SessionAssignmentNewHorizonLearningCenterwillconductamorningandafternoonsessiondaily.Studentswillbeassignedasessionuponadmissiontotheprogram.Placementwillbedeterminedbasedonavailablespaceandincollaborationwithparticipatingdistricts.Effortswillbemadetoaccommodatestudentsbasedonworkschedulesandothercircumstances.Theprogramadministratorwillmakethefinaldecisiononplacement.Attendance• DailyattendanceisexpectedatNewHorizonsLearningCenter• Studentabsencesrequireaphonecallfromtheparent/guardianinordertobe

• NewHorizonsLearningCenterwillfollowthePorterTownshipSchoolCorporationdelayandclosingschedule.InformationondelaysandclosingscanbefoundonthePorterTownshipSchoolCorporationWebsite,www.ptsc.k12.in.us
• Inrareinstances,NewHorizonsmaybeinsessionandastudent’shomedistrictmaybeonadelayorhaveschoolcancelled.Ifthestudent’shomedistricthasadelayorcancelationduetounsafetravelconditions,thestudentshouldfollowthedelayorcancelationoftheirhomedistrict.

§ Arehouseslippersorspikedshoes,anytype.• Ifastudentsustainsanytypeofinjuryoraccidentasaresultofdisregardingthis
rule,theschoolisnotliable/responsible.• Parentsmayberequiredtobringachangeofclothesforstudentsnotabidingbythe
dresscode.StudentMisconductorSubstantialDisobedienceGroundsforsuspensionorexpulsionapplywhenthestudentis:
• Onschoolgroundsimmediatelybeforeorduringschoolhoursorimmediatelyafterschoolhoursoratanyothertimewhentheschoolisbeingusedbyaschoolgroup.
• Offschoolgroundsataschoolactivityfunctionorevent.• Travelingtoorfromschoolorschoolactivityfunctionorevent.
Groundsforsuspensionorexpulsionarestudentmisconductorsubstantialdisobedience.Examplesofstudentmisconductorsubstantialdisobedienceforwhichastudentmaybesuspendedorexpelledinclude,butarenotlimitedto:
• Usingviolence,force,noise,coercion,threat,intimidation,fear,passiveresistanceorotherconductconstitutinganinterferencewithschoolpurposesorurgingotherstudentstoengageinsuchconduct.Thefollowingenumerationisonlyillustrativeandnotlimitedtothetypeofconductprohibitedbythisrule:
o Occupyinganyschoolbuilding,schoolgrounds,orpartthereofwithintenttodepriveothersofitsuse.

o Blockingtheentranceorexitsofanyschoolbuildingorcorridororroomthereinwithintenttodepriveothersoflawfulaccesstoorfrom,oruseofthebuilding,corridororroom.
o Settingfiretoordamaginganyschoolbuildingorproperty.o Preventionoforattemptingtopreventbyphysicalacttheconveningor
continuedfunctioningofanyschooloreducationfunction,orofanymeetingorassemblyonschoolproperty.
o Intentionallymakingnoiseoractinginanymannersoastointerferewiththeabilityofanyteacheroranyotherpersontoconductorparticipateinaneducationfunction
• Causingorattemptingtocausedamagetoschoolproperty,stealingorattemptingtostealschoolproperty.
• Causingorattemptingtocausephysicalinjuryorbehavinginsuchawayascouldreasonablycausephysicalinjurytoanyperson.Self-defenseorreasonableactionundertakenonthereasonablebeliefthatitwasnecessarytoprotectsomeotherpersondoesnotconstituteaviolationofthisrule.
• Threateningorintimidatinganypersonforanypurpose,includingobtainingmoneyoranythingofvaluefromthestudent.
• Failingtoreporttheactionsorplansofanotherpersontoateacheroradministratorwherethoseactionsorplans,ifcarriedout,couldresultinharmtoanotherpersonorpersonsordamagepropertywhenthestudenthasinformationaboutsuchactionsorplans.
• Possession,handlingortransmittingaknifeoranyobjectthatcanreasonablybeconsideredaweapon,isrepresentedtobeaweapon,orlookslikeaweapon.
• Possessing,using,transmittinganytypeoftobaccoproductincludingbutnotlimitedto,cigarettes,smokelesstobacco,e-cigarettes,hookahpens,andvaporizerpens.
• Possessing,using,transmittingorbeingaffectedbyanycontrolledsubstance,prescriptiondrug,narcoticdrug,hallucinogenicdrug,amphetamine,barbiturate,marijuana,alcoholicbeverage,intoxicantordepressantofanykind,oranyparaphernaliausedinconnectionwiththelistedsubstances.Alsoprohibitedistheconsumptionofanyofthestatedsubstancesimmediatelybeforeattendingschooloraschoolfunctionorevent.
o Exception:astudentwithachronicdiseaseormedicalconditionmaypossessandself-administerprescribedmedicationforthediseaseorconditionprovidedtheymeettherequirementsstatedintheHealthServicessectionattheendofthishandbook.
• Possession,usingortransmittinganysubstancewhichisrepresentedtobeorlookslikeanarcoticdrug,hallucinogenicdrug,amphetamine,barbiturate,marijuana,alcoholicbeverage,stimulant,depressantorintoxicantofanykind.
• Possessing,usingtransmittingorbeingaffectedbycaffeine-basedsubstances,substancescontainingphenylpropanolamine(PPA),orstimulantsofanykind,betheyavailablewithorwithoutaprescription.
• Engaginginthesellingofacontrolledsubstanceorengaginginacriminallawviolationthatconstitutesadangertootherpersonsorconstitutesaninterferencewithschoolpurposeoraneducationalfunction.

• Failinginanumberofinstancestocomplywithdirectionsofteachersorotherschoolpersonnelduringanyperiodoftimewhenthestudentisproperlyundertheirsupervision,wherethefailureconstitutesaninterferencewithschoolpurposesoraneducationalfunction.
• Falselyaccusinganypersonofsexualharassment,orofviolatingaschoolruleand/orastateorfederallaw.
• EngaginginanyactivityforbiddenbythelawsoftheStateofIndianaortheUnitedStatesthatconstitutesaninterferencewithschoolpurposesoraneducationalfunction.
• Aiding,assistingorconspiringwithanotherpersontoviolatethesestudentconductrulesorstateorfederallaws.
• Violatinganyrulesthatarereasonablynecessaryincarryingoutschoolpurposesoraneducationalfunction,includingbutnotlimitedto:
o Engaginginsexualbehavioronschoolpropertyo Disobedienceofadministrationauthorityo Willfulabsenceortardinessofstudentso Engaginginspeechorconduct,includingclothing,jewelryorhairstyle,
whichisprofane,indecent,lewd,vulgar,oroffensivetoschoolpurposeso Failingtotellthetruthaboutanymatterunderinvestigationbyschool
personnelo Possessionoforusingalaserpointerorsimilardevice.
• Usingduringschoolhoursoronthebusrideanelectronicpagingdeviceoracellphone.
• Sending,sharing,viewingorpossessingpictures,textmessages,emailsorothermaterialofasexualnatureinelectronicorotherform,includingthecontentsofacellphoneorotherelectronicdeviceisgroundsforsuspensionorexpulsion.

o Atypeofweaponthatmaybereadilyconvertedtoexpelaprojectilebytheactionofanexplosiveorotherpropellantthroughabarrelthathasaborediameterofmorethanone-halfinch,or
o Acombinationofpartsdesignedorintendedforuseintheconversionofadeviceintoadestructivedevice.AdestructivedeviceisNOTadevicethatalthoughoriginallydesignedforuseasaweapon,isredesignedforuseasasignaling,pyrotechnic,linethrowing,safetyorsimilardevice.
• Thepenaltyforpossessionofafirearmoradestructivedevice:o Requestforexpulsionfromschoolforatleastonecalendaryearwiththe
returnofthestudenttobeatthebeginningofthefirstsemesteraftertheone-yearperiod.Thesuperintendentmayreducethelengthoftheexpulsionifthecircumstanceswarrantsuchreduction.
o Thesuperintendentwillimmediatelynotifytheappropriatelawenforcementagencywhenastudentisexpelledunderthisrule.
PossessingaDeadlyWeapon
• Nostudentwillpossess,handleortransmitanydeadlyweapononschoolproperty.• ThefollowingdevicesareconsideredtobedeadlyweaponsasdefinedinI.C.35-41-
1-8:o Weapon,Taser,orelectronicstunweapon,chemicalsubstanceorother
materialthatinthemanneritisused,orcouldordinarilybeused,orisintendedtobeused,isreadilycapableofcausingseriousbodilyinjury.
o Ananimalreadilycapableofcausingseriousbodilyinjuryandusedinthecommissionorattemptedcommissionofacrime.
• Thepenaltyforpossessionofadeadlyweapon:requestforexpulsionfromschoolforaperiodofuptoonecalendaryear.

• Thesuperintendentwillimmediatelynotifytheappropriatelawenforcementagencywhenastudentisexpelledunderthisrule.
UnlawfulActivityAstudentmaybesuspendedorexpelledforengaginginunlawfulactivityonoroffschoolgroundsiftheunlawfulactivitymayreasonablybeconsideredtobeaninterferencewithschoolpurposesoraneducationalfunction,ifthestudent’sremovalisnecessarytorestoreorderorprotectpersonsonschoolproperty.Thisincludesanyunlawfulactivitymeetingtheabovecriteriathattakesplaceduringweekends,holidays,otherschoolbreaks,andthesummerperiodwhenastudentmaynotbeattendingclassesorotherschoolfunctions.SearchandSeizureThesearchofastudent’spersonorpropertyshallbebasedonareasonablesuspicionthatthestudenthasinhis/herpossessionanyitemofanillicit,inappropriateorillegalnature,stolenproperty,orothersuchpossessionastocausedisruptionoftheeducationalprocess,orwhichmayendangerstudentsorschoolpersonnel.Reasonablesuspicionmaybebasedupon,butnotlimitedto,studenttips,facultyreferrals,parentphonecalls,orsuspiciousbehavioronthepartofthestudent.Anyinformationreceivedwillbeexaminedastoitsvalidityandcredibilitypriortoanyactionbeingtaken.Buildingadministratorsandsecuritypersonnelshallhavetheauthoritytoexamineorcausetobeexamined,astudent’spersonorproperty.Thesearchmayinclude,butisnotlimitedto:
• Thepocketsofthestudents(i.e.clothing,jackets,backpack,etc.).• StudentLockers/Desks.Alllockers/desksprovidedforstudentuseremainthe
propertyoftheschoolcorporation.Studentshavenoexpectationofprivacyinlockers/desksortheircontents.
Searchesofthepersonofastudentasprovidedaboveshallbeconductedbyanadministratorordesignee,inaprivateroombyapersonofthesamesexasthestudentbeingsearched.Awitnessshallbepresentduringthesearch.Dependinguponwhatisfound,adeterminationshallbemadewhetherornottoinvolvethepoliceauthorityhavingjurisdictionoverthearea.Anythingfoundinthecourseofasearch,whichisevidenceofaviolationofthestudentconductstandards,maybe:
• Seizedandadmittedasevidenceinanysuspensionorexpulsionproceeding.• Returnedtotheparentorguardianofthestudentattheendoftheschoolyear.• Destroyedifithasnosignificantvalueor.• TurnedovertothePorterCountySheriff’sDepartmentorotherauthorizedlaw
enforcementagency.

Theparentorguardianofanystudentsearchedshallbenotifiedassoonasisreasonablypossible.Astudentwhorefusestohavehis/herpersonorpropertysearchedshallbesubjecttosuspensionand/orexpulsionGangActivityPolicy
• Definition:o A“gang”isdefinedasanygroupofstudentswhoareperceivedasadistinct
group(notanapprovedschoolorganization),whichpromptsadisruptiveresponseintheschoolcommunity.
• ProhibitingGangActivities:ThePorterTownshipSchoolBoardofTrusteesfindsthatthepresenceofgangsandgangactivitiescancauseasubstantialdisruptionoformaterialinterferencewithschoolandschoolactivities.Bythispolicy,thePorterTownshipSchoolBoardofTrusteesactstopreventdisruptionandtoprohibitgangactivitiesbyrestrictingtheactions,whichfostersuchactivities.
• Therefore,nostudentonoraboutschoolpropertyoratanyschoolactivity:
o Shallwear,possess,use,distribute,displayorsellanyclothing,jewelryorothertrappings,identifiedandassociatedwithgangmembershiporaffiliation;
o Shallusehandsignals,graffitigesturesorotherwrittencommunicationsshowingmembershiporaffiliationinagang;
o Shalluseorhaveintheirpossessionanycellularcommunicationdevices,pocketpagers,orsimilarelectronicpagingdevices;
o Shalluseanyspeechorcommitanyactinfurtheranceofganginterestsoractivitiesincludingbutnotlimitedto:
§ Solicitingothersformembershipinanygang.§ Threateningorintimidatingothers.§ Incitingotherstocommitphysicalviolence.
Studentswhoviolatetheprovisionsofthispolicyshallbesubjecttodisciplinaryaction,whichcouldincludesuspensionorexpulsionfromschoolinaccordancewithstatutorydueprocessprocedures.Bullying
• Thisruleapplies:o Regardlessofthephysicallocationinwhichthebullyingbehavioroccurs
whenever:§ Thestudentcommittingthebullyingbehaviorandanyoftheintended
targetsofthebullyingbehaviorarestudentsattendinganyofthedistrict’sschools.

§ Disciplinaryactionisreasonablynecessarytoavoidsubstantialinterferencewithschooldisciplineorpreventanunreasonablythreattotherightsofotherstoasafeandpeacefulenvironment;
§ Inallothersituations,onschoolgroundsimmediatelybeforeorduringschoolhours,immediatelyafterschoolhoursoratanyothertimewhentheschoolisbeingusedbyaschoolgroup(includingsummerschool);offschoolgroundsataschoolactivity,function,orevent;whiletravelingtoorfromschooloraschoolactivity,function,orevent;orwhenusingpropertyorequipmentprovidedbytheschool.
• Bullyingbyastudentorgroupsofstudentsagainstanotherstudentwiththeintenttoharass,ridicule,humiliate,orharmthetargetedstudentthroughovert,unwanted,repeatedactsorgestures,includingverbalorwrittencommunicationsorimagestransmittedinanymanner(includingdigitallyorelectronicallyand/orthroughuseofdataorcomputersoftwareaccessedthroughanycomputer,computersystemorcomputernetwork),physicalactscommitted,aggression,oranyotherbehaviorsthat:
o Placethetargetedstudentinreasonablefearofharmtohis/herpersonorproperty.
o Hasasubstantiallydetrimentaleffectonthetargetedstudent’sphysicalormentalhealth.
o Theeffectofsubstantiallyinterferingwiththetargetedstudent’sacademicperformance;or
o Hastheeffectofsubstantiallyinterferingwiththetargetedstudent’sabilitytoparticipateinorbenefitfromtheservices,activities,andprivilegesprovidedbytheschoolareprohibited.
o Retaliationagainstthosewhoreportorareinvolvedintheinvestigationofbullyingbehaviorisprohibited.Falsereportingofbullyingisalsoprohibited.
• Parentsorstudentswhosuspectthatbullyingistakingplaceshouldreportthematterdirectlytotheschoolprincipalordesignee.Schoolpersonnelwillinvestigateallreportsofbullying.
• Counseling,correctivediscipline,and/orreferraltolawenforcementwillbeusedtochangethebehaviorofthestudentengaginginbullying.Thisincludesappropriateintervention(s),restorationofapositiveclimate,follow-upengagementwiththestudentwhoengagedinbullying,andsupportforvictimsandothersimpactedbytheviolation.
• Educationaloutreachandtrainingwillbeprovidedtoschoolpersonnel,parents,andstudentsconcerningtheidentification,prevention,andinterventioninbullying.
• Allschoolsinthecorporationareencouragedtoengagestudents,staff,andparentsinmeaningfuldiscussionsaboutthenegativeaspectsofbullying.Theparentinvolvementmaybethroughparentorganizationsalreadyinplaceineachschool.

ElasticClauseTheschooladministrationwillsetupfairandreasonablerulesandexpectationsforcircumstancesthatmayneedactionnotcoveredinthishandbook.Rules,expectationsandconsequenceswillbeconsistentwithsimilarpreviouslysettledincidentsconsideringthereasonsidentified.Itemsomittedfromthishandbookshouldnotlimitthescopeoftheschool’sresponsibilityorauthorityindealingwithanymisbehaviorthatmaynotbeinthebestinterest,safetyorwelfareofstudents.Theserulesapplytoanystudentontheirwaytoandfromschool,onschoolproperty,presentatschool,attendinganyschoolactivity,usingschoolnetworks,accountsorotherservicesandwhosemisbehavioratanytimeorplacemayinterferewiththeoperations,discipline,orgeneralwelfareoftheschool,students,andstaff.PhysicalRestraintProperforceis“reasonablephysicalforceusedtoquelladisturbance,gainpossessionofweaponsordangerousobjectsonthestudentorwithintheimmediatecontrolofthestudenttodefendoneselforothers,ortopreventharmtoanotherpersonorschoolproperty.”Reasonableforcemaybeusedbyateacher“intheexerciseoflawfulauthoritytorestrainorcorrectsuchchildorstudent”or“whennecessarytorestrainthechildfromself-injuryorinjury”;directthemovementofactionsofastudenttoavoidundueordeliberatedisruptionoftheclassroomorotherpartsoftheschool;suchactswillnotbeconstruedtoconstitutecorporalpunishmentwithinthemeaningofthehandbook.Stealing/DamagingSchoolPropertyStealingfromotherstudents,faculty,schoolpersonnel,orofschoolproperty,alongwithdamageofschoolpropertyincludingcomputers,desks,chairs,oranyotherpieceofschoolequipmentwillnotbetolerated.Studentswhostealordamagepropertywillreturnorreplacetheobjectsandfacedisciplinaryactions,whichmayincludebutarenotlimitedtothefollowing:suspension,andexpulsion.ComputerFacilities,Equipment,andSoftwareProcedures

• WhiletheNewHorizonsLearningCenter’sintentistomakeInternetaccessavailableinordertofurthereducationalgoalsandobjectives,studentsmayfindwaystoaccessothermaterialsaswell.EvenshouldNewHorizonsLearningCenterinstitutetechnicalmethodsorsystemstoregulatestudents’Internetaccess,thosemethodscouldnotguaranteecompliancewiththedistrict’sacceptableusepolicy.Thatnotwithstanding,thedistrictbelievesthatthebenefitstostudentsofaccesstotheInternetexceedsanydisadvantages.

• Anyundiagnosedinflammatoryeyecondition.• Anycoughassociatedwithfeverorcontinuousunrelievedcoughing.• Coryza(cold)ifassociatedwithothersignsofdisease.• Dischargefromears.• Pediculosis(headlice).Excludeuntiltheyarefreeoflivelice.Studentsaretobe
checkedbynurseuponreturntoschoolbeforeclassroomadmission.

• Parents,andstudents,areencouragedtolettheschoolknowaboutsuchcircumstancessothatallconcernedcanworktogethertoassistthefamilyandstudent.Aparentconference,whichmayincludetheadministration,guidance,schoolnurse,andteachers,isrecommended.Attheconference,documentationofthesituationandacompletedCertificateofIncapacity(assuggestedbytheIndianaDepartmentofEducation,AttendanceOffice)willbeprovidedbythefamily.Thepurposeoftheconferencewouldbetodetermineanygeneraleducationinterventionsneededandestablishanon-goingmeansofcommunicationbetweenschoolandfamily.
Immunizations:
• Inaccordancewithstatelaw,childrenenteringschoolmustcomplywiththeIndianaStateDepartmentofHealth'simmunizationrequirements.Theseincludevaccinationagainstdiphtheria,whoopingcough,tetanus,polio,mumps,measles,rubella,HepatitisBVaccine(HBV)andVaricella(ChickenPox).IncludingMeningococcalconjugatevaccine(MCV4)forgrades6th-12th.Numberofvaccinationswillbedependentonthechild'sageandgradelevelasdeterminedbytheINStateDepartmentofHealth.Allvaccinationrecordswillbeenteredintothestateregistryforlong-termstorage.Ifyou’dprefertooptoutoftheregistryoraportionoftheregistry,pleasesubmitanannualobjectioninwritingtotheschoolnursewithinthefirst20daysofschool.
• TwoDosesofVaricella(chickenpox)vaccine,orevidenceofimmunity,willberequiredforallstudentsK-12.TwodosesofHepatitisAvaccine(HepA)arerecommendedforstudentsenteringkindergarten.Onedosemeningococcalconjugatevaccine(MCV4)isrequired&oneboosterdoseofMCV4isrecommendedforallstudentsgrades11&12.
Parentswhoobjecttoimmunizationforreligiousorhealthreasonsmustcompleteanimmunizationwaiver(availableintheHealthClinic).Adoctor’ssignatureisrequiredforanyhealthreasons.Waiversmustbeverifiedannually.MedicationsGiveninSchool:Exceptasspecifiedin“Self-AdministeredMedications”section,
• Allmedicationmustbebroughttotheschoolofficewhereitwillbekeptinlockedstorageintheclinic.Dispensingofmedicationswillonlybedonebytheschoolnurseortraineddesigneeoftheschool.
• Allprescriptionmedicationmustbesentinthelabeled,pharmacycontainer.• Over-the-countermedicationmustbesentintheoriginalcontainer.

• MedicationmaybesenthomewithstudentsinGrade9-12,ifthestudent'sparentprovideswrittenpermissionforthestudenttoreceivethemedication.Somemedicationsarenotsuitableforsendinghomewithchildren.Insomecases,thenursewillcontactparentstopickupexcessattheendoftheschoolyear.
• Foranyover-the-countermedicationrequiredonaroutinebasisformorethan10daysandanymedicationregimenthatdiffersfromthepackageinstructions,adoctor’snoteforadministrationisrequired.
• Itistheresponsibilityofthestudenttocometotheofficeforhis/hermedication.• Nomedicationcanbeadministeredtostudentsunlessithasbeenprovidedbythe
student’sparent/guardian.Theclinicsdonothavestockmedications.Self-AdministeredMedication:
• Astudentwithachronicdiseaseormedicalconditionmaypossessandself-administeremergencymedicationforsuchconditionsonschoolgrounds,duringschoolorschoolactivities,orwhiletravelingtoorfromschoolactivities.Thestudentispermittedtodosoonlyifthestudent’sparent/guardianhasfiledanauthorizationwiththeprincipalonanannualbasis.Thisauthorizationmustincludeawrittenstatementfromthestudent’sphysicianthat:
o Thestudenthasanacuteorchronicdiseaseormedicalconditionforwhichthephysicianhasprescribedmedication.
o Thestudenthasbeeninstructedhowtoself-administerthemedication.o Thenatureofthediseaseormedicalconditionrequiresemergency
administrationofthemedication,(i.e.inhalers,epi-pens,glucagon.)DiscardingMedications:
• Theparent/guardianisresponsibleattheendofthetreatmentregimenforremovingfromtheschoolanyunusedmedicationthatwasprescribedforhis/herchild.Iftheparentdoesnotpickupthemedicationbytheendoftheschoolyear,theschoolnursewilldisposeofanddocumentthatthemedicationwasdiscarded.Destructionofthemedicationwillbedoneinamannerthatensuresthatnootherpersoncanobtainpossessionofit.
CommunicableIllnesses:
• Everyeffortwillbemadetokeepparentsinformedofpossibleexposuretocommunicableillnessesthroughwebsite&emailnotices.Ifyourchildisdiagnosed

withacommunicableproblemsuchasstrepthroat,chickenpox,pinkeye,bedbugs,orflu-likesymptoms,pleaseinformtheschoolimmediately.Witheveryone'shelp,thespreadofthesehealthconcernscanbelimited.
Accidents:
• Ifanaccidentshouldoccuratschool,thefollowingactionswilltakeplace:o Theofficewillattempttonotifytheparentsathome.o Ifparentscannotbereachedathome,wewillattempttoreachthematwork.o Ifparentscannotbecontacted,theemergencynumberwillbecalled.
• Ifanaccidentinvolvesseriousinjury,thefollowingwilloccur:
o Theprincipalorhis/herdesigneewillusetheirbestjudgmenttodeterminetheneedforemergencymedicalservice.
o Anambulancewillbecalled,ifdeemednecessary.Foryourchild'ssafety,parentsarerequestedtoimmediatelynotifytheschooloffice(inwriting)ofachangeofaddress,phonenumber,orplaceofemployment.
