    On the ongoing fight between the purist and pragmatic factions:

    Every organization has these sorts of internal fights. The Nazis had them an example is the Night of the Long Knives, where

    Himmler's SS wiped out Rohm's SA, with Hitler's support. The Soviet Russians had them the purges of the 1930's under Stalin, followed by

    the De-Stalinization program after Big Joe croaked in 1953. The Chinese Communists had them the Cultural Revolution pushed by Mao was

    his reaction to others in the CCP trying to lessen his power. Here in New Mexico, John Dendahl, past LPNM convention speaker, was ousted

    from his spot at the head of the GOPNM after he spoke up in favor of some form of marijuana law reform.

    Also here in New Mexico, the Green Party goes through this every time one of their candidates causes a Democrat to lose a race. Their infighting makes Libertarianslook like pikers.

    As for purity, here's a quote from Falling Stars, the last book in the Firestar series byMichael Flynn:

    The Goal can eat you up if you let it, and turn you against yourself. Purity isnot to be found in this world; but there is a line in the sand, which, if you crossit, you lose yourself. . . . You must learn where you have drawn your ownline.

    On that note, I can't recommend the four books of the Firestar series enough. It'slibertarian / extropian / panarchic science fiction at its best. The Probability Broach byL. Neil Smith takes you to a better world through an interdimensional hole in the wall.

    Flynn shows us a way to make this world a better one when you don't have a broachto escape through.

    On supporting coalitions and non-LPNM candidates, I don't have a problem with that per se , but there are two candidates that I won't vote for under any circumstances Patsy Madrid (running for U.S. House, 1st District) and Jim Bozo, er, I mean Baca(running for State Land Commissioner). The reasons for naming Patsy here areobvious she's not even close to libertarian in the policies she advocates, AND whileshe was warming the executive chair at the Attorney General's Office, she went out of her way to use the powers of that office to KILL the LPNM.

    As for Bozo Baca, well, ask any Albuquerque Libertarian who remembers his term asMayor of Albuquerque about what a great job he did he was actively bigoted againstgun owners, he gave Bernalillo Township five SunTran busses each bus costAlbuquerque 292,000, yet Bozo let them go for 1,800 apiece . . . . If the LPNM'scandidates end up not being included on the ballot, I'll cast a blank in these two races.

    Court Case Decided Against the LPNM

    As some of you already know, the recent court case filed on our behalf by the ACLU, concerning the New Mexico ballot accesslaw, was decided against us. Naturally, we are disappointed inthe decision and we respectfully disagree with that decision.

    We were not allowed an opportunity to present our evidence or have anyone testify. Rather, the judge issued a decision basedon the briefs that had been filed. It is unusual for a judge todecide before discovery has begun, and we feel it was apremature decision.

    The ACLU is currently reviewing our options with. Hopefully, wewould like to see this appealed. An appeal would probably go tothe 10th Circuit Court for decision. If this is appealed, thereshould be a good chance we could win an appeal in the firstround, on the question of, should the judge have given anopportunity to present evidence? But, thats not guaranteed.

    Richard Winger notes that this year New Mexico is the only statein which more than a single petition would be needed if a newparty set out to qualify a slate of nominees for all statewideoffices. He double checked this.

    He found that if one calculates how many signatures would beneeded for a new party to run a full slate of candidates for allstatewide offices up for election this year, the number of validated signatures in New Mexico would be 60,512, higher than the number of signatures needed in any other state exceptCalifornia (that would require about 120,000 signatures toensure the count of 60,512 validated signatures).

    Loss of a Media Access Friend

    Up until the end of September, KAGM Talk Radio, 106.3 FM hasbeen very friendly towards the Libertarian Party of New Mexico.However, they decided to change their format at the end of September. Now, instead of talk radio, they first switched to a

    Hispanic music format, then to country-western music.In the past, every time an issue has arisen warranting any newscoverage at all, Larry Ahrens, Lee Logan, Diane Anderson, andtheir production director, Peter St. Cyr, have all been verycooperative with us. Each time, they have afforded us with anin-studio, live interview session, lasting a full half hour. We wereallowed to state our position, without being cut off or shouteddown.

    Other interviews we have had, with KUNM, the local NPR radiostation and with Associated Press, have only been telephonicinterviews. In those cases, they cut the interviews down tosound bites, and while they may sometimes get the gist of our position, that is not always the case.

    Well miss the cooperative spirit and the easy access to themedia that we have previously enjoyed with KAGM Talk Radio.

    LP Platform Undergoes Major Change

    There were major changes to the LP National Platform passedat the Convention in July. Mainly, it eliminated the majority of the planks. I envision a flurry of efforts between now and thenext LP Convention in 2008 to reinstitute as many of the planksas possible.Lets take a look at the second of the remaining planks fromour LP National Platform.

    I.3 Freedom of Religion

    Issue Government routinely invades personal privacy rightsbased solely on individuals religious beliefs. Arbitrary taxstructures are designed to give aid to certain religions, and denyit to others.

    Principle We defend the rights of individuals to engage in (or abstain from) any religious activities that do not violate the rightsof others.

    Solution In order to defend freedom, we advocate a strictseparation of church and State. We oppose government actionsthat either aid or attack any religion. We oppose taxation of church property for the same reason that we oppose all taxation.We condemn the attempts by parents or any others viakidnappings or conservatorships to force children to conformto any religious views. Government harassment or obstruction of religious groups for their beliefs or non-violent activities mustend.

    Transitional Action We call for an end to the harassment of churches by the Internal Revenue Service through threats todeny tax-exempt status to churches that refuse to disclosemassive amounts of information about themselves.

    oriented radio show to replace (and possibly do better than) theradio interviews that Jay has been doing on KAGM-FM. We

    New Study Finds New Mexico Government among Worst inNorth America at Promoting Economic Growth

    (Albuquerque, New Mexico) In a just-released study by the U.S.-based National Center for Policy Analysis [ www.ncpa.org ] andCanada-based Fraser Institute [ www.fraserinstitute.ca ], NewMexico government is taken to task for burdening its citizenswith some of the highest taxes and regulatory burdens of anystate or provincial government in all of North America.

    With an overall ranking of 50th out of 50 states and 10 Canadianprovinces, only West Virginias abysmal scores prevents NewMexico from being the least economically-free state in thenation. The Canadian provinces of Alberta and Ontario alsooutscore New Mexico despite more burdensome taxes andregulations imposed by that nations government.

    Categories, along with information on New Mexicos overallstanding are listed below: Size of government: New Mexico was ranked 56th in this

    measure as its state and local tax burden of at 10.1% is wellabove average;

    Takings and taxation: New Mexico was 48th (This score hasbeen in a free fall since the state scored 13th in the previousversion of this study three years earlier);

    Labor market freedom: New Mexico was ranked 41st;

    Commenting on New Mexicos poor showing, Paul Gessing of New Mexicos Rio Grande Foundation, noted, These poor results are no surprise, as New Mexico has relied ongovernment largesse for far too long. New Mexico has morestate and local employees per capita than all but two states andfederal taxpayers spend $2 in New Mexico for every $1 NewMexicans send to Washington.

    Gessing went on to argue that, New Mexico is a clear exampleof the reality that government growth hinders economic growth.Low taxes, strong property rights, and limited labor marketrestrictions, on the other hand, allow individuals and businessesto create wealth and raise living standards. New Mexico haslong been considered a poor state, and according to federaldata, New Mexicans have the fifth-lowest personal incomes inthe nation.

    The lamestream media told you:

    The nation's newest light-rail system, scheduled to debut in2008, will use unarmed police to deter crime. "Transit officialssay light rail is safe," according to reporter Sean Holstege onSep. 25, 2006, even though the system is not operating yet.

    "Metro [the system operator] will have a visible, well-trained

    transit-security force," according to spokeswoman Marty McNeil."Metro is also going to invest in the latest and best securitydevices," she says, which will not include any firearms for policeofficers.

    "Light-rail foes cite federal crime statistics that suggest light railhas more crime than any other form of mass transit," the ArizonaRepublic article continues, but this will be combated with clear "sight lines, emergency phones, intercoms, alarms, lots of lights,and surveillance systems," plus a large number of officers andfare checkers in uniforms.

    The Uninvited Ombudsman notes however that:

    Commuters were shocked to learn today that public officialshave decided to disarm police responsible for safety on crime-plagued light rail, scheduled to start running in the nation's fifthlargest city in 2008."They have no legitimate authority to disarm anyone, butsomehow figure it's OK to disarm police stationed to protect thepublic. It's just unmitigated gall, and plain stupid," says oneobserver familiar with the plans. In the first six months of theyear, Phoenix police statistics show 1,349 crimes per 100,000people, with 866 of these along the light-rail route. (With morethan 3 million people, the Phoenix stats should be multiplied by30.)

    In an ironic twist, a new law in Arizona requires governmentagencies to allow people to keep possession of their personalfirearms, unless safe and secure storage is provided near entryand exit points. Unless Metro plans to require riders to checktheir guns in and out of the train cars, people will be better

    prepared to protect police officers than the other way around.Libertarian commentators say this is actually quite a refreshingstate of affairs for a change.

    (3) As a result of today's decision, New Mexico is the only statein the west with a Dem-Rep monopoly in all statewide races.Libertarian candidates for statewide office are on the Nov. 2006ballot this year in all the western states except New Mexico.

    (4) The judge seems to have made a mistake on the law. Shesaid a major party is one that got 5% (of the gub. or pres. vote,whichever was later) in the last election for ANY of itscandidates. But in March 2000, Judge Pfeffer, a state court

    judge, in our ballot case, said a major party is one that got 5%for president or governor.

    Survey readies county residents for tax,government increase

    Editor:

    The world is full of people who do things for others out of thegoodness of their hearts with no expectations of gain.

    Unfortunately, none of these people have been elected or appointed to any public office.

    I received a survey from San Juan County along with one of mylocal utility bills. Actually, it wasn't a survey, rather a notice to getready for a tax increase and expansion of local government. The

    questions were designed so that any answer you gave meantthat you were in favor of increased taxes and governmentcontrol. Nowhere on the survey did they suggest they mightwant to cut spending and reduce government's power.

    To make it easier, the County Clerk has graciously agreed tocontribute to your hanging by paying the return postage withyour money. It may be my imagination, but several of the surveyquestions make me think private business interests that stand toprofit are pulling a few strings.

    Question No. 10. "More growth should be directed to occur inside cities and less growth directed to outside cities." What?Are we in competition with some Communist countrysomewhere? My question No. 1 to government. Why are you sostinking worried about where I live or what my place looks like?You got some buddies you need to help out, or what?

    Question No. 12. "There is a need for middle and upper-scalehomes in unincorporated S.J.C." Real meaning. Get ready, poor people, here they come again. By the way, is it all right for alower-class family to live in a middle or upper-scale home? Isthere a government form that we lower class unincorporated-scale people can fill out that says we want you uppity-scalepeople to just leave us alone?

    Now why did you ask the city folk what they think of myunincorporated place? You didn't ask me what I thought aboutpeople packed like sardines.

    The world is full of people who will rob and steal from you in thedead of night or broad daylight. Unfortunately, most of thesepeople have been elected or appointed to public office.

    On pages 4-5, the Vasquez decision says a major party in NewMexico is a group that polled 5% (of the vote for Governor or President) for ANY of its nominees. This is what the lawappears to say. However, a state court ruled in March 2000 thata major party is a group that polled 5% for president or governor. The state court decision of March 2000 is the law inNew Mexico, so clearly Judge Vazquez was uninformed.

    If the definition of "major party" were as Judge Vazquez says,then the Libertarian Party would have been recognized as amajor party after the 1998 election. It ran Maurice McDonald for Land Commissioner. There was no Republican in the race, so itis not surprising that McDonald polled 35,878 votes, or 8.54% of the vote in his race. That also worked out to be 7.19% of thegubernatorial vote that year. The Libertarian Party also gots itsregistration up to one-third of 1%.

    But, even though an Attorney General's Opinion had alsoagreed that a major party was one that got 5% (of thegubernatorial or presidential vote) for ANY of its candidates, astate court in March 2000 ruled that the law really requires amajor party to be one that got 5% for president or governor.This had the effect of costing the Greens their major partystatus.

    The judge also made a factual error when she said the LP of New Mexico filed its party petition in April 2006. It filed thesignatures in October 2005. It took the state all that time tovalidate the signatures.

    The most irritating part of the decision is on page 13, when shecites the crowded ballot for president in 1992, without seemingto understand that presidential candidates have never needed anominee petition. In fact, that is one of our strongestarguments...if the state can get along without a nominee petitionfor president, why does it need them for other office? I don'tthink the judge understands that no nominee petitions areneeded for president. She didn't mention that fact.

    She also didn't mention Workers World Party v Vigil-Giron, nor the Minnesota Independence Party case.

    As for the Maryland Green Party case, she distinguishedMaryland from New Mexico by saying that the Maryland nomineepetition was fewer signatures than the Maryland new partypetition. So, actually, she is acknowledging that Maryland'ssignature burden was EASIER than New Mexico! You may havegot a wrong impression on your first reading. Is is peculiar thatan easier burden in Maryland is unconstitutional, whereas amore difficult burden in New Mexico is OK, but that is what sheis saying.

    AND

    I assume one of you will be contacted by New Mexico reporters,to comment on the decision. The simplest criticism we shouldmake is that the judge refused to allow any evidence to bepresented in the case. She had scheduled a hearing for Sep.18, but then had cancelled it. If she had not cancelled it, I wouldhave testified that:

    (1) New Mexico always has a majority of its state legislativeraces as one-candidate elections.

    (2) No state has had fewer minor party and independentcandidates on its ballot for US Senate and Governor (in theperiod 1980-2006) than New Mexico. New Mexico has had 4:Greens for Governor in 1994 and 2002, a Green for US Senatein 1996, and a Libertarian for US Senate in 1996. No state hashad fewer (though there are two states that also had just 4, butthose two states are Arkansas and Maryland and both haverecently liberalized their laws).

    What is the Simon Jester Project?

    If you haven't read the classic SF novel, The Moon is a HarshMistress, by Robert A. Heinlein, the whole Simon Jester thingmay be confusing you. Simon Jester was the "imaginary"creation of a group of Loonies fomenting rebellion. He was alittle devil who tormented the Lunar government with catchy little

    jokes, ditties, poems, slogans, and cartoons. Later, Simonexpanded into the poltergeist business by playing practical jokeson gov-goons and bureaucrats. He always signed his work witha little cartoon image of a grinning devil.

    "Simon" was a game everyone could play, anyone who wantedto bug the ruling authoritarians, that is. Any pissed-off miner could scribble a bit of seditious graffiti on a wall and attribute itto "Simon" with the easily scrawled logo. To the Authority, itseemed that Simon Jester was everywhere, all the time.

    We need Simon Jester now.

    A "meme" is an idea, a thought; hopefully a seed that willgerminate in the recipient's mind and grow into a whole gardenof worthwhile ideas. In theory, one exposes people to short,memorable phrases or images which stick with them; rather likethe tune you can't get out of your head. In this case, the "tune" isakin to Yankee Doodle Dandy and is meant to generatethoughts on liberty.

    Planting those mental seeds is what the Simon Jester Project isall about. To get you started, we've provided a few basic files.

    Surely this is enough to get us started.

    Enough plotting; let's get out and do something!

    What to Do With This Stuff

    Okay. We've told you who Simon Jester is. We've given you abunch of files for posters, stickers, flyers, et cetera.

    So what the devil (pun intended ) are you supposed to dowith this stuff?

    Assuming you read The Moon is a Harsh Mistress, you shouldalready have a pretty good idea. But here some specifics youmight try: Flyers can go on bulletin boards, car windshields in parking

    lots, or simply be handed out. The same goes for folded pamphlets, or you might put some

    in the form slots on bank tables and the counters at the postoffice.

    Stickers can go anywhere: Service counters at DMV, the postoffice, post drop boxes, windows and doors. But if you'reconsidering putting them on private property, also consider whether the owner might not appreciate it.

    Business cards can be handed out, left on magazine piles inwaiting rooms, set on counters, stuck under windshieldwipers, or even flung out high windows. Try including one inall your bill payment envelopes.

    The Cthulhu election posters can go up anywhere you seeother campaign signs posted. Try putting them up in your car windows, too. If you stake out a polling station like the other campaign aides, come election time, the Cthulhu posters gogreat with the Democracy Explained flyers to get voters'attention.

    Stickers can also go on packages and envelopes. Kinda likeEaster Seals, but a lot more fun.

    As for writing your article, It should be concise (no longer than afull page) and topical. A bit of humor helps, especially for op-edpieces.

    What I'm really looking for in the way of articles is what's goingon in the LPNM what YOU the membership are up to inspreading the message. For example, an article about thestupidity, insanity and evil of the UN might get put in, dependingon available space and the quality of the article. A group of LPNM members counter-protesting the raising of a UN flag bythe city council WILL get put in, and probably will get firstpriority.

    The editor will publish letters on a space-available basis. Thesame standards apply for letters that apply for articles keep

    During July of this year, the Arizona Republic reported that aScottsdale woman was indicted for trying to evade federalbanking deposit rules. After Lucy Lu took over $300,000 fromher massage business, she hid over half of the money in a safein her house and then made small deposits with the rest into her mother's bank account. Aside from the obvious question of:"who cares what this woman does with her money?" there's a

    bigger issue here: When (not if) the economy here goes downthe tubes, it may give Americans an incentive to look for jobselsewhere.

    A number of government actions have accelerated this process:new passport requirements enacted by the State Department(for Americans traveling to Mexico, some Caribbean islands andCanada); the legalized monitoring and tracking of citizensresulting from the USA PATRIOT Act; and National Guardtroops stationed at the U.S.-Mexico border and in our nation'sairports. As these things continue, the ability to leave the U.S.will be made even harder, and I'd dare to argue the stage is setfor the time when the U.S. government can forcibly keepAmericans in the United States.

    If people here decide to up and leave either for moreprosperous parts of the world, or simply because their dollarswould do better in countries like Mexico or Canada -- the U.S.government will have ample time and resources to legally stopthem. If you withdraw money from your account, as Lucy Lu did,the feds can then flag your profile on their terrorist watch lists,and hold you up at your point of departure. Younger peoplecould also be prevented from leaving as well, since fewer youngpeople means not only fewer potential long-time taxpayers, butthe loss of someone who could produce future taxpayers.

    Unfortunately, the threat of this happening is real. According toAuthor Jim Peron, who recently moved to Germany, a newfederal law now targets non-U.S. banks. Essentially, the lawstates that if the U.S. government claims an American holder of an account in a foreign bank has done anything that the fedsdeem illegal, the bank itself has violated the law even if the act

    committed (or allegedly committed) by the U.S. citizen tookplace well after the account was open. Simply on the U.S.government's say-so, the bank is now considered a co-conspirator with that U.S. citizen, and all assets owned by thebank and held in the U.S. may be confiscated. The net result, of course, is that foreign banks are now refusing to open accountsfor Americans. Even the Swiss, who once took anyone's money,won't open accounts for U.S. citizens anymore.

    At the beginning of August, The New York Times reported that aU.S. Senate Committee had held a hearing and adopted areport submitted by Democrats, in which Carl Levin of Michigangave a long speech about people and corporations who cheaton their income taxes with investments that just happen to belocated offshore. In their lust for more of people's hard-earnedmoney, politicians continue to look for ways to "close theloopholes" on people or organizations seeking to avoid the U.S.income tax system, by locating in countries with either minimaltax and regulatory enforcement or existence outside the I.R.S.'s

    jurisdiction.

    With economic hardships coming down the line due to theenormous amounts of money created by the Federal Reserve'sprinting presses as well as the ballooning federal debt anddeficits it's no surprise that this kind of hearing is held,especially since the Chairman of the committee is a Republicanaccepting a Democrat-backed report. Rather than close the U.S.directly for migration out of the country, it seems clear thatpoliticians and bureaucrats will now look for ways to extractmore of your income, making it harder for people andcompanies to leave. Instead of admitting their own policies are afailure, they will instead demonize people and entities located

    outside the United States, label them as "tax cheats," and thenre-write the tax laws to crack down on them further.

    Those who advocate "securing our borders" would do well tokeep these points in mind. If North Korea is any example, thepowers granted to government can be used not only to keeppeople out, but also to keep you in.
