Item: Senior Center Accreditation Recognition Initiated By: Stacie Shatzer, Aging Director Action Proposed: No Action Required

Description: In 1978 the National Institute of Senior Centers developed standards for the senior center field and offers the nation’s only National Senior Center Accreditation Program. The purpose of the program is to advance the quality of senior centers nationwide. The National Institute of Senior Centers developed the program with nine standards of excellence for senior center operations. They are Purpose, Community, Governance, Administration and Human Resources, Program Planning, Evaluation, Fiscal Management, Records and Reports and the Facility. Each standard has a principle, rationale, and detailed criteria section. These standards serve as a guide for all senior centers to improve their operation today and position themselves for the future. More than 200 senior centers have been accredited nationwide. North Carolina has three nationally accredited centers and two of those are located right here in Nash County. The Nash County Senior Center was first accredited in July of 2010 and was recently reaccredited until 2020. The Rocky Mount Senior Center achieved this national standard in July 2015 and is also accredited until 2020. The accreditation process improves and strengthens the overall senior center operations. The self-assessment process brings the staff, participants, aging service provider representatives and the community together to look at the senior center and compare it to the standards that have been established by the National Institute of Senior Centers. Together, the center and the community identify strengths and areas that need improvement and develop a strategy for moving forward. At the October meeting, we want to recognize Michele McKnight, Senior Center Coordinator for the Nash County Senior Center and Alex Langley, Senior Center Manager for the Rocky Mount Senior Center for this national achievement. Both of these individuals have dedicated themselves to achieve excellence in their programs, operations and facilities. They each have a strong work ethic and keep the consumers, Nash County’s senior population, in mind when performing all of their duties. These individuals are leaders here locally in the region as well as at the state level. Today we want to say thank you for their commitment and hard work. The senior adults and caregivers of Nash County say thank you as well.

Item: Public hearing - Petition to consider approving a Conditional

Use Permit (CU-150901) for a proposed solar farm on approximately 28 acres of a 65 acre tract located on the west side of Pace Road by landowners W. Graham Farmer, Jr. and Brenda L. Farmer and by Louis Iannone and Beth Trahos Representing Strata Solar, LLC and Kojak Farm, LLC

Initiated By: Nancy M. Nixon, Planning Director Action Proposed: Conduct a quasi-judicial public hearing and take action on

the request.

Case summary: Note: This is not a rezoning, but a stand-alone Conditional Use Permit request. This petition submitted by Louis Iannone representing Strata Solar, LLC and Beth Trahos representing Kojak Farm, LLC as well as by W. Graham Farmer, Jr. and Brenda L. Farmer, the property owners, is a request for a Conditional Use Permit (CU-150901) to allow the development of a solar farm on approximately 28.78 acres of a 65.21 acre portion of an existing tract located in the R-40 Single-Family Residential Zoning District

on the west side of Pace Road (SR 1961). A solar farm as defined by the UDO is allowed with a Conditional Use Permit approved by the Board of Commissioners. The subject tract is located immediately north of the Town of Bailey's extraterritorial jurisdiction (ETJ). The proposed site is located in the Buckhorn Public Water Supply Watershed but it is not located in a regulated floodplain. The developer has identified existing streams and wetlands on the western portion of the parcel, however, they should not be impacted by the proposed facility itself. The site is located in the Neuse River Basin so any stormwater permitting requirements would be administered at the state level by the N.C. Department of Environment and Natural Resources (NCDENR). The submitted site plan depicts a single fenced area containing arrays of ground-mounted solar panels and related inverter equipment that would be accessed directly from Pace Road. The site plan also includes a temporary laydown yard, staging area and parking area to be utilized during the construction period. There is no exterior lighting proposed for the site. Because the proposed solar farm facility would be located within 100 feet of the immediately adjacent, residentially-zoned lots to the north and south, the "Incompatible Land Use" screening requirements of UDO 11-3.3 (B) would apply. Since no homes currently exist along the majority of the affected property lines, the developer is requesting an alternative screening plan for consideration under the provisions of UDO

11-3.4 (A). The proposed landscape design is less substantial than the standard requirements and would include a 15 foot wide buffer yard with a single row of evergreen shrubs planted every 10 feet on center. The shrubs shall be of a species that will reach a minimum height of 10 feet and provide a minimum of 75% opacity within three years of planting. The Board may approve the alternative screening plan provided that it will appropriately and effectively meet the purposes of the ordinance.

UDO Definition: A solar farm is defined by the Nash County Unified Development Ordinance (UDO) as "a facility used to convert solar energy into electrical power for interconnection with the power grid for primarily off-site energy consumption" (UDO Article II, Section 2-4.158a) Development Standards for Solar Farms: UDO Article XI, Section 11-4.72(a) establishes the following required development standards for solar farms:

(A) Where Required A1, R-40, RC, LI, GI, PI Zoning Districts - The proposed site is located in the R-40 Single-Family Residential Zoning

District.

(B) Maximum Height Structures shall not exceed twenty-five (25) feet in height, as measured from grade at the base of the structure to its highest point. - The site plan notes that the proposed systems, equipment and structures

will not exceed twenty-five (25) feet in height when ground mounted and the sample schematics provided by the applicant depict typical solar panel racks that are nine (9) feet in height.

(C) Setbacks

Solar farm facilities and structures shall conform to the principal building setback requirements of the zoning district in which they are located. - The site plan indicates that the proposed facility would satisfy the principal

building setback requirements for the R-40 Single-Family Residential Zoning District.

(D) Security Fencing

Solar farm facilities shall be enclosed by a chain-link security fence, a minimum of 6-feet in height and topped with barbed wire. - The site plan includes security fencing in compliance with the above

requirements.

(E) Site Plan Solar farms shall be developed in accordance with an approved site plan that includes: (1) the location of the solar farm facility (including the arrangement of any

existing or proposed buildings, structures or panels);

(2) the distance from any proposed solar farm facility, structure or use area to the surrounding property lines;

(3) any existing or proposed signs, fencing, lighting, parking areas, driveways, landscaping, vegetative screening or required buffers;

(4) horizontal and vertical (elevation) scale drawings with dimensions of proposed solar collector structures; and

(5) noted limitations on built-upon area as required for compliance with stormwater, watershed and/or riparian buffer regulations.

- The submitted site plan and related schematics satisfy the above

requirements.

(F) Safety Solar farm facilities shall not create a visual safety hazard for passing motorists. - No potential visual safety hazard is anticipated.

(G) Abandonment Solar farm facilities shall be removed, at the owner's expense, within one hundred eighty (180) days of a determination by the Zoning Administrator that the facility is no longer being maintained in an operable state of good repair. - The landowner of record shall be responsible for the deconstruction and

removal of the solar farm at such time that the facility is either decommissioned or abandoned.

Conditional Use Permit Requirements (UDO Article IV, Section 4-7): In addition to the development standards detailed above, the ordinance requires the Board of Commissioners to conclude that the proposed development:

(1) Will not materially endanger the public health or safety; (2) Will not substantially injure the value of adjoining or abutting property; (3) Will be in harmony with the area in which it is to be located; and (4) Will be in general conformity with the land development plan or other plans

officially adopted by the Board of Commissioners. If the Board of Commissioners concludes that the proposed development will not comply with the above criteria, it may deny the permit or attach to the permit any reasonable requirements in addition to those specified by the ordinance that will ensure its compliance.

Note: Because this request does not change the existing zoning classification of the subject property, there is no need to address "spot zoning" or to recommend a rezoning consistency statement.

TRC Recommendation: The Nash County Technical Review Committee (TRC) considered Conditional Use Permit Request CU-150901 on September 3, 2015 and unanimously recommended approval, with conditions. Planning Board Recommendation: The Nash County Planning Board considered Conditional Use Permit Request CU-150901 at its regular meeting on September 21, 2015. The Planning Board unanimously recommended APPROVAL on the basis of the following finding:

The proposed solar farm is a relatively low-intensity land use that should not generate additional traffic (post construction) or significant noise and that should be able to exist in harmony with the surrounding land uses in the Rural Growth Area as designated by the 2006 Nash County Land Development Plan. In addition, solar power is a green initiative that provides a clean, renewable alternative energy source.

AND SUBJECT TO THE FOLLOWING CONDITIONS:

1) The proposed facility shall comply with the development standards for solar

farms as set forth in the Nash County Unified Development Ordinance Article XI, Section 11-4.72(a).

2) The property shall be developed in accordance with the submitted and

approved site plan as well as in compliance with all other applicable development regulations.

3) The vegetative screening buffers depicted on the site plan were approved in

accordance with UDO Article XI, Section 11-3.4 (A) "Alternative Screening Methods." All vegetative screening buffers must be planted prior to the final approval of the solar farm and must be preserved and/or maintained as shown on the approved site plan.

4) This Conditional Use Permit shall be issued subject to the approval and

issuance of the following additional permits and documents, as applicable:

a) NCDENR Erosion and Sedimentation Control Plan Approval b) NCDENR Stormwater Permit (Neuse River Basin) c) NCDOT Driveway Permit d) Nash County Zoning Permit e) Nash County Electrical Permit

5) The landowner of record shall be responsible for the deconstruction and

removal of the solar farm at such time that the facility is either decommissioned or abandoned.

Suggested Motion: I move that the Nash County Board of Commissioners APPROVE or DENY (choose one) Conditional Use Permit Request CU-150901 for the development of the Kojak Farm,

LLC solar farm on the west side of Pace Road on the property further identified as Nash County Tax Parcel ID # 001346, subject to the conditions recommended by the Planning Board. NOTE: Because this request does not include a rezoning, there is no need to address "spot zoning" or to recommend a rezoning consistency statement. NOTE: If the motion is for Denial, the Board of Commissioners must identify which of the Conditional Use Permit Requirements is/are not met.

You should be seeing billboard, TV, radio and print advertisements all around the region, as well as an integrated social media campaign among entities and individuals in our region. We also hope you have already visited our website herestosuccess.org to view all of our videos, advertisements, brand materials, Twin Counties communications channels, business & citizen supporters, etc. We have raised $115,000 from caring businesses and citizens in the Twin Counties, and are now seeking funding from the municipalities to help us reach our $200,000 goal for full implementation of the plan. Attached is our plan with status updates on the far right, as well as a press release from our July launch that provides a good overview of the initiative. Positive Image – Regional Marketing & Communications Plan

as part of the Twin Counties Visioning Plan

Positive Image Action Group Status as of August 2015: As outlined below, several key objectives have been accomplished or are in progress. We have raised $115,000 from caring businesses and citizens, and are now seeking funding from the municipalities to reach our $200,000 goal for full plan execution. Develop an internal, community-wide communications plan that raises awareness of our region’s assets, positive work happening in the region, resources and opportunities available to residents, and the coordinated external marketing campaign.

a. Internal Communications

i. Create “Twin Counties Communicators” group (communications representatives from municipalities, chambers, economic development, tourism organizations, etc.) to collaborate in sharing positive news with one another and their followers.

ii. Educate Twin Counties citizens on assets and accomplishments

of region. Secure advertisements in local newspapers, TV, radio,

and billboards to communicate interesting and surprising factoids about the combined region relating to education, arts and culture, healthcare, tourism, quality of life, etc.

Build website (herestosuccess.org) to host all videos and print advertisements, positive news stories, links to key websites and social media channels. The landing page will show all logos and names of supporters who fund the initiative. A sub-site will house brand materials for download.

Pursue local media coverage of initiative (editorial).

Group was established in Spring 2014 & continues to collaborate. Launched July 2015

REGIONAL POSITIVE IMAGE CAMPAIGN LAUNCHES IN TWIN COUNTIES

Initiative Aims to Communicate Assets and Successes of the Twin Counties ROCKY MOUNT, N.C., July 6, 2015 – The Positive Image Action Group, formed in January 2013 from

the Twin Counties Visioning Process, launched on Monday the first phase of its regional positive image campaign. The initial phase focuses on educating citizens of Edgecombe and Nash Counties on

interesting facts about the combined region through local advertisements and social media.

“The goal of Phase I is to make our own residents aware of the great things happening here, for which we

all should be proud,” said Don Williams, president of Lewis Advertising and co-chair of the Positive Image Campaign. “People will see their neighbors, friends and coworkers on local billboards, TV commercials,

newspapers, radio and social media, talking about interesting facts that represent our combined Twin Counties region.”

The group, comprised of citizen volunteers from Edgecombe and Nash Counties representing diverse

backgrounds, age groups, gender, race, professional experience and geography within the two counties,

spent the last two years developing a marketing and communications plan for the region based on the feedback provided in the Twin Counties Visioning Process public study circles in 2012. With the help of

Lewis Advertising, the group developed a regional brand logo and the tagline “Here’s To Success”. They also developed a website, herestosuccess.org, to aggregate positive news happening in the area and

channels for businesses and individuals to follow to learn more.

The strategy also includes an “Ambassador’s Program” which will train staff in the hospitality industry on

opportunities they can share with tourists and local customers about where to go and what to do in the Twin Counties. The first wave of training is set to begin this fall.

Phase 2 will focus on external marketing as well as continuing to support the internal campaign and

Ambassador Program. The group plans to develop external messages and purchase strategic advertisements outside of the region in places like the Triangle in an effort to show business owners,

individuals and families the positive things the Twin Counties region has to offer.

With the help of the local chambers of commerce and citizens, the group has raised $115,000 of its

$200,000 goal thus far from businesses and individuals to fund the multi-phase campaign.

“It has been incredibly encouraging to see businesses and individuals from all ends of this region come together to support this initiative,” said Dorsey Tobias, media relations manager for PNC Bank, and co-

together for social, economic and cultural success.”

INTERLOCAL AGREEMENT

THIS INTERLOCAL AGREEMENT (the “Agreement”) dated, for reference purposes

only, the ____ day of _____________, 2015, by and between NASH COUNTY, a body politic

and corporate of the State of North Carolina (the “County”) and TOWN OF ELM CITY, a

North Carolina municipal corporation (the “Town”). The County and Town are collectively

referred to as the “Parties”. The “Effective Date” of this Agreement shall be the date of the last

party to sign.

RECITALS

A. The Town is purchasing two contiguous tracts of land from Charlotte M. Bissette

for the expansion of its wastewater treatment facility.

B. One tract of land is located entirely within Nash County and is designated as Nash

County Tax Parcel 3736-0066-9569 (“Parcel I”). The other tract of land is located partly in Nash

County and partly in Wilson County and is designated as Wilson County Tax Parcel 3736-55-

9745 (“Parcel II”). Parcel I and Parcel II are collectively referred to as the “Property”.

C. Pursuant to North Carolina General Statute Section 153A-15(b), the purchase of

land in a county by a city or town, located wholly or primarily outside the county, must first be

approved by the Board of Commissioners where the land is located.

D. The County has approved the conveyance of the Property subject to the terms and

conditions of this Agreement.

E. The Town has agreed that the conveyance of the Property shall be subject to the

terms and conditions of this Agreement

NOW, THEREFORE, in consideration of the premises, which are incorporated into and

made part of this Agreement, and of the terms set forth herein and for other good and valuable

consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties hereby

agree as follows:

1. Restrictions Upon the Property. The deed(s) conveying the Property to the

Town (collectively and individually, the “Deed”) shall contain the following restrictions (the

“Restrictions”):

(i) The Town shall not construct or place a wastewater lagoon on any portion

of the Property located within the County; and

(ii) The Town shall not spray, discharge, apply, irrigate or distribute any

wastewater, wastewater effluent, sewage or any other wastewater or sewage byproduct of

any kind whatsoever over or upon any portion of the Property located within the County.

2. Binding Effect of Restrictions. The Deed shall contain language stating that:

(i) The Restrictions shall be binding upon the Town, its successors and

assigns, and shall inure to the benefit of the County, its successors and assigns;

(ii) Any portion of the Property located within the County shall be held,

transferred, sold, conveyed, encumbered, leased, used, occupied and improved, subject to the

Restrictions;

(iii) The Restrictions shall run with and bind any portion of the Property

located within the County;

(iv) The Restrictions shall be binding on all persons having or acquiring any

right, title or interest in any portion of the Property located within the County; and

(v) The Restrictions shall not be amended, supplemented or terminated

without the written consent of the County, which consent shall be in its sole discretion.

3. Enforcement of Restrictions. The Deed shall contain language stating that the

County, it successors and assigns, shall have the authority to enforce the Restrictions against any

person or entity violating or attempting to violate the same; and that the County shall be entitled

to all remedies available at law or in equity for the breach or potential breach of the Restrictions,

including injunctive relief.

4. County Approval of Deed. The Deed shall not be executed or recorded without

the prior review and approval of the County.

5. Miscellaneous.

a. The validity, construction, and interpretation of this Agreement shall in all

ways be governed and determined in accordance with the laws of the State of North Carolina.

b. The captions used in this Agreement have been inserted only for purposes

of convenience and the same shall not be construed or interpreted so as to limit or define the

intent or the scope of any part of this Agreement.

c. This Agreement contains the entire agreement between the Parties as to

the subject matter hereof, and supersedes all prior negotiations, representations, guarantees,

warranties, promises, statements, or agreements, either written or oral, between the Parties

hereto.

d. This Agreement shall not be modified or amended in any respect, except

by a written agreement executed by the Parties to this Agreement.

e. This Agreement shall be binding upon and inure to the benefit of the

Parties hereto and their successors and assigns.

f. This Agreement may be executed in one or more counterparts, including

facsimile counterparts, and all such executed counterparts shall contain one agreement, binding

on all the parties hereto, notwithstanding that all the parties are not signatory to the original or

representatives of the Parties as of the dates set forth below their respective signatures.

Description: The attached ordinance for the Board’s consideration prohibits the public and employees from possession of firearms and other deadly weapons on county operated buildings including recreational facilities. Firearms and other deadly weapons” are defined as, all handguns, rifles, shotguns, stun guns, knives and any other deadly weapon as defined in N.C.G.S. §14-269(a). The possession or display of firearms and other deadly weapons, concealed or otherwise, is prohibited on or within any property, buildings and recreational facilities, owned, operated, managed, controlled or leased by the county Exceptions to this ordinance include the following: Officers and enlisted personnel of the Armed Forces of the United States and Sworn law enforcement officers while in discharge of their official duties, storing a firearm or other deadly weapon within a locked vehicle, and possession of an ordinary pocket knife carried in a closed position. Any person convicted of violating this section shall be guilty of a Class 3 misdemeanor and shall be fined not more than five hundred dollars ($500.00). ARTICLE II. FIREARMS AND WEAPONS

Sec. 16-26. Firearms and Other Deadly Weapons on County Property

(a) Prohibition. The possession or display of firearms and other deadly weapons,

concealed or otherwise, is prohibited on or within any property, buildings and recreational

facilities, as well as the appurtenant premises to such property, buildings and recreational

facilities, now or hereafter owned, operated, managed, controlled or leased by the county

(collectively, the “County Property”).

(b) Definitions. “Firearms and other deadly weapons” include without limitation, all

handguns, rifles, shotguns, stun guns, knives and any other deadly weapon as defined in

N.C.G.S. §14-269(a). “Recreational facilities” are defined in N.C.G.S. §14-415.23 and county

recreational facilities subject to this ordinance are identified in a list of recreational facilities

maintained in the office of the Director of Parks and Recreation.

(c) Posting of Signs. The county manager or his designee is authorized and instructed

to post conspicuous signage or notices on or within the County Property indicating that the

possession or display of firearms and other deadly weapons are prohibited therein. The county

manager or his designee shall exercise reasonable discretion in determining the number and

appropriate location of signs or notices to be placed on or within the County Property.

(d) Exceptions. The possession or display of firearms or other deadly weapons on

County Property is allowed in the following situations:

(1) Officers and enlisted personnel of the Armed Forces of the United States,

including National Guard and Reserve, when in discharge of their official

duties as such and acting under orders requiring them to carry arms and

weapons.

(2) Sworn law enforcement officers while in discharge of their official duties.

(3) Storing a firearm or other deadly weapon within a locked vehicle.

(4) Possession of an ordinary pocket knife carried in a closed position. As

used in this section, “ordinary pocket knife” means a small knife with a

blade of no more than three (3) inches, designed for carrying in a pocket

or purse, that has its cutting edge and point entirely enclosed by its handle,

and that may not be opened by a throwing, explosive, or spring action.

(e) Violation. Any person convicted of violating this section shall be guilty of a

Class 3 misdemeanor and shall be fined not more than five hundred dollars ($500.00).

Virginia Sky Painters has submitted a permit application to conduct a fireworks display as a part of wedding festivities at Rose Hill Farms on October 24, 2015. The application and accompanying documents are in order and on file in the Fire Marshal’s Office. With NC G.S. 14-410, the Board of County Commissioners must give approval prior to the Fire Marshal issuing this permit. The Fire Marshal recommends approval. NC G.S. 14-410 (3) The display operator has secured written authority under G.S. 14-413 from the board of county commissioners of the county, or the city if authorized under G.S. 14-413(a1), in which the pyrotechnics are to be exhibited, used or discharged. Written authority from the board of commissioners or city is not required under this subdivision for a concert or public exhibition provided the display operator has secured written authority from The University of North Carolina or the University of North Carolina at Chapel Hill under G.S. 14-413, and pyrotechnics are exhibited on lands or buildings in Orange County owned by The University of North Carolina or the University of North Carolina at Chapel Hill.

Among the duties of the Tax Collector is:

amount he has collected on each year’s taxes with which he is charged, the amount remaining

uncollected and the steps he is taking to encourage or enforce payment of uncollected taxes.
