Section 1: Executive Summary


Section 1: Executive Summary Performance Report for November 2010 Mehring Way is open for traffic, with road construction work shifting to pavement replacement at Joe Nuxhall Way and the bike path installation south of Mehring Way. At the Lot 2 Garage, pile installation is complete, and despite cold weather, crews continue placement of pile caps, shear walls, columns and new slabs. The Developer is on schedule with the commercial and residential construction, with projected move-in of tenants to Current@TheBanks apartments in Spring 2011. The Cincinnati Riverfront Park’s progress continues, with placing slab steel and forming for the first structural slab on grade placement for the Walnut Street Fountain and Grand Stairway, and concrete placement in the Schmidlapp Event Lawn and Stage.

• Safety A total of 1,607 trade workers, Phases 1 and 2 combined, attended site safety orientations to date. The Project passed a significant safety milestone, logging 301,360 work-hours without a lost-time accident as of November 30. Workers continue to demonstrative both the attitudes and behaviors that result in a safe work environment.

• Economic Inclusion As of October 25, 2010, Small Business Enterprise (SBE) construction participation is 35.3% (goal 30%). Minority Business Enterprise (MBE) participation is 17.3%, with Women Business Enterprise (WBE) participation at 2.8%. The combined minority/female workforce participation is 17.85%.

• Budget With minimal work remaining, Phase 1 construction projections are within approved target budget. Phase 2a construction expenditures are projected to remain within the approved budget. No change orders occurred in November that impacted the construction budget.

• Schedule Phase 2a construction, including Bid Package #9 (TC-24) and Bid Package #11 (TC-25), remains on schedule. Successful construction schedule coordination continues among all Project team members working on behalf of The Public Partnership, Cincinnati Parks and the private developer.

Section 2: Schedule Mehring Way opened ahead of schedule and to a regional fanfare on November 5. Lot 2 Garage construction continues on schedule. Private developer is meeting deadlines for apartment tenant move-ins to begin in Spring 2011 and continues earnest marketing efforts for retail and entertainment tenants. Contractors for the Central Riverfront Park’s Walnut Street Fountain and Grand Stairway began preparation for the first structural slab on grade placement. Architect for the Moerlein Lager House is finalizing design, with construction anticipated to begin in early 2011.

Section 3: Development Manager’s Review


Section 3: Development Manager’s Review Phase 1 – Progress Update Positive progress was made on the closeout of Phase 1 work over the month. As previously reported, Bid Packages #1 through #4 have been finalized. The final retainage invoice for Bid Packages #5 and #7 were processed for payment, which will serve to effectively close out these packages. Only Bid Packages #6, #8, and #10 remain open at this time. Bid Package #10 will need to remain open since it includes the signage for the Phase 2 parking facility. On Bid Packages #6 and #8, work on the originally issued punchlists was completed. In addition, the originally scheduled work on the terra cotta material installation was finally completed. THP has reviewed the work and compiled a punchlist that Messer is administering. The team is working to have these items completed before the Christmas holidays. Good progress was also made on resolution of several deficient work items. An agreement on the approach to rework the expansion joint blockout conditions was reached with the Private Developer. Additonally, the Bid Package #6 contractor, Monarch, has documented a proposed remedy for the battered wall condition. This proposal is being circulated to the County and the Parks team, with the hope that acceptance by Parks will resolve the matter. THP has completed its review of the closeout materials and is finalizing all substantial completion documentation. Phase 2 – Progress Update The Phase 2 work of the Parking Facility continues to progress according to schedule.

On Bid Package #9, Messer has been eagerly waiting for Duke Energy to complete de-energizing the existing ductbank in the new Mehring Way area. Once Duke Energy’s efforts are complete, the contractor will then be able to remove the existing ductbank, pave the balance of the road and sidewalk, and install the necessary lighting. Duke is expected to complete their efforts the week of December 13, which will allow for the contractor to begin this balance of work. Four lanes of traffic have been open on new Mehring Way for the last month, and once this last section of roadwork is completed, the road will be open in its entirety. The Bid Package #9 contractor is projecting a completion date of late January 2011 for all of Mehring Way.

Work on the pavement replacement at Joe Nuxhall Way is underway. The trade contractor is coordinating with Parks, the Private Developer, and the City on this work.

The team is currently studying the timing of the start of removal of Theodore M. Berry Way. Contractually, this work was to start at the completion of the Cincinnati Bengals

season. Several new issues have been raised that may impact the timing and/or cost of this work. First, an existing Duke Energy line serving the Freedom Center must be de-energized and removed. Second, the team is confirming the geotechnical design assumptions related to the tieback wall at Theodore M. Berry Way. Third, options for stockpiling dirt for Parks are being studied. On each of these issues, the Project team is gathering information and working towards providing a recommendation to the stakeholders.

Significantly visible progress was seen over the month on Bid Package #11 scope of work involving Lot 2 Garage construction, Freedom Way, and Theodore M. Berry Way. Construction of the H –shaped pile caps and walls proceeded during the month, as did the construction of the more typical pile cap and column configuration in the northeast side of the Lot 2 site. All 500 level pours of Freedom Way were completed, as were two pours on the eastern edge of the project site. Work will continue in a counter-clockwise direction over the coming months, with the focus on getting the northeast corner completed. The northeast area will allow for commencement of some of the critical path components for the project, including elevators and exhaust shafts.

The Project Team is currently exploring options to expedite the delivery of Freedom Way West by two months, with the completion date by August 1, 2011. This measure will allow for the new roadway to be open and operational prior to the start of the Bengals 2011-2012 season. The Project team is in the early stages of this analysis, and will be suited to make recommendations to the stakeholders in the coming weeks. Messer has been working to procure the submittals for the Freedom Way East head house. The team is working to have this information reviewed and returned to the trade contractors prior to the end of the year so that materials can be placed on order. The head house is targeted for completion by Opening Day 2011. Safety continues to be a tremendous success for the Project. The Project has now exceeded 300,000 manhours worked without a lost time accident. This continues to speak to the impressive focus on safety by the Project team. Weekly site inspections continue to be favorable, with only minor items being cited.

With the recent completion of the Roebling Bridge re-painting, Theodore M. Berry Way work, and Mehring Way, fewer changes in traffic flow around the site have been required over the last month. However, the team continues to work with the City and County to ensure that the environment is safe for patrons and the general public. Messer continues to proactively work with the trade contractors on preparing the perimeter of the site area when games or special events are scheduled. Items such as temporary protection, sequencing, and pedestrian routing are reviewed and discussed so that the impact to the public and operations is minimized. Quality is also a ongoing focus of the team. Through the services of four independent testing firms and various City and County inspections, ongoing and completed work is evaluated. As deficient items are raised, they are tracked on a deficiency log. A request for information (RFI) is issued to the design team for their input on the item. All parties

are working to ensure that each field issue is properly addressed and closed out. The most recent log reflects that all deficient items have been closed out.

The design team is sufficiently supporting the trade contractor’s efforts. As submittal and request for information (RFI) documents are issued, they are being addressed. To date, the design team has been responsive and their turnaround times have supported the timely workflow of the Project. Budget Review Messer is working to close out the Bid Package Contracts associated with Phase 1. Bid Packages #1 through #5, as well as #7, are closed out. All change orders on Bid Packages #6 and #8 have been processed, and there are no new pending change orders under review. Allowance dollars remain in Bid Packages #6 and #8 in amounts of $60,683 and $49,440, respectively. As closeout of these packages conclude, reconcilation of the remaining amounts will be done, with the appropriate contract adjustments being made.

On Phase 2, the hard costs are projected to be $29.472M for Bid Packages #9 and #11. This amount is approximiately $10.792M below the Construction Manager Published Estimate of $40.3M.

Bid Package #9 was awarded at an amount of $7.1M. No changes have been made to the contract amount since the contract was executed. A pending change order in an amount of $13,031 has been requested and is being reviewed. An allowance of $800,000 was included within the contract. Approximately $185,000 of this allowance remains, the majority of which is part of the allowance for historical excavation.

The original contract amount for Bid Package #11 is $22.3M. Two change orders have been executed to date totalling $49,461. A contract allowance of $975,000 was included in the contract. Approximately $160,000 of this allowance has been used or requested to date.

The County and City have prepared the first draft of the soft costs budget. Recent finalization of the Carter and Ellington Management Services contracts allow for the budget to be confirmed. Parks and Overbuild Construction Parks Throughout November progress was evident on the Cincinnati Riverfront Park project. The contractor for the Walnut Street Fountain and Grand Stairway, Monarch Construction, began placing slab steel and forming for the first structural slab on grade placement. Underground plumbing continued and nearly all submittals for the project have been

completed and approved. Shop drawings continued for various portions of the project including fountain elements, slab on grade steel and granite. The contractor for the Schmidlapp Event Lawn and Stage, Megen Construction, continued concrete placement in the event lawn area and for the stage walls. Waterproofing installation continues and electrical installation also began in late November. Megen also continued moving forward with submittals and shop drawings and is nearing the completion of the project submittal process. Tilsley and Associates, architect for the Moerlein Lager House, expects to receive their building permit in early December. They are currently finalizing design of the Lager House and are expected to complete the design by the end of the year. The Lager House contractor, Schumacher-Dugan Construction, is currently reviewing project pricing and finalizing the project construction budget process; structure construction is expected to begin in early 2011. Developer The Private Developer work continues to take shape on-site. On Block 26, the contractor is working to complete the skin cladding. The window, masonry, and stucco work is substantially complete on the south, east, and north elevations. Field measurements on the metal panels are occurring on-site now, which will allow for material deliveries in late January or early February. The waterproofing membrane for the above-grade parking has been installed. Work on the Block 26 amenity terrace is starting, and will continue as the weather supports installation of the components. The Block 26 interior buildout is maintaining pace with the building façade construction. The retail shell areas are approaching substantial completion and will soon be available for tenant construction. Interior finishes, including paint, cabinets, and granite installation, are being installed along the second and third floors of the building. Drywall and gypcrete work is ongoing at upper floors of the block. Installation of the elevators is underway. On Block 16, activities are scheduled to lag the Block 26 trades by approximately six weeks. All structure work has been completed, as has the installation of the roof. Work on the building skin has started, with installation of windows on the north elevation complete and crews mobilized on the west elevation of the block. The mason has moblized on the north elevation and is proceeding from east to west. Mechanical, electrical, and plumbing rough-in installation is nearly complete at the retail areas. Rough-in’s and drywall work are underway at the retail level. The structural steel for the two-story retail building and parking deck roof has been installed. Framing and sheathing work is underway, and brick veneer will begin in the coming weeks. Retail storefront will be set after the first of the year.

Section 4: Budget With 99% of the work completed in Phase 1, construction expenditure projections still remain within the approved target budget. (See Phase 1 Construction Budget on the following page.) Total change orders for Phase 1 Construction contracts total 3.88%. For comparison, Federal Highway Administration historical data indicate an industry average of total change orders at 10% of construction. Phase 2a Construction projected expenditures remain within the approved budget of $52.3 million. Phase 2a Construction Budget cost tracking includes the latest status of approved change orders and potential change orders by Bid Package. To date, all additional scope items have been covered by the allowances contained in the contracts as bid.

Section 5: Economic Inclusion


Section 5: Economic Inclusion Report October 2010 Summary As Phase 2 of the Project continues, the Economic Inclusion consultant team is focusing its attention on tracking inclusion and workforce outcomes. There are 13 contracts subject to the Small Business Enterprise Program that are closed; a total of 11 of the contractors either met (four) or exceeded (seven) their committed goals. Only two contractors missed their committed goals by .3%, and .5%, respectively. The meeting of The Banks Employee Readiness Committee scheduled for October 18, 2010 was cancelled. The agenda and discussion items will be moved to the December 2010 meeting. Planned discussion items include general updates on The Banks business and workforce inclusion efforts, an update from the Two-Way Referral Subcommittee related to the SuperJobs Center and Construction Apprentice Program referral process. We continue to exceed the 30% goal for Small Business Enterprise (SBE) participation for construction. The actual SBE participation for construction through September 25, 2010 is 35.4%. In addition, Minority Business Enterprise (MBE) participation is 15.2%, and Women Business Enterprise (WBE) participation is at 2.8% (Appendix D: October Attachment A). The Public Parties have not established any goals for MBE and/or WBE participation. The Disadvantaged Business Enterprise participation goal established by the Ohio Department of Transportation (ODOT) for Bid Packages #5 and #7 is 8%. Contractors committed 10.8% and 10.7% DBE participation for Bid Packages #5 and #7, respectively. The actual participation to date is 12% for Bid Package #5, and 11.8% for Bid Package #7. The goal for Bid Package #6 is 5.0%. The contractor DBE commitment for Bid Package #6 is 5.0%. The participation to date is 5.3%. Bid Package #6 also has 1.7% WBE participation. The goal for Bid Package #9 is 4%. The commitment is 4.9%. The actual DBE participation is 2.9% and 2.3% WBE participation. The work is still in progress and there is work remaining for the DBE subcontractors to complete. The goal for Bid Package #11 is 8%. The contractor committed to achieving 8.2% DBE participation. Actual participation to date is 4.1%. This contract is only at 25% completion and there remains work for the DBE subcontractors to complete (Appendix D: October Attachment B). The goal is 10% SBE participation for professional services. The current level of participation is 8.6%. Contracts for both Messer and THP have more than doubled with no corresponding increase to subconsultants. As a result, participation has fallen below the goal since August 2010. The MBE participation is 7.4% and WBE participation is 1.8% (Appendix D: October Attachment C). The Public Parties set a combined minority and women workforce participation goal of 22% as measured in work hours. Total minority workforce participation is 16.31%, which includes minority female hours. The non-minority female participation is 1.28%, and the

combined minority and female participation is 17.59% (minority females are not counted twice) as reported by hours for September 1, 2008 – September 25, 2010 (Appendix D: October Attachment D). From April 26, 2010 to September 25, 2010, employees on The Banks Project living within the 15-County Cincinnati-Middletown Metropolitan Statistical Area (MSA) represented 87% of the workforce (Appendix D: October Attachment E). Workforce inclusion reporting forms and certified payroll records were used to analyze the composition of The Banks Project workforce in regard to residency. The analysis covered the period from December 2008 through July 2010. Only information for production workers active on site during the covered period was analyzed. Analysis of data for 1,062 workers active on the project during the covered period revealed that 1,032 or 97.18% lived within the Tri-State (Ohio, Kentucky, and Indiana). Of the total, 806 workers or 75.89% lived within the Cincinnati-Middletown MSA. A total of 269 workers or 25.33% lived within Hamilton County and a total of 97 workers or 9.13% lived within the City of Cincinnati. (There are no local residency participation goals for this project.) November 2010 Summary As presented in the October Executive Summary, there are 13 contracts subject to the Small Business Enterprise Program that are closed, eleven of the contractors met (four) or exceeded (seven) their committed goals. Only two contractors missed their committed goals by .3%, and .5%, respectively. One prime contractor that is still working on the project has made a contractor substitution. The initial SBE contractor was unable to provide the goods and services that the project requires. However, the SBE contractor was replaced with a MBE contractor who has been encouraged to apply for The Banks SBE Certification. The substitution helped increase overall MBE participation by 2.1%. We continue to exceed the 30% goal for Small Business Enterprise (SBE) participation for construction. The actual SBE participation for construction through October 25, 2010 is 35.3%. In addition, Minority Business Enterprise (MBE) participation is 17.3%, and Women Business Enterprise (WBE) participation is at 2.8% (Appendix D: November Attachment A). Progress Update With Mehring Way open for traffic, the Bid Package #9 work has shifted to the pavement replacement at Joe Nuxhall Way, the bike path installation south of Mehring Way, and tying up loose ends at the Main Street and Elm Street intersections. At the Lot 2 Garage, pile installation is complete after four long months of drilling. Though the weather has turned colder of late, crews still continue to place pile caps, shear walls, columns and new slabs. Current Highlights

Community Environment Impact & Project Safety The Bid Package #9 and #11 Trade Contractors have continued to make public safety a priority. They have been mindful of the public within the Lots B, C, D and F and have utilized construction fencing to isolate their activities. Pro-active communication with the County has also kept the patrons of these lots informed of the ongoing changes associated with the construction work. Between Phases 1 and 2, a total of 1,607 trade workers have attended the site safety orientation. A Celebration Lunch is planned for December! The Project has NOW PASSED THE 300,000-HOURS WITHOUT A LOST TIME ACCIDENT milestone. Actual hours: 301, 360 through November 30. Formal site safety walk-throughs are conducted three times a week. Workers continue to maintain a very good attitude about working safely. The scorecard below categorizes observations from our safety walk-throughs by hazard, severity and resolution rate for the past 30 days.

The impact to Riverfront Operations around the Phase 2 work has been as follows: Traffic

• Race Street between Second Street and Theodore M. Berry Way will remain closed until the fourth quarter of 2011.

• Theodore M. Berry Way is now open to the Roebling Bridge. The only area of Theodore M. Berry Way that is still closed is at the dogleg at Walnut Street.

Operation of Adjacent Facilities

• No impact to GABP, Reds HOF, PBS, the US Bank Arena or the Transit Center. Pedestrian Routes

• Pedestrian traffic within Lots D and F has now been restored since new Mehring Way is open.

• Theodore M. Berry Way has reopened from Rosa Parks to the Roebling Bridge. The only area that is still closed is at the dogleg at Walnut Street.

• The West Pete Rose Way entrance to the Central Riverfront Garage remains closed for the Bid Package #11 work. Pedestrians within the Garage are being routed up to street level from the Central Riverfront Garage.

Parking

• The West Pete Rose Way entrance to the Lot 3 Garage remains closed for the Bid Package #11 work. This will require Lot 3 Garage patrons to utilize the new entrances to the Garage on Mehring Way and Main Street.

Signage and Fencing

• Site fencing and gates are checked on a daily basis to insure they are secure. Construction Schedule Phase 1 is 99% complete, leaving only minor punch list items. The schedule included in this month's report charts activities associated with the two active Phase 2 contracts: Bid Packages #9 and #11. Change Management Attached are updated Approved and Pending Change Order Logs for Bid Package #9 (TC-24) and Bid Package #11 (TC-25). Also attached are updated allowance tracking logs for each Bid Package describing the changes being billed against the allowances. RFIs and Bulletins The RFI Log identifies requests for information issued to date and the status of each RFI. To date, there have been a total of 139 RFIs created, of which 133 are closed. To date, there has been only one bulletin issued for the Bid Package #11 work.

Quality Management and Assurance Plan The QM/QA currently incorporates professional firms to do special inspections and testing associated with the construction of Bid Packages #9 and #11. Thelen Associates Inc. is the professional services firm providing support to execute the Project QM/QA Plan for Bid Package #9. HC Nutting and ATC Associates are the professional firms providing support for Bid Package #11. The City and the County provide personnel for inspections and material verification per ODOT requirements. Prus Construction and Baker Concrete Construction will also have their own testing agencies provide services per their contracts. In addition to the inspections above, local utility providers such as Greater Cincinnati Water Works, Cincinnati Bell, Duke Energy and the Metropolitan Sewer District are on site regularly to inspect the installations associated with their systems. Installations are also subject to the approval of the building department, as well as local electrical and plumbing inspectors. The QM/QA plan will cover areas such as inspection and testing of shallow foundations, controlled structural fill, mix design, material certification, reinforcement and installation, formwork geometry, concrete placement, evaluation of concrete strength, grouting operations and evaluation of masonry strength. The Quality Management and Assurance Plan continue will be used for Bid Packages #9 and #11. All Non-Conforming Work gets addressed with the Trade Contractor in a timely manner.

Update for November

Throughout November progress was evident on the Cincinnati Riverfront Parks project. The contractor for the Walnut Street Fountain and Grand Stairway, Monarch Construction, began placing slab steel and forming for the first structural slab on grade placement. Underground plumbing continued and nearly all submittals for the project have been completed and approved. Shop drawings continued for various portions of the project including fountain elements, slab on grade steel and granite. The contractor for the Schmidlapp Event Lawn and Stage, Megen Construction, continued concrete placement in the event lawn area and for the stage walls. Waterproofing installation continues and electrical installation also began in late November. Megen also continued moving forward with submittals and shop drawings and is nearing the completion of the project submittal process. Tilsley and Associates, architect for the Moerlein Lager House, expects to receive their building permit in early December. They are currently finalizing design of the Lager House and are expected to complete the design by the end of the year. The Lager House contractor, Schumacher-Dugan Construction, is currently reviewing project pricing and finalizing the project construction budget process; structure construction is expected to begin in early in 2011.

APPENDIX A: Project Scope Description

The Central Riverfront Intermodal Transit Facility, and the completion of Central Riverfront Street Grid and pedestrian network, utility infrastructure and traffic control (i.e., the “Project”) is the design and construction of multiple structured public parking facilities and related public infrastructure improvements including, but not limited to, site development, streets and sidewalks, public utility distribution, structural elements, mechanical, electrical and plumbing systems, interior and exterior building and parking systems and fixtures, fire and security systems, interior and exterior pedestrian and vehicular traffic control and access systems, landscaping and related improvements. The overall Project will be planned, designed and constructed in multiple phases or parts over a period of several years. This Project is executed through the efforts of Hamilton County, the City of Cincinnati, and the Development Manager, Carter Dawson. Hamilton County has retained THP Limited, Inc. for Central Riverfront Intermodal facility design services. The City of Cincinnati has retained Burgess & Niple for Freedom Way structural bridge deck, utility infrastructure and traffic control design services. In addition, Hamilton County has retained Messer Construction for construction management services.

Phase 1 of the Project includes the Central Riverfront Intermodal facility between Second Street (to the North), Mehring Way (to the South), Walnut Street (to the West) and Main Street (to the East).
