website of ZRTI and Northern Railway i.e. www.zrti.in and www.nr.indianrail.gov.in. If the

Tender form is downloaded from the Website, the Tenderer must attach a DD of Rs.1,000/- only

from Nationalized Bank of India in favour of Sr. Divisional Finance Manager, Northern Railway,

Moradabad.

the form of Money Receipt for each Tender Document in favour of Sr.DFM/MB.

2. Completely filled Sealed Tender Forms can be dropped in the TENDER BOX kept in the

chamber of Vice Principal, Zonal Railway Training Institute, Chandausi on 22.06.2015 upto

14:00hrs, which will be opened at 15:30 hrs on same day in presence of the tenderers or their

representatives. If the day of opening of tender is declared holiday, the same procedure shall be

adopted on the next working day.

3. Earnest Money shown as above shall be deposited in the form of Fixed Deposit Receipt or

Demand Draft issued from Nationalized Bank of India only, drawn in favour of Sr. Divisional

Eligibility, Terms & Condition for Tendrer. 1. Tender will open for 90 days from the date of opening. However this work is proposed

for 3 Years on tender basis but the period may be extended upto 3 months. If the work is

not satisfactory Contract may be terminated with immediate effect and security will be

forfietted.

2. Only Experienced Contractor/Firms who have adequate experience for such type of work

are elligible to apply and contractor must be attached experience certificate with tender

document.

3. Firm/Tendrer should have adequate and secure compound and source of clean water in

chandausi area for the purpose of dry & cleaning of linens and above said Land, water &

Electric connection must be in the name of contractor, copies of of Land record, water &

Electric bill must be submitted with tender document, in the absence of these documents

tender will not consider and Tendrer should also have expereince for the same type of

work in Government/Non government sector.

4. Required earnest money will be 4340/- such amount accepted only in the form of FDR,

DD or Pay order issued by any Nationalized bank in the favour of Sr. DFM/Moradabad,

EMD must be submitted with tender form other wise tender form will not accept.

5. Before submiting the tender the tendrer should visit the ZRTI and to observe the nature

and scope of work. After that tenderer submitt the tender form with availability of 90

days.

6. Tender will drop only in sealed envolope endorsed the name of work on 22.06.2015 at

14.00 hrs. in tender box kept in the Chamber of Vice-Principal, ZRTI/Chandausi, Tender

will open on same day at 15.30 hrs.

7. Inspection:- Before the handing over the work to Firm Railway officer/represantative

will inspect the site for the purpose of ensuring availability of resourses/equipments.

Inspection may be conducted time to time by Railway officer/represantative to ensuring

the compliance of Terms & Conditions of Tender. The contractor must be present at

inspection site.

8. Successful Tenderer must be deposited performance guarantee which is the 5% of Tender

Value in the form of FDR or DD issued by any Nationalized bank in the favour of Sr.

DFM/Moradabad, Performance Guarantee must be submitted.

9. Security Money is the 5% of Tender Value. Earnest Money treated as the part of Security

Deposite rest 3% of security Deposite will be deducted from the running bill @ 10%.

10. Contractor must be affix his signature on each page of tender form.

Schedule of Work-II Terms & Condition for Receive and back of used linen under Principal, Zonal Railway Training,

Institute, N. Rly., Chandausi.

1. The contractor or his representative will collect the used Dirty Linen (Pillow cover, Blanket

woolen, Towel, Curtain) from pre-fixed place at ZRTI campus by nominated

supervisor/reprasentative, after well check-up the condition of cloth (Pillow cover, Blanket

woolen, Towel, Curtain) as cut/teared ; and same provision will be adopted when washed &

cleaned Bed Sheets will make over to ZRTI’s represantative. ZRTI’s represantative will check

condition of linen ( as stain, cut/teared and properly pressing etc.) When he will take over

washed linen. Contractor may be ensured supply of cleaned & washed linen daily basis except

Sunday and other Gazetted Holidays at ZRTI/Chandausi.

2. A) Cleaning & washing Work will be done in clean and hygeinic condition with fresh water.

Contractor will use Clax rinse or equivalent detergent made by reputed/standred companey. For

the purpose of washing use of Coastic Soda/Sodium Hydro-oxide is totally banned. To avoid bad

smell from linens contractor will use standrad perfume as and when required.

b) Ezee or equivalent dettergent should be used for washing and cleaning of woolen blanket.

c) Pressing quality should be good and rinkle free.Bedsheets are folded in longitudnal.

3. Penalty/ Responsibility in case of damage and deficiancy:- a) If the linens are not Dry &

washed improper manner as per work of schedule and not handed over to Rly. Admin. (in 48 hrs)

in time, the supervisor may impose penalty maximum up-to Rs. 1000/-perday.

b) If the linen missed/damaged in the coustody of contractor, the contractor will pay the full cost

of linen and as panalty 25% total cost also be paid by the contractor

c) Railway Represantative is fully impowred to reject the improper dry/washed and

pressed linen. Such type of linen will be rewashed by contractor on his own cost, for rewashing

work Railway will not pay any amount. If the bed Sheets find improper washed penalty will be

imposed on contractor @ maximum Rs.15/- per Blanket, Rs.2/- per Pillow Cover, Rs.2/- per

Towel, Rs.5/- per Curtain.

4. Labour cost:- Railway administration will pay to contractor for all cleaned and washed linens as

per quoted rate by contractor in Schedule of rates. For this purpose railway administration will

maintain a register and number of washed/cleaned linen will be endorsed in this register. For the

purpose of above clause, the entries in this register are full & final.

5. Quality Audit:- Railway administration will empowred to inspect the firm for the purpose of

check to washing quality of linens during contract period.

6. Tender is valid for 3 years from the date of issue of acceptance latter the contract period may be

extended up to maximum 3 months by Railway administration. If the work is not satisfactory

tender may be terminated any time in the notice of 24 hours. Principal, ZRTI/Chandausi will fully

impowred for that.

7. Terms for payment:- For work done by contractor in this contract, contractor will produce bill

for three months before 5th day of next month. Appropriate income tax, security money and

penalty( if any) etc. Duly deducted in this bill. The bill produce in triplicate on approved

proforma with mesurement book, jointly prepared.

8. Above said bill (In triplicate) with MB send to Sr. DFM/Moradabad for payment. This payment

will made by Cheque/RTGS/NEFT for the purpose of payment contractor will produce the RTGS

form issued by Bank & photocopy of PAN card.

9. Transfer & sublating of Tender is strictly prohibited other wise contract may be terminated and

10. CONTRACTOR shall thoroughly familiarise him self about the provision of the contract

labour act 1870 and other concern following act and will fully responsible for

compliance.

11. Contractor will not apoint minors (below 18 years) directly or indirectely for the washing

of linens or any work the labour should wear I/Card all time issued by contractor.

Labours are well deciplined and will not involve in any activity caused harm to Railway

reputation or property for such type of activity the contractor will responsible.

12. In case of death of contractor as per agreement or appropriate legal successor certificate

will be produced by wife, Husband, Son, Widow depandent Daughter or Daughter In-

Law may complete the work on descrition of Railwy Administration.

13. Any additional changes in agreement may be made by mutual commitment. In case of

changing about equipment firm’s Adress, Phone No. etc. must be informed to Railway

Administration with-in 7 days

14. In addition of above terms & Condition General Condition of Contract 1999 and

modifications till date on Northern Railway will also be applicable.

15. Place, washing facilities, washing material, labour, transportation cost and other

expenditures will be born by contractor for the compliance of this agreement

” Contractor will not entitle of any type of Passes over Railway”.

16. In case of any kind of dispute COM/G’s decession will full & Final.

17. in addition of above condition Indian Judicial Act 1940 will also be effected with all

Amendments made time to time.

PART- I: GENERAL CONDITIONS OF TENDER

1. The Tenderer (s) shall quote his/their rates with reference to each item and must tender for all the items shown in

attached schedules. The quantities shown in the attached schedule are given as a guide and are approximate only and

are subject to variation according to the need of the Railway. The Railway accepts no responsibility for their

accuracy. The Railway does not guarantee works under each item of the schedule.

2. Tender containing erasures and/or alternation of the tender documents are liable to be rejected. Any correction

made by the tenderer/tenderers in his/their entries must be attested by him/them. No correction ship of type of

script of tender form issued by the Railway will be taken notice of, if the contractor wished to stipulate any

conditions of his own he should state that in writing separately Railway reserves the right not to consider such

conditional tenders and to reject the same without assigning any reasons.

3. EARNEST MONEY:-

a) The tenderer shall be required to deposit earnest money with the tender for the due performance

with the stipulation to keep the offer open till such date as specified in the tender, under the

conditions of tender. Earnest money shall be 2% of the estimated tender value as indicated in

the Tender Notice. The earnest money shall be rounded to the nearest Rs. 10. This earnest

money shall be applicable both for Open & Limited tenders. Facility of lump-sum Standing

Earnest Money (LSEM) available to registered contractors/firms has been withdrawn and

now they have to submit the earnest money separately with each tender, failing which their

offer will be rejected. b) It shall be understood that the tender documents have been sold/issued to the tenderer and the

tenderer is permitted to tender in consideration of stipulation on his part, that after submitting his

tender he will not resile from his offer or modify the terms and conditions thereof in a manner not

acceptable to the In-Charge/Nominated Committee. Should the tenderer fail to observe or comply

with the said stipulation, the aforesaid amount shall be liable to be forfeited to the Railway.

c) If his tender is accepted this earnest money mentioned in sub clause(a) above will be retained as

part security for the due and faithful fulfillment of the contract in terms of Clause 16 of the

General Conditions of Contract. The Earnest Money of other tenderers, shall save as herein

before provided, be returned to them, but the Railway shall not be responsible for any loss or

depreciation that may happen thereto while in their possession, nor be liable to pay interest

thereon.

d) The tender should be accompanied by a deposit made either in cash with CBS Northern Railway,

Chandausi on any working day before 12:00 hours on the last date of tender deposition or in any

of the following form duly pledged in favour of Sr. Divisional Finance Manager, Northern

Railway, Moradabad-:-

(i) Deposit receipts, pay orders, demand drafts. These forms of earnest money could be

either of the State Bank of India or of any of the nationalized banks. No confirmatory

advice from the Reserve Bank of India will be necessary.

(ii) Deposit receipts executed by the Scheduled Banks (other than the State Bank of India

and the Nationalised Banks) approved by the Reserve Bank of India for this purpose.

The Railways will not, however, accept deposit receipt without getting in writing the

concurrence of the Reserve Bank of India

e) The Tenderer(s) shall keep the offer open for a minimum period of 90 (Ninety) days from the date

of opening of tender within which period, the tenderer cannot withdraw his offer subject to the

period of tender being extended further if required by mutual agreement from time to time. Any

contraventions of the above conditions will make the tenderer liable for forfeiture of his earnest

money.

f) It is understood that the tender documents had been sold/issued to the tenderer (s) and the

tenderer (s) is /are permitted to tender in consideration of the stipulation on his/their part that after

submitting his/their tender subject to the period being extended further if required by mutual

agreement from time to time, he will not resile from his offer or modify the terms and conditions

thereof in manner not acceptable to the Railway Administration. Should the tenderer fails to

observe or comply with the foregoing stipulation, the amount deposited as Earnest money shall be

forfeited by the Railway.

g) The earnest money for the due performance of the stipulation to keep the offer open till the date

specified in the tender will be refunded to the unsuccessful tenderer/tenderers. The earnest money

deposited by the successful tenderer/tenderers will be retained towards the security deposit for

due and proper fulfillment of the contract but shall be forfeited, if the contractor fails/contractors

fail to execute the agreements and to start the work within reasonable time (to be determined by

the in-charge/Nominated Committee) after notification of the acceptance of his/their tender.

h) The Earnest money of the unsuccessful tenderer(s) will have as here-in-before provided will be

returned to the unsuccessful tenderer(s) within a reasonable time, but the Railway shall not be

responsible for any lose or depreciation that may happen to the security for the due performance

of the stipulation to keep the offer open for the period specified in the tender documents or to the

Earnest money while in their possession nor be liable to pay interest thereon.

i) No interest shall be allowed on the earnest money and security deposit.

j) If the tenderer is a labour co-operative societies pay deposit 50% of the required earnest money

and security.

k) Deposit receipts, pay order and demand drafts, of the State Bank of India, or any of the nationalized

banks or any of the schedule commercial bank, must have an endorsement from the authority

issuing such PayOrder/DD that “received from M/s. /Shri ____________ and pledged in

favour of Sr. Divisional Finance Manager, Northern Railway, Moradabad.

l) The official cash receipts having a mention of the firm/individual who has deposited the cash or

the deposit receipt mentioned in ‘a’ above etc. as the case may be must be attached with the

tender failing which, the tender will be summarily rejected.

m) It will be responsibility of the firm / individual who has deposited cash that the name of party /

tenderer is correctly spelt out in the money receipt.

n) Any request for recovery from outstanding bills for earnest money against present tender will not

under any circumstances be entertained. Tenderers submitted with earnest money in cheque,

government securities or in any form other than those specified above shall not be considered.

o) Earnest money in the form of Guarantee Bonds shall not be accepted. 4. SECURITY DEPOSIT :-

(a) The Earnest Money deposited by the Contractor with his tender will be retained by the Railways as part of security for

the due and faithful fulfillment of the contract by the contractor. The balance to make up the security deposit, the rates

for which are given below, may be deposited by the Contractor in cash or may be recovered by percentage deduction

from the Contractor’s “on account” bills. Provided also that in case of defaulting contractor the Railway may retain any

amount due for payment to the Contractor on the pending “on account bills” so that the amounts so retained may not

exceed 10% of the total value of the contract.

(b) Total Security Deposit/ rate of its recovery and mode of recovery shall be as under-

(i) Security Deposit for each work would be 5% of the contract value.

(ii) The rate of recovery would be at the rate of 10% of the bill amount till the full security deposit is

recovered.

(iii) Security Deposits will be recovered only from the running bills of the contract and no other mode of

collecting SD such as SD in the form of instruments like BG, FD etc. shall be accepted towards Security

Deposit. (c) This amount will be retained as security deposit free of interest for due & proper fulfillment of the contract. The

contractor will have to maintain the work for a period of 6 months from the date of issue of completion certificate by

the in-charge/Committee in terms of Northern Railway General conditions of Contract. Final bill or bills will be

prepared on the basis of actual work done and Security Deposit (S.D.) will be retained as fresh security deposit free of

interest for six months after the completion of the work as security for the quality of the work and any shortage of

material etc. which may come to light after the completion of work & which the contractor will be liable to rectify or

make good. This amount will be refunded on the certificate given by the in-charge/committee concerned that the work

has been satisfactorily completed.

5. PERFORMANCE GUARANTEE:-

(a) The successful bidder will have to give a Performance Guarantee in the form of an

irrevocable bank guarantee amounting to 5% of the contract value,

(b) The Performance Guarantee will have to be furnished by the successful contractor after the

letter of acceptance has been issued, but before signing of the agreement and it should be

valid up to expiry of the maintenance period. The agreement shall normally be signed

within 15(fifteen) days after the issue of LOA and Performance Guarantee shall also be

submitted within this time limit.

(c) Performance Guarantee will be released after satisfactory completion of the work and

maintenance period is over. The procedure for releasing will be same as for releasing

Security Deposit.

(d) Wherever the contracts are rescinded due to failure of contractor, the security deposit will

be forfeited and the Performance Guarantee will be en-cashed.

(e) Balance work will be got done independently without any further risk and cost of the

original contractor.

(f) The original contractor will be debarred from participating in the tender for executing the

balance work. If the failed contractor is a JV or a partnership firm, then every

member/partner of such a firm would be debarred from participating in the tender for the

balance work either in his/her individual capacity or as a partner of any other JV/

partnership firm.

6. It shall not be obligatory on the Principal ZRTI/CH to accept tender and no tenderer/tenders shall demand

explanation for the cause of rejection of his/their tender.

7. SUBMISSION OF WRONG/FALSE CERTIFICATE -If the tenderer/s deliberately gives a wrong

information/false credentials/documents in his/their tenders and thereby create (s) circumstances for

acceptance of his/their tender, railway reserves the right to reject such tender at any stage, besides, shall

suspend the business with the firm for one year.

8. If the tenderer expires after the submission or his tender or after the acceptance of his tender, the Railway

shall deem such tender as cancelled. If a partner of the firm expires after the acceptance of the tender, the

railway shall deem such tender as cancelled unless the firm retains its character and the railway informed

accordingly and it is satisfied on that account. If the contractor firm is dissolved on account of death or

retirement of any partner or for any reason whatsoever before fully completing the whole work or any part

of it undertakes by the principal agreement, the

partner shall remain jointly, separately and personally liable to complete the whole work to the satisfaction

of the railway and to pay compensation for the loss sustained if any, by the railway due to such dissolution.

The amount of such compensation shall be decided of the General Manager or the railway and his decision

in the matter shall be final and binding on the contractor on the firm expenses.

9. a) The tenderer/contractor shall submit a statement of contractual payments received during last three

financial years and current year on the prescribed proforma as given below. The details shall be based on

the Form-16(A) issued by the employer i.e. the certificate of deduction of tax at source under Section-203

of the Income Tax Act/1961. The photocopies of the Form-16(A) shall be enclosed duly attested by Notary

Public with seal & notarial stamp thereon-

b) Income Tax clearance Certificate:

Under Section 194-C of the Income Tax Act/1961, deduction of 2% plus surcharge as applicable on income

tax will be made for sums paid for carrying out the work under this contract. In case of supply contract for

ballast, deduction of 2% (Two percent) income tax will be made for the sums paid for labour portion only

(i.e. Loading, unloading, stacking, measurement and laying etc.)

10. Tender must be enclosed in scaled cover super scribed tender for ……………………… and must be sent by

registered post to the address of the P/ZRTI Northern Railway Chandausi, so as to reach this office not later

than 14.00 hrs. On 22.06.2015 or deposit in the special box allotted for the purpose in the chamber of Vice

Principal, Zonal Railway Training Institute, Chandausi. The tender will be opened at 15.30/hrs. in presence of

such tenderers or their agents or may elect to be present. In case, for any reasons the office is closed on 22-06-

2015 those will be opened at the same time on the next working day.

11. Non compliance with any of the conditions set forth therein above is liable to result in the tender being rejected.

12. The authority for the acceptance of the tenders will rest with the P/ZRTI/CH who does not bind himself to accept

the lowest or any other tender and no tenderer(s) shall demand explanation for the cause of rejection of his /their

tender. The Accepting Authority reserves the right to split up the work amongst two or more contractors without

assigning any reason.

13. The successful tenderer (s) shall be required to execute an agreement with the President of India acting through

the P/ZRTI/CH or his authorised officer for carrying out this work according to the General Conditions of

Contract/1999 and standards specification for works and material of N.Rly/1987.

14. COST OF TENDER DOCUMENT:The cost of this tender is Rs. 1000/- as indicated in tender notice & Rs.

500/- additional if required by post to cover the registration charges.

(a) Tender documents are available on website of ZRTI and Northern Railway i.e. www.zrti.in and

www.nr.indianrail.gov.in and the same can be downloaded and used as tender document for submitting the

offer. This facility is available free of cost. However the cost of tender documents will have to be deposited

by the tenderer in cash with Divisional Cashier, Northern Railway, Moradabad or in the form of a bank

draft payable in favour of Sr. Divisional Finance Manager, Northern Railway, Moradabad along with

the tender document. This should be paid separately and not included in the Earnest Money. In case, tender

is not accompanied with the cost of the tender documents as detailed above, tender will be summarily

rejected.

15. The tender form is not transferable.

16. That after the work is completed and taken over by the Railway as per terms and conditions of the contract

agreement or the contract is otherwise concluded by the parties with mutual consent full and final payment is

made by the Railway to the contractor for the work done under the contract, the parties shall execute a

supplementary agreement as performance prescribed by the railway administration.

17. Contractor not borne on the list of approved contractor shall submit evidence regarding their financial status and

previous experience and ability to execute the works in the form of certificates from their bankers and officer

under them they have worked in a separate cover subscribed testimonials of

M/s……………………………………………………. copies of the testimonials will not be accept except when

these are attested by Gazetted officer.

18. Tenderers shall specify their business name and shall also attach a copy of the constitution of their firm with

their tender if not already done, In case of firm consisting of more than one partner documents in support of

constitution of the firm including registration & Power of Attorney must be submitted with the tender.

19. The tenderers shall quote one uniform percentage rate for all labour as well as labour & material & material

items of the new Northern Railway. Schedule of Rates/1996. (Subject correction slip issued upon date

separately for each item) has shown in schedule of rates and quantity. The rates should be quoted in figures as

well as in words and if there is variation between the rates quoted in figures and in words, then the lower side

rates will be considered. If more than one or improper rates are tendered for the same item, the tender is liable to

be rejected.

20. All the possible fluctuations in the rates for labour, materials General conditions & other factors of each and

every kind in connection with the execution for the work due to any cause whatever should be considered

before quoting the rates and no claim whatever on this account will be entertained afterwards.

21. The Administration reserves to himself the right at any time after acceptance of the tender to keep back

from the contract & to carry out in other ways or by other agency any portion of the work he may think

fit without assigning any reason.

22. The authority accepting the tender, reserves to himself the right to reject any or all the tenders received or to split

up work amongst two or more contractors without assigning any reasons.

23. The submission of a tender will not constitute a contract actual or implied.

24. The submission of a tender by a contractor implies that he has read and agrees to abide by the conditions therein

stated.

25. Work will be given out at the accepted tendered rates on standard forms & will be subjected to the General

conditions of Contract/1999 and Standard Specifications laid down therein and in the Northern Railway

Standard Specification/1987 with all correction slips issued except in so far as general conditions which have

been modified by the tender conditions.

26. The tenderer(s) are not permitted to change the description of any items appearing at the schedule of items on the

provisions or any clause of additional and special conditions and specifications and such change in the tender

documents will be liable to tender as null and void.

27. Tenders are however permitted to submit a separate statement indicating the changes proposed by them which

are necessary for the execution of the work bringing out clearly the financial effect of the alteration proposed by

them.

28. Contractors should note that any conditions inserted by them anywhere in the tender documents will not be taken

into consideration. They may however make a contention for their special conditions if any in their forwarding

letter to be attached to the tender. The Railway reserves the right not to consider conditional tenders and reject

the same without assigning any reason. Each page of tender papers is to be signed by the tenderer(s) or such

person(s) on his /their behalf who is/are legally authorised to sign for him/them.

29. The contractor shall have to acquaint himself with and abide by all the provisions of the Minimum Wages

Act/1948 and the rates made there under applied to works of road construction & building operation stone

breaking or stone crushing over this Railway situated in the State of Uttar Pradesh. He shall keep relevant

records at the work spot in the prescribed form display the required notices and grant paid weekly holiday etc to

employees concerned and issue wages slips, reported described of provisions of the law by the inspecting

officers of the Central industrial Relations machinery shall be viewed seriously and contractors convicted on

this account by Court of law may be disqualified.

30. The advice of the commencement and completion of the work will be forwarded in writing by the contractor to

the P/ZRTI/CH on the date of commencement and completion of the work giving reference to this agreement.

31. The contractor shall also intimate Director of Supervisor of Labour/New Delhi, the number of men employed by

him that come under the Minimum Wages Act/1936.

32. The contractor shall abide by the resolution that may be informed in the area in which work is to be done

prohibiting the recruitment of local labour.

33. Rates not provided in the Schedule of Rates, Northern Railway/1996, P/ZRTI/CH subject to their sanction by the

Divisional Railway Manager/Moradabad or the General Manager, Northern Railway, New Delhi as the case

may be. These rates either be based on the current market or on the basis of the analysis in the schedule of rates.

If based on the later, the tender percentage rate will also apply.

34. The contractor will be paid for the actual quantities of the approved work done. 35. The contractor shall be responsible for all structural and decorative damage to property and injury caused by

work or his workmen to persons animal or things and shall indemnify the Rly in respect thereof.

36. The contractors shall be held entirely responsible for all works carried out by him until it is finally taken over by

the Railway and he will be liable to be called upon to make good any damage or loss which may occur to the

building and work by inclemency of weather, floods etc, or due to any other cause during the entire period until

the work is taken over.

37. Subject to as otherwise provided in this contract all notices to be given behalf of the President of India & taken

on his behalf by the Principal ZRTI/Chandausi.

38. The successful tenderer will have to complete the work to the satisfaction of the P/ZRTI/CH. Northern Railway .

They will maintain adequate progress and if in the opinion of the P/ZRTI/CH. Northern Railway the progress

of the quality of work is not satisfactory the P/ZRTI/CH Northern Railway shall have the power to remove the

contractor from the work to consider the contractor as unfulfilled and to penalise the contractor according to the

provision in the Northern Railway General Condition of Contract/1999.

39. When the final bill is prepared, the contractor will give “No Claim Certificate” in taken of having accepted the

payment in full and final settlement of the work done by them. This should imply that the contractor owns

admits and acknowledged of his free will that no more money is due to him in connection with the execution of

the particular contract.

40. If the contractor has any claims he/they should state this in writing to the Principal ZRTI/Chandausi at the time

of preparation of the final bill.

41. Except as otherwise provided a verbal or written agreement abandoning, varying or supplementing the contract

or any of the terms thereof, shall be deemed conditional and shall not be binding on the Railway administration

unless or until the same is endorsed in an agreement or incorporated in formal instrument and signed by the

parties an till then the Railway shall have the right to repudiate such arrangements.

42. Vehicles & equipments of contractors can be drafted by Railway administration without any notice in

case of accidents / natural calamities.

PART-II: SPECIAL CONDITIONS OF CONTRACT

1. No lead lift, loading or unloading or stacking charges will be paid for the contractor’s material that the

contractor is required to bring to site of work for use on the work or for incorporation in the work.

2. The rate quoted by the contractor shall include all payment that the contractor may have to make his own

arrangement for the material to be supplied by him for incorporation in the work for payment of royalty,

terminal, Octroi, charges, sales tax or any other local tax etc. No extra payment shall be made by the Railway

Administration on this account.

3. SUPPLY OF MATERIALS BY THE CONTRACTOR (S):

(a) Materials used in the work shall confirm to the Standard Specifications/1987.

(b) It should be clearly understood that the labour and material rate in the schedule of rates include wastage,

wash way, either due to rains/or storm or floods or any other causes whatsoever. These shall also include

any cleaning ofBedroll(BedSheets) etc, that must be necessary for stacking the material at site of work prior

to their being used on the work.

(c) If only limited area is available at site of work stacking of material may be done at other places not far away

from the site of work. In such cases no extra lead or any other claim for carriage of materials to the site of work

shall be entertained.

(d) To avoid misuse of Railway land by the contractor as per para 3(b) of the tender form the following

formalities shall be observed-

(i) The working contractor shall submit written request for the permission to the use of Rly land near the

site of work.

(ii) The principal should grant permission to writing specifying the area and location.

(iii) The subordinate-in-charge should hand over the possession after proper demarcation. (iv) In case of any unauthorised encroachment on the part of the contractor action as per rule on the subject

will be taken against him.

(v) Before arranging final payment and release of earnest money & security, the Railway land will be got vacated

and certificate to the effect recorded by the In Incharge/Nominated Committee.

4. All material carried by Railway will be responsibility of the contractor & no claim or excuse whatsoever for not

supply of wagon, or material damaged or pilfered or lost in transit shall be entertained. The claims against the

Railway as carried shall be governed by the rules regarding carriage by the Railway on public material.

The contractor shall make his arrangement for accommodation his labour and staff and supply of drinking water

for them.

5. SALES TAX / TURN OVER TAX, LOCAL TAX, etc. -

(A) Sales tax including, turn over tax on works contract, octroi, royalty, toll tax, local tax,

duties/levies as well as services and any other tax levied by central govt., state govt. or

local bodies, as applicable on the date of quoting the rates and any change therein at a

later date, shall be considered to be included in the rates quoted by the tenderer/s in the

tender schedule.

(B) Railways shall deduct the sales tax/turn over tax or any other tax from the contractor’s

bill at the rate as applicable as per rules framed by concerned Govt. /local bodies from

time to time and remit it to concerned deptt. and shall issue a certificate regarding

tax/duties/levies so deducted on demand by the contractor.

6. (a) The rates should be quoted both in words and figures. (b) No passes will be issued to the contractors.

8. At such locations where contractor’s road vehicles are permitted to work by Railway adjacent to the running lines,

an experienced gangmen shall be posted as a flagman at the cost of the contractors to prevent accidents.

9. CONTRACT LABOUR ACT -

(A) The contractor/s shall thoroughly familiarise himself about the provisions of the contract labour act 1870 and

contract labour central Rule/71 and submit a certificate to the incharge of the work indicating weather the

provision of said act and Rules are applicable to him. In case said act and rules are applicable, contractor’s

shall take action indicated para-2.

(B) The contractor/s shall observe all the formalities perform all the act and abide by all the provisions contained

in the Contractor Labour Act/1970 and Contractor’s Labour Central Rules/1971 which is addition to other,

stipulating inter-alia provides that:-

(i) The contractor/s shall keep and maintain necessary register/records, issue employment cards/ service certificates and

display notice in accordance with section 75 to 82 of the contractor labour central rules/1971.

(C) In any case in which by virtue of section 20(2) and 2(4) of the contract labour (Regulation and Abolition)

Act/1971 the Railway is obliged to provide amenities and/or pay wage to labour employed by the contractor directly

or through petty contractor/or male contractors under this contract then the contractor shall indemnify the Railway

fully and the Railway shall be entitled to recover from the contractor the expenditure incurred providing the said

amenities and/or the wages so paid by deducting it, from the security money or from any sum due by the Railway to

the contractor, provided, that if any dispute arises as to the expenditure incurred by the Railway provisions of the

said amenities the decision of the In-charge/Nominated Committee there of shall be final and binding.

10. DEMURRAGE AND WHARFAGE DUES:

Any demurrage or wharfage charges according to the usual scale enforce on the Railway that may be incurred on

Railway wagons/trucks due to contractor falling to unload or load the same on being called upon to de so will be

debited to the contractor account and shall be paid by him to the proper office on demand or deducted from any

sums which may become due to him on the contract from the said security deposit.

11.The contractor cannot enhance his rate originally tendered in case he is called for negotiation with regard

to this work. Such negotiations shall not amount to cancellation or withdrawn of the original offer and the rate

originally quoted will be binding on the contractor.

12. The tenderer should note that any person such as Principal, and the Gazetted Officer whether in Executive duties in

the operating department of the Railway, whether pensionable or non-pensionable are not allowed to work as

contractor, employees of contractor within 3 years of his/their retirement without prior approval of the competent

authority. If any such person is found working as contractor or any employees of a contractor without prior

permission of General Manager on behalf of the President of India after the submission, acceptance, of his/their

tender of award of the contract shall be liable to be rejected/ terminated for breach of tender conditions.

13 The contractor shall sign on each page of the tender documents.

Tenderer/s are free to down load tender documents from Internet at their own risk and cost for the purpose of

perusal as well as for using the same as tender document for submitting their offer. Master copy of the tender

document will be available in the P/ZRTI/CH. After award of work an agreement will be drawn up. The

agreement shall be prepared based on the master copy available in the office of P/ZRTI/CH and not based on

the tender documents submitted by the tenderer.

In case of any discrepancy between the tender documents down loaded from Internet and the master

copy, later shall prevail and will be binding on the tenderer. No claim on this account will be entertained.

16 TECHNICAL AND FINANCIAL CAPABILITY:-

For justifythe technical eligibility and financial capability, only those works which had been executed for

the Govt./ Non Govt. or Semi Govt. organizations shall be considered and the tenderer will submit the

certificate to this effect from the officer concerned duly signed under the official seal. It should be noted

that credentials for the works executed for private organization shall not be considered.
