications,access and maintenancedisputes and domestic violenceapplications.It can be seen that the Courtprovides a wide ranging service.The service is vital because it islocal. If say for instance SwordsDistrict Court were to close, allthe foregoing matters wouldhave to be dealt with in the CityCentre or possiblyBlanchardstown. This causesobvious travel and cost problemsfor claimants and defendantsalike. The lists are long in manycity centre courts and frankly alocal solicitor in Swords wouldnot be inclined to attend thatcourt and if he/she does therewould be greater charging impli-cations.Further, whilst you as the readerI suspect would not have toomuch sympathy for people on theend of criminal summonses, inthe event of a local court closureall persons in the entire of NorthCounty Dublin would have toattend the CCJ in Parkgate Street,Phoenix Park. That causesobvious travel difficulties.However, what if you are theinadvertent and not a guiltyrespondent to a parking fine orsomething similar and you learnthat you have to travel to the CityCentre.It goes without saying the SmallClaims Court and the family lawsessions are vital local services.They need to be local for avariety of reasons. Accessibilityto court is a vital and necessaryright and our local Court and thecourts staff provide an excellentservice.In my view and in conclusionyour local District Court is a vitalnecessity and we should fighthard to keep it.Finally, one of the most inter-esting judgements in the entireof Europe this year was aconsumer test case, McDonagh vRyanair ultimately decided bythe European Courts of Justice infavour of Ms McDonagh and shewas represented by Hennessy &Perrozzi Solicitors. However,importantly the case started itslife in Swords District Court.Swords District Court referredthe matter directly to theEuropean Court of Justice withoutthe need for going through theHigh Court and Supreme Court ofIreland. Accordingly, one of themost important consumer deci-sions in Europe in recent yearswas handled almost entirely bySwords District Court and theirstaff. I rest my case.
