REVIEW OF DEVELOPMENT PERMIT APPLICATION

The Town has received a development permit application to develop a secondary suite in the propertythat is currently being redeveloped at 4730 - 48 Street. As secondary suites are listed as adiscretionary use in the General Residential District (R2), this application has been referred to theMunicipal Planning Commission for decision.

The subject property is located in east Olds and is in the General Residential (R2) land use district.Normark Homes is currently in the process of redeveloping the older home at this location. Theredevelopment includes a large addition on the east side of the existing house. Attachment 3 showsthe site plan and elevation drawing of the redevelopment as per approved DP1 9-127.

The applicant is proposing a 454 ft2 secondary suite in the basement of the redeveloped dwelling.Land Use Bylaw 01-23 (LUB) stipulates that the maximum gross floor area to be used for a secondarysuite is 80 m2 (S64 ft'z) and shall not be more than 4Oo/o of the gross floor area of the principal dwellingunit. The gross floor area of the main floor of the redeveloped dwelling will measure approximately1474 ft2 in total. The proposed 454 ft2 represents 31% of the dwellings gross floor area. The applicanthas met the requirement of secondary suites floor area in the LUB.

The LUB requires two (2) off-street parking stalls for the principal dwelling, and one (1) off-streetparking stall for the secondary suite. The applicant proposes to provide all parking stalls required inthe rear yard.

Twenty (20) area landowners were circulated with regards to this application. At the time of writing thisreport, no letters of concern were received.

The Development Officer supports approval of this application because the applicant has met therequirements of the Land Use Bylaw. Also, in the opinion of the Development Officer, thedevelopment of a secondary suite in this dwelling would not unduly affect the use and enjoyment ofthe neighbouring parcels of land.

RECOMMENDATION: That the Municipal Planning Commission approve Development Permitapplication 19-130 as presented, subject to the conditions listed in the aftached draftDevelopment Permit.

This application is classified as aHome Occupation Class 2 because clients will visit the home and is therefore a 'discretionary' use. Theapproving authority for this application is the Municipal Planning Commission (MPC).

Van Anh Diep proposes to provide salon services for up to 5 days a week (Monday to Friday) betweenthe hours of 1Oam andT pm, for up to 8 clients per day, by appointment only.

Regarding parking, the applicant parks their vehicle/s in the rear yard off the lane. There is streetparking available for the clients of the Home Occupation.

REVIEW OF DEVELOPMENT PERMIT APPLICATION

Development Permit application 19-148 is for a change of use to the 'public & quasi-public' use at#1, 4513 - 52 Avenue (Mountain View Plaza). The proposal is to use the space as a church. Thisapplication is being circulated because the use is listed as a 'discretionary use' in the Town's LandUse Bylaw. Therefore, the application is being referred to the Municipal Planning Commission (MPC)for decision.

ln the Town's Land Use Bylaw, the definition of "public and quasi-public use" is:a use of land or a building for purposes of public administration and service and shatt atsoinclude a building for the purpose of assembly, instruction, culture, recreation or othercommunity activity.

The Home Church proposes to use the space for their church services and meetings. The services,which will be for up to 350 people, will be held on Sunday mornings. Throughout the week, it's likelythat the space will be used for various meetings, including groups varying from 25 to 40 people.

According to the Land Use Bylaw formula of 1 stall per 4 seats, the Church will need approximately 88parking stalls for a Sunday service. The mall parking lot has 160 parking stalls.

Four (4) area landowners were circulated with regards to this application. At the time of this writing,no communications expressing concerns or issues were received.

The Development Officer is of the opinion that this use, especially if primarily used on Sundays, wouldnot, unduly affect the use and enjoyment of the neighbouring parcels of land and, therefore, supportapproval of this application.

RECOMMENDATION: That the Municipal Planning Gommission approve Development Permitapplication 19-148 as presented, subject to the conditions listed in the attached draftDevelopment Permit.
