Over 25 years ago a group of founding memberscreated the Nantucket Association of Real

Estate Brokers — formed to help our organizationengage in community activity and to help nurture acooperative relationship amongst all member realestate offices while striving to cultivate consistentprofessional standards.

Our 208 member association with 34 offices, hasthe resources of robust multiple listing services and membership-owned publications that help all member agents deliver market dataand timely and accurate information on any property for sale to buy-ers, sellers, other professionals or just the curious.

The Nantucket market has been in slow decline since 2005, butthe end of 2010 brought promising news that suggests that the bot-tom of the market is behind us. The total number of sales in 2010was 364, up from 238 in 2009. The dollars for those sales increased47 percent to $695 million, from $435 million in 2009. Looking atour historical record over the last 10 years, we see that the average

selling price of a Nantucket home has increased from $970,000 to$1,907,000 — up 197 percent. The average selling price of vacantland has increased in a similar fashion, from $570,000 to $1,073,000— an increase of 189 percent. That compares to the Dow Jones,which is down four percent over the same period.

Because owning property on Nantucket is discretionary for most,owning a property is about so much more than just an investment.It is about having a home in this special place and enjoying theisland with family and friends.

With 2010 behind us and the trends suggesting a continuedgradual improvement in our market, we have a healthy positive atti-tude to 2011 that the attractive inventory, adjusted pricing over the lastfew years and continued favorable interest rates will continue to con-tribute to increased property sales. Most importantly, this very specialspit of sand will continue to remain a well-preserved island with aninteresting and vibrant community that cannot be found elsewhere.

Brant PointOnce you pass the White Elephant Resort

buildings on Easton Street, the Brant Point area ispurely residential, made up of neighborhoodswith impressive, old homes lining HulbertAvenue. Many have expansive porches, a mix ofbarn, Cape or mansard roofs, lots of windowsand well-manicured lawns overlooking NantucketHarbor. Short side streets stretching betweenHulbert Avenue and North Beach Street to Bathing Beach Road are incontrast, with essentially small and simple summer cottages along theoften-unpaved ways. This area is populated mostly by seasonal resi-dents. It includes Jetties and Children’s beaches, and is a short walk orbike ride to downtown.

CiscoAt the curve approaching the intersection of

Somerset Lane and Austin Farms, HummockPond Road becomes agricultural and an areawhere horses, sheep and other livestock thrive.Homes, with the exception of moderately densedevelopments off Heller’s Way and Ahab Drive,for example, are spaced far apart on good-sizedlots. The farther one gets toward Cisco Beach,the fewer year-round homes there are in this area. Bartlett Farm isopen all year, stocked with a variety of groceries and prepared food.Cisco Brewery, the Winery and Distillery is open year-round for salesand socializing, and Sandole’s Fish Market is open throughout the sum-mer season.The earliest homes in Cisco are low and simple in design,while many of the newer residences have second floor decks, affordingimpressive views of the rolling Atlantic Ocean.The beaches of Cisco area popular surfing destination on the island.

CliffSitting high above Nantucket Harbor are some

of the island’s stateliest homes, with wraparoundverandas permitting outstanding views. It is diffi-cult to pinpoint a particular architectural designhere, because beyond the historic core districtNantucket has always seemed to have designs ofits own that characterize a relaxed, yet refined,lifestyle. These shingled mansions often attract discriminating families,with generations visiting in the summer. Nevertheless, as it is in BrantPoint, the homes in the Cliff area side streets are frequently modest,tend to be more of a cottage-style and house many year-round resi-dents.The ever-present wind keeps trees along the Cliff fairly low andmainly in the sturdy pine family. This lovely location is convenient toSteps Beach, Jetties Beach and the routes to Dionis, Eel Point andMadaket. It is also just minutes from the heart of downtown.

DionisEel Point Road, off Madaket Road and leading to Dionis, is on the

way to the Linda Loring Nature Foundation property.There are mod-erate to elaborate homes, many of which are seasonal, on both sides of

the road to the Dionis Beach parking lot, aboutmid-way on the right.Those living nearby only havea short walk or bike ride to climb through and upthe dunes overlooking the calm water along thisnorthern shoreline, speckled with collectible shellsand small, colorful stones. Past the rock markingthe path to Dionis Beach, the road continues to aleft turn along Eel Point Road lined with resorthomes of contemporary designs. A little farther is the popular 40thPole, a beach area favored by locals for its fishing and expanse of sandfor family get-togethers and picnics. Dionis is mere minutes fromMadaket, around the corner from the upper start of Cliff Road andclose to town and bike paths.

Fisher’s LandingThis is another example of the clustering that is

based on early settlement principles. Fisher’sLanding is an attractive development off MadaketRoad, before the turn onto Warren’s LandingRoad. Though house lots are not large, they areadequate for personal enjoyment and landscapingopportunities, and have been priced affordably topermit creative home designs that meet individualor family needs. Many year-round residents live in this area. Fisher’sLanding is minutes from Madaket Beach, and is even nearer to the smallbeach area at Warren’s Landing. The Madaket bike path, extending tojust outside of town, is easily accessible from Fisher’s Landing.

Hummock PondOn the western side of Hummock Pond Road,

leading to Cisco, are several meandering dirt roadsthat are home to generally small, low summer cot-tages, either individually owned or rentals that linethe shores of Hummock Pond. Some have suchinteresting names as Moth Ball Way, to offer asense of the environment so close to the pond andocean.This area is remarkably quiet and rural, giv-ing a real sense of simple, relaxed summer living that is only minutesaway from conveniences, swimming, boating and beach combing.

MadaketThere is some debate as to where the western

settlement of Madaket officially begins, but thegeneral opinions is that it starts after crossingsecond bridge. While all areas of the island —other than the core historic district — have seenat least some new development, growth inMadaket has remained minimal. To ensure thecommunity stays quiet and rural, residents (themajority being summer folk often as devoted as the year-rounders)have consistently spoken against expansion of commercial uses inMadaket other than the existing West End seasonal restaurant withmini-market, Madaket Marine boatyard and a proposed health club.Thehomes in Madaket are a mixture of rustic cottages, standard-size, sin-gle-family dwellings, large contemporary designs in the popular upside-down style and townhouse condos. Many short side streets off themain road are named after a letter of the alphabet, up to Ames Avenueat the end where the famous (perhaps infamous) Madaket Millie oncelived. Millie, though seemingly a gruff old salt, was admired by her neigh-

bor, the late Fred Rogers of the long-running “Mr. Rogers’Neighborhood” children’s program. Though Madaket Beach has sus-tained substantial erosion in the past few years, it is still one ofNantucket’s prettiest shorelines and the venue for the island’s mostspectacular sunsets. Smith’s Point, a popular fishing spot, is accessiblefrom the far side of “Millie’s Bridge” over Ames Avenue. Shuttle busservice extends to Madaket, however as far out as it seems, it is just a10-minute drive to town or mid-island.

MadequechamThe uninterrupted view across the wide, gla-

cier-formed Madequecham Valley is unparalleled,with grassy dips and rises of conservation andtown-owned acres meeting the sea between TomNevers and Nobadeer.This amazing sight is visi-ble from where the valley begins off New SouthRoad, but across the expanse a small develop-ment of primarily sizable, seasonal homes has evolved.The houses arereached by driving down Russell’s Way, a long, mostly straight and widedirt road that ends with options to continue ahead or bear left. Homesin this location, on Wigwam Road, for example, are large and oftencome with plenty of land.This area has pristine beaches and is abouthalfway between mid-island and Siasconset. The Milestone Road bikepath crosses the turn onto Russell’s Way.

MiacometOld-timers remember the Miacomet Raceway

and fairgrounds that once occupied many acresat the end of Somerset Lane.Answering a grow-ing need for more reasonably priced year-roundfamily homes, the raceway was replaced withneat, small, quiet neighborhoods with names suchas Henderson’s Drive or Doc Ryder Drive. Thehouses are typically Cape-style, are on ample lotsand have nicely tended yards. Many homes are desirably situated alongMiacomet Pond. Though residents here enjoy personal landscaping,Miacomet is another flat and open location where tall trees do notthrive. This area, close to Miacomet Golf Club and the family-friendlyMiacomet Beach, is all residential except for a nursery business at thestart of the main road.

Mid-IslandThe lines delineating the boundaries of what is

called mid-island have shifted over the past half-dozen years. This area has become a desirabledestination for businesses and is one wherehomes are affordable and conveniently locatednear shopping, schools and the hospital. Thesedays, it is safe to say that after the five cornersintersection of Pleasant Street and AtlanticAvenue, mid-island encompasses a large area stretching to HooperFarm Road, to the start of Old South Road, across Fairgrounds Roadto Macy’s Lane near the airport and plenty of acreage in between. Manyof the homes on Hooper Farm, Fairgrounds and Newtown roads, forinstance, are ranch-style, one-story designs with large picture windowson the front. Capes are also popular in this area, and many of thedwellings, while modest, have sizable yards. Besides its proximity toshopping, dental and health care offices, and the fire and new policedepartment, the mid-island offers attractive and affordable living.

MonomoyThis peaceful, residential area off the beginning

of Milestone Road is home to more seasonal resi-dents than those living here all year. Most of thelong-established houses are quite sizable and ram-bling, with large lots. Properties along the northside of Monomoy Road enjoy spectacular views ofNantucket Harbor,The Creeks and a town skylineincluding prominent, historic church steeples.While Monomoy has a rural feel, it is mere minutesfrom mid-island shopping and just a scoot away from the town center.

NashaquissetLocated a short distance from island schools

and conveniently near mid-island shopping anddowntown, Nashaquisset is a community withinthe greater community, built on acres holding arich agricultural history. While approximately halfthe development is comprised of seasonal resi-dents, Nashaquisset off Surfside Road is a magnetfor year-round families. The houses, varying indesign from Cape-style to Federal to Saltbox and others, are moder-ately priced. Homes along Washaman, the main avenue, and the severaloffshoot ways and lanes, are clustered closely together in the patternof Nantucket’s Old Historic District, yet many mature trees, landscap-ing features and the siting of the houses offer privacy in an intimate,neighborhood setting.The sales and rental office for Nashaquisset wasoriginally built in 1800 on Fair Street by Levi Starbuck.

NaushopLike Nashaquisset and the island’s numerous

subsequent residential developments, the homes inNaushop off Old South Road are on small lots andbuilt closely together. It is a design established dur-ing Nantucket’s earliest construction, valued todaybecause it maximizes use of finite open land andlends a friendly element. Homes in Naushop are ofclassic architecture, most framed by white picketfences, arching arbors and with attractively landscaped yards.The side-walks throughout this winding, hilly enclave, with streets named afterbird species, are of brick. Naushop has tennis courts, a pool and a play-ground for use by its mix of year-round and seasonal residents.

PocomoThe turnoff to Pocomo and Wauwinet begins at

a curve on the Polpis Road across from the edgeof Windswept Cranberry Bogs. On the way toPocomo Road, one passes varied, dense and tallvegetation and trees that part occasionally toallow glimpses of harbor inlets.There is quite a bitof conservation property in this area, includingSquam Swamp with its popular walking trails. breathtaking vistas. It is about a 15-minute drive to Siasconset’s sum-mer conveniences and 20 minutes to mid-island or downtown shop-ping. There is also a well-maintained bicycle path from thePocomo/Polpis junction to the Milestone Rotary.

PolpisPolpis is Nantucket’s true countryside. It is an

expansive area where examples of the island’swidely varied habitat and terrain are evident in alltheir beauty and diversity. Traveling along thewinding Polpis Road there are vast stretches ofconservation land, a feast for the eye abundantwith precious and important heaths.This centralarea is protected, and offers generous publicaccess to points high and low, passing through arching copses andreaching the shores of ponds. The homes on Polpis Road, many year-round, are spaced far apart. Some are quite old, some newer; some aretiny cottages while others are estates with guesthouses. Some are snug-gled in small valleys or among trees and some sit perched atop rises,lending spectacular views up and down the harbor.

QuaiseNot long after turning left off Polpis Road on

to the well-maintained dirt Quaise Road, there isa small pond on one side and a wetland area onthe other side. Among the low hills banking theway are many cedars, pines and scrub oak grow-ing on both private and conservation properties.The mostly seasonal homes here are fairly mod-est in scale. At the road’s end, houses perchabove the harbor with views up to Polpis andWauwinet.This is a quiet, quite rural location with plenty of open skyfor sunsets and star-gazing. Just past Quaise Road is Quaise PastureRoad, holding a surprise treat of its own.This road is paved part of theway, but the dirt stretch is essentially smooth.Weathered split rail fenc-ing lines the road where just a few seasonal homes are spaced far apartwith open land in between. At the end, the harbor is seen over a crestpast the entrance to private property and directly next to theNantucket Conservation Foundation’s wooded walking trails throughMasquetuck Reservation, open from sunrise to sunset.

QuidnetQuidnet is home to just a few year-round

residents, and is a peaceful part of the island sit-uated between Squam and Siasconset. At theend of the main road, a left turn leads to Squam.Straight ahead there are houses bordering theAtlantic and to the right is a slope that bringsyou to the shore of Sesachacha Pond. Thehomes on the hill and opposite the pond arenicely kept and appealing, but not elaborate indesign.Though these homes are predominantly seasonal, people enjoythe island’s largest saltwater pond all year. It is a clean pond and suit-able for swimming. A long, grassy dune area separates the pond fromthe ocean side of this small, picturesque community.

SiasconsetTime and again, people have said, “Nothing will ever replace

‘Sconset.” Entering this small hamlet on the island’s eastern end is likestepping into the past. Narrow, one-way lanes are lined with low, rose-

covered cottages dating to the eighteenth andearly nineteenth centuries. In the village center,there is a post office, a seasonal convenience mar-ket, a real estate office, a small package store, a caféand Claudette’s for breakfast and lunch. One streetover, the pretty ‘Sconset Chapel is a popular placefor weddings.The Summer House, overlooking theAtlantic Ocean, offers lodging, dining and drinks bythe pool. Fine dining is available at The Chanticleer.There are also ten-nis courts adjacent to The ‘Sconset Casino, where live performancesare staged and films are shown throughout the summer season.The vil-lage also has its own fire department. At the bottom of a hill there isa small playground with swings facing a peaceful expanse of oceanstretching to Spain. This area is appropriately called Codfish Parkbecause fishermen once hauled in cod at this location, with some livingin what amounted to mere shacks across the way from the beach.Reaching higher ground again, the effects of erosion along ‘Sconset’sbluff are dramatically evident. This act of nature prompted a majorundertaking three years ago to relocate Sankaty Lighthouse fartherinland to protect the historic and functional landmark. Sconset is hometo the Sankaty Head Golf Club, one of the few, true world-class linksstyle golf courses, and the 9-hole Siasconset Golf Course.

ShawkemoThe Shawkemo Road, a short distance before

the Shipwreck and Lifesaving Museum off PolpisRoad, is partially paved, lined with mature cedarsand pines and stretches between the scenic, gentlyrolling Shawkemo Hills.The properties in this ruraland mainly seasonal area are impressive, and sitedon generous parcels of land, so that there is plen-ty of privacy.The road eventually opens onto PolpisHarbor; however, it is wise to reach this locationby four-wheel drive. Soon after the pavement turns to dirt, the roadnarrows to barely one lane and is unimproved with few places to pullto the side for an oncoming vehicle. If peace and quiet is what isdesired, it will surely be found here.

ShimmoOn the left, off Polpis Road, just before the entrance

to Moors End Farm, is Shimmo Road.Tall, healthy nativepines line the long and winding dirt way, which meas-ures two lanes wide. A smattering of the attractivelydesigned and spacious Shimmo homes are occupiedyear-round, but most are contemporary summerretreats.After driving a fairly short distance the harborcomes into view. Shimmo is primarily residential andrural in nature, yet is convenient to the Polpis family-owned farm and a quick drive to mid-island shopping.

South of TownThere is some overlap in areas designated to be south or west of

town proper, which fall within the mid-island category. The southernarea before Surfside includes Vesper Lane off Atlantic Avenue, the begin-ning of Fairgrounds Road and Bartlett Road with its many offshootssuch as Friendship Lane and the Mizzenmast development wherestreets have nautical names.This location consists of moderately pricedhomes, many in the familiar Cape-style and is widely populated by year-round residents. It is near the hospital and mid-island shopping andschools, as well as close to emergency assistance.

SquamWild grapes are prolific in Squam, a decidedly

rural area home to a mix of year-round and sum-mer residents. The long, dirt road, occasionallytoo narrow for cars to pass, reaches from theWauwinet Road to Quidnet Road. It presentsbeautiful and restful views of the Atlantic onNantucket’s eastern shore from houses situateddirectly along the beach, as well as upside-downhomes with second floor views on the inland side.Squam is convenient to Quidnet, the small enclave along SesachachaPond, a saltwater pond favored by families with young children.

SurfsideWhile a number of year-rounders live in Surfside, the relentless

ocean winds that whip across the area’s grass-lands and keep trees and vegetation hearty andlow are part of the reason this location is hometo a majority of seasonal visitors. The openexpanse of sky is one of the best features of thissouthern part of Nantucket.There are sweepingvistas of the rolling Atlantic visible from small,rustic cottages near the bluff, as well as fromupside-down houses with high decks that take in the surrounding beau-ty. Heading east, Surfside and its popular family beach rolls intoNobadeer, a mecca for teens and young adults where uninsulated,unadorned but cherished old shoreline homes dot the landscape.Goingwest, Surfside joins with Miacomet Beach, another favorite family des-tination.The Surfside area is residential except for a seasonal conces-sion stand, open during the summer, in the main beach parking lot.

Tom NeversUpside-down houses with sizable yards and spacious decks over-

looking the sea and sizable yards are scatteredthroughout the wide expanse called Tom Nevers,off Milestone Road and about five minutes awayfrom the village of Siasconset.While there are anumber of seasonal homes in the area, there isalso a high population of year-round residents.Since the properties in this area are affordable,building continues where open land still exists.Despite its density,Tom Nevers has a rural atmosphere.You might heara rooster crow, and many bird species enjoy the habitat.At the end ofTom Nevers Road, there is a playground on the former Navy base. Inthe summer, the traveling carnival sets up there, and this is where theisland’s annual Demolition Derby is held.Tom Nevers and its road alongthe bluff are close to the beautiful beach and approximately 10 minutesfrom mid-island shopping. The beginning of the main road intersectswith the Milestone Road bicycle path, and a shuttle bus stop shelter isacross the road.

TownThere is a special quality of living in Nantucket Town. One distin-

guishing feature is the wealth of historic structures, documented andhonored whether they are former whaling captain’s homes or werebuilt for utilitarian family living. Being in the heart of town is peacefuland lends a sense of protection from the elements, one of the originalreasons homes were built so close together. Most streets, reachingfrom upper Main to Fair, Pine, Jefferson and across town to Centre and

others, are home to locals who stay all year. Livingin town means more activity on holidays and in thesummer tourist season, but many enjoy the influxof visitors after a long and quiet winter. Living inthe town district also means easy accessibility togovernment offices, a grocery market and othershopping, a variety of fine restaurants, theater,movies, concert performances and traditional cel-ebrations. If a town home is without a driveway, parking stickers areavailable at the police station.

TuckernuckTuckernuck Island off the mainland’s western coast is about as rural

as it gets for Nantucket living. No electricity, run-ning water or paved roads exist on this windsweptspit of sand measuring five miles long and holdinga mere handful of simple, low houses.Travel to andfrom Tuckernuck is by boat, so it is best to checkthe supplies list a couple of times before headingback after a trip to the supermarket. In 1996, theTuckernuck Land Trust was founded by itslandowners and citizens concerned about protecting the island’s spe-cial, unfettered character rich in natural beauty with a pristine environ-ment necessary to maintain undisturbed communities of flora andfauna. Many of Tuckernuck’s properties now have permanent conserva-tion restrictions.This is a place where man and nature join in harmony.

WauwinetWauwinet literally marks the end of the road, with only a handful of

houses up the beach after passing The Wauwinet.There are a few seasonal homes between the gate-house, where beach driving permits may be pur-chased, and the last of the pavement. For most ven-turing to this far northerly tip of the island,Wauwinet is the entrance to Coatue and Coskata,where wildlife is abundant and lives undisturbed. Itis also the approach to Great Point, a favorite fish-ing and recreational destination. From the point, and along the way,there is a clear view across the channel to Pocomo and down harborto Polpis.

West of TownThe areas to the west of town include West Chester Street, one of

the earliest developed.Today,West Chester Streetboasts gigantic, old trees shading the way, and theoriginal Cottage Hospital building, now sold ascondo units. This area reaches to Vestal Street,starting with Maria Mitchell properties and endingin rural-type lots on a peaceful dirt road. It alsoincludes Millbrook Road, reachable off MadaketRoad and Hummock Pond Road, and New Lanewith its historic cemeteries. Off New Lane isWoodbury Lane, a relatively recent cluster of classic home styles. AsNew Lane leads onto Madaket Road, there is another sparse, recentdevelopment to the left which abuts Dukes Road, a long, well-populat-ed dirt way very rural in nature.

The Board is responsible for insuring that licensed home inspectorshave proper training and experience through an education programand meet minimum inspection requirements in each inspection per-formed.Applicants are required to pass a board approved examina-tion prior to licensure and fulfill continuing education requirementsfor license renewal.The Board publishes a Standards of Practice andCode of Ethics for home inspectors.

About Home InspectionsA standard home inspection is a visual examination of the physicalstructure and major interior systems of a residential building con-sisting of one to four dwelling units.An inspection can be likened toa physical exam by a physician; however, it should be clearly under-stood that a home inspection is not to be confused with an apprais-al, a building code inspection, a guarantee of any kind, and/or aninsurance policy on the condition of the property.

During an inspection, the inspector will review the readily accessi-ble exposed portions of the structure of the home, including theroof, the attic, walls, ceilings, floors, windows, doors, basement, andfoundation as well as the heating/air conditioning systems, interiorplumbing and electrical systems for potential problems.

Home inspections are not intended to point out every small prob-lem or any invisible or latent defect in a home. Most minor or cos-metic flaws, for example, should be apparent to the buyer withoutthe aid of a professional.

Timing of the Home InspectionA home inspector is typically hired by a potential homebuyer rightafter the offer to purchase contract is signed, prior to executing thefinal purchase and sales agreement. However, before the potentialbuyer signs the offer to purchase contract, he/she should determineif they want to have an inspection clause in the contract making thepurchase obligation contingent upon the findings of a professionalhome inspection.This clause should specify the terms to which boththe buyer and seller are obligated.

Selecting a Home InspectorGood referral sources for home inspection services are friends,neighbors, or business acquaintances who have been satisfied witha home inspector. In addition, lawyers and mortgage brokers may alsorecommend a home inspector.The names of local inspectors can befound by searching the Division of Professional Licensure website atwww.mass.gov/reg/boards/hi, or in the Yellow Pages where manyadvertise under “Building Inspection Service” or “Home InspectionService.”

Real estate brokers and salesmen may not directly recommend a spe-cific home inspection company or home inspector unless representingthe buyer as a buyer’s broker. Brokers, however, may provide assistanceto buyers in finding information on licensed home inspectors.

A current home owner may also want to get a home inspection toidentify any problems, especially if the owner plans to sell the homein the near future.

Following are additional tips when searching for a home inspector:

• As of May 2001, home inspectors are required to be licensed inthe Commonwealth of Massachusetts. A home inspector’s licenseshould be verified prior to hiring. Consumers should not be confusedby home inspector “certifications” offered by, or sold by home inspec-tion trade societies or companies, obtained via home study courses,or provided by home inspection companies that certify their ownhome inspectors. Since the home inspection business is unregulated inmost states, certifications are available to anyone. A home inspector’slicense can be verified with the Board of Registration of HomeInspectors at its website or by calling the Board at 617-727-4459.

• The home inspection company that is retained should welcomethe potential buyer’s presence at the home inspection. The homeinspector should be willing to address all of the buyer’s questionsand provide a full verbal and written report.• Those hiring an inspector should expect an open door policy fromthe home inspection company to be able to ask questions about thecontent of the home inspection report in the future.

During the Home InspectionWhile not necessary, it is recommended that the buyer be presentfor the inspection.This allows the buyer to observe the inspector,ask questions directly, and obtain a better understanding of the con-dition of the home, how its systems work, and how to maintain it.The written report may be easier to understand if the buyer waspresent during the inspection.

It is important that safe access and sufficient lighting is provided sothat the inspector can inspect the property.

Inspectors must provide a written evaluation report based on thestandards of compliance in accordance with Massachusetts GeneralLaws Chapter 146.

At the conclusion of the home inspection, the buyer should be wellinformed of the condition of the home. It should be known if thereare visible, apparent problems, if repairs need to be made, orwhether or not there are any risks of concealed damage, andwhether further investigation is recommended and/or required.

Other Inspections and Tests to ConsiderIt is strongly recommended that potential buyers consider havingthe following inspections and/or tests performed prior to signingthe final purchase agreement:• Lead paint.The seller, under CMR 460.750(A) shall disclose if theproperty has been inspected for lead paint and provide copies ofany lead paint reports prior to signing the final purchase agree-ment.• Water quality (Is it drinkable)• Wood destroying insects, including termites• Air quality, including radon gas • Fungi, mold and allergens• Seller required, under 105 CMR 651.010, to provide the poten-tial buyer with an affidavit disclosing the presence of UreaFormaldehyde Insulation if it exists.

While some home inspectors are qualified to offer these services,these inspections and tests are not part of the basic home inspec-tion and should be contracted through qualified licensed profes-sionals in those fields.

Filing a ComplaintWhile most licensees conduct themselves as true professionals, theDivision of Professional Licensure will take action against thoselicensees who fail to maintain acceptable standards of competenceand integrity. In some cases, complaints are made by dissatisfiedconsumers, however, dissatisfaction alone is not proof of incompe-tence or sufficient grounds for disciplinary action.

Fuel: There is no municipal gas supply but there are several privatesuppliers of heating oil, kerosene, diesel fuel and propane gas.

Post Office: As of 2010 there are 3 post offices: the main build-ing is at 5 Federal Street (508- 228-1067), the branch is at 120Pleasant Street (508-228-4143) and the Sconset location is on theSquare (508-257-4402).The postal annex for pick-up of oversizedpackages is at 155 Old South Road (508-325-5682).

Real Estate and Personal Property Taxes:The mil rate is fair-ly low (2009 was $2.76/$1,000 assessed value for residential prop-erty) compared to most other areas of the country. It changeseach year depending upon the annual budget and the amountscoming to the town and county from state and federal sources.Real estate is re-assessed every three years.The tax year is fromJuly 1 to June 30. Bills are issued twice a year and are due within30 days. Water: The Wannacomet Water Company is owned by the Townof Nantucket.Water comes from artesian wells in the well fieldsbetween Old South Road and Milestone Road. Pressure is main-tained on the opposite side of town by the water tower on CliffRoad near the Madaket Road intersection.‘Sconset has a separatewell field near the ballpark. Water mains extend throughout thecenter of town and private wells are used elsewhere. Our watertends to be of an excellent quality and is quite soft. If you wouldlike to have the well water tested there is a nominal fee and ittakes about seven to ten business days to get the results.

Sewer Fee: Buildings are either conected to Town Sewer or aseptic system. Buildings that are conected to Town Sewer arecharged a sewer fee by Wannacomet Water Company based onwater consumption. Buildings that are on septic systems are notcharged a sewer fee; however, maintenance of septic systems isrecommended, if not required, to ensure they function properly.

Septic Systems: Other areas have individual, in ground, septicsystems, usually with leach pits or leach fields.The majority of theIsland has permeable beach sand which is an excellent natural fil-ter. The Land Bank has worked to accomplish its legislated purpose byactively competing in the open market to acquire land which pro-vides the public a wide range of opportunities. Land Bank holdingscurrently include beaches, wetlands, aquifer recharge areas, moor-lands, heathlands, rare species habitat, ocean, pond and harborfrontage, and properties for passive and active recreation.To date theLand Bank has committed more than $106 million dollars to land pro-tection,acquiring over 2,218 acres,with an additional 105 acres perma-nently protected by conservation restrictions. It is funded by collectinga fee on each Nantucket County real estate transfer. It is operated bya five member, publicly elected, body. Currently, a buyer pays 2% ofthe purchase price to the Land Bank.A property transfer goes firstto the Land Bank and then is recorded at the Registry of Deeds.The IRS has ruled that this fee cannot be deducted as a sales taxbut is added to the purchase price.

WORKING WITH THE HDC:POLICIES AND PROCEDURESThe Historic District Commission has existed since 1955, whenthe Nantucket community voted to implement official historicpreservation procedures to protect and preserve historic build-ings, places, and districts.The measures were based on the expect-ed economic benefits from tourism revenues resulting from thecommunity’s maintenance of its historic and cultural resources.

“Building with Nantucket in Mind” is the official HDC guide-book. It is essential reading for all architects, builders and personsplanning to build or to purchase property on Nantucket as well asall residents who wish to maintain and renovate their houses orcommercial structures.The unbound guidebook is available for afee at the office on the second floor of the Town Annex, 37Washington Street, Nantucket, MA 02554.

• There are five elected regular commissioners and three electedalternate members. Commissioners serve staggered three-yearterms.• The HDC reviews all exterior changes and new construction onNantucket Island according to the Commonwealth ofMassachusetts Acts, 1970, Chapter 395, as amended (Appendix A,Building with Nantucket in Mind). THE APPROVAL PROCESS

Staff ReviewAfter the information listed on the back of the application form issubmitted, the staff checks for completion and date-stamps thedocuments, noting the date, 60 days from receipt, by which theHDC is required to take action. A staff recommendation sheet iscompleted and added to the file. The most complex applicationsare assigned specific appointment times at the Tuesday night meet-ing.

HDC meetingsRobert’s Rules govern the meetings. A majority vote is necessaryfor approval. Approved applications are assigned Certificate ofAppropriateness numbers.The Commission may request addition-al information, revisions, or a site visit to determine any visualimpact from the “travelled way”, which is the legal definition forthe HDC’s jurisdiction.

The HDC’s schedule revolves around weekly Tuesday meetings,held from 5 to 10 p.m. in the Cyrus Peirce School Cafeteria onSurfside Road. The meetings alternate each week from NewBusiness (New Applications) to Old Business (PendingApplications). Pre-agendas are available at the HDC on Tuesdays.If the Agenda was not completed on Tuesday night they continueon Thursdays. These Thursday meetings are generally held in theConference Room at the Town Annex Building on WashingtonStreet.

Applications Deadlines are every other Friday at noon. New applications sub-mitted are heard, in the order they were submitted to the HDCoffice, at the following “New Business” meeting, which is approxi-mately 11 days following the deadline. The eleven days gives theoffice time to process the application. The HDC is not alwaysrequired to notify abutters concerning pending applications.

Approvals If an application is approved, the staff will process the paperworkby the end of the following business day.Two copies of the plansare stamped and returned to the applicant.The third copy is keptin the HDC files.That copy is used when the HDC conducts thefinal on-site inspection of the completed work.

Building Permit/Certificate of Occupancy When the project is completed, the owner/agent should call theHDC office to arrange for the final inspection and sign-off on the

Building Permit/Certificate of Occupancy. An HDC inspector isrequired to visit the site within five working days from the date ofrequest.The inspection involves a visual survey of the exterior ele-vations and any HDC-approved site improvements, including fenc-ing, gates, walls, etc.The Building Permit may be signed on the site,or the owner/agent may have it signed at the HDC office follow-ing the inspection. If the HDC inspector determines that the workis incomplete or in violation of the original approval, the propertyowner is notified.

Where can I find information about a structure’s history? The HDC has survey forms with information about most of thestructures which were built on Nantucket before 1945.The sur-vey forms include a photograph of the structure, a conditionassessment, and some historical references. Dates of construction,original owners, and brief histories might be found on the surveyforms. More detailed research material is available at theNantucket Historical Association’s Research Center, located in theFair Street Museum. Call 508-228-1655 for hours, which are lim-ited in the off-season.

How do you process an HDC application? The deadline for submitting new applications and related docu-ments is every other Friday at noon, in order to be on Tuesday’sHDC meeting agenda eleven days later.

Why does the HDC have different responses to similar requests? Each application is reviewed according to its context, meaning thatno design is considered as an isolated object.The guidebook sep-arates the Island into settled (town or village) areas, unsettled(outlying) areas, and considers topography and vegetation factors.Each area’s characteristic features are considered.

How high can I build my house? Height is measured from finished grade to roof ridge. (Any changefrom existing grade must be noted on the application form.) Allstructures on Nantucket (exceptions for utility towers, etc.) arelimited by the zoning by-law to 30 feet. To avoid inappropriatelyimposing masses on Nantucket’s open landscape, one-and-a-half-story ridge heights are often required, unless deed restricted.
